Alaska s Aleutian Island chain, barren and windswept, arcs for over a thousand miles toward Asia from the Alaska Peninsula. In this remote and hostile archipelago is Kiska, an uninhabited sub-arctic speck in the tempestuous Bering Sea. Few have the opportunity even to visit this island, but in June of 1942 Japanese troops seized Kiska and neighboring Attu in the only occupation of North American territory since the War of 1812. The bastion of Japan s possessions in Alaska, Kiska was (...) soon fortified with 7,500 enemy troops, a seaplane base, naval anchorage and submarine base, heavy guns and a labyrinth of tunnels. For thirteen months Japanese troops held a tenuous hold on the island under constant bombardment from American forces, but finally and successfully abandoning the island. So hurried was the evacuation that equipment and personal effects were left behind. The Japanese occupiers of Kiska have remained shadowy figures. Brendan Coyle spent 51 days on Kiska searching out the tunnels, equipment and personal effects frozen in time. Those objects are brought back to life in the over three hundred images Coyle has assembled from his own visit and from archives. Discussions of Nazi law tend to centre upon Fuller’s desiderata of the rule of law. Whilst not disputing this connection, this essay argues that tyranny and oppression are marked by the (ab)use of law to invade the domain proper to individual moral thinking, and to transform citizens into models of conformity to whatever values the tyrant cherishes. Its main consideration is how a community can recover from periods of tyranny, and how the law can recover its dignity having shown itself (...) capable of evil uses. Faced with high levels of unemployment and discrimination in Poland, Polish women have made up a very large proportion of those leaving the former Communist states of central Europe, to work in EU member states. They have constituted a large undocumented migrant workforce in Europe, usually working as domestic workers and carers in the informal economy. Poland’s membership of the EU is starting to regulate Polish women’s work abroad and to increase their access to better paid and skilled work in (...) the formal labour market. New market-led immigration policies in Europe are still selective and restricted however. What Polish women really need from the EU is help in securing a new framework of gender equality and equal treatment in Poland that offers hope for an improvement in their rights at home. (shrink)

Both of the books under review offer a challenge to the dominant jurisprudential tradition of legal positivism. Underlying this superficial similarity in aims is a sharp divergence in philosophical outlook. Whereas Dworkin's arguments operate within a body of background assumptions that he shares with his opponents, and which he has done much to shape, Simmonds sees his task as challenging those assumptions. This is particularly evident in the moral philosophies at the heart of each book: Dworkin can be seen as (...) offering a Protestant-voluntarist-atheist philosophy; whereas Simmonds resembles a Catholic-conservative-Aristotelian. People value highly the digital technologies that are so pervasive in everyday life and work, certainly as measured by economists. Yet there are also evident harms associated with them, including the likelihood that they are affecting political discourse and choices. The features of digital markets mean they tend toward monopoly, so great economic and political power lies in the hands of a small number of giant companies. While tougher regulation may be one way to tackle the harms they create, it (...) does not get at the structural problem, which is their advertising-driven business model. The hunt for people's attention drives algorithmic promotion of viral content to get ever-more clicks. An alternative policy intervention to reclaim public space would be to create a public service competitor that could drive competition along other dimensions. Online space must be reclaimed as a public space from the privately-owned US and Chinese digital giants. (shrink)

Following Snyderman and Rothman, we surveyed expert opinions on the current state of intelligence research. This report examines expert opinions on causes of international differences in student assessment and psychometric IQ test results. Experts were surveyed about the importance of culture, genes, education, wealth, health, geography, climate, politics, modernization, sampling error, test knowledge, discrimination, test bias, and migration. The importance of these factors was evaluated for diverse countries, regions, and groups including Finland, East Asia, sub-Saharan Africa, Southern Europe, the Arabian-Muslim (...) world, Latin America, Israel, Jews in the West, Roma, and Muslim immigrants. Education was rated by N = 71 experts as the most important cause of international ability differences. Genes were rated as the second most relevant factor but also had the highest variability in ratings. Culture, health, wealth, modernization, and politics were the next most important factors, whereas other factors such as geography, climate, test bias, and sampling error were less important. A recent series of papers, sparked off by a note by Robert Walter (1996), has rekindled the debate over the possibility of creating a logic of normative concepts. The debate correctly centres on ways in which Jørgensen’s dilemma might be resolved (Jørgensen 1937–8), since a means of resolving that dilemma is the only apparently available way in which to establish that a logic of norms is possible. Two separate questions require answers: (i) what is the correct way in which to (...) regard Jørgensen’s dilemma; and (ii) how should one face that dilemma? I shall argue that traditional responses to the first question are inadequate, and I shall then try to expose as flawed two recent attempts to resolve the dilemma. Finally, I shall relate my conclusions in the earlier part of the paper to the wider question of whether a logic of normative concepts is, after all, a possibility. (shrink)

The modern lawyer operates within a conception of law as a body of rules. To confront the law of contract, of torts, or of property, is to familiarize oneself with an intricate set of rules. Such familiarity is not yet legal scholarship, much less legal practice. For in order to use the rules as lawyers use them, the rules must be contemplated and considered, and the relationship between the different rules must be understood. Because the intellectual processes involved in handling (...) the rules exhibit a high degree of sophistication, those intellectual processes may themselves become the subject matter of philosophical argument. Thus we may regard jurisprudential theories as embodying differing understandings of the processes of handling legal rules; and we may conceive of legal theory as the attempt to grasp the moral significance of rules as a foundation for social order. This essay shall offer some thoughts on the relationship between the rule of law, considered as a moral ideal, and the notion of rules as the principal means by which legal order is manifested. The essay considers whether there are necessary truths about rights. The existence of rights is contingent, but our practices involving rights rest upon fundamental conceptual assumptions necessary to their coherence. Hohfeld's analysis is proffered as the embodiment of those assumptions. An examination of the concept of necessity shows how those assumptions can be necessary truths about rights without being logically necessary.

An underpinning assumption of modern legal positivism is that the question of how legal standards differ from normative standards in other spheres of human thought is resolved via the concept of a legal system and the notion of internal logic, through use of contextual definition. This approach is seen to lead to an untenable form of structuralism altogether at odds with the positivist's intentions. An alternative strategy is offered which allows the positivists to retain their deepest insights, though at a (...) price. (shrink)

Since it was first presented, James Fowler’s faith development theory has proven influential in pastoral care and counselling, pastoral and practical theology, spiritual direction, and Christian education. However, it has also been subject to substantial critical evaluation. This article reviews the major themes within psychological critiques and considers the agenda provided by these critiques for the theory’s future development. Critical themes concern Fowler’s understanding of “faith”; the theory’s structural “logic of development”; its overemphasis on cognition and lack of attention to (...) processes of transition and transformation; its gender bias and cultural specificity; and its purported difficulty in accommodating postmodern trends in psychology. To address these critiques in a meaningful way, there is a need to embrace alternative existing theories of faith development and spiritual/religious change, to construct a radically revised, process-focused version of faith development theory, and to continue to develop new localized process models of faith development. If deontic logic is to cast light on any of the normative sciences, such as legal reasoning, then certain problems regarding its logical constants must be faced. Recent studies in the area of deontic logic have tended to assume that it is our responses to the “paradoxes” of deontic implication which are fundamental to resolving problems with the use of deontic logic to investigate various branches of normative reasoning. In this paper I wish to show that the paradoxes are of (...) secondary importance; that they are merely by‐products of the central issue, namely the ability of certain syntactic forms to embody natural language structures used in reasoning about norms. An investigation of modal syntax is proffered as the best starting‐point from which to tackle the questions that still dog the legitimacy of deontic logic. Part I provides some philosophical background to the discussion of deontic logical constants. Part II addresses in greater detail issues concerning the representation of normative concepts; and Part III offers a few remarks on the general issue of deontic logic's fruitfulness as an analytical tool.
