It is widely held that free speech is a distinctive and privileged social kind. But what is free speech? In particular, is there any unified phenomenon that is both free speech and which is worthy of the special value traditionally attached to free speech? We argue that a descendent of the classic Millian justification of free speech is in fact a justification of a more general social condition; and, via an argument that 'free speech' names whatever natural social kind is (...) justified by the best arguments, that free speech is therefore this more general condition. This condition involves not merely the orthodox freedom (in some sense) of speakers to distribute words, but also two less frequently acknowledged dimensions of free speech: audience understanding and consideration. We conclude with some discussion of the policy implications of this conception of free speech. (shrink)

In this paper I outline an “agent-centered” approach to learning ethics. The approach is “agent-centered” in that its central aim is to prepare students toact wisely and responsibly when faced with moral problems. The methods characteristic of this approach are suitable for integrating material on professional and research ethics into technical courses, as well as for free-standing ethics courses. The analogy I draw between ethical problems and design problems clarifies the character of ethical problems as they are experienced by those (...) who must respond to them. It exposes the mistake, common in ethics teaching, of misrepresenting moral problems as multiple-choice problems, especially in the form of ‘dilemmas’, that is, a forced choice between two unacceptable alternatives. Furthermore, I clarify the importance for responsible practice of recognizing any ambiguity in the problem situation. (shrink)

ABSTRACT This paper aims to illustrate the contribution of Acquisition Linguistics combined with the dialogic view driven by Bakhtin’s ideas, in order to describe morpho-syntactic acquisitions. According to the first approach, interaction is the main driver of syntactic acquisition processes, especially adults’ adjustments to the morpho-syntactic attempts of children and children’s repetitions of adults’ speech. In parallel, a dialogic approach to language acquisition focuses on how the two speakers’ co-construction of discourse leads children to use and acquire the linguistic ability (...) to share and construct meaning in discourse. We analyse conversations between adults and children aged between 2 and 4 years old, with typical and atypical developments. Our results show how inter-discursive facts in dialogue and repetition in interaction are major contributors of language acquisition processes. (shrink)

We provide an account of chimpanzee-specific agency within the context of philosophy of action. We do so by showing that chimpanzees are capable of what we call reason-directed action, even though they may be incapable of more full-blown action, which we call reason-considered action. Although chimpanzee agency does not possess all the features of typical adult human agency, chimpanzee agency is evolutionarily responsive to their environment and overlaps considerably with our own. As such, it is an evolved set of capacities (...) for goal-directed behavior, which solves problems that chimpanzees naturally encounter. Solving actual moral problems is not simply a matter of choosing the “best” of several possible responses. It is also a matter of devising possible responses. Design practice in engineering affords important lessons about addressing practical problems.

Climate change and decarbonization raise complex justice questions that researchers and policymakers must address. The distributions of greenhouse gas emissions rights and mitigation efforts have dominated justice discourses within scenario research, an integrative element of the IPCC. However, the space of justice considerations is much larger. At present, there is no consistent approach to comprehensively incorporate and examine justice considerations. Here we propose a conceptual framework grounded in philosophical theory for this purpose. We apply this framework to climate mitigation scenarios (...) literature as proof of concept, enabling a more holistic and multidimensional investigation of justice. There is currently a growing interest in the philosophy and political thought of Baruch de Spinoza following many years of comparative neglect, particularly within political philosophy. The focus of this paper is Spinoza's major work, the Ethics, and its relation to his political writings. It explores Spinoza's distinctive formulations of imagination and affect and considers some of the ways in which these impact upon his political thought, specifically via his reflections upon democracy and knowledge. The discussion draws particular attention to (...) the aporetic status of imagination and its tendency towards ambivalence. It argues that this dynamic account of imagination introduces provisionality and contingency into Spinoza's reflections upon politics that may, in turn, enrich discussions seeking to introduce an awareness of the affective resonances of communication and identification to democratic theory. This article reports on a method of group mentoring to strengthen responsible research conduct. A key feature of this approach is joint exploration of the issues by trainees and their faculty research supervisors. These interactions not only help participants learn about current ethical norms for research practice, but also draw on the accumulated experience of faculty and staff about practical problems of research conduct, and help to make faculty more articulate about responsible research conduct and so better able to guide (...) their trainees. By working with departments or laboratories as a whole the method facilitates the formulation of specific norms appropriate to particular research situations and to strengthen the group’s ability to support appropriate behavior and deal with new issues as they arise. It also gives students more ways to ask questions about research practice and to benefit from the experience of all members of their department or group as well as their own research supervisors. The method is well tested and has been well received by a wide variety of departments and research groups. It provides the means for a constructive and enjoyable response to the Public Health Service’s (PHS) new Policy on Instruction in the Responsible Conduct of Research (RCR) that requires education in the responsible conduct of research for all those funded by PHS funds, including faculty and staff as well as trainees. ABSTRACT In ‘Just Words: On Speech and Hidden Harm: An Overview and an Application’, Mary Kate McGowan argues that some racist speech in public places should be made unlawful in the United States for the same reason that sexist behaviour in the workplace is already legally actionable—namely, to protect individuals from a hostile discriminatory environment. While McGowan may be correct that some public racist speech may constitute an act of discrimination in some morally significant sense, I present several reasons for (...) doubting that such speech constitutes a hostile discriminatory environment in the relevant legal sense. The article contributes to the debate on new materialism commenced by Sara Ahmed (2008). Taking up Lena Gunnarsson’s (2013) argument that erasing distinctions is no effective antidote to dualistic theorising, the article argues that Karen Barad’s (2003, 2007) theory is problematic on this count. Whereas Barad dilutes the theoretical distinction between mind and matter as well as that between the animate and the inanimate, the contention here is that it is ethically and politically vital to hold on to a notion (...) of subjectivity understood in terms of the capacity for experience, on account of which sentient being is exposed to suffering. This requires accentuating the passive dimension of subjectivity rather than merely the active dimension of matter. This article contests Barad’s reinscription of a masculinist devaluation of passivity on the grounds that only by moving beyond it can we overcome the hierarchical opposition of subject versus object and, in consequence, of mind versus matter. Although Sign Languages are gestural languages, the fact remains that some linguistic information can also be conveyed by spoken components as mouthing. Mouthing usually tend to reproduce the more relevant phonetic part of the equivalent spoken word matching with the manual sign. Therefore, one crucial issue in sign language is to understand whether mouthing is part of the signs themselves or not, and to which extent it contributes to the construction of signs meaning. Another question is to know whether mouthing (...) patterns constitute a phonological or a semantic cue in the lexical sign entry. This study aimed to investigate the role of mouthing on the processing of lexical signs in French Sign Language (LSF), according the type of bilingualism (intramodal vs. bimodal). For this purpose, a behavioral sign-picture lexical decision experiment was designed. Intramodal signers (native deaf adults) and Bimodal signers (fluent hearing adults) have to decide as fast as possible whether a picture matched with the sign seen just before. Five experimental conditions in which the pair sign-mouthing were congruent or incongruent were created. Our results showed a strong interference effect when the sign-mouthing matching was incongruent, reflected by higher error rates and lengthened reaction times compared with the congruent condition. This finding suggests that both groups of signers use the available lexical information contained in mouthing during accessing the sign meaning. In addition, deaf intramodal signers were strongly interfered than hearing bimodal signers. Taken together, our data indicate that mouthing is a determining factor in LSF lexical access, specifically in deaf signers. (shrink)

Should our commitment to freedom of speech extend to freedom of hate speech: speech that promotes hatred toward an individual or group on the basis of a characteristic such as race, gender, sexuality, nationality, or religion—often, although perhaps not exclusively, using slurs and epithets? Drawing on philosophy of language and empirical research, this essay outlines five theoretical models of how hate speech may function, and explores their implications for this issue. I argue that (some) hate speech can be regulated without (...) compromising freedom of expression; and furthermore that, under certain circumstances, considerations of free speech may favour regulating hate speech. It is argued that the common definition of diagnosis as the determination of the nature of a disease is misleading. Many diagnoses are not the names of disease entities. This finding reflects the integral relation of the diagnostic task to the rest of clinical reasoning. Diagnosis has no separate goal of its own, in particular it does not have the goal of determining the nature of a disease. Instead, diagnosis contributes to the general goals of clinical medicine. Any attempt to (...) model diagnostic reasoning abstracted from the rest of clinical reasoning will yield an inadequate representation of diagnosis. Such a distortion of medical reasoning will blind us to whatever implications an adequate epistemology of medicine may have for an understanding of the relation between theoretical and practical knowledge in other contexts. This article seeks to open up a discussion of issues relating to the significance of sexual difference, the thinking and politics emerging from it and how it might affect educational philosophy. It briefly examines the initial work of Luce Irigaray, which has become quite influential in parts of the English speaking world, particularly focussing on the idea that there are implications for our educational objectives if gender equality were to be put in question as one of the underlying paradigms with (...) which to measure children's performance. It then looks at the work of some groups of Italian philosophers and educationalists who have not been translated into English and are consequently less well known. Their work has been devoted to exploring Irigaray's challenge to re-think the world from the perspective of sexual difference. In particular, in tune with the theme of this special issue, this article shows how this work puts forward the practice and philosophy of relationship for consideration at different stages of the educational process, focussing particularly on Luisa Muraro's philosophical ‘invention’ of the symbolic order of the mother as a way to bring into the shared world the erased sexual difference that Irigaray had articulated. Muraro's work considers the meaning of the first relationship between mother and infant and suggests that the mother, or the one doing her work, is in fact the first and ongoing educator and transmitter of philosophy, a fact that is only partially recognised in our formal educational structures. The article introduces, finally, the idea that as the historical patterns of mainly women teaching younger children and men teaching older children are shifting, to understand the need for and argue for a more sexuate world, with both sexes participating in the educational process at all stages would allow for the possibility of a new discussion of concepts that are already central to educationalists such as equality, freedom, autonomy, authority, flourishing and the relationship with parents. Where is America in the republic of letters? This question has formed in my mind over the last four years as I have collaborated on a new project based at Stanford University called Mapping the Republic of Letters. The project aims to enrich our understanding of the intellectual networks of major and minor figures in the republic of letters, the international world of learning that spanned the centuries roughly from 1400 to 1800. By creating visual images based on large digitized (...) data sets, we hope to reveal the hidden structures and conditions that nourished the growth of the republic of letters in the early modern era and the causes of its transformation in the nineteenth century. This task has only recently become feasible with the digitization of the correspondences of major intellectuals such as Benjamin Franklin, John Locke, Athanasius Kircher, and Voltaire, and of libraries, cabinets of artifacts, and Grand Tour itineraries. This paper traces the meaning of technology in Arendt and Foucault’s work, their historical analyses of technology, and the way that their notions of technology’s role in modernity influence their historical methods. I argue that whilst the two political thinkers approach the idea of technology from different perspectives, there is also substantial overlap in the way that they conceive of technology – often critically – as a wide-ranging set of practices of power interlocked with particular modes of knowledge. This helps (...) to properly situate some aspects of their work that converge, for instance their analyses of what Foucault calls ‘biopolitics’. But their different conceptions of the historical character of technology, and its relationship to modernity, also create divergence: their concepts of ‘technology’ suggest different ways of thinking through the nature of historical continuity and discontinuity and the degree of access that we have to meaningful histories. In the first edition of The Gay Science (GS), Nietzsche proposes that we treat knowledge as unconditionally valuable and life as a tragic quest for truth. In the second edition of GS, he seems to retract this proposal, suggesting that we substitute “incipit parodia” for “incipit tragœdia.” But Nietzsche does not say what he means by “parody,” or what role he believes it should play in our evaluative lives. This article proposes that by introducing parody into GS, Nietzsche intends not (...) only to correct the original text by mocking his earlier treatment of science as tragic, but also to designate parody as a basis for new tasks, duties, and values beyond what science can offer. This article speculates that parodic value creation might consist in the imitation of behaviors and practices associated with preexisting values without the reproduction of the beliefs and feelings corresponding to those practices. This chapter reviews evidence that both memory disturbances and emotional disturbances characterize schizophrenia and examines how memory and emotion interact in schizophrenics, whether these patients exhibit a particular difficulty in remembering emotional events, and whether they still show the Pollyanna tendency. Because conscious awareness may represent the fundamenal impairment in schizophrenia, this chapter emphasizes not only objective accuracy of memory but also states of awareness associated with emotional memories. It argues that memory for emotional material operates “normally” in schizophrenic states (...) when emotional aspects of experience are genuinely noted. Of course, often these experiences are not interpreted by a person with schizophrenia in a fashion that accurately reflects the event's emotionality, with a corresponding memory impairment. But in many cases the emotional characteristics of an event require little controlled attention, and, under these conditions, we should expect to see intact emotional memory, even in this population which is disrupted in so many other ways. The chapter concludes by suggesting that intact emotional processing potentially plays a role in perpetualing delusional cognitions, through constructive memory processes. (shrink)

Background The COVID-19 pandemic posed many unprecedented challenges to health care systems and public health efforts worldwide. Policy making and science were deeply intertwined, in particular with regard to the justification of health policy measures. In this context, ethical considerations were often at the core of decision-making trade-offs. However, not much is known about the actual ethical challenges encountered by policy makers and scientists involved in policy advice. With this study, we therefore aim to explore the ethical challenges during COVID-19-related (...) political decision-making in Switzerland as perceived by policy makers and scientists involved in policy making. We also explore the role ethics advice had during the pandemic response and what can be learned for future public health crises. Methods We conducted thirteen qualitative expert interviews with policy makers and scientists involved in decision-making on COVID-19 policy responses in Switzerland on the regional and national level. We used inductive content analysis to analyse the interviews. Results Among the multitude of ethical challenges highlighted, interviewees perceived making trade-offs between the common good vs. the individual good and between economic welfare vs. health of the population, as well as proportionality of the policy measures, and the capacity of the public to accept uncertainty as central. Interviewees had diverging opinions on whether ethical considerations were sufficiently raised and discussed on the Swiss policy level during the COVID-19 pandemic. Among the reasons why ethics was not sufficiently discussed, they mentioned a lack of time in the fast-paced dynamic of the pandemic, ethics as a complex subject area, the interconnectedness between ethics and law, too much focus on few topics (mostly on vaccination-related ethical questions), and power relationships, such as dominance of medical professionals over ethicists. They evaluated ethics support to have been adequately present in the decision-making process, but wished for ethics training, involvement of the public in the discourse and for accompanying communication to build trust among the population for the future. Conclusions The study provides empirical insights into the ethical considerations of COVID-19 policy making in practice in Switzerland. It can help to develop ethics assistance for future crises and inform ethical health policy and decision-making not only in Switzerland, but also in other countries. (shrink)

Medical ethics educators have a responsibility to assess the dominant ped­agogical methods and textbooks we utilize to advance our students’ knowledge about cultural differences and health disparities. In this essay, I argue that intersectional theory functions as an effective tool for the assessment and correction of diversity, equity, and inclusion training models for medical students. I critique, in particular, the additive conceptions of identity and diversity that dominate the literature. Intersectional theorists also provide helpful directives for how to train students (...) to be suspicious of social categories and their relations to power structures. Their ideas can be used to create parameters for case-based learning so as not to undertheorize the culture of medicine and to add depth to core concepts like autonomy and privacy through much-needed investigations of identity formation and expression. Ultimately, intersectional theory pushes medical ethicists to educate their students to understand difference, diversity, and inequity within a wider moral frame. (shrink)

Sendo, para esse filósofo, o conhecimento humano moldado, em larga medida, pela inteligência – faculdade intimamente relacionada a uma compreensão determinista – como poder- se-ia compreender a atividade criadora, em particular a criação artística, a qual está intimamente relacionada com a noção de imprevisibilidade? O artista, como um pintor, por exemplo, por mais que planeje, não (...) sabe como será no final a sua pintura, assim como os momentos e ações de sua vida. Com a criação, ele apresenta a fluidez da duração, a sua criação contínua. Procuramos mostrar que para Bergson a criação artística envolve um distanciamento da inteligência e o envolvimento de outra capacidade humana, liberta das necessidades da ação, ou seja, a intuição. This study investigates the intricate process of visualizing the concept of paradise through the lens of Artificial Intelligence (AI), employing neural networks to craft intricate visual depictions of utopian realms. The project scrutinizes the prevalent themes associated with paradisiacal imagery, dissecting the intricate weave of religious doctrines, mythologies, and the intrinsic nature of paradise – be it a tangible realm or a metaphysical state. This inquiry critically assesses the role of AI-generated art, derived from complex algebraic formulations, in mirroring conventional (...) iconography and exposing inherent biases. Such revelations underscore the cultural resonance of diverse traditions and the potential presence of subconscious prejudices. Employing AI algorithms capable of transforming textual prompts into vivid illustrations, this research unveils insights into the nexus of AI and cultural portrayals of utopia, thereby provoking profound philosophical deliberations. Central to these contemplations is the extent of human dominion over conceptualized ideals and the prospect of AI-crafted art inadvertently molding our paradisiacal perceptions, with implications ranging from reinforcement of stereotypes to shaping intrinsic cognitive schemas. Empathy is operationalised and measured in various different ways in research. I have identified several trends in empathy research that have resulted in what I refer to as neurotypical gatekeeping of the concept of empathy. Narrow assumptions on the relationship between experiences and expressions have made the concept exclusive to those who are perceived as neurotypical. In several ways, this has biased our knowledge of empathy, especially regarding autism. This does not only invalidate autistic empathy, but also sustains a harmful (...) and stigmatizing narrative of autism. In this paper, I expand on the neurotypical gatekeeping of empathy as a matter of epistemic injustice and argue why and how neurodiversity calls for a reconceptualization of empathy. I continue by building a proposal for a clear and fair notion of empathy. I argue that we need to settle the dispute on empathy and morality by accepting the value associated with empathy in society, and use an anti-discriminatory normative conceptualization accordingly. I propose to understand empathy as appropriately attending to experiential differences and similarities, balancing between – what I introduce as - distantism and proximism. I discuss conceptual and methodological implications of this approach to empathy, as well as its application to neurodiversity. (shrink)

This article examines how and why Ayn Rand uses fairy tales as intertexts in her novels. It argues that she evokes and revises fairy tales to exemplify the metaphysical values that her novels resist. For Rand, fairy tales like “Cinderella” are problematic because they typically endorse conventionality over the truly heroic. She therefore associates them with secondhanders and villains. She rejects their message that mindless conformity leads to happily-ever-after, and she exposes how fairy tales can be formidable vehicles for promoting (...) the senseless. She reinforces her point by contrasting them with her revisions of myths, which she associates with heroes. (shrink)

Whilst the concept of the subject has been called into question by many diverse approaches within contemporary political and social theory, there remains a focus upon agency, now attributable to reformulated subjectivities or assemblages. I query the persistence of this grammar of agency and ask whether politics can do without a ‘scene of the subject’. Spinoza’s philosophy, in particular, his conception of conatus, has inspired and offered some basis for rethinking agency. I examine two such prominent positions and argue that (...) ultimately neither captures the political promise of Spinoza’s philosophy. Configuring a concept of morphology to analyse this scene, my argument detaches the conatus from a narrow focus upon human desire, and focuses attention upon the scene of the subject as it folded into a wider complex body. My approach also returns a study of power to the discussion: the conatus is the power to persist, but it is also a differential force and site of conflict. By placing the spotlight on the scene of subjectivity in this way, the contemporary political theorist avoids the false antinomy between agency and structure, whilst continuing to track the production and composition of subjectivity in new political forms. This article illuminates the relationship between John Rawls' and Michael Walzer's accounts of non-domestic justice by tracing its connection to their domestic relationship. More precisely, it places the celebrated positional shifts that characterize the latter within the context of the fundamental justificatory tension between their projects which endures: reason vs trust; and then juxtaposes this justificatory tension and their non-domestic political prescriptions. Such contextualization is important to the clarification of the pair's non-domestic relationship since it enables the observation that despite (...) this enduring justificatory tension these political prescriptions are remarkably similar.
