Although it is well known that intimacy and sexual expression are an important part of being human and of healthy living, facilities such as nursing homes, adult group homes, or assisted living residences commonly struggle with knowing how to balance supporting residents who are incapable to have sexual lives with their duty to protect them from foreseeable harm. Although nurses in almost every long-term care facility face daily challenges involving issues related to residents' sexual lives, guidelines for ethically supporting sexual activity are rare and inadequate. A decision-making framework was developed to guide care providers in responding to the sexual expression of residents in long-term care. The framework recommends that nurses should weigh the documented substantial benefits of having a sexual life against harm to the resident and others, and against offence to others. This article illustrates the use (...) of this ethical decision-making framework by using the example of nurses supporting a resident's expression of his sexuality. Offering intensive care to neonates who have conditions that carry extremely poor prognoses is a source of great contention amongst neonatologists. The concept of best interests is commonly used as a rationale for refusing such care, despite the fact that parents of these infants often have a different view of what best interests means. This article takes up the question of what best interests should incorporate for infants with lethal conditions not curable with intensive care, and how and who should (...) decide which treatment options should be implemented. Based on our recommendation that parents be apprised of the basis upon which physicians are evaluating treatment options, we offer a framework that allows all relevant parties to approach the issue of what is appropriate treatment from a similar place. We maintain that this approach will increase transparency, dialogue, understanding, and trust, which, in turn, may result in greater consensus. (shrink)

There is an old worry, which dates back to Mill but has analogs even in Sextus, that the very definition of ‘validity’ implies that all valid arguments are circular. This paper investigates how contemporary formal tools can ellucidate that old worry. Its main finding is the existence of a genuine puzzle: a difficult-to-avoid correspondence between the definitions of ‘valid argument’ and ‘premise circular argument’.

Anthony Everett gives a philosophical defence of the common-sense view that there are no such things as fictional people, places, and things. He argues that our talk and thought about such fictional objects takes place within the scope of a pretense, and that we gain little but lose much by accepting fictional realism.

Journey images deeply inform the way people understand processes of alienation and reconciliation, both with other peoples and with the earth. This essay explores classic journey stories from Cherokee life, South Africa, and China in order to develop an understanding of the different types of journey myths and the way they shape understandings of alienation and reconciliation. People can conflict because they are oriented by very different journey stories or because one party is fundamentally oriented by stories of place. Constructive (...) refashioning of journey myths must appropriate both personal and collective uses of the story and find imaginative ways of reweaving conflicting stories into a new journey myth. This book is an exploration of interrelationships among culture, language, and the individual unconscious (the "dark matter of the mind”), how these feed into a sense of self, and implications for the notion of "human nature.” The first part of the book is concerned with perceptual and cultural bases of dark matter and the effect of dark matter on perception (especially vision) and the interpretation of discourse. The second part is concerned with the contribution of dark matter to language--with language (...) viewed as a combination of speech and gesture, and including issues related to translation. In the final part Everett addresses implications of his account, summarizing and extending arguments for replacing an instinct-based account of human nature with a culturally-based, dark matter view of the "constructed self.” Everett makes a powerful argument for the influence of culture on unconscious forces that underlie human behavior and the individual’s sense of self, with much of the power of the argument coming from the deep insights he gained from living and working with the Pirahãs of the Amazon. This is an important book that sits at the intersection of anthropology, linguistics, psychology, and philosophy, and it is enriched by a combination of the author’s knowledge of these fields and his cross-cultural perspective. The book will make an important contribution to newly emerging directions taken by cognitive science. After decades of a field derailed by ethnocentric, instinct-based views of language and the mind, the cognitive sciences need such informed analyses of the relationship between culture, cognition, and language, as embodied in speech and gesture. In recent years a number of authors sympathetic to Referentialistaccounts of proper names have argued that utterances containingempty names express `gappy,' or incomplete, propositions. In this paper I want to take issue with this suggestion.In particular, I argue versions of this approach developedby David Braun, Nathan Salmon, Ken Taylor, and by Fred Adams,Gary Fuller, and Robert Stecker.

There has recently been considerable interest in accounts of fiction which treat fictional characters as abstract objects. In this paper I argue against this view. More precisely I argue that such accounts are unable to accommodate our intuitions that fictional negative existentials such as “Raskolnikov doesn’t exist” are true. I offer a general argument to this effect and then consider, but reject, some of the accounts of fictional negative existentials offered by abstract object theorists. I then note that some of (...) the sort of data invoked by the abstract object theorist in fact cuts against her position. I concludle that we should not regard fictional characters as abstract objects but rather should adopt a make-believe theoretic account of fictional characters along the lines of those developed by Ken Walton and others. In a world with limited resources, allocation of resources to certain individuals and conditions inevitably means fewer resources allocated to other individuals and conditions. Should a patient's personal responsibility be relevant to decisions regarding allocation? In this project we combine the normative and the descriptive, conducting an empirical bioethical examination of how both Norwegian and British doctors think about principles of responsibility in allocating scarce healthcare resources. A large proportion of doctors in both countries supported including responsibility for illness in (...) prioritization decisions. This finding was more prominent in zero‐sum scenarios where allocation to one patient means that another patient is denied treatment. There was most support for incorporating prospective responsibility (through patient contracts), and low support for integrating responsibility into co‐payments (i.e. through requiring responsible patients to pay part of the costs of treatment). Finally, some behaviours were considered more appropriate grounds for deprioritization (smoking, alcohol, drug use)—potentially because of the certainty of impact and direct link to ill health. In zero‐sum situations, prognosis also influenced prioritization (but did not outweigh responsibility). Ethical implications are discussed. We argue that the role that responsibility constructs appear to play in doctors' decisions indicates a needs for more nuanced—and clear—policy. Such policy should account for the distinctions we draw between responsibility‐sensitive and prognostic justifications for deprioritization. (shrink)

The major question—what is categorial analysis and how can it be reliably performed?—lies beyond the scope of this paper. Indeed, I would presume that very little can be said significantly about it in general. One's convictions on the subject have to be shown by actual performance, which is my intention in the present instance. But it may help the process of communication if I try to indicate at the beginning the general frame in which this analysis of value occurs.

I argue for the existence of intrinsic Finks, Masks, and Mimics, and argue that these undermine certain recent attempts to revive simple conditional analyses of dispositions. I present some examples of intrinsic Finks, Masks, and Mimics, and argue that the example of an intrinsic fink I present has certain advantages over the examples of intrinsic finks recently suggested by Randolph Clarke. I conclude that the existence of such Finks, Masks, and Mimics, undermine a recent attempt by Sungho Choi to distinguish (...) dispositional properties from categorical properties. (shrink)

The ArgumentIn Merton's early work in the sociology of science three theses are identified: economic and military influence in shaping early modern science; the “Puritan spur” to scientific activity; the critical role of a democratic social order for the support of science. These themes are located in the contemporary economic crisis of the 1930s, the rise of Nazism and fascism, and the emerging radical and Marxist political activism of scientists in the United States and the United Kingdom. Merton's interaction with (...) this context is critical for understanding his choice of problems and issues for the nascent sociology of science. The enunciation of the four-part normative structure of science is closely identified with the political ideals of this context. Merton's transition from an interest in problems of science in society to his postwar concern with the social and organizational structures of science and the social behavior of scientists is framed against the anticommunist and anti-Marxist thrust of immediate postwar politics in the United States. The implications of this change for the paradigms of the sociology of science are noted. (shrink)

A review of the life and works of Jeremy Bentham, the "philosopher of legislation" and an analysis of his legacy in law and politics.

This paper aims to determine whether we can locate temporal passage in a non-dynamical (block universe) world. In particular, we seek to determine both whether temporal passage can be located somewhere in our world if it is non-dynamical, and also to home in on where in such a world temporal passage can be located, if it can be located anywhere. We investigate this question by seeking to determine, across three experiments, whether the folk concept of temporal passage can be satisfied (...) in our world if it is non-dynamical, and, if it can, what sort of thing in our world satisfies that concept. In particular, we focus on the question of whether that concept (if satisfied) is satisfied by something mind-dependent or something mind-independent. In other words, we ask, is temporal passage something that is at least partially in the mind, or is it entirely external to the mind? We find, contrary to what is often assumed by dynamists and non-dynamists alike, that the folk concept of temporal passage is satisfied in our world conditional on it being non-dynamical, and that the concept is satisfied by something mind-independent. This provides further ammunition for recent deflationary accounts of temporal passage that attempt to locate passage somewhere in our non-dynamical world. (shrink)

As befits an emerging field of enquiry, there is on-going discussion about the scope, role and future of the medical humanities. One relatively recent contribution to this debate proposes a differentiation of the field into two distinct terrains, ‘medical humanities’ and ‘health humanities,’ and calls for a supersession of the former by the latter. In this paper, we revisit the conceptual underpinnings for a distinction between ‘the medical’ and ‘health’ by looking at the history of an analogous debate between ‘medical (...) geography’ and ‘the geographies of health’ that has, over the last few years, witnessed a re-blurring of the distinction. Highlighting the value of this debate within the social sciences for the future development of the medical humanities, we call for scholars to take seriously the challenges of critical and cultural theory, community-based arts and health, and the counter-cultural creative practices and strategies of activist movements in order to meet the new research challenges and fulfill the radical potential of a critical medical humanities. This paper extends the discussion of business ethics by examining the issue of corruption, its definition, the solutions being proposed for dealing with it, and the ethical perspectives underpinning these proposals. The paper’s findings are based on a review of association, think-tank, and academic reports, books, and papers dealing with the topic of corruption, as well as the pronouncements, websites, and position papers of a number of important global organizations active in the fight. These organizations include the World Bank, the (...) International Monetary Fund, the Organization for Economic Co-operation and Development, Transparency International, USAID, the United Nations, the International Chamber of Commerce, the Organization of American States, and the Council of Europe. Our discussion departs from prior analyses by adopting a Foucaultian theoretical framing and by incorporating insights found in the virtue ethics literature. There is considerable evidence for the existence of a form of publicly recognized and institutionalized effeminacy or transvestism among males in pre-Islamic and early Islamic Arabian society. Unlike other men, these effeminates or mukhannarhiin were permitted to associate freely with women, on the assumption that they had no sexual interest in them, and often acted as marriage brokers, or, less legitimately, as go-betweens. They also played an important role in the development of Arabic music in Umayyad Mecca and, especially, Medina, (...) where they were numbered among the most celebrated singers and instrumentalists. Although they were subject to periodic persecution by the state, such measures were not based on any conclusions about their own sexual status – they were not assumed to be homosexual, although a few were – but on their activities as musicians and go-betweens, which were seen as corrupting the morals of society and especially of women. A particularly severe repression under the caliph Sulayman put an end to the mukhannarhiin's prominence in music and society, although not to their existence. (shrink)

In two recent papers, Michael Della Rocca accuses Descartes of reasoning circularly in the Fourth Meditation. This alleged new circle is distinct from, and more vicious than, the traditional Cartesian Circle arising in the Third Meditation. We explain Della Rocca’s reasons for this accusation, showing that his argument is invalid.
