We investigate the dynamics of sensory integration for perceiving musical performance, a complex natural behavior. Thirty musically trained participants saw, heard, or both saw and heard, performances by two clarinetists. All participants used a sliding potentiometer to make continuous judgments of tension (a measure correlated with emotional response) and continuous judgments of phrasing (a measure correlated with perceived musical structure) as performances were presented. The data analysis sought to reveal relations between the sensory modalities (vision and audition) and to quantify (...) the effect of seeing the performances on participants' overall subjective experience of the music. In addition to traditional statistics, functional data analysis techniques were employed to analyze time-varying aspects of the data. The auditory and visual channels were found to convey similar experiences of phrasing but different experiences of tension through much of the performances. We found that visual information served both to augment and to reduce the experience of tension at different points in the musical piece (as revealed by functional linear modeling and functional significance testing). In addition, the musicians' movements served to extend the sense of phrasing, to cue the beginning of new phrases, to indicate musical interpretation, and to anticipate changes in emotional content. Evidence for an interaction effect suggests that there may exist an emergent quality when musical performances are both seen and heard. The investigation augments knowledge of human communicative processes spanning language and music, and involving multiple modalities of emotion and information transfer. (shrink)

Trauma’s ubiquity in society leads to an acknowledgement that damaging experiences likely affect more students than they leave untouched. Dewey acknowledged the importance of the past throughout his theorizing of experience and simultaneously recognized that students need to draw upon past experiences in new learning encounters. In this paper, we argue that Dewey may have opened the door to account for the possibility of traumatic experience affecting learning. We acknowledge the potential of music to prompt a trauma response and (...) seek to explore ways that music education may also provide a mechanism for working through difficult and traumatic pasts. This paper examines how significant musical moments, occurring within singular contexts, may be performative to the development of community. While community is often viewed within music education as an unequivocal good, I argue that this result may not always be beneficent. In this paper, I look at one unique performative moment through the lens of anti-racism education as the potential for community conceived as multicultural human subjectivity. Drawing upon the arguments of Theodore Adorno, Paul Gilroy, and others, I then (...) examine this same moment as one in which the seeds of fascistic community may also be sewn. Her study has a moral and an ethical dimension; the style of writing is fresh and honest, and she is deeply involved in her important theme. In addition, she is able to explore both (...) sides of the same coin: how music education may support not only anti-racism but also fascism.The approach might be characterized as socially and politically oriented philosophical research. I think that it is most important to shed light on philosophical and theoretical concepts and make them clearer through practical examples, and this is how Bradley explores her research subject. The theories and concepts she uses, such as the concept “multicultural human subjectivity,” are clarified not only by theoretical exploration but also through the personal experiences of human beings particularly interviews of choir members.A more coherent structure, and a focus on a theme, might have helped the writer to go deeper in her research subject, but in that case, the paper would have very probably lost its mission for music educators: the promotion of anti-racism as part of critical pedagogy, not only theoretically but also in practice. Moreover, the structure of the paper and its philosophical argumentation might have been clearer if the writer had focused just on the first theme in her paper: the positive effects of music education, especially a world choir music curriculum, argued to promote both self-understanding (connected with identity) and tolerance between different kinds of human beings. Music and education in Nazi Germany is taken as an example, but it is not only the specific historical circumstances, the Third Reich, that demonstrates these problems: “freedom” and “democracy” can be interpreted in various ways, and creating “better people” may refer to different kinds of educational aims also in our multicultural world of today. What should music educators do? Should music education be separated from all kinds of social aspects related to moral and ethical education?Bradley raises questions rather than gives answers, which is as valuable as aiming at finding one right answer (that may not exist). Of course, music’s autonomy could be one basis for music education: the aim of music educators could be to teach children to analyze musical structures and to understand musical works cognitively. A Kantian view of pure art, aesthetic experience, morality and beauty, or excellence as the aim of artistic activity might also be taken as an aim in music education. Following these views, the choir director should rather train the choir members to sing purely in rhythm than to concentrate on authentic emotions, promoting their growing into morally conscious and ethically responsible human beings. She recommends that students actively engage with the material and provides suggestions for group discussion throughout the book. Her research began in 1981, continued through twenty years of investigations, interviews, library searches, and analyses, and has culminated in Charles Faulkner Bryan: His Life and Music. This book is not just the usual sequence of events in the life of a musician. Rather, it is more like becoming acquainted with someone you have never met before, yet feel comfortable with immediately. Charles Faulkner Bryan is genuinely likeable, and Livingston brings the person of Bryan to the fore and lets his humanity shine through his life and his music.Charles Faulkner Bryan: His life and Music is divided into two sections (pre- and post-WWII), each with four chapters. Livingston looks at this musician from several perspectives: the composer, the educator, the researcher, and the man. Appalachian folk music is the theme that connects the chapters, as it connected the events in Bryan's life. [End Page 211]Chapter 1 focuses on Bryan's youth, during which he and his family discovered his musical abilities. From performing at school, to building his own "turtle uke,"2 to his studies at the Nashville Conservatory of Music, Livingston describes the family support behind his developing musicality. Chapter 2 shows the reader his humanity even more clearly. Livingston tells of his early career as a music educator at the Tennessee Polytechnic institute; his marriage; and his mentorship of a young Black singer, J. Robert Bradley. That Bryan, a white Southerner, gave voice lessons to Bradley was not only generally unheard of with segregation as it was in the United States during the 1930s, but was dangerous to his career as well. Bryan moved on to teach at Peabody College in Nashville and then worked for the Works Progress Administration (WPA) Music Program on the Tennessee Music Project. Later he became the assistant state coordinator for the Tennessee State Defense Council. During both of these service positions, he called for music education improvements in Tennessee. Commenting on his work during this period, Livingston says, "Bryan was both of his time and ahead of his time... grounded in reality and yet visionary."3In Chapter 3, Livingston gives the reader a review of the "status of folk music scholarship and performance" as it existed in the 1930s.4 She takes pains to introduce the folk music researchers and musicians who influenced Bryan in his work with Appalachian folk music: Lucien L. McDowell and Flora Lassiter McDowell, George Pullen Jackson, Charles Seeger, and John Jacob Niles. These connections and friendships were to influence his awareness of Appalachian folk music and would continue for the rest of his life. By 1945 he had come to be considered an authority on folk music in his own right and his vision of this music came to encompass "the ultimate meaning in representing America itself."5Chapter 4 traces Bryan's development as a composer. It is in this chapter that Livingston begins to incorporate analyses of Bryan's most popular compositions. Her reviews of these compositions are clear and detailed without being overly theoretical. Some of the selections she analyzes include "Charlottown," "The Ballad of the Harp Weaver," and the White Spiritual Symphony. The Symphony in particular shows his respect for the folk songs he incorporated in this composition. Indeed, as Livingston points out several times, he maintained the integrity of these songs in all his compositions and performances. There is a fascinating debate that was initiated by Graham Priest, who is a chief proponent of dialetheism, about the possibility of legal gluts. In this essay, after critically evaluating the original cases for and against the possibility of legal gluts, I adjudicate a recent debate in this Journal regarding their possibility and provide new reasons for countenancing them. If my considerations are correct, then I will have provided new grounds for the possibility of legal gluts.

The move to satisficing has been thought to help consequentialists avoid the problem of demandingness. But this is a mistake. In this article I formulate several versions of satisficing consequentialism. I show that every version is unacceptable, because every version permits agents to bring about a submaximal outcome in order to prevent a better outcome from obtaining. Some satisficers try to avoid this problem by incorporating a notion of personal sacrifice into the view. I show that these attempts are unsuccessful. (...) I conclude that, if satisficing consequentialism is to remain a position worth considering, satisficers must show (i) that the move to satisficing is necessary to solve some problem, whether it be the demandingness problem or some other problem, and (ii) that there is a version of the view that does not permit the gratuitous prevention of goodness. This paper is a review essay of W. Bradley Wendel's Lawyers and Fidelity to Law, part of a symposium on Wendel's book. Parts I and II aim to situate Wendel's book within the literature on philosophical or theoretical legal ethics. I focus on two points: Wendel's argument that legal ethics should be examined through the lens of political theory rather than moral philosophy, and his emphasis on the role law plays in setting terms of social coexistence in the midst (...) of moral pluralism. Both of these themes lead him to reject viewing legal ethics as an instance of "the problem of role morality." In part III I note the similarity between Wendel's view and that of legal process theorists, and I argue that the view involves too much complacency about the American legal system. Part IV examines the central metaphor of Wendel's book, fidelity to law. I distinguish between two forms of fidelity, personal and interpretive. The former is a relation between persons, while the latter means mimetic accuracy in interpretation, translation, performance of music, portraiture, or other forms of representation. I agree with Wendel's views on the requirement that lawyers exhibit interpretive fidelity toward law, but not personal fidelity. I argue that law is not the kind of thing toward which one can have personal fidelity; rather, the fidelity must be toward other members of the community rather than toward norms as such; and in cases where the law systematically discriminates, or is otherwise systematically unjust, the bonds of reciprocity grounding such a relation are absent, and the kind of unconditional obedience to law that Wendel supports is unjustified. Part V asks where, on Wendel’s view, the morality went. I argue that Wendel's view, which derives from but modifies Joseph Raz's analysis of legal authority as exclusionary reasons, does not succeed—either it begs the question of whether law actually provides exclusionary reasons or, if (as Wendel suggests) the reasons are not wholly exclusionary, Raz’s two levels of reasoning collapse into one, and acting on moral grounds is not in fact excluded by legal authority. I then turn to Wendel's ideas about "moral remainders"—the moral costs that acting on his view of legal ethics may inflict on others. Wendel suggests that some form of atonement can cancel the moral remainder, but I am skeptical that his proposal—atoning through law reform activities—can do the job. (shrink)

Richard Jeffrey espoused an antifoundationalist variant of Bayesian thinking that he termed ‘Radical Probabilism’. Radical Probabilism denies both the existence of an ideal, unbiased starting point for our attempts to learn about the world and the dogma of classical Bayesianism that the only justified change of belief is one based on the learning of certainties. Probabilistic judgment is basic and irreducible. Bayesian conditioning is appropriate when interaction with the environment yields new certainty of belief in some proposition but leaves one’s (...) conditional beliefs untouched (the ‘Rigidity’ condition). Although Richard Jeffrey denied the general applicability of this condition, one of his main contributions to probabilistic thinking is a form of belief updating—now typically called ‘Jeffrey conditioning’ or ‘probability kinematics’—that is appropriate in circumstances in which Rigidity is satisfied, but where the interaction causes one to reevaluate one’s probability judgments over some partition of the possibility space without conferring certainty on any particular element. The most familiar occasion for Jeffrey conditioning is receipt of uncertain evidence: things partially perceived or remembered. But it also serves to illuminate belief updating occasioned by a change in one’s degrees of conditional belief, a kind of belief change largely ignored by classical Bayesianism. I argue that such changes in conditional belief can also be basic (in the sense of not being analyzable as a consequence of conditioning on factual information) and offer a kinematical model for a particular kind change in conditional belief. Both are applied to changes in preference. Finally, I argue that Rigidity can fail when changes of belief give inferential grounds for changes in conditional belief (and vice versa). These failures show that conditioning methods are properly regarded, not as valid rules of inference, but as tools in the ‘art of judgment’. (shrink)

In this paper I argue that this asymmetry is incompatible with a plausible principle of independence of irrelevant alternatives, and that a more general asymmetry between harming and benefiting is difficult to defend. This paper examines the affective disorders plaguing many young people and the problem of attention-deficit hyperactivity disorder in particular. It aims to define the limits of the critique of British educationalist Sir Ken Robinson in terms of his philosophy of ‘creativity’ through a consideration of the ideas of French philosopher Bernard Stiegler, especially the notions of ‘industrial temporal objects’ and stupidity. It makes the case for adopting elements of each distinct research paradigm as a prolegomena to forging a social critique (...) of capitalist-dominated, market-led educational institutions. The former, it will be seen, identifies some of the problems facing teachers in terms of the use and application of technology, the false divide between arts and the humanities, but falls short of explaining the root of the structural and psychic malaise in neo-liberal regimes regarding classroom breakdown in general. The latter, despite the apocalyptic tone of some his pronouncements provides an update and radicalization of Deleuze’s societies of control thesis in terms of what Stiegler designates ‘uncontrollable societies’. Stiegler, it will be seen, presents a critique of technology that is all the more pressing in an age in which the loss of expectation in the lives of young people can lead to a corresponding fall off or destruction in ‘deep attention’. I want to test the hyperbole of Stiegler’s assertion that young people today suffer from a ‘colossal’ attention deficit disorder of unprecedented scale and magnitude. (shrink)

Bayesian models typically assume that agents are rational, logically omniscient and opinionated. The last of these has little descriptive or normative appeal, however, and limits our ability to describe how agents make up their minds (as opposed to changing them) or how they can suspend or withdraw their opinions. To address these limitations this paper represents the attitudinal states of non-opinionated agents by sets of (permissible) probability and desirability functions. Several basic ways in which such states of mind can be (...) changed are then characterised and compared with those found in AGM style models of attitude revision. We review the question of whether objective chances are compatible with determinism. We first outline what we mean by chance and what we mean by determinism. We then look at the alleged incompatibility between those concepts. Finally, we look at some ways that one might attempt to overcome the incompatibility.

This paper investigates the role of conditionals in hypothetical reasoning and rational decision making. Its main result is a proof of a representation theorem for preferences defined on sets of sentences (and, in particular, conditional sentences), where an agent’s preference for one sentence over another is understood to be a preference for receiving the news conveyed by the former. The theorem shows that a rational preference ordering of conditional sentences determines probability and desirability representations of the agent’s degrees of belief (...) and desire that satisfy, in the case of non-conditional sentences, the axioms of Jeffrey’s decision theory and, in the case of conditional sentences, Adams’ expression for the probabilities of conditionals. Diversity of opinion both presents problems and aff ords opportunities. Diff erences of opinion can stand in the way of reaching an agreement within a group on what decisions to take. But at the same time, the fact that the differences in question could derive from access to different information or from the exercise of diff erent judgemental skills means that they present individuals with the opportunity to improve their own opinions. This paper explores the implications for solutions to the (...) former (aggregation) problem of supposing that individuals exploit these opportunities. In particular, it argues that rational individual revision of opinion implies that aggregation problems are unstable in a certain sense and that solving them by exploiting the information embedded in individual opinion has profound implications for the conditions that we should impose on aggregation procedures. Suppose you find yourself in a situation in which you can either save both A and B or save only C. A, B and C are relevantly similar – all are strangers to you, none is more deserving of life than any other, none is responsible for being in a life-threatening situation, and so on. John Taurek argued that when deciding what to do in such a situation, you should flip a coin, thereby giving each of A, B and C (...) a 50% chance of survival . Only by doing this can we treat each person with the appropriate degree of respect. Taurek seemed to be employing the “Equal Greatest Chance” principle , according to which, when deciding whom to save, one must give each person the greatest possible chance of survival consistent with everyone else having the same chance. An obvious alternative is the “Save the Greater Number” principle . I describe an example that shows that EGC is false. I show that the example also demonstrates the falsity of other related views, including Jens Timmermann’s “Individualist Lottery Principle.” I conclude that SGN is true. And I extend the argument to other kinds of cases, showing that which person should be saved may depend on whether some additional well-being may be gained for someone in the process. (shrink)

How should we respond to evidence when our evidence indicates that we are rationally impaired? I will defend a novel answer based on the analogy between self-doubt and memory loss. To believe that one is now impaired and previously was not is to believe that one’s epistemic position has deteriorated. Memory loss is also a form of epistemic deterioration. I argue that agents who suffer from epistemic deterioration should return to the priors they had at an earlier time. Dominic Lopes proposes that seeing-in admits of kinds. He thus suggests five ways of seeing-in that he feels do justice to the variety of pictorial representations. More recently Dan Cavedon-Taylor has argued that the space of seeing-in marked out by Lopes is incomplete, and thus proposes a sixth kind of seeing-in that fits neatly into the taxonomy. I argue that the phenomenon of seeing-in does not divide in as many ways as Lopes and Cavedon-Taylor propose. I show that the purported (...) cases of pseudo-design seeing do not demonstrate that actual design properties are not experienced and as such these cases can be captured by the other ‘ways of seeing-in’ that Lopes identifies. I also argue against the claim that actualism is a distinct kind of seeing-in. Thus the space of seeing-in ought to be significantly reduced. (shrink)

This work examines the rise of postmodernism in management scholarship and argues that the prevalence of postmodernist thought reflects a lack of understanding by management researchers of the core principles upon which Western business endeavour is based. The author highlights postmodernism’s methodological and conceptual failings, such as disbelief in material progress and economic advancement, and its denial of generalizable laws to direct management research. In its place, the author proposes a return to traditional modernist principles in management research, based on (...) scientific evidence. This ground breaking, timely work will spark debate and challenge previously accepted claims of postmodernism, a nice retort to the anti-business/anti-capitalist literature now prevalent in academia. Religious freedom is included among the basic liberties to which persons are entitled in John Rawls’s account of Justice as Fairness. Rawls’s revised presentation of this as a political conception of justice in Political Liberalism aims to show how it can be (along with the other parts of Justice as Fairness) the focus of an overlapping consensus of reasonable comprehensive doctrines. As an example, Rawls contends that his understanding of religious freedom is consistent with that of the Roman Catholic Church, (...) at least since the Second Vatican Council. I argue that he was mistaken in this in so far as other aspects of his political conception, especially its characterization of citizens as normatively having the power to form their own conceptions of the good, puts it at odds with the teaching of the Council’s Declaration on Religious Freedom, Dignitatis humanae. This suggests more generally that the limits of consensus in modern pluralist societies are greater than Rawls’s theory holds. (shrink)

Brian Hill argues for a restriction of the Preservation condition that is based on a notion of epistemic, as opposed to logical, consistency. In this reply I consider possible criteria for epistemic consistency and suggest that a natural candidate for one leads to a more severe restriction on the Preservation condition than Hill proposes. I also question whether his proposed restriction is either necessary or sufficient to avoid the impossibility results for the Preservation condition, suggesting that it is the way (...) in which belief expansion is characterized within the AGM framework that is the real source of the problem. Finally, I draw on the notion of belief undermining to support a different resolution of the problem. (shrink)

This article introduces cultural studies of medicine to medical humanities readers. Rather than offer extended definitions of cultural studies of medicine or provide a detailed history of the domain, I have organized this introduction around a close reading and review of three recently published texts in the field. These three texts, dealing respectively with cyborg technology, AIDS, and the medical management of sexual identity problems, represent excellent examples of the opportunities and possibilities of applying cultural studies approaches to medical topics. After working through these texts (and the semiotic theories which animate them), I devote my conclusion to a broader consideration of the role of cultural studies of medicine for both medical practice and medical humanities scholarship.
