Many bioethicists have recently shifted from using “physician-assisted suicide” (PAS) to “medical aid-in-dying” (MAID) to refer to the act of voluntarily hastening one’s death with the assistance of a medical provider. This shift was made to obscure the practice’s connection to “suicide.” However, as the charge of “suicide” is fundamental to arguments against the practice, “MAID” can only be used by its proponents. The result has been the fragmentation of the bioethical debate. By highlighting the role of human agency—as opposed (...) to natural processes—in causing death, the term “PAS” makes it easier both to perceive potential risks to vulnerable populations and to affirm suicide as a potentially autonomous choice. As such, “PAS” thus more transparently expresses the arguments of both supporters and opponents of the “right to die,” while avoiding the unnecessary stigmatization of suicide and suicidal people which is a result of the usage of “MAID.”. As they age, many people are afraid that they might become a burden to their families and friends. In fact, fear of being a burden is one of the most frequently cited reasons for individuals who request physician aid in dying. Why is this fear so prevalent, and what are the issues underlying this concern? I argue that perceptions of individual autonomy, dependency, and dignity all contribute to the fear of becoming a burden. However, this fear is misplaced; common conceptions (...) of these values should be re-framed and re-examined. Practices that support a more community-centered type of autonomy can be found in dependency and dignity. This paper offers some practical examples of how to address common end-of-life situations that may cause anxiety to patients who are worried about being a burden. These practices include discussing expectations, both for care and how the relationship among the participants might change, and modeling respectful caregiving behaviors. Most difficult of all, though, includes cultural and societal attitude changes so that people recognize the good in receiving care and get used to the idea that they do not need to do anything to be valuable. This paper will be concerned with the conjunctive interpretation of a family of disjunctive constructions. The relevant conjunctive interpretation, sometimes referred to as a “free choice effect,” (FC) is attested when a disjunctive sentence is embedded under an existential modal operator. I will provide evidence that the relevant generalization extends (with some caveats) to all constructions in which a disjunctive sentence appears under the scope of an existential quantifier, as well as to seemingly unrelated constructions in which conjunction appears under (...) the scope of negation and a universal quantifier. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. The laboratory animal environment: room for concern.

The notion of measurement plays a central role in human cognition. We measure people’s height, the weight of physical objects, the length of stretches of time, or the size of various collections of individuals. Measurements of height, weight, and the like are commonly thought of as mappings between objects and dense scales, while measurements of collections of individuals, as implemented for instance in counting, are assumed to involve discrete scales. It is also commonly assumed that natural language makes use of (...) both types of scales and subsequently distinguishes between two types of measurements. This paper argues against the latter assumption. It argues that natural language semantics treats all measurements uniformly as mappings from objects (individuals or collections of individuals) to dense scales, hence the Universal Density of Measurement (UDM). If the arguments are successful, there are a variety of consequences for semantics and pragmatics, and more generally for the place of the linguistic system within an overall architecture of cognition. Almost all philosophers agree that a necessary condition on lying is that one says what one believes to be false. But, philosophers haven’t considered the possibility that the true requirement on lying concerns, rather, one’s degree-of-belief. Liars impose a risk on their audience. The greater the liar’s confidence that what she asserts is false, the greater the risk she’ll think she’s imposing on the dupe, and, therefore, the greater her blameworthiness. From this, I arrive at a dilemma: either the belief (...) requirement is wrong, or lying isn’t interesting. I suggest an alternative necessary condition for lying on a degree-of-belief framework. Individuals with high levels of growth mindsets believe that attributes are malleable. Although links between acute stress responses and growth mindsets of thought, emotion, and behaviour are central to the conceptualisation of psychological disorders and their treatment, such links have yet to be examined. Undergraduate participants (N = 135) completed a modified Trier Social Stress Test (TSST), and their salivary cortisol and anxiety were assessed throughout the session. Hierarchical linear models revealed that higher growth mindset of behaviour was associated with (...) lower cortisol levels at 25-min after the TSST onset (i.e. peak cortisol stress reactivity) in men, but not in women. Considering one’s gender may be critical in understanding the relationship between growth mindset and stress responses. (shrink)

Schopenhauer repeatedly claims that all pleasure is negative, and this view seems to play key roles throughout his work. Nonetheless, many scholars have argued that Schopenhauer actually acknowledges certain positive pleasures. Two major arguments have been offered for this reading, one focused on the link between Schopenhauer's view of pleasure and Plato's, and one focused on Schopenhauer's distinction between two components of aesthetic pleasure. I argue that neither way of motivating the positive pleasure reading succeeds. Both overlook a key aspect (...) of Schopenhauer's account: namely, his suggestion that there are two distinct kinds of negative pleasure, pleasures of satisfaction and pleasures of distraction. This exploration into spirituality and climate change employs the “four paths” of the creation spirituality tradition. The author recognizes those paths in the rich teachings of Pope Francis’s encyclical, Laudato Si' and applies them in considering the nobility of the scientist's vocation. Premodern thinkers often resisted any split between science and religion. The author then lays out the basic archetypes for recognizing the sacredness of creation, namely, the Cosmic Christ (Christianity); the Buddha Nature (Buddhism); the Image of God (Judaism); the (...) “Primordial Man” (Hinduism), as well as the premodern universal teaching of “God as Beauty.” He addresses the subject of evil which deserves serious attention in the face of the realities posed by climate change and the resistance to addressing them. In the concluding section, the author speaks of a new Order of the Sacred Earth that was launched in fall 2017 to gather persons of whatever spiritual tradition or none to devote themselves to preserving Mother Earth. A common assumption is that paternalism generates a special, and especially grievous, insult. Identifying this distinctive insult is then presented as the key to unlocking the concept and determining its moral significance. I submit that there is no special insult. It is, rather, a particular form that a lack of recognition respect can take. Attempting to capture the special insult has led us into confusion. In particular, it has led theorists to abandon the idea that paternalists must act for the (...) sake of the individual whose agency they supplant, and even the notion that paternalistic action requires a distinctive motivation at all. I argue that paternalistic actions must come from a place of care and concern for the paternalised agent and show that this explains the moral significance of paternalism since it tempers the general insult that such actions deliver and provides a partial defence when paternalism is misguided. A broad range of scholars contend that the rule of law is indifferent to human rights. I call this view the "no-rights thesis," and attempt to unsettle it. My argument draws on the work of Lon L. Fuller and begins with the idea that the fundamental justification of the rule of law rests on a juridical conception of human agency, one that finds expression in the legal and moral claims that can arise from human agency within the context of legal (...) relationships. I argue that the state and its legal subjects are in a particular kind of legal relationship with one another, a fiduciary relationship, and that the content of the state's ensuing fiduciary obligation is the rule of law. Because the rule of law is intelligible in terms of the right, and independently of the good, it follows that compliance with the rule of law necessarily makes a moral difference regardless of how poorly the state lives up to the demands of the good. This is a conceptual rather than an empirical claim, and it leads to the conclusion that respect for human agency in the context of the state-subject fiduciary relationship necessarily entails respect for human dignity, respect for human dignity entails respect for human rights, and therefore a commitment to the rule of law entails a commitment to human rights. In this paper, we investigate the ‘ought implies can’ thesis, focusing on explanations and interpretations of OIC, with a view to clarifying its uses and relevance to legal philosophy. We first review various issues concerning the semantics and pragmatics of OIC; then we consider how OIC may be incorporated in Hartian and Kelsenian theories of the law. Along the way we also propose a taxonomy of OIC-related claims.

Machine ethics and robot rights are quickly becoming hot topics in artificial intelligence and robotics communities. We will argue that attempts to attribute moral agency and assign rights to all intelligent machines are misguided, whether applied to infrahuman or superhuman AIs, as are proposals to limit the negative effects of AIs by constraining their behavior. As an alternative, we propose a new science of safety engineering for intelligent artificial agents based on maximizing for what humans value. In particular, we challenge (...) the scientific community to develop intelligent systems that have human-friendly values that they provably retain, even under recursive self-improvement. (shrink)

The human sciences—including psychology, anthropology, and social theory—are widely held to have been born during the eighteenth century. This first full-length, English-language study of the Enlightenment sciences of humans explores the sources, context, and effects of this major intellectual development. The book argues that the most fundamental inspiration for the Enlightenment was the scientific revolution of the seventeenth century. Natural philosophers from Copernicus to Newton had created a magisterial science of nature based on the realization that the physical world operated (...) according to orderly, discoverable laws. Eighteenth-century thinkers sought to cap this achievement with a science of _human_ nature. Belief in the existence of laws governing human will and emotion; social change; and politics, economics, and medicine suffused the writings of such disparate figures as Hume, Kant, and Adam Smith and formed the basis of the new sciences. A work of remarkable cross-disciplinary scholarship, this volume illuminates the origins of the human sciences and offers a new view of the Enlightenment that highlights the period's subtle social theory, awareness of ambiguity, and sympathy for historical and cultural difference. The medical humanities were organized, beginning in the late 1960s, by a small group of people who shared a critique of medical education and a commitment to vigorous action to change it. They proposed to create several demonstration programs in humanities education at American schools. Although the group began with a religious orientation, it soon acquired a broader, more secular mission. As a result of shrewd political organizing, the group attracted members from within medicine, and was awarded a grant to (...) promote the medical humanities. Based on interviews with 40 first-time mothers, the authors develop an argument that supplements the critique of medicalized childbirth by focusing on the social context in which women give birth. Particularly important about that context is women's privatized responsibility for babies' well-being, and a dearth of social supports for mothering, including the sharing of that responsibility by fathers. Contextualizing childbirth in this way makes clearer not only why many women are favorable toward medical intervention but also the decisions women make (...) during hospital births. The women we interviewed displayed widely ranging reactions to giving birth in the hospital. Describing their experiences, these women often emphasized pain and anxiety. Both conditions appear to have been relieved as effectively by social support as by medical assistance. Furthermore, women who had generally supportive partners were less likely to receive medical intervention during the birth and less likely to suffer postpartum depression. (shrink)

In this paper I consider Corneliu Porumboiu’s ‘Police, Adjective’ (Romania, 2009) as an instance of a puzzling work of art. Part of what is puzzling about it is the range of extreme responses to it, both positive and negative. I make sense of this puzzlement and try to alleviate it, while considering the film alongside Ludwig Wittgenstein’s arguably puzzling “Lectures on Aesthetics” (from 1938). I use each work to illuminate possible understandings of the other. In this paper we address an important issue in the development of an adequate formal theory of underspecified semantics. The tension between expressive power and computational tractability poses an acute problem for any such theory. Generating the full set of resolved scope readings from an underspecified representation produces a combinatorial explosion that undermines the efficiency of these representations. Moreover, Ebert (2005) shows that most current theories of underspecified semantic representation suffer from expressive incompleteness. In previous work we present an account (...) of underspecified scope representations within Property Theory with Curry Typing (PTCT), an intensional first-order theory for natural language semantics. We review this account, and we show that filters applied to the underspecified-scope terms of PTCT permit expressive completeness. While they do not solve the general complexity problem, they do significantly reduce the search space for computing the full set of resolved scope readings in non-worst cases. We explore the role of filters in achieving expressive completeness, and their relationship to the complexity involved in producing full interpretations from underspecified representations. In an influential series of papers, Cleland (2001, 2002, 2011) argued that historical natural scientists employ a distinctive methodology—which exploits Lewis (1979)s asymmetry of over determination—that is capable of putting knowledge of the deep past on an epistemic par with experimental knowledge. Currie (2018) clarified the nature of the asymmetry claim and used it to argue for a more restricted form of optimism toward the historical sciences. This optimism is licensed by the evidential redundancy that the asymmetry of over determination (...) guarantees.In this chapter I show that the argument for the asymmetry of over determination is circular and the thesis is false. Over determination toward the past is smuggled in from the start by ruling out of consideration so-called backtracking counterfactuals. By banning backtracking counterfactuals, consideration is restricted to possible worlds in which the over determination thesis holds. But in the actual world, the present is compatible with many different histories. (shrink)

This survey, by a pupil of Geoffrey de Ste. Croix and eventual successor in his Oxford job, combines personal recollections of de Ste. Croix’s horizons and intellectual range with a penetrating study of his Origins of the Peloponnesian War, its underlying debts and detailed contentions. It addresses his, and Thucydides’, engagement with origins and causes, his central contention about votes by the Spartans and their allies on whether to go to war, the roles of Corinth, Megara and the much-discussed Megarian (...) decree. It also presents a close reading of an Athenian involvement in Macedon and the north and its relevance to de Ste. Croix’s views on Athenian imperialism. Encoding articulate speech is widely accepted as the principal (or sole) role of the frontal operculum. Clinical observations of speech apraxia have been confirmed by brain-imaging studies of speech production. We present evidence that the frontal operculum also programs limb movements. We argue that this area is a ventral counterpart of the dorsal premotor area. The two are functionally distinguished by specialization for somatic and visual space, respectively.

Prior to the end of the Cold War, the word 'democracy' was rarely used by international lawyers. Few international organisations supported democratic governance, and the criteria for recognition of governments took little account of whether regimes enjoyed a popular mandate. But the events of 1989–1991 profoundly shook old assumptions. Democratic Governance and International Law attempts to assess international law's new-found interest in fostering transitions to democracy. Is an entitlement to democratic government now emerging in international law? If so, what are (...) its normative foundations? How have global and regional organisations encouraged transitions to democracy, and are their efforts consistent with their constitutional frameworks? How should international law react to elections in which profoundly anti-democratic parties win the vote?
