This edited volume of original contributions deals with the economic and political thought of Michael Polanyi. Requiring little prior knowledge of Polanyi, this volume further develops a somewhat neglected side of Polanyi's work. In particular it examines the 'tacit integration', of subsidiary details into focal objects or actions as central to all knowing and action. It traces ontological counterparts in the structures of comprehensive entities and complex actions, and a multi-level universe in which lower levels have their boundary conditions, the (...) extents to which they apply, determined by those of the next higher level, whilst each possessing its own laws or operative principles. This schema of 'dual control' preserves the reality and relative autonomy of each level, and its interactions with others, against the various reductions. The essays in this volume also employ and develop important additional concepts and distinctions such as: 'corporate' and 'spontaneous' order; 'public' and 'private' liberties; 'general' and 'specific authority'; and 'moral inversion'; which, as the essays show, are necessary for understanding and maintaining a free society and the freedom of institutions within it. Among the topics treated with them are: more of the prerequisites of freedom in public liberties dedicated to principles and transcendent values; totalitarianism and society as spontaneous order; the balance of general and specific authority in society and particular institutions; reductionism, totalitarianism and consumption in consumer societies, as moral inversions; the mutual interactions of economics and politics as distinct and autonomous but interacting levels; the sociological aspects of economics; and Polanyi's own contributions to sociology. Although, as indicated, Polanyi has his special terms, the essays in this volume, like his works, give them meaning with concrete examples and so avoid merely shuffling a mass of abstractions. Allen Buchanan argues that it doesn’t matter whether a state has authority in the sense of being able to create binding obligations for its citizens, so long as it is morally justified in wielding political power. In this paper, I look at this issue from a slightly different angle. I argue that it matters a great deal whether citizens relate to their state in an obligatory fashion. This is for two reasons. First, a fully morally justified state must be (...) an efficacious state; it must be able to realise its values and make its rules stick. My contention will be that enduring stability can only be secured when citizens, or at least a significant proportion of citizens, are tangibly bound to regulate their conduct in accordance with a principle of obedience to just states. Second, it is only when individuals interact in the right way with the justification for state power that the state itself as a pervasive and coercive entity does not pose a problem for them as reason-responsive agents. The indirect argument (IA) for incompatibilism is based on the principle that an action to which there is no alternative is unfree, which we shall call ‘PA’. According to PA, to freely perform an action A, it must not be the case that one has ‘no choice’ but to perform A. The libertarian and hard determinist advocates of PA must deny that free will would exist in a deterministic world, since no agent in such a world would perform an action (...) to which there were alternatives: an action there being the necessary consequence of preceding events and the laws of nature, it would not be possible for a person to perform actions besides those he actually performs. Determinism is seen here as “indirectly” ruling out free will by making the satisfaction of a necessary condition of free agency impossible, the former requiring, according to the leading proponent of libertarianism, Robert Kane, the performance of free actions. To have a free will, on his view, is to have committed “self-forming” actions, that is, to have done things to which there were alternatives the doing of which led to the development of the desires, preferences, and beliefs that make up one’s character. -/- The range of phenomena obeying probabilistic laws has yet to be ascertained. Under certain assumptions, both STR and GTR entail an indeterministic mechanics. But, contrary what is often claimed, quanta do not behave indeterministicly: the wave function/probabilistic laws being necessary only insofar as we wish to macroscopicly describe their behavior. It is far less clear, however, that the macro-events involved in human decision making and behavior, such as the releasing of neurotransmitters and the contracting of muscles, occur indeterministically. The ontological status of these events-whether or not they are the necessary effects of prior occurrences-is, of course, what matters in the free will debate. For present purposes, however, this question will be put aside. Instead, I will concentrate on buttressing the existing case against PA, aiming to show that even if deterministic laws hold at the level of macro-phenomena, free will remains a possibility. That is to say, I shall defend the thesis that so-called “Frankfurt cases” demonstrate that alternatives are not required to perform an action that is free in the sense of being something for which its agent is responsible. -/- My defense will be carried out in three stages. First, I must respond to those who maintain that a Frankfurt case is not a counterexample to PA because it is not an example of someone acting without alternatives. Here, I confront the question of how “robust” an alternative must bein order to provide an agent with a way of avoiding praise or blame for the action that she actually commits. Secondly, I must show that an agent may be praiseworthy or blameworthy despite lacking alternatives at the time at which she acts, i.e., an appropriate object of one of a Strawsonian “reactive attitude” sans what I shall call “local” alternatives. At this point, I must attend to David Widerker’s recent critique of the use of Frankfurt cases as counterexamples to PA. Finally, I set for myself what I take to be the most difficult task of a compatibilist: demonstrating that not even an “historical” alternative-the possibility of having chosen a different path in life than the one that one has actually taken-is needed to have a free will. In this connection, it will be incumbent upon me to explain why it would be fair to hold someone accountable for behavior issuing from a self she did not create, dispositions originating from natural conditions she did not establish. That is to say, in denying that a free will entails the ability to transcend oneself, I shall be faced with what Kane calls the “ultimacy” problem: how to explain away the incompatibilist’s intuition that it is senseless to adopt a reactive attitude towards someone incapable of self-transcendence, even if such a reaction is itself unavoidable. By showing that the desire for self-transcendence is itself irrational, I intend to solve this problem. I will, thus, be left defending a version of compatibilism according to which a free will is to be understood as a healthy faculty-the will-being exercised in an environment conducive to self-realization, which is its purpose. The Principle of Robust Alternatives states that an agent is responsible for doing something only if he could have performed a ‘robust’ alternative thereto: another action having a different moral or practical value. Defenders of PRA maintain that it is not refuted by a ‘Frankfurt case’, given that its agent can be seen as having had such an alternative provided that we properly qualify that for which he is responsible. I argue here against two versions of this defense. First, I (...) show that those who maintain that a ‘Frankfurt agent’ is responsible for voluntarily performing his action must attach moral significance to his luck. I proceed to discuss Carl Ginet's strategy of temporally qualifying ascriptions of responsibility, arguing that his counterexample to the principle that ‘If an agent is responsible for doing A @ t, then he is responsible for doing A simpliciter ’ is disanalogous to a Frankfurt case. This study of American intellectual histories sketches their development from colonial chronicles to today's professional scholarship. It concentrates upon the writings of a dozen or more major historians between the late 1800's and the middle 1900's who have contributed to the study of the history of ideas in America, including Moses Coit Tyler, Edward Eggleston, Charles Beard, Carl Becker, Vernon Farrington, Merle Curti, Perry Miller, and Ralph Gabriel. The various histories are analyzed partly from the perspective of a developing (...) scholarly discipline and partly from the perspective of the "climate of opinion" in which the histories were written. The methods employed by the historians in studying ideas, as well as the substantive interpretations expressed in the histories, are analyzed in relation to the "world-views" or "ideological positions" of the historians themselves. Ihr Vermachtnis sind ungewohnlich zahlreiche Vorlesungsnachschriften zu Pandekten, Institutionen, Romischer Rechtsgeschichte, preussischem Allgemeinen Landrecht, Methodologie und weiteren Materien, die Savignys Lehren von den Anfangen als junger Professor bis zum ungekronten Haupt der Rechtswissenschaft widerspiegeln. Da Savigny keine Lehrbucher publizierte und sein grosses Hauptwerk zum Privatrecht erst ab 1840 gedruckt wurde, lasst sich sein Einfluss auf die Rechtswissenschaft seiner (...) Should we hold beliefs only insofar as they are rationally supportable? According to Allen W. Wood, we're morally obliged to do so—and yet how does this apply to religious beliefs? _Unsettling Obligations_ examines these and related ethical and philosophical issues, taking and defending stances on many of them. One of the most interesting programs in the foundations of quantum mechanics is the realist quantum logic approach associated with Putnam, Bub, Demopoulos and Friedman (and which is the focus of my own research.) I believe that realist quantum logic is our best hope for making sense of quantum mechanics, but I have come to suspect that the usual version may not be the correct one. In this paper, I would like to say why and to propose an alternative.

Social distancing has become the most prominent measure many countries have implemented to combat the spread of COVID-19. The aim of the current study was to explore the potential role of empathy and self-construal styles, as individual personality traits, on self-reported social distancing. Participants completed the Interpersonal Reactivity Index, the Singelis Self-Construal Scale, and were asked to rate their level of social distancing and how much they endorsed social distancing on a five-point Likert-scale. Across a large and diverse sample, results (...) showed that trait-levels of empathic concern and perspective taking positively correlates with social distancing. However, we did not find evidence to suggest that trait-levels of personal distress correlates with social distancing. We interpret these findings as suggesting that empathy, both its altruistic and cognitive dimensions, plays an important role in motivating people to socially distance and should be emphasized during times of crisis. Furthermore, we suggest that emphasizing a person’s self-distress during times of crisis may not be an effective approach in promotion social distancing policies. We also found that both independence and interdependence self-construal styles positively correlates with social distancing. While we expected the latter result, we did not expect the former. This suggests that more work is needed to fully understand how self-construal styles, along with their cultural level analogs, influences social distancing. Overall, these results provide us with novel multi-national data about the role of individual differences on social distancing tendencies specifically, and human behavior during a global health crisis more generally. Some people change dramatically over time, and often those changes result partly from what they have chosen to do for a living. Drawing on the work of Richard Sennett and Sandeep Jauhar, I explore how practicing in a market-driven medical system can corrupt the character of doctors.

Where has all the hilarity gone – and, with it, the ethics of the dark? In this article, I engage with our metaphysical entities of darkness and nothingness. Undermining and re-declaring are more than just pleasurable exercise for my own indigenous group – Maori; they are ethical necessities that keep one’s certainties in check. Whether it is agreeable or uncomfortable, this acknowledgement of those first beings is necessary if we are to avoid taking ourselves too seriously. I then consider one (...) controversial statement about trauma and lend my perverse, indigenous sense to it, reinterpret it and recalibrate it in light of our inherent fallibility as human citizens who are always destabilised by our own metaphysical entities. This drive to undercut ourselves by making our statements contingent on other things, I shall argue, is an ethical one. (shrink)

In recent years, it has become commonplace among the Global Burden of Disease study authors to regard the disability-adjusted life year primarily as a descriptive health metric. During the first phase of the GBD, it was widely acknowledged that the DALY had built-in evaluative assumptions. However, from the publication of the 2010 GBD and onwards, two central evaluative practices—time discounting and age-weighting—have been omitted from the DALY model. After this substantial revision, the emerging view now appears to be that the (...) DALY is primarily a descriptive measure. Our aim in this article is to argue that the DALY, despite changes, remains largely evaluative. Our analysis focuses on the understanding of the DALY by comparing the DALY as a measure of disease burden in the two most significant phases of GBD publications, from their beginning to the most recent releases. We identify numerous assumptions underlying the DALY and group them as descriptive or evaluative. We conclude that while the DALY model arguably has become more descriptive, it remains, by necessity, largely evaluative. (shrink)

Naturalistic experiments of color perception are critically evaluated. The review concludes that they fail to confirm a natural determination of color perception. Rather than demonstrating universal sensitivity to focal colors, the experiments actually yielded enormous cultural variation in response. This variation is interpreted as supporting a sociohistorical psychological explanation of color perception.

This book brings together ten influential essays on justice and healthcare, written by a major figure in bioethics and political philosophy. What emerges is a systematic and unified approach to the issues that challenges widely-held dogmas and unsettles the framing assumptions of a number of prominent debates. This paper presents a typology of human actions, based on Aristotle’s kinesis–energeia dichotomy and on a formal elaboration (with some refinement) of the Vendler–Kenny classificatory schemes for action types (or action verbs). The types introduced are defined throughout by inferential criteria, in terms of what here are referred to as “modal-temporal expressions” (‘MT-terms’). Examples of familiar categories analysed in this way are production and maintenance, but the procedure is meant to offer a basis for defining various other commonsense categories. Among (...) the more theoretical categories introduced are “Aristotelian projects”, i.e. actions defined in terms of Aristotle’s conceptions of movement/change, as well as “abstract projects”, in which the agent ensures that something changes from not being a fact to being a fact, and “conditional agency”, which involves actions that are to be performed when/if certain conditions come to be fulfilled. A category like “starting an action” is itself inferentially defined here in MT-terms, and so, inter alia, are proceeding with, finishing, stopping and interrupting an action. There is also a demonstration of how actions of one type may be converted into those of other types, where this is a matter of the way they are “seen” or described. There is also an implication to the effect that some of these distinctions may be useful for formulating certain critical insights regarding modern life. (shrink)

In the philosophical tradition, the notions of determinism and causality are strongly linked: it is assumed that in a world of deterministic laws, causality may be said to reign supreme; and in any world where the causality is strong enough, determinism must hold. I will show that these alleged linkages are based on mistakes, and in fact get things almost completely wrong. In a deterministic world that is anything like ours, there is no room for genuine causation. Though there may (...) be stable enough macro-level regularities to serve the purposes of human agents, the sense of “causality” that can be maintained is one that will at best satisfy Humeans and pragmatists, not causal fundamentalists. Distinctions among juristic ways of thinking -- Classification of juristic ways of thinking in the overall development of legal history.

Carl Mika claims in the symposium’s lead essay that we need more myth today. In fact, an “unscientific” attitude can potentially reorient the alienation from the world. For Mika, a philosophical mātauranga Māori incorporates such a way of being in the world. Through it, an unmediated and co-existent relationship with the world can be built up. Some of Mika’s co-symposiasts invite Mika to substantiate aspects about this bold claim. Carwyn Jones nudges Mika to discuss the parallels between tikanga Māori—a (...) system that seeks to incorporate Māori law—and the common-law tradition that is adopted in New Zealand today. W. Julian Korab-Karpowicz agrees with Mika that to understand the world through an indifferent “scientific” investigation is to understand the world only partially, while the Māori scientist Ocean Ripeka Mercier illustrates how she seeks to develop a third space in her work that reconciles the fear of the unknown with the propensity to control the world through knowing. Helen Verran invites Mika to think about whether, and how, his understanding of a philosophical mātauranga Māori can help to facilitate the cultivation of a naturalism that is able to generate a cosmopolitics in New Zealand. Through exploring multiple contemporary conceptions of justice, this article illustrates that justice matters when considering outcomes in nongovernmental organization assistance. In environmental justice scholarship, the term justice has been underproblematized, assuming a tacit understanding of the concept as fairness or equitable distribution of environmental harms. Using the rebuilding of two heavily damaged poor and minority neighborhoods in post–Katrina New Orleans as case studies, this article makes evident the different conceptualizations of justice embedded within the strategies and techniques of NGOs and (...) community organizations. Examining both practices and outcomes, I argue that the definition of justice that NGOs implicitly or explicitly adopt in their strategies and technologies of assistance can lead to very different results in postdisaster neighborhood revitalization. For science and technology studies, conceptions of justice can help articulate a more critical social science that opens up the descriptive/normative divide. This is important in thinking about equitable social change and allied policy—as it applies not only to NGO assistance but also to other science and technology issues that intersect with marginalized communities as well. Simon Blackburn’s expressivist logic of attitudes aims to explain how we can use non-assertoric moral judgements in logically valid arguments. Patricia Marino has recently argued that Blackburn’s logic faces a dilemma: either it cannot account for the place of moral dilemmas in moral reasoning or, if it can, it makes an illicit distinction between two different kinds of moral dilemma. Her target is the logic’s definition of validity as satisfiability, according to which validity requires an avoidance of attitudinal inconsistency. Against (...) Marino’s arguments, I contend that expressivists following Blackburn are able to show how we appreciate the validity of arguments found in dilemma-contexts, and that Marino’s argument concerning the distinction between contingent moral dilemmas and logical moral dilemmas rests on a mistake concerning the logical representation of a contingent dilemma. The greatest diversity of butterflies and their host plants occurs in tropical regions. Some groups of butterflies in the tropics exhibit monophagous feeding in the larval stage, exploiting only one family of plants; others are polyphagous, feeding on plants in two or more distinct families. The two major types of tropical habitats for butterflies, namely primary and secondary forests, offer very different evolutionary opportunities for the exploitation of plants as larval food. Butterflies are faced with the major logistical problem, as (...) are many other herbivorous insects, of depositing eggs on the correct plant for successful larval feeding. This paper, using the concepts of phenotype set and spatial patchiness of resources, attemps to make some predictions as to the optimal phenotypic systems for monophagous and polyphagous feeding in tropical butterflies, as related to the spatial patchiness of larval host plants in primary and secondary forests. In addition to the secondary compound chemistry of larval host plants as playing a role in the evolution of monophagy and polyphagy, the assumption is made that the spatial patchiness of host plants within and among different families also acts as a major factor in determining optimal ranges of phenotypes for different patterns of larval feeding. Owing to the high spatial patchiness of primary forest species of canopy trees and vines, it is predicted that butterflies exploiting these will be mostly polyphagous, whereas secondary forests having stable formations of fewer plant species and larger patches of these plants, will have mostly monophagous species. Forest understories may have both monophagous and polyphagous species, depending upon the layer of forest and the general type of understory (i.e. palmaceous or dicotyledonous). Field data on some groups of butterflies from tropical America support these predictions. Polyphagous butterflies are predicted to possess a genetic system of mixed morphs with a population being polymorphic as a whole; monophagous butterflies are predicted to have individuals all more or less similar genetically, and with a high amount of genic variation within individuals. Other forms of monophagy may evolve in species that are essentially monomorphic but with various mechanisms (physiological, developmental, behavioral) of phenotypic flexibility at the individual level. Although the environment is essentially coarse-grained for larvae since most are sedentary and polymorphism is an optimal adaptive strategy, the oviposition strategy of the adult must also be considered and some situations (i.e. forest canopy) have resources (host plants) distributed in a fine-grained fashion. A vast literature has developed probing the law's aversion to statistical/probability evidence in general and its rejection of naked statistical evidence in particular. This literature rests on false premises. At least so far as US law is concerned, there is no general aversion to statistical forms of proof and even naked statistics are admissible and sufficient for a verdict when the evidentiary proffer meets the normal standards of admissibility, the most important of which is reliability. The belief to the contrary (...) rests upon a series of mistakes: most importantly, mismodeling of the structure of legal systems and the nature of common law decision making. Contributing to these mistakes is the common methodology in this literature of relying on weird hypotheticals that mismodel the underlying legal relations and contain impossible epistemological demands. Collectively, these phenomena have distracted attention from issues that actually affect real legal systems. (shrink)
