It is largely agreed that if constructivism contributes anything to meta-ethics it is by proposing that we understand ethical objectivity “in terms of a suitably constructed point of view that all can accept” (Rawls 1980/1999: 307). Constructivists defend this “practical” conception of objectivity in contrast to the realist or “ontological” conception of objectivity, understood as an accurate representation of an independent metaphysical order. Because of their objectivist but not realist commitments, Kantian constructivists place their theory “somewhere in the space between (...) realist and relativist accounts of ethics” (O’Neill 1988: 1). Furthermore, they argue that their practical conception of objectivity succeeds in making sense of certain features of morality, such as its categorical authority and its relation to rational agency, which escape rival theories (Korsgaard 1996b, Korsgaard 2003b). To this extent, constructivism claims a privileged place in meta-ethics. The legitimacy of this claim is widely challenged. Precisely because of its practical conception of objectivity, many – including some constructivists — regard constructivism as a first-order normative theory, rather than as a meta-ethical position, hence not on a par with realism. Some critics object that constructivism fails to offer a distinct meta-ethics because it is structurally incomplete and thus must be combined with a fully-fledged meta-ethics (Hussain and Shah 2006); others argue that it tacitly relies on realism (Timmons 2003; Shafer-Landau 2003; Larmore 2008). Thus far, the debate about the prospects of constructivism as a meta-ethical theory has been driven by the conviction that the case for or against constructivism depends on its ontological commitments. In this chapter, I propose a change in perspective. My aim is to defend constructivism as an objectivist account of practical knowledge. Its defining feature is the claim that practical knowledge is knowledge by principles. Its task is to establish a constitutive relation between knowledge of oneself as a practical subject and knowledge about what one ought to do. By focusing on the issue of practical knowledge I hope to show that the difficulty in situating Kantian constructivism firmly on the meta-ethical map, along with other meta-ethical theories, reflects ambiguities and oscillations about the practical significance of ethics. Even though the term is ambiguous, I retain the qualification “Kantian” for the constructivist theory I outline, and for two reasons. First, while the theory I outline differs from current agnostic or anti-realist variants, it is closer to its origins, since Kant treats practical reason as a cognitive capacity and takes moral judgments to be objective moral cognitions, which importantly differ from other sorts of rational cognitions because they bind us in the first person. Practical cognitions are common knowledge because they are such that all subjects endowed with rationality can arrive at them by reasoning and find them authoritative. Thus understood, Kantian constructivism carves a distinct logical space in the meta-ethical debate that other sorts of constructivism fail to identify. This is the second reason for keeping the qualification “Kantian”. On this formulation, constructivism is antagonistic to non-cognitivist theories denying that moral judgments have cognitive contents, because they deny that there is something to be known; but it is also a rival to cognitivist theories denying that knowledge can be practical in itself. How constructivism differs over the realist theories of practical reason is the least understood aspect of this debate. This essay aims to make the case that practical reason is both discursive and emotional. In contrast to foundational and anti-realist accounts of practical reasoning, it attempts to show that the moral feeling of respect plays a cognitive but non-evidential role in the account of the cognitive and practical powers of reason. The argument proceeds as follows. In section 1, I consider some prominent constructivist arguments against the model of applied knowledge and show that they are driven by non-cognitivist assumptions about the practicality of ethics and the legitimacy of epistemological claims. In section 2, I argue that these arguments do not succeed in disposing of the idea of practical knowledge as incoherent, because they trade on an ambiguity regarding the proper object of practical knowledge. To solve this ambiguity, I turn to Anscombe’s contrast between “practical” and “speculative” knowledge as models for understanding action. I thus suggest that Anscombe’s account of practical knowledge as knowledge of oneself as an agent is an important resource for Kantian constructivism. This finding prompts us to reset the current dispute about the ontological and epistemological commitments of Kantian constructivism, as illustrated in section 3. While constructivism does not postulate any moral ontology prior to reasoning, it attributes to reasoning the cognitive powers to establish a distinctive relation between the agent and her action. The task of sections 4-7 is to account for the distinctive features of Kantian constructivism understood as an objectivist account of practical knowledge. In section 4, I argue that in order for reasoning to accomplish its normative tasks, it should be conceived as a self-legislating activity. I respond to some objections to the idea of self-legislation as the form of rational willing by offering a dialogical view of practical reason. In section 5, I propose a non-standard interpretation of Kant’s argument of “the fact of reason” to show that the constructivist account of self-legislation does not build on realism about value, as its detractors claim. The “basis of construction” is the subjective experience of respect for the self-legislative capacity itself. This moral feeling conveys our awareness of rational agency and shows our responsiveness to the demands of practical reason. It is an emotional mode of practical knowledge of oneself as an agent (in the sense specified in section 2), but not as a mode of moral discernment. In section 6, I show how practical knowledge of oneself as an agent relates to practical knowledge about what one ought to do. I thus account for the relation between respect as emotional moral consciousness and respect as a deliberative constraint. Finally, in section 7, I reply to the objection of subjectivism. I explain how the complex sort of objectivity that Kantian constructivism affords is at the same time more ambitious and more modest than is generally assumed. (shrink)

In this paper, I ask feminist philosophers and science studies scholars to consider the goals of developing critical analyses of evolutionary psychology. These goals can include development of scholarship in feminist philosophy and science studies, mediation of the uptake of evolutionary psychology by other academic and lay communities, and improvement of the practices and products of evolutionary psychology itself. I evaluate ways that some practices of feminist philosophy and science studies facilitate or hinder meeting these goals, and consider the merits (...) of critical engagement with some of the scientists themselves. Finally, I describe a community of feminist evolutionary psychologists with whom it might be both fruitful and interesting to engage, and identify ways that these interactions may benefit the science and the study of the science. Habermas (2023) analisa uma nova mudança estrutural da esfera pública. Em razão disso, supomos uma esfera pública processual em mutação. Para argumentar, optamos pela leitura do Código de Processo Civil (CPC) em sintonia com Habermas (2023). No plano normativo, o processo é regulado pela Constituição Federal e pelo Código de Processo Civil. Em termos físicos, ele é composto de peças processuais redigidas em papel ou de peças processuais digitalizadas, pois a maioria dos tribunais brasileiros adotou o processo 100% digital. Em (...) termos funcionais, os tribunais adotam o processo como instrumento da jurisdição (devido processo legal). Nesse contexto, a regulação dos atos digitais importa para a existência válida e regular do processo. Por outro lado, a nova esfera pública processual regula a participação dos sujeitos processuais (autor, réu, juiz, servidores, promotores, advogados e defensores públicos, etc.). Essa participação vem sofrendo coerções normativas do tipo: interpretação conforme valores e normas fundamentais estabelecidas na Constituição Federal, solução consensual de conflitos, solução integral do mérito, comportamento de acordo com a boa-fé, dever de cooperação entre si, paridade de tratamento, ônus de argumentação das partes e ônus de avaliação dos argumentos pelo juiz. Podemos acrescentar a utilização das provas digitais e as audiências telepresenciais. Com esse aporte normativo e teórico, intuímos o processo como instrumento dessa esfera pública processual, na qual participam sujeitos com ônus argumentativos e a possibilidade de influenciar o convencimento e as deliberações judiciais. Portanto, a nova esfera pública processual denota o direito de participação e de influência, tal como deduzimos em Habermas. (shrink)

In questo articolo sosterrò che vi è un argomento ancora più radicale di quello pluralista e pragmatista secondo il quale la commensurabilità, così come l’incommensurabilità, (...) non sono ipotesi sulla natura del valore, ma sono piuttosto atti costitutivi della valutazione. Falar-se-á a Nicômano como a um juiz iniciante. Em tempo longíquo, Nicômaco foi devidamente instruído sobre questões de conduta. Ao juiz iniciante, apresenta-se alguns assuntos de conduta processual, cujas lições analisa-se regras jurídicas para que o juiz não se afaste do senso de justiça, que a tanto aspira, e não confunda a objetividade processual com a subjetividade instrínseca, que ao erro soberbo da injustiça pode levá-lo a subverter o Direito em razão das paixões políticas. Com Levitsky e Ziblatt, introduz-se o (...) tema sobre a cooptação do juiz e, com Habermas, apresenta-se a ética processual, observando o processo como espécie de comunidade jurídica. Dworkin acrescenta algo mais sobre a conduta interpretativa do Direito. Em assuntos de conduta pessoal, Aristóteles alerta que toda ação e toda escolha objetiva um bem qualquer. Logo, em conduta pessoal, não admira prevalecer a subjetividade do agente no exame entre meios e fins. No entanto, em termos de conduta processual, o juiz age em conformidade com bens jurídicos normativamente considerados. Numa palavra, em termos de conduta processual impera a objetividade dos fatos, visando a aplicação imparcial das regras jurídicas, em conformidade com os princípios da dignidade da pessoa humana, em suas inviolabilidades, na presunção de inocência, na ampla defesa, no contraditório e num julgamento imparcial. As considerações finais, ancoradas em observações diretas, na conjuntura brasileira e na literatura referenciada, permitem concluir que a ordem jurídica democrática depente, dentre outros fatores, da conduta ética do juiz. A relação capital-trabalho é cada vez mais complexa. Da fábrica hierarquizada ao sistema de produção pulverizado, tecnológico e digital, a concentração do poder econômico produz uma grave externalidade negativa: a descentralização do trabalho e do seu valor social. A concentração do capital cada vez mais descarta o trabalhador em sua condição humana e de cidadania. A partir do tema do Colóquio Habermas é possível identificar o enfraquecimento do Estado como promotor e garantidor de direitos fundamentais dos trabalhadores, afetando a adesão (...) sindical como forma de lealdade da classe trabalhadora, ou em outras palavras a consciência de classe ou de solidariedade entre os trabalhadores. Por conseguinte, sindicatos enfraquecidos operam com déficit de legitimidade e de representatividade, tal como se dá com a estrutura do sindicato único por categoria profissional. Nesse contexto, refletimos sobre os efeitos dessa relação complexa e tensa, no momento de reconstrução ou de restauração da ordem democrática participativa e deliberativa, objetivando o não retrocesso social dos trabalhadores. Ancoramos o estudo na Constituição Federal, em princípios do Direito do Trabalho, em reflexões habermasianas sobre o tema. Situamos nossa pesquisa a partir de 2017, quando se deu a Reforma Trabalhista. Com essa abordagem, propomos um diálogo para além do direito positivado, uma vez que o valor social do trabalho e da livre iniciativa do empresário atravessam várias estruturas sociais que disputam espaço junto aos vários segmentos do Estado brasileiro. Philip Pettit is the most important contemporany advocate of the republican tradition in political philosophy. He advances a concept of freedom as non-domination, and constrasts it with the liberal conception of freedom as non-interference. He claims that two features distinguish domination from interference: The capacity of interference , and the fact that the interference is arbitrary. I shall argue that Pettit´s republicanism is not sufficiently differente from liberalism, certainly not from John Rawls´s liberalism. The only relevant difference between republicanism and (...) liberalism is related to : the notion of arbitrariness. Yet this difference makes republicanism an unattractive version of liberalism, insofar as it, paradoxically, allows for republicanism to legitimize a grave form of domination, paternalism, and, in general, domination coming from the state. This problem gets exacerbated by Pettit´s consequentialist framework. (shrink)

Neoliberal ideology and exclusionary policies based on racialized identities characterize the current contexts in North America and Western Europe. Nursing knowledge cannot be abstracted from social, political and historical contexts; the task of examining the influence of race and racial ideologies on disciplinary knowledge and inquiry therefore remains an important task. Contemporary analyses of the role and responsibility of the discipline in addressing race‐based health and social inequities as a focus of nursing inquiry remain underdeveloped. In this article, we examine (...) nursing's engagement with ideas about race and racism and explore the ways in which nursing knowledge and inquiry have been influenced by race‐based ideological discourses. Drawing on Henry and Tator's framework ofdemocratic racism, we consider how strategic discursive responses—the discourses of individualism, multiculturalism, colour‐blindness, political correctness and denial—have been deployed within nursing knowledge and inquiry to reinforce the belief in an essentially fair and just society while avoiding the need to acknowledge the persistence of racist discourses and ideologies. Greater theoretical, conceptual and methodological clarity regarding race, racialization and related concepts in nursing inquiry is needed to address health and social inequities. (shrink)

A lack of diversity remains a significant problem in many STEM communities. According to the epistemic approach to addressing these diversity problems, it is in a community’s interest to improve diversity because doing so can enhance the rigor and creativity of its work. However, we draw on empirical and theoretical evidence illustrating that this approach can trade on the epistemic exploitation of diverse community members. Our concept of epistemic exploitation holds when there is a relationship between two parties in which (...) one party accrues epistemic benefits from another party’s knowledge and epistemic location and, in doing so, harms the second party or sets back their interests. We demonstrate that the ironic outcome of this nominal application of the epistemic approach is that it undermines the epistemic benefits which it promises. Indeed, we show that epistemic exploitation undermines the relationships and interactions among community members that produce rigor and creativity. Our central argument is that for communities to reap the benefits of an epistemic approach to diversity, to implement a genuine epistemic approach, they need to develop cultures that ameliorate the harms faced by, and protect the interests of, their diverse community members. This ethnography concerns itself with such questions as they have played out in a series of entangled conflicts with, and over, the non-human world; specifically, historically rooted tensions over the inception of the Wet Tropics World Heritage Area in Queensland Australia and (...) contemporary arguments over the ‘hunting’ and ‘management’ of feral pigs ( Sus scrofa), an ‘exotic’ pest species. Similarities evident in the politics of natural heritage and animal death illuminate two distinct contemporary strategies for confronting existential struggles over life, death and destruction. People with mental illness are subjected to stigma and discrimination and constantly face restrictions in the exercise of their political, civil and social rights. Considering this scenario, mental health, ethics and human rights are key approaches to advance the well-being of persons with mental illnesses. The study was conducted to review the scope of the empirical literature available to answer the research question: What evidence is available regarding human rights and ethical issues regarding nursing care to persons with mental illnesses? (...) A scoping review methodology guided by Arksey and O’Malley was used. Studies were identified by conducting electronic searches on CINAHL, PubMed, SCOPUS and Hein databases. Of 312 citations, 26 articles matched the inclusion criteria. The central theme which emerged from the literature was “Ethics and Human Rights Boundaries to Mental Health Nursing practice”. Mental health nurses play a key and valuable role in ensuring that their interventions are based on ethical and human rights principles. Mental health nurses seem to have difficulty engaging with the ethical issues in mental health, and generally are dealing with acts of paternalism and with the common justification for those acts. It is important to open a debate regarding possible solutions for this ethical dilemma, with the purpose to enable nurses to function in a way that is morally acceptable to the profession, patients and members of the public. This review may serve as an instrument for healthcare professionals, especially nurses, to reflect about how to fulfil their ethical responsibilities towards persons with mental illnesses, protecting them from discrimination and safeguarding their human rights, respecting their autonomy, and as a value, keeping the individual at the centre of ethical discourse. Analisando o processo judicial, identificamos uma relação entre falantes que permite uma abordagem sociológica desse instrumento jurídico. A partir de uma visão instrumental do processo, percebemos uma interação entre pessoas regidas por determinada gramática jurídica. Nesse sentido, autor, réu e juiz praticam atos de fala na jurisdição, formando uma comunidade particular num espaço público institucionalizado. Ao exercer o seu papel como falantes, interagindo entre si, cada um deles postula um tipo de reconhecimento em práticas intersubjetivas com o outro da relação. (...) This paper posits that differences in corporate governance structure partly result from differences in institutional arrangements linked to business systems. We developed a new international triad of business systems: the Anglo-American, the Communitarian and the Emerging system, building on the frameworks of Choi et al. (British Academy of Management (Kynoch Birmingham) 1996, Management International Review 39, 257–279, 1999). A common factor determining the success of a corporate governance structure is the extent to which it is transparent to market forces. Such (...) transparency is more than pure financial transparency; as it can also be based on factors such as governmental, banking and other types of institutional transparency mechanism. There may also be a choice for firms to adopt voluntary corporate disclosure in situations where mandatory disclosure is not established. The Asian financial crisis of 1997–1999 and the more recent corporate governance scandals such as Enron, Andersen and Worldcom in the United States and Ahold and Parmalat in Europe show that corporate governance and business ethics issues exist throughout the world. As an illustration we focus on Asia’s emerging1 markets, as, both in view of the pressure of globalization and taking into account the institutional arrangements peculiar to the emerging business system, these issues are important there. Particularly for those who have to find an accommodation between the corporate governance structures and disclosure standards of the Emerging system and those of the Anglo-American and Communitarian systems. In this paper, we propose a performative account of hinge epistemology to make the case for a feminist hinge epistemology. We characterize it as follows: 1) there are hinges that enable and govern our ordinary epistemic practices, functioning as rules; 2) these hinges are enacted and actualized in the specific actions of agents that participate in such practices; 3) this makes room for the transformation and emergence of hinges; 4) against this background, we argue in favor of the possibility of (...) feminist hinges. This novel account opens the way for hinge epistemology to be useful for feminist goals in epistemology, which we believe is the ultimate criterion for hinge epistemology to be legitimately feminist. This paper takes a constitutivist approach to self-deception, and argues that this phenomenon should be evaluated under several dimensions of rationality. The constitutivist approach has the merit of explaining the selective nature of self-deception as well as its being subject to moral sanction. Self-deception is a pragmatic strategy for maintaining the stability of the self, hence continuous with other rational activities of self-constitution. However, its success is limited, and it costs are high: it protects the agent’s self by undermining the (...) authority she has on her mental life. To this extent, self-deception is akin to alienation and estrangement. Its morally disturbing feature is its self-serving partiality. The self-deceptive agent settles on standards of justification that are lower than any rational agent would adopt, and thus loses grip on her agency. To capture the moral dimension of self-deception, I defend a Kantian account of the constraints that bear on self-constitution, and argue that it warrants more discriminating standards of agential autonomy than other contemporary minimalist views of self-government. This article argues that immoralists do not fully enjoy autonomous agency because they are not capable of engaging in the proper form of practical reflection, which requires relating to others as having equal standing. An adequate diagnosis of the immoralist’s failure of agential authority requires a relational account of reflexivity and autonomy. This account has the distinctive merit of identifying the cost of disregarding moral obligations and of showing how immoralists may become susceptible to practical reason. The compelling quality of (...) reason should not be represented as the capacity to force them to abide by morality on pain of incoherence. Rather, its authority (and objectivity) is shown when it presents them with the prospect of a transition that makes sense for them to undertake. (shrink)

Sein Ausgangspunkt ist der Andere: Ein anderer Mensch, der durch seine Ansprache die subjektive Weltordnung aus den Angeln hebt, der fordert und zur Verantwortung ruft. Ein Ruf, dem auf ethischer Grundlage entsprochen werden muss. Es bleibt ein vergeblicher, der auf dem Mittelmeer verhallt. Die Ethik von Emmanuel (...) Lévinas ist heute so aktuell wie selten zuvor. Erweitert um die Theorien Jacques Derridas und Judith Butlers stellt Carla Schrievers Studie eine spannende Suche nach Anwendungsmöglichkeiten einer Ethik dar, die nicht Subjektivität, sondern Alterität ins Zentrum der Diskussion stellt. A onda conservadora que assola diferentes países e regiões do mundo contemporâneo, entre muitos outros aspectos, nos faz ponderar sobre as práticas culturais e suas permanências, principalmente as permanências autoritárias, ao longo dos anos. Para este artigo, propomos enfrentar esta questão considerando o contexto brasileiro. Refletir sobre a cultura é sempre difícil em função de sua enorme abrangência, temporal e temática e, por isso, propomos como delimitação, recuperar a visão que estratos da intelectualidade brasileira apresentaram sobre as camadas populares ao (...) longo de nossa história republicana, definindo como recorte cronológico o período de 1920-2000. Ao percorrer este cenário, propomos identificar o conceito de cultura prevalecente em cada período e como este afetou o olhar da intelectualidade sobre a produção cultural popular. (shrink)

In this article, the right to health is discussed as a social right and an essential requisite in the construction and guarantee of human rights, more precisely human dignity, considering this right as a complex but effective process in the transformation of the social reality. In the first place, the activities of the public power and its difficulties to guarantee universal access to health are highlighted. This scenario ends up inhibiting the practice of the right to health and prevents users (...) from enjoying and using it. In that sense, this article challenges and explores some alternatives to solidify and put in practice the right to health in Brazil. Departing from the analysis of the Unified Health System (SUS) and social participation in Brazil, this article discusses the judicialization of health in the country, highlighting the difficulties the State faces to equitably offer universal healthcare to society. This context offers an opportunity for reflection and a paradigm change, from the “judicialization of health” to the “judicialization of health policies.” Finally, the public health policies adopted by other countries are emphasized, in the attempt to construct the empowerment of human beings in the practice of their rights, particularly social participation and the discussion about the States’ responsibility to put their citizens’ right to health in practice. In conclusion, the political and collective construction of the right to health needs to be encouraged, distinguishing the legitimate interests of the different interlocutors involved. (shrink)

Networks and the World Wide Web seem to provide an answer to efficiently creating and disseminating knowledge resources. Knowledge, however, is ambiguous in character, and contains both explicit (information) and tacit dimensions - the latter being difficult to value as well as to transfer. Participant identity, commitment and behaviour within the network also affect the sharing of knowledge. Hence, existing laws and norms (including property rights) which have been established on the basis of discrete transactions and monetary value-oriented exchange may (...) not be adequate to deal with the whole spectrum of knowledge transfer. A model is needed to address transfer across a large heterogeneous network. We introduce the concept of sub-networks where tacit knowledge resides and argue that considering social norms underlying trust and other informal mechanisms provides a more suitable basis for understanding the exchange of tacit knowledge. Norm establishment is complicated by the fact that values differ across cultures; however, the social norms that underpin sub-networks can sustain knowledge transfer within them. The purpose of this conceptual article is to introduce the concept of sub-networks and to identify the sub-network/network relationship as an area in which it is necessary to look beyond property rights and raise the issue of norms. We believe that an analysis of the role of social norms in knowledge sub-networks and their interaction with global networks points to a key element in understanding networks and any emerging theory of network ethics in the twenty-first century. The reform of the health care system will include a mandate: Individuals are required to purchase health insurance provided that affordable options are available. But what is affordable health insurance? Three accounts of affordability of health coverage have been advanced. The first two accounts are empirical. The third account is needs-based. All three accounts are inadequate. I propose a fourth, the reasonable tradeoff account, according to which individuals should only be required to make reasonable tradeoffs in order to pay for (...) their health coverage. That is, health insurance is affordable if in order to pay for it one does not to have to sacrifice other benefit(s) that are comparable in importance to the benefits of health coverage. (shrink)

Thought experiments play an important epistemic, rhetorical and didactic function in Galileo’s dialogues. In some cases, Salviati, Sagredo and Simplicio agree about what would happen in an imaginary scenario and try to understand whether the predicted outcome is compatible with their respective theoretical assumptions. There are, however, also situations in which the predictions of the three interlocutors turn out to be theory-laden. Salviati, Sagredo and Simplicio not only disagree about what would happen, but they reject each other’s solutions as question-begging (...) and somtimes even dismiss each other’s thought experiments as misleading or nonsensical. Grounded in experiences growing up in apartheid South Africa, she considers the intersections of representation, knowledge, and power, with a focus on colonial histories and enduring constructions of race and geography. Carla's ongoing project, Good Hope, was published by (...) MACK in 2021, and was shortlisted for the 2022 Aperture Paris Photo First Book Award, and the Arles 2022 Prix du Livre in the Photo-Text Category. An excerpt from Good Hope is also featured in On Whiteness, by SPBH Editions. Carla was a 2021 winner of the Open Walls Arles competition presented by The British Journal of Photography and exhibited work during Rencontres d'Arles Festival in 2021 and 2022. She is a 2021 Light Work Grant recipient and the 2022 recipient of the Silver Eye Fellowship, culminating in a photo-sculptural installation at Silver Eye Center for Photography in Pittsburgh. Carla was recently named a Foam Talent, with exhibitions at Foam Museum in Amsterdam, the Deutsche Börse Foundation in Frankfurt, along with a solo exhibition of Good Hope through PhMuseum in Bologna. Carla lives between South Africa and Ithaca. In Ithaca, she works as Visiting Critic in Cornell University's Art Architecture and Planning Department; as Lecturer in the Art, Art History and Architecture Department at Ithaca College; as faculty at the International Center of Photography; and as coordinator of the School of Criticism and Theory at Cornell. Have I told you of the White children from the Cape of Good Hope Seminary dressed in their afternoon 'civilian clothes'? Or of the more racially integrated group from Mseki High in their grey-and-turquoise uniforms surrounding me on the main steps leading to the garden? The cacophony of lunch-time chatter, chip packets crinkling, the flap-flap of wings as seagulls scavenge for tasty morsels? Have I told you of the signs pointing to the Scientific Pleasure Garden? Or of the gift store filled with locally sourced flower oils, handmade candles, Delft-blue china tea-sets and postcards depicting the early colony? Have I told you of the small rock in the corner of the vegetable garden with a label hidden beneath weeds? The arrival of the Dutch to establish a refreshment station, providing fresh produce for the ships plying the spice route, marked the end of a free and independent existence for the native Gorinhaiqua Khoikhoi. And what of the large label at the stone-walled entrance? A story of how a garden in 1654 brought together continents and affected the course of history. Transgender individuals and families throw existing taxonomic classification systems of identity into perplexing disarray, illuminating sociolegal dilemmas long overdue for critical sociological inquiry. Using interview data collected from 50 cisgender women from across the United States and Canada, who detail 61 unique partnerships with transgender and transsexual men, this work considers the pragmatic choices and choice-making capacities of this social group as embedded within social systems, structures, and institutions. Proposing the analytic constructs of “normative resistance” and “inventive pragmatism” to situate (...) the interactional processes between agency and structure in the everyday lives of this understudied group of cisgender women, this work theorizes the liminal sociolegal status of an understudied family form. In so doing, it exposes the increasingly paradoxical consolidation and destabilization of sociolegal notions of identity, marriage, normativity, and parenthood—challenging, contributing to, and extending current theoretical and empirical understandings of agency and structure in twenty-first-century families.
