This book develops a liberal theory of justice in exchange. It identifies the conditions that market exchanges need to fulfill to be just. It also addresses head-on a consequentialist challenge to existing theories of exchange, namely that, in light of new harms faced at the global level, we need to consider the combined consequences of millions of market exchanges to reach a final judgment about whether some individual exchange is just. The author argues that, even if we accept this challenge, (...) the effect of it is minimal. For different reasons, normatively problematic collective market outcomes like externalities, monopolies, violations of the Lockean proviso, inequality, and commodification do not pose particular problems to the justice of market exchanges. He outlines the various conditions a market exchange needs to fulfill to be considered just from a liberal background and in light of the new harms. Ultimately, he shows, it is not the market which is to blame; if we want to tackle issues like global warming or global economic injustice, we should not blindly follow the intuition that we best restrain and regulate markets. Commutative Justice is unique in its focus on justice in exchange rather than on end-state distributive justice, and the way in which it addresses the new harms we are facing today. It will be of interest to researchers and advanced students in philosophy, politics, and economics who are working on questions of economic justice. (shrink)

We argue that intelligible appeals to interlevel causes (top-down and bottom-up) can be understood, without remainder, as appeals to mechanistically mediated effects. Mechanistically mediated effects are hybrids of causal and constitutive relations, where the causal relations are exclusively intralevel. The idea of causation would have to stretch to the breaking point to accommodate interlevel causes. The notion of a mechanistically mediated effect is preferable because it can do all of the required work without appealing to mysterious interlevel causes. When interlevel (...) causes can be translated into mechanistically mediated effects, the posited relationship is intelligible and should raise no special philosophical objections. In this paper I argue against one variety of contextualism about aesthetic predicates such as “beautiful.” Contextualist analyses of these and other predicates have been subject to several challenges surrounding disagreement. Focusing on one kind of contextualism— individualized indexical contextualism —I unpack these various challenges and consider the responses available to the contextualist. The three responses I consider are as follows: giving an alternative analysis of the concept of disagreement ; claiming that speakers suffer from semantic blindness; and claiming that (...) attributions of beauty carry presuppositions of commonality. I will argue that none of the available strategies gives a response which both satisfactorily explains all of the disagreement -data and is plausible independent of significant evidence in favor of contextualism. I conclude that individualized indexical contextualism about the aesthetic is untenable, although this does not rule out alternative contextualist approaches to the aesthetic. (shrink)

This paper develops a theory of how democratic governance is possible. It analyses democracy as a laminated system consisting of three interdependent levels – the political/institutional, the social/interactional, and the psychological/intrapsychic – each of which is necessary for the others to exist. Each level is subject to a regulatory principle that is necessary for it to function appropriately. At the political/institutional level, competing political parties must be governed by the regulatory principle of ‘loser’s consent,’ in which the losing party must (...) agree to cede power to the winning party. At the social/interactional level individuals from opposing political parties must be governed by the regulatory principle of a superordinate identity as citizen, which allows them to transcend their partisan political identities. At the psychological/intrapsychic level individuals must be governed by the regulatory principle of mutuality/thirdness which allows the possibility of an alternative to the binary identities that result from the doer/done-to position. The fundamental tenet of modern empiricism is the view that all non-analytic knowledge is based on experience. Let us call this thesis the principle of empiricism. [1] Contemporary logical empiricism has added [2] to it the maxim that a sentence makes a cognitively meaningful assertion, and thus can be said to be either true or false, only if it is either (1) analytic or self-contradictory or (2) capable, at least in principle, of experiential test. According to this so-called empiricist criterion (...) of cognitive meaning, or of cognitive significance, many of the formulations of traditional metaphysics and large parts of epistemology are devoid of cognitive significance--however rich some of them may be in non-cognitive import by virtue of their emotive appeal or the moral inspiration they offer. Similarly certain doctrines which have been, at one time or another, formulated within empirical science or its border disciplines are so contrived as to be incapable of test by any conceivable evidence; they are therefore qualified as pseudo- [p. 42:] hypotheses, which assert nothing, and which therefore have no explanatory or predictive force whatever. This verdict applies, for example, to the neo-vitalist speculations about entelechies or vital forces, and to the "telefinalist hypothesis" propounded by Lecomte du Noüy. (shrink)

The bulk of the paper focusses on the dispute between simple indeterminism - the view that the occurrence of a simple mental event is determined by its subject if it possesses the "actish" phenomenal (...) quality and is undetermined by antecedent events - and Timothy O''Connor''s agent-causation view. An electron clearly has the property of having a charge of þ1.6 10 19 coulombs, but does it also have the property of being charged ? Philosophers have worried whether so-called ‘determinable’ predicates, such as ‘is charged’, actually refer to determinable properties in the way they are happy to say that determinate predicates, such as ‘has a charge of þ1.6 10 19 coulombs’, refer to determinate properties. The distinction between determinates and determinables is itself fairly new, dating only to its (...) definition by the Cambridge logician W. E. Johnson early in the last century.1 But despite its newly minted condition the distinction has found little currency in on-going philosophical debates. Or at least until recently. Renewed interest in realist positions about properties, and arguments that the determinable-determinate relation may hold the key to understanding mental causation, have thrust Johnson’s distinction to the fore. With this new attention has also come new ‘optimistic’ positions that endorse the existence of determinable properties. David Armstrong, Evan Fales, and Sydney Shoemaker, among others, have all defended such optimistic accounts that take determinable predicates, such as ‘is charged’, to refer to determinable properties.2 In this paper, our goal is to carefully assess optimism and to argue that a pessimistic view, which rejects the existence of determinable properties, is actually the appropriate default position. For, first of all, a sentence cannot even be considered as expressing an empirical hypothesis at all unless it is theoretically capable of confirmation or disconfirmation, i.e. unless the kind of evidence can be characterized whose occurrence would confirm, or disconfirm, the sentence in question. And secondly, the acceptance or rejection of a sentence which does represent an (...) empirical hypothesis is determined, in scientific procedure, by the degree to which it is confirmed by relevant evidence. Understanding the 'making-up' relations, to put things neutrally, posited in mechanistic explanations the sciences is finally an explicit topic of debate amongst philosophers of science. In particular, there is now lively debate over the nature of the so-called 'realization' relations between properties posited in such explanations. Despite criticism (Gillett, Analysis 62: 316-323, 2002a), the most common approach continues to be that of applying machinery developed in the philosophy of mind to scientific concepts in what is known as the 'Flat' or (...) 'Subset' model of 'realization' (Kim, Mind in a physical world, 1998; Shapiro, J Philos XCVII: 635-654, 2000; Clapp, J Philos XCVIII: 111-136,2001 ; Wilson, Philos Stud 145: 149-169,2009). My primary goal in this paper is to show in still more detail that the Subset model of realization is inadequate for the descriptive task of describing the 'making-up' relations posited between properties or their instances in mechanistic explanations in the higher sciences. And my secondary goal is to highlight why this critique of the Subset view as a first-order descriptive account also shows there are deep difficulties in using the Subset account to address second-order issues in the philosophy of science as well. The contributors are well-established scholars in the field who build on their previous work, and most advance an original argument in these essays. The focus is on western Christian philosophers and theologians from the thirteenth and fourteenth centuries and “the intricacies and varieties of the conceptual relationships among intentionality, cognition, and mental representation” in their thought. Stephan Blatti claims to have a new line of reasoning using evolutionary theory that resolves arguments over our deeper natures in favor of the Animalist position that we are identical to Homo sapiens organisms. Blatti thus raises an important question about which views of what we are can take us to be evolved. However, in this response I show that Blatti’s argument using evolution is based upon a false assumption about contemporary biology. I highlight how a better understanding of evolutionary (...) theory allows us to see that the major theories of what we are, including Psychological, Brain and even Soul theories, as well as Animalism, can all accept that we are products of evolution. Jonathan Weisberg claims that certain probability assessments constructed by Jeffrey conditioning resist subsequent revision by a certain type of after-the-fact defeater of the reasons supporting those assessments, and that such conditioning is thus “inherently anti-holistic.” His analysis founders, however, in applying Jeffrey conditioning to a partition for which an essential rigidity condition clearly fails. Applied to an appropriate partition, Jeffrey conditioning is amenable to revision by the sort of after-the-fact defeaters considered by Weisberg in precisely the way that he demands.

By quantifying over properties we cannot create new properties any more than by quantifying over individuals we can create new individuals. Someone murdered Jones, and the murderer is either Smith or Jones or Wang. That “someone,” who murdered Jones, is not a person in addition to Smith, Jones, and Wang, and it would be absurd to posit a disjunctive person, Smith‐or‐Jones‐or‐Wang, with whom to identify the murderer. The same goes for second‐order properties and their realizers. (Kim 1997a, 201).

The idea of a precautionary principle (or precautionary principles) is beginning to come to the wider attention of the environmental community, governmental agencies, regulatory agencies, and the regulated community. Different precautionary principles have not been specified in detail, and, of course, this is difficult to do. Yet some specification must be done in order to understand it better and, if it is to be used for specific action-guidance, to implement it. Moreover, it is important to understand more about the principle, (...) its background assumptions and its comparison with other principles to which we might subscribe. This paper explores aspects of the PP and its background assumptions and presuppositions, comparing them with those for risk assessment and other statements of the PP. It also briefly indicates how it resembles legal principles in addressing problems of uncertainty. Finally, it recapitulates two possible versions of the PP and suggests an application of it for an emerging threat to the environment and public health. This review suggests the PP has plausible applications and is not the radical principle some have suggested. (shrink)

As the two comprehensive humanistic disciplines, philosophy and history have a complex interface. By ‘comprehensive’, I mean that only philosophy and history have the prerogative of being immediately and justifiably relevant to all domains of human endeavor. Thus, there is the history and philosophy of mathematics, the history and philosophy of art, the history and philosophy of religion, the history and philosophy of politics, not to mention the history of philosophy, the philosophy of history, and, in qualified senses, the history (...) of history and the philosophy of philosophy. History is always immediately relevant to human endeavor because the latter aims at a coherence beyond simple behavior, yet necessarily leaves a spatio-temporal trace; philosophy is always immediately relevant because all forms of human endeavor have their primary principles—noetic, ethical, and metaphysical. Philosophy and history are necessarily interconnected not only because both are themselves human endeavors, but also because history’s orientation about coherence and philosophy’s about primacy both face, at a fundamental level, the dialectic of universal and particular induced by the hunt for intelligibility. The two are therefore led to quarrel about which really is the magistra vitæ, for both hope to be wise, i.e., intelligent and accomplished, about τἀνθρώπινα, the human things. (shrink)

A mutual fund family incubates a fund when it creates a privately subsidized fund not available to the general investing public. It destroys unsuccessful incubator funds. The few successful funds will report higher incubation returns than the market return in advertisements intended to attract money from individual investors. This practice is currently allowed by the SEC. The evidence is that incubation returns are not a good predictor of subsequent fund performance and likely serve to mislead unsuspecting investors.

The paper explicates a version of dispositionalism and defends it against Kripke's objections (in his "Wittgenstein on Rules and Private Language") that 1) it leaves out the normative aspect of a rule, 2) it cannot account for the directness of the knowledge one has of what one meant, and 3) regarding rules for computable functions of numbers, a) there are numbers beyond one's capacity to consider and b) there are people who are disposed to make systematic mistakes in computing values (...) of functions they understand perfectly well.
