In a landmark text, ‘The Theological Turn of French Phenomenology’, Dominique Janicaud posits a boundary that sharply divides the legitimate phenomenological tradition from a problematic variant seen to be fundamentally compromised by theology. This article develops an immanent critique of Janicaud’s position. It demonstrates that his boundary relies on the mature work of Maurice Merleau-Ponty as a constitutive exemplar of the tradition, that this work is centrally concerned with beauty, and that its notion of beauty is irreducibly theological. Merleau-Ponty himself (...) will thus be shown to enact his own version of the theological turn. I shall consequently propose a reconstrual of the boundary of phenomenology. My argument relies fundamentally on Merleau-Ponty’s essay, ‘Eye and Mind’, and includes a critical restatement of Galen Johnson’s reading of this text. In addition to its direct relevance to phenomenology, this article bears upon broader concerns, including the relationships between theory, the body, aesthetics, and the post-secular. (shrink)

In this extended essay, Vittorio Hösle develops a theory of the comical and applies it to interpret both the recurrent personae played by Woody Allen the actor and the philosophical issues addressed by Woody Allen the director in his films. Taking Henri Bergson’s analysis of laughter as a starting point, Hösle integrates aspects of other theories of laughter to construct his own more finely-articulated and expanded model. With this theory in hand, Hösle discusses the incongruity in the characters (...) played by Woody Allen and describes how these personae are realized in his work. Hösle focuses on the philosophical issues in Allen’s major films by exploring the identity problem in _Play It Again, Sam_ and _Zelig_, the shortcomings of the positivist concept of reality in _A Midsummer Night’s Sex Comedy_, the relation between reality and art in _The Purple Rose of Cairo_, the objective validity of morality in _Crimes and Misdemeanors_, the power of evil in _Shadows and Fog_, and the relation between art and morality in _Bullets over Broadway_. He cites Allen’s virtuosic reinterpretation of older forms of expression and his integration of the fantastic into the comic universe—elements like the giant breasts, anxious sperm, extraterrestrials, ghosts, and magicians that populate his movies—as formal moves akin to those of Aristophanes. Margaret Cavendish was a contemporary critic of the mechanistic theories of matter that came to dominate seventeenth-century thought and the proponent of a distinctive form of non-mechanistic materialism. Colour was a central issue both to the mechanistic theories of matter that Cavendish opposed and to the non-mechanistic alternative that she defended. This chapter considers the form of colour realism that Cavendish developed to complement her non-mechanistic materialism, and uses her criticisms of contemporary views of colour to try to better understand (...) the experimental approach to natural philosophy associated with writers like Hooke and Boyle. Allen argues that Cavendish’s discussion of colour in Observations upon Experimental Philosophy helps to show that there was a close connection between experimental philosophy and mechanistic theories of matter, and that, at least in the middle of the seventeenth century, experimental and speculative forms of mechanism were not mutually exclusive. This essay builds on recent work by Susan Haack to suggest that Oliver Wendell Holmes Jr.’s conception of the common law was influenced by Darwinian evolution and classical pragmatism. This is no small claim: perceptions of what the common law is and does within the constitutional framework of the United States continue to be heavily debated. Holmes’s paradigm for the common law both revised and extended the models set forth by Sir Edward Coke, Thomas Hobbes, Sir Matthew Hale, and Sir (...) William Blackstone. Adding additional substance to Haack’s argument by pointing out passages in Holmes’s opinions and in his only book, The Common Law, that corroborate her claims about the particular features of Holmes’s pragmatism, this essay concludes by suggesting that, because of his connections with the classical pragmatists and his reverence for Emerson, Holmes is the best place to begin answering the famous question formulated by Stanley Cavell: “What’s the Use in Calling Emerson a Pragmatist?”. If, as Axel Honneth has recently argued, critical theory needs psychoanalysis for meta-normative and explanatory reasons, this does not settle the question of which version of psychoanalysis critical theorists should embrace. In this paper, I argue against Honneth's favoured version – an intersubjectivist interpretation of Winnicott's object-relations theory – and in favour of an alternative based on the drive-theoretical work of Melanie Klein. Klein's work, I argue, provides critical theorists with a more realistic conception of the person and a richer (...) explanatory account of human aggression and destructiveness than does Honneth's intersubjectivist view. As such, it better serves the ends for which Honneth claims that critical theory should turn to psychoanalysis in the first place. (shrink)

The global city is a contested site of economic innovation and cultural production, as well as profound inequalities of wealth and life chances. These cities, and large cities that aspire to ‘global’ status, are often the point of entry for new immigrants. Yet for political theorists (and indeed many scholars of global institutions), these critical sites of global influence and inequality have not been a significant focus of attention. This is curious. Theorists have wrestled with the nature and demands of (...) global justice, but have for the most part supposed that the debate is between statist and cosmopolitan formulations. Questions of redistribution, immigration, humanitarian obligations, coercion at borders, and territorial rights have correspondingly been cast as either the domain of sovereign territorial states, or of the nascent web of supranational institutions that might bind those states and peoples, morally and legally. Examining some of these issues and arguments through the lens of the global city casts them in a new and informative light, and buttresses an associative turn in thinking about global justice. Legal theorists have characterized physical evidence of brain dysfunction as a double-edged sword, wherein the very quality that reduces the defendant’s responsibility for his transgression could simultaneously increase motivations to punish him by virtue of his apparently increased dangerousness. However, empirical evidence of this pattern has been elusive, perhaps owing to a heavy reliance on singular measures that fail to distinguish between plural, often competing internal motivations for punishment. The present study employed a test of the theorized double-edge pattern using (...) a novel approach designed to separate such motivations. We asked a large sample of participants (N = 330) to render criminal sentencing judgments under varying conditions of the defendant’s mental health status (Healthy, Neurobiological Disorder, Psychological Disorder) and the disorder’s treatability (Treatable, Untreatable). As predicted, neurobiological evidence simultaneously elicited shorter prison sentences (i.e., mitigating) and longer terms of involuntary hospitalization (i.e., aggravating) than equivalent psychological evidence. However, these effects were not well explained by motivations to restore treatable defendants to health or to protect society from dangerous persons but instead by deontological motivations pertaining to the defendant’s level of deservingness and possible obligation to provide medical care. This is the first study of its kind to quantitatively demonstrate the paradoxical effect of neuroscientific trial evidence and raises implications for how such evidence is presented and evaluated. In his reading of Kant’s moral philosophy and its grounding in freedom of the will, Allison is best know for giving an exclusively “practical” reading to doctrines about noumenal agency, so that they are taken to have none of the outlandish metaphysical implications often thought to be associated with the Kantian conception of freedom. The central feature of Allison’s interpretation is that Kant operates with a theory of agency in which, from the agent’s standpoint, reasons do not act as causes, (...) but operate only insofar as they are taken up by the agent into principles or “maxims.” According to this “Incorporation Thesis,” sensuous impulses or desires are not causes of an action. So there is no reason to regard the motive of duty as a “noumenal” cause competing with sensuous or “phenomenal” causes. Instead, Kant’s “two standpoints theory” is to be understood as distinguishing the action as viewed from the agent’s practical standpoint from causal conceptions governing the theoretical standpoint. This paper investigates interactive kinds, a class of kinds suggested by Ian Hacking for which classification generates a feedback loop between the classifiers and what is classified, and argues that human interactive kinds should be distinguished from non-human ones. First, I challenge the claim that there is nothing ontologically special about interactive kinds in virtue of their members being classified as such. To do so, I reject Cooper’s counterexample to Hacking’s thesis that kind descriptions are necessary for intentional action, arguing (...) that classification is required for intentional action. Having considered ways to characterise the metaphysics of interactive kinds and the semantics of kind terms, I argue that the fact that classification facilitates intentional action makes human interactive kinds ontologically distinctive because of the anomalous nature of the change which the kind-classification brings about. I then briefly examine further distinguishing features of human interactive kinds. (shrink)

In her recent paper ‘The Epistemology of Propaganda’ Rachel McKinnon discusses what she refers to as ‘TERF propaganda’. We take issue with three points in her paper. The first is her rejection of the claim that ‘TERF’ is a misogynistic slur. The second is the examples she presents as commitments of so-called ‘TERFs’, in order to establish that radical (and gender critical) feminists rely on a flawed ideology. The third is her claim that standpoint epistemology can be used to establish (...) that such feminists are wrong to worry about a threat of male violence in relation to trans women. In Section 1 we argue that ‘TERF’ is not a merely descriptive term; that to the extent that McKinnon offers considerations in support of the claim that ‘TERF’ is not a slur, these considerations fail; and that ‘TERF’ is a slur according to several prominent accounts in the contemporary literature. In Section 2, we argue that McKinnon misrepresents the position of gender critical feminists, and in doing so fails to establish the claim that the ideology behind these positions is flawed. In Section 3 we argue that McKinnon’s criticism of Stanley fails, and one implication of this is that those she characterizes as ‘positively privileged’ cannot rely on the standpoint-relative knowledge of those she characterizes as ‘negatively privileged’. We also emphasize in this section McKinnon’s failure to understand and account for multiple axes of oppression, of which the cis/trans axis is only one. (shrink)

This historical compendium investigates scientific methods conceived between the Renaissance and the nineteenth century. Beginning with attacks on Scholasticism and the rist of the New Science, the authors explain the roles of both major andminor figures in describing scientific methods. Although the chapters are interrelated and contain explicit comparisons, each chapter is a complete study in itself. The authors' emphasis on writing for the non-specialist and their liberal use of primary sources make this an outstanding textbook.

There is some important data which has not as yet found its way into philosophic discussions on the problem of evil. Some religious people report that suffering, instead of being contrary to the love of God, is actually a medium in and through which his love can be experienced. This looks highly paradoxical, but it will be our purpose to show that it is intelligible and that it has important consequences for philosophical discussions of the problem of evil.

A vast literature has developed probing the law's aversion to statistical/probability evidence in general and its rejection of naked statistical evidence in particular. This literature rests on false premises. At least so far as US law is concerned, there is no general aversion to statistical forms of proof and even naked statistics are admissible and sufficient for a verdict when the evidentiary proffer meets the normal standards of admissibility, the most important of which is reliability. The belief to the contrary (...) rests upon a series of mistakes: most importantly, mismodeling of the structure of legal systems and the nature of common law decision making. Contributing to these mistakes is the common methodology in this literature of relying on weird hypotheticals that mismodel the underlying legal relations and contain impossible epistemological demands. Collectively, these phenomena have distracted attention from issues that actually affect real legal systems. (shrink)

In this article I offer a defence of the use of deceptive placebos—inert treatments like sugar pills or saline injections—in clinical practice. In particular, I will defend what I call the ideal placebo case—where a doctor or nurse has good reason to believe that a deceptive placebo offers a patient’s best, or only, chance of some therapeutic benefit. Taking a Kantian approach to the question of clinical placebo use, I examine the Kantian prohibition on deception as interference with the will (...) of a rational agent, and argue that deception to promote the placebo effect can be carried out in a way that does not interfere with the patient’s will in the way prohibited by Kant. The deception involved in a placebo treatment is not carried out to interfere with or obstruct the function of the will, but merely to make possible a means to the patient’s ends that that would otherwise be unavailable. I will therefore argue that deception carried out in order to promote a therapeutic placebo effect can be done in a way that is consistent with respect for a patient’s autonomy, and may be a rare case of deception that is compatible with a Kantian ethical approach.
