This paper describes the automated classification of legal norms in German statutes with regard to their semantic type. We propose a semantic type taxonomy for norms in the German civil law domain consisting of nine different types focusing on functional aspects, such as Duties, Prohibitions, Permissions, etc. We performed four iterations in classifying legal norms with a rule-based approach using a manually labeled dataset, i.e., tenancy law, of the German Civil Code ). During this experiment the \ score continuously improved (...) from 0.52 to 0.78. In contrast, a machine learning based approach for the classification was implemented. A performance of \ was reached. Traditionally, machine learning classifiers lack of transparency with regard to their decisions. We extended our approach using so-called local linear approximations, which is a novel technique to analyze and inspect a trained classifier’s behavior. We can show that there are significant similarities of manually crafted knowledge, i.e., rules and pattern definitions, and the trained decision structures of machine learning approaches. (shrink)

In recent years, philosophical developments of the notion of distributed and/or scaffolded cognition have given rise to the “extended mind” thesis. Against the popular belief that the mind resides solely in the brain, advocates of the extended mind thesis defend the claim that a significant portion of human cognition literally extends beyond the brain into the body and a heterogeneous array of physical props, tools, and cultural techniques that are reliably present in the environment in which people grow, think, and (...) act (Clark and Chalmers 1998; Clark 1997, 2003, 2008; Wilson 2004; Rowlands 1999, 2012; Menary 2007; Theiner 2011). However, as commentators who are friendly to the idea of distributed cognition have pointed out, the philosophical debate over extended cognition has predominantly focused on the impact of tools on our thinking while somewhat neglecting the distinctively social and cultural dimensions of cognitive scaffolding (Sterelny 2004, 2010; Caporael 1997a, 1997b; Smith and Semin 2004; Wilson 2005; Barnier et al. 2008; Sutton et al. 2010; Theiner, Allen, and Goldstone 2010). -/- To reorient the reigning paradigm, Hutchins (2010, 445) has recently proposed the “hypothesis of enculturated cognition” (HEnC) as an alternative to Clark’s (2003, 2008) largely individualistic vision of the extended mind. According to the HEnC, the “ecological assemblies of human cognition make pervasive use of cultural products” and are typically “assembled … in ongoing cultural practices” (ibid.). Cultural practices, for Hutchins, are essentially “the things people do in interaction with one another” (ibid., 440). My goal in this chapter is to follow up on Hutchins’s call to “spur the program forward” (ibid., 445), by generalizing Kirsh and Maglio’s (1994) distinction between pragmatic and epistemic actions from the level of individuals to the level of groups. The concept of a collective epistemic action refers to the ways in which groups of people actively change the structure of their social organization, with the epistemic goal of reshaping and augmenting their cognitive performance as integrated collectivities. By placing a renewed emphasis on the interactions between people, rather than between people and their tools, I hope to reconnect the cognitive-scientifically-driven “extended mind” thesis with complementary areas of social-scientific research in which groups are analyzed as the seats of action and cognition in their own right. In particular, the literature to which I aim to build a bridge in this paper is, on the one hand, certain segments of social and organizational psychology (Larson and Christensen 1993; Hinsz et al. 1997; Mohammed and Dumville 2001), and, on the other hand, theories of collective and institutional action (Ostrom 1990; List and Pettit 2011). This paper concerns Carnap’s early contributions to formal semantics in his work on general axiomatics between 1928 and 1936. Its main focus is on whether he held a variable domain conception of models. I argue that interpreting Carnap’s account in terms of a fixed domain approach fails to describe his premodern understanding of formal models. By drawing attention to the second part of Carnap’s unpublished manuscript Untersuchungen zur allgemeinen Axiomatik, an alternative interpretation of the notions ‘model’, ‘model extension’ and ‘submodel’ (...) in his theory of axiomatics is presented. Specifically, it is shown that Carnap’s early model theory is based on a convention to simulate domain variation that is not identical but logically comparable to the modern account. (shrink)

In this paper my primary aim is to present a logical system of practical reasoning that can be used to assess the validity of practical arguments, that is, arguments with a practical judgment as conclusion. I begin with a critical evaluation of other approaches to this issue and argue that they are inadequate. On the basis of these considerations, I explain in Sect. 2 the informal conception of practical validity and introduce in Sect. 3 the logical system P , which (...) is an extension of propositional logic and can be used to assess the validity of a wide range of practical arguments. In the last section, I apply this system to some examples of practical reasoning in order to demonstrate how it can be used in practice. (shrink)

Wegner, Giuliano, and Hertel (1985) defined the notion of a transactive memory system (TMS) as a group level memory system that “involves the operation of the memory systems of the individuals and the processes of communication that occur within the group (p. 191). Those processes are the collaborative procedures (“transactions”) by which groups encode, store, and retrieve information that is distributed among their members. Over the past 25+ years, the conception of a TMS has progressively garnered an increased interest among (...) social and organizational psychologists, communication scholars, and management theorists (Ren & Argote 2011). But there remains considerable disagreement about how exactly Wegner’s appeal to group memory should be understood. My goal in this paper is contribute to this debate, by articulating more clearly the value of conceptualizing groups as TMSs. This value, I argue, consists in providing us with a blueprint for how to explain group memory in terms of collective information-processing mechanisms. Collective information-processing mechanisms are dependent on, and interact with, the brain-bound information-processing of individuals, but cannot be reduced to the latter. In my analysis, I lean on extant accounts of mechanistic explanation in the philosophy of science (Bechtel & Richardson 1993; Machamer, Darden, & Craver 2000; Wimsatt 2007) that have been used to analyze the explanatory practices of psychology and cognitive neuroscience (Bechtel 2008, 2009). Based on my reconstruction of Wegner’s conceptualization of a TMS, I argue that the reality of emergent group cognition is compatible with its mechanistic explanation. More generally, my analysis shows that group cognition cannot be reduced to individual cognition, while avoiding the false dilemma between “wholism” and “nothing but-ism” which has hampered traditional construals of the “group mind” thesis (Allport 1968). Carnap and Goodman developed methods of conceptual re-engineering known respectively as explication and reflective equilibrium. These methods aim at advancing theories by developing concepts that are simultaneously guided by pre-existing concepts and intended to replace these concepts. This paper shows that Carnap’s and Goodman’s methods are historically closely related, analyses their structural interconnections, and argues that there is great systematic potential in interpreting them as aspects of one method, which ultimately must be conceived as a component of theory development. The (...) main results are: an adequate method of conceptual re-engineering must focus not on individual concepts but on systems of concepts and theories; the linear structure of Carnapian explication must be replaced by a process of mutual adjustments as described by Goodman; Carnap’s condition of similarity can be analysed into two components, one securing a relation to the specific extensions of the pre-existing concepts, one regulating the transition to the new system of concepts; these two criteria of adequacy can be built into Goodman’s account of reflective equilibrium to ensure that the resulting concepts promote theoretical virtues while being sufficiently similar to the concepts we started out with. Hegel's Encyclopaedia Logic constitutes the foundation of the system of philosophy presented in his Encyclopaedia of the Philosophical Sciences. Together with his Science of Logic, it contains the most explicit formulation of his enduringly influential dialectical method and of the categorical system underlying his thought. It offers a more compact presentation of his dialectical method than is found elsewhere, and also incorporates changes that he would have made to the second edition of the Science of Logic if he had lived (...) to do so. This volume presents it in a new translation with a helpful introduction and notes. It will be a valuable reference work for scholars and students of Hegel and German idealism, as well as for those who are interested in the post-Hegelian character of contemporary philosophy. Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

Øystein Linnebo and Richard Pettigrew have recently developed a version of non-eliminative mathematical structuralism based on Fregean abstraction principles. They argue that their theory of abstract structures proves a consistent version of the structuralist thesis that positions in abstract structures only have structural properties. They do this by defining a subset of the properties of positions in structures, so-called fundamental properties, and argue that all fundamental properties of positions are structural. In this article, we argue that the structuralist thesis, even (...) when restricted to fundamental properties, does not follow from the theory of structures that Linnebo and Pettigrew have developed. To make their account work, we propose a formal framework in terms of Kripke models that makes structural abstraction precise. The formal framework allows us to articulate a revised definition of fundamental properties, understood as intensional properties. An English translation of Hegel's introduction to his lectures on the philosophy of history, based directly on the standard German edition by Johannes Hoffmeister, first published in 1955. The previous English translation, by J. Sibree, first appeared in 1857 and was based on the defective German edition of Karl Hegel, to which Hoffmeister's edition added a large amount of new material previously unknown to English readers, derived from earlier editors. In the introduction to his lectures, Hegel lays down the principles (...) and aims which underlie his philosophy of history, and provides an outline of the philosophy of history itself. The comprehensive and voluminous survey of world history which followed the introduction in the original lectures is of less interest to students of Hegel's thought than the introduction, and is therefore not included in this volume. In this paper, the Executive Head of the Global Compact shares some of his own reflections on the evolution of the Global Compact initiative – United Nations Secretary-General Kofi Annan’s voluntary corporate citizenship initiative in the area of human rights, labor, the environment and anti-corruption. Two main themes are addressed. The first considers the Global Compact’s institutional context, examining how such an initiative is even possible in the historically hierarchical and traditionally business-unfriendly UN. The second concerns the voluntary nature of (...) the initiative and how it interacts with regulatory approaches. It explains what the Global Compact has to offer as a voluntary initiative, as well as how it can make a unique and complementary contribution to regulation-backed initiatives. In her essay , 82–111), Shell wants to demonstrate that 1. Kant's theory of the right of nations ‘can furnish us with some much needed practical help and guidance’, and 2. ‘Kant is less averse to the use of force, including resort to pre-emptive war… than he is often taken to be’ . The first claim is unconvincing. The second one is in need of clarification. Shell turns Kant into a kind of realist and just-war theorist, into a liberal who (...) is prejudiced against illiberal regimes. In the end, her Kant is closer to Locke, Vattel and other early liberal international lawyers than to himself. Almost all that is unique in Kant's theory of the right of nations gets lost. In this, Shell follows a general trend among some Kant interpreters: the interpretation is only loosely based on Kant; it claims to follow his ‘spirit’ and offers creative ‘Kantian perspectives’. Amidst interpretational creativity, Kant's texts more or less disappear in the mist. (shrink)

It is well known that Hegel exerted a major influence on the development of Marx's thought. This circumstance led Lukács, one of the chief Marxist theoreticians of this century, to embark on his exploration of Hegelian antecedents in (...) the German intellectual tradition, their concrete expression in the work of Hegel himself, and later syntheses of seemingly contradictory modes of though. Four phases of Hegel's intellectual development are examined: "Hegel's early republican phase," "the crisis in Hegel's views on society and the earliest beginnings of his dialectical method," "rationale and defense of objective idealism," and "the breach with Schelling and The Phenomenology of Mind." Lukács completed this study in 1938, but because of the imminent outbreak of war, it was not published until the late 1940s. A revised German edition appeared in 1954, and it is this text that is the basis of this first English translation of the work. (shrink)
