The value of and the need for rich data for criminal justice research is increasingly apparent, especially following recent restrictions on primary data collection due to COVID-19. Whilst the benefits of using administrative data for research are well established, less understood are the perspectives of data contributors and their expectations for the ethical governance and use of these data. This study describes the findings from a preliminary study comprising four focus groups with a total of seventeen adult males serving sentences (...) in a Category A prison in England. Participants were asked to offer opinions about the possibility of making survey data collected from them as part of the prison inspection process more widely accessible, beyond the organizational priorities for which it was initially collected. Generally, participants were content for survey data to be shared with recipients who intended to use the data to bring about change within prisons; this aligns with the purpose for data collection. Participants were opposed to data being made accessible to recipients who might produce spurious findings. We discuss implications for the future accessibility of a vast wealth of prisoner survey data in England and Wales and highlight the importance of consultation with incarcerated persons on this subject. I examine Alan Moore and Kevin O’Neill’s adaptation of Margaret Cavendish’s Blazing World in the comic series The League of Extraordinary Gentlemen. I interpret philosophical aspects of Cavendish’s fictional landscape, including her vitalist materialism and naturalized talking animals, as they appear in series The League of Extraordinary Gentlemen, rendered through 3-D images and corresponding 3-D glasses worn by readers. Through this world adaptation, Moore and O’Neill onboard themes of naturalness, experimentation, technology-aided perceptual processes, and travel to intersecting worlds (...) to enhance The League of Extraordinary Gentlemen’s commentary on the formative influence of fiction on authors and audiences. This article explains how data associated with attitude change and persuasion in mainstream psychology and social psychology can be reinterpreted as evidence of the agentive ability of taking a position. A critical review is made of the elaboration likelihood model and a position model is adapted from positioning theory. The postulates of the elaboration likelihood model are then subjected to critical scrutiny by means of comparison with our position model. In this way regularities associated with attitude change and persuasion are (...) interpreted as evidence of a deliberative process, involving negotiation and the use of supporting and opposing arguments. Two‐ and 3‐year‐old children (N = 96) were tested in an object‐choice task with video presentations of peer and adult partners. An immersive, semi‐interactive procedure enabled both the close matching of adult and peer conditions and the combination of participants’ choice behavior with looking time measures. Children were more likely to use information provided by adults. As the effect was more pronounced in the younger age‐group, the observed bias may fade during toddlerhood. As there were no differences in children’s propensity (...) to follow peer and adult gestures with their gaze, these findings provide some of the earliest evidence to date that young children take an interlocutor’s age into account when judging ostensively communicated testimony. Thirty years later we seem no closer to a consensus on the ethics of sterilizing profoundly mentally compromised young girls than was Judge Blumenfeld.

Supersaturated hcp f -Zr alloys containing 22-28 at.% N were prepared by nitriding sheets of Zr in an atmosphere of high-purity N 2 , followed by homogenization under high-purity Ar gas. Quenching and isothermal ageing of the alloys for various times between 500 and 650°C resulted in precipitation of a metastable phase, rather than the equilibrium phase ZrN. This investigation focused on determining the structure, orientation relationship, habit plane, morphology, growth kinetics and atomic growth mechanism of this non-equilibrium precipitate using (...) transmission electron microscopy imaging and diffraction techniques, high-resolution transmission electron microscopy, electron-energy-loss spectroscopy and various simulation programs. The precipitate, which was arbitrarily designated the  phase, has a monoclinic Bravais lattice. Its lattice parameters are a = 0.32 nm, b = 0.60 nm, c = 0.56 nm, f = g = 90° and n = 121.5°. Its orientation relationship with the f matrix is $$ _alpha /mskip-2/ _xiquad adquad [01bar 10] _alpha /mskip-2/ [001]_xi, $$ and the average habit plane of lenticularly shaped precipitates is $_alpha$ . Two aspects of mothering—using drugs during pregnancy and giving up the rearing of one's children—are the focus of this analysis of 58 addicted Chicana mothers who spent their adolescent years in barrio gangs. From a traditional stance, such women were doubly deviant, since they violated gender-role prescriptions by joining a barrio gang and by becoming involved in heroin and street life. Half of these women added to this deviance by using heroin during pregnancy, and 40 percent relinquished at least one (...) of their children. This article explores what distinguishes these classically “bad mothers” from addicts who maintain some degree of conventionality in their mothering. We found that Mexican gender-role traditionalism is not the only influence on these women. Many came from cholo or underclass families with a tradition of street involvement. In addition, their involvement in gang and heroin worlds may influence their behavior as mothers. We found that women who used drugs during pregnancy were more likely than abstainers to be cholas and to reject traditional gender-role values. However, those who gave up their children were more likely than those who kept their children to be from traditional families. We discuss the implications of these findings for research on deviance and the underclass among Hispanic women. (shrink)

Spontaneous play, important for forming the basis of friendships and peer relations, is a complex activity involving the management and production of talk-in-interaction. This article focuses on the intricacies of social interaction, emphasizing the link between alignment and affiliation, and the range and importance of verbal and nonverbal interactive devices available to children. Analysis of the way in which two girls, one of whom has been diagnosed with Asperger’s Syndrome, engage in spontaneous activities demonstrates the potential for interactional difficulty due (...) to the unscripted nature of the interaction. The article argues for further research into how improvised, unscripted interactions are initiated within moment-by-moment talk, how they unfold, and how they are brought to a close in everyday contexts in order to understand how children create their social worlds. The recent death of Peter McHugh becomes an occasion for the remembrance and recollection of the distinctive form of reflexive or analytic social inquiry, which framed his work and that of his longtime friend and collaborator, Alan Blum. Following dual appointments at York University, Toronto, Canada in 1972, Blum and McHugh’s partnership formed the basis for a community of scholars and students throughout the 1970s, 1980s, and 1990s. A brief review of McHugh and Blum’s works shows theoretical roots in social (...) constructivism and a deep appreciation of the linguistic turn, which in turn lead to the development of a form of social analysis that meets the stringent requirements of a reflexive sociology by repudiating any claim to a privileged exemption of theoretical speech (practice) from the hermeneutical circle of speech and language. Blum and McHugh are shown to embrace and not to evade the hermeneutical circle by a form of social inquiry that subverts the inherent possibilities available within speech and social convention to make available an encounter with the (moral) authority or form of life for that self-same speech. With each example of everyday life or conventional usage, McHugh (and Blum) move from theorizing which formulates the complexity of a particular instance of social interaction through its rules, to the question of the form of life that make that particular instance of the rules possible. It is the pursuit of transparency between speech and its roots in language that informed and continues to inform the distinctive style of social theory fostered at York-Toronto under the orchestration of McHugh and Blum. In this far-reaching essay, historian Michael Edward Moore examines modernity as an historical epoch following the end of the medieval period -- and as a "messianic concept of time." In the early twentieth century, a debate over the meaning and origins of modernity unfolded among the philosophers Ernst Cassirer, Hans-Georg Gadamer and Hans Blumenberg. These thinkers tried to resolve the puzzle of the fifteenth-century master Nicholas of Cusa. Was Cusanus the last great medieval thinker, his ideas a summa of (...) medieval tradition? Or was he a mysterious epochal figure, seated at one end of the bridge leading to modern thought? Nicholas of Cusa lived during a time of historical and existential crisis, or kairos, when medieval governments and cherished sources of unity were shaken. Likewise, the debate over his significance took place during a later phase of crisis for Europe, in the decades before and after the Second World War, when the collapse of European civilization was witnessed. Moore argues that modernity, so intently examined as an historical and spiritual problem, has significance for our contemporary sense of crisis. (shrink)

While addiction is not a legal defense in any legal system, the chapter assays whether it should be. The conclusion is largely negative, denying that there should be any general defense but allowing that in certain cases at least a partial defense would be appropriate. The chapter rejects the shibboleths commonly asserted in this area: that no addict can be excused because he or she was responsible for becoming an addict in the first place and that all addicts must be (...) excused because addiction is a brain disease. The ELSI Program: Closing the Loop was an interpretive policy study undertaken to identify how the research and the researchers funded through the program to study the ethical, legal, and social implications of mapping the human genome contributed to the construction of a public policy agenda. The stated goals of this federal grant program, known as ELSI and administered through the National Center for Human Genome Research within the National Institutes of Health, was to maximize the benefits and minimize the (...) harms of the genetic information developed as a result of the government supported genomic research. The purpose of the research project was to generate meaning and understanding regarding the social constructions of this community of researchers. Specifically, identifying themes in the process and outcomes of the research activity was intended to inform future public policy actions, thereby, closing the loop on the reflexive activity generated by the ELSI Program. The activities of the sixty-four researchers granted awards between 1990 and 1993 comprised the core sample for the study. The research process was embedded in a constructivist philosophy and the design included participant observation and an analysis of textual materials generated by the grantees. Data included periodical articles, authored and edited books, videos, popular print and visual media materials, conference papers and presentations, forum reports, interviews, and materials generated by the researcher in the process of the research--notes and analytic memos. Data analysis was an interpretive synthesis of a content analysis, contextual analysis, grounded theory coding categories, and the reflexive process of the researcher. ;The phenomena under investigation were the interactional activities of the ELSI group of researchers through which meaning was shaped on the ethical, legal, and social implications of genomic mapping. A theoretical model of the constructions of the researchers as developed included two core categories: "Framing Academic Constructions" and "Institutionalizing the Myth". The ELSI researchers used a variety of strategies, including rhetorical questioning, professional blocking and impersonalizing, plying a trade, and academic time in generating constructions. The research and researchers contributed to institutionalizing a myth of a genome through strategies that included being the expert, narrowing the focus, and marveling. The consequence of these social interactions was a process of "Making Points Not Meaning", participation in symbolic activities that generated few issues for the public policy agenda. The constructions of the policy study were then situated in the context of the discipline of public administration and policy studies. Significant to the impact of the research findings was understanding how the cooptation of these researchers might effect an health care delivery system dominated by commercial interests such as biotechnology and managed care organizations. The study concluded with a discussion of how situated knowledge constructions, social epistemology, interdisciplinarity, and interpretive research methods might contribute to enhanced credibility in public policy actions.
