Insider trading is illegal, and is widely believed to be unethical. It has received widespread attention in the media and has become, for some, the very symbol of ethical decay in business. For a practice that has come to epitomize unethical business behavior, however, insider trading has received surprisingly little ethical analysis. This article critically examines the principal ethical arguments against insider trading: the claim that the practice is unfair, the claim that it involves a misappropriation of information and the (...) claim that it harms ordinary investors and the market as a whole. The author concludes that each of these arguments has some serious deficiencies; no one of them by itself provides a sufficient reason for outlawing insider trading. This does not mean, however, that there are no reasons for prohibiting the practice. The author argues that the real reason for outlawing insider trading is that it undermines the fiduciary relationship that lies at the heart of American business. (shrink)

In this essay I consider the argument that Bernard Williams advances in ‘The Makropolus Case’ for the meaninglessness of immortality. I also consider various counter-arguments. I suggest that the more clearly these counter-arguments are targeted at the spirit of Williams's argument, rather than at its letter, the less clearly they pose a threat to it. I then turn to Nietzsche, whose views about the eternal recurrence might appear to make him an opponent of Williams. I argue that, properly interpreted, these (...) views in fact make him an ally. Concerns about children's ability to fully comprehend and evaluate advertising messages has stimulated substantial research and heated debate among scholars, business leaders, consumer advocates, and public policy makers for more than three decades. During that time, some very fundamental questions about the fairness of marketing to children have been raised, yet many remain unresolved today. With the emergence of increasingly sophisticated advertising media, promotional offers and creative appeals in recent years, new issues have also developed. After exploring MacIntyre’s (1985) practice—institution distinction, the article demonstrates its applicability to business-as-practice and to corporations as institutions. It then considers the implications of MacIntyre’s schema to ethical schizophrenia, to the claim that themarket is a source of the virtues and to the opposite claim that capitalism corrodes character. A fully worked out modern virtue ethics, based on MacIntyre’s work, is then established and the claim is made and substantiated that such an understanding of MacIntrye’s work revitalises it and makes (...) it directly applicable to business and to corporations. Those inclined to believe in the existence of propositions as traditionally conceived might seek to reduce them to some other type of entity. However, parsimonious propositionalists of this type are confronted with a choice of competing candidates – for example, sets of possible worlds, and various neo-Russellian and neo-Fregean constructions. It is argued that this choice is an arbitrary one, and that it closely resembles the type of problematic choice that, as Benacerraf pointed out, bedevils the attempt to reduce numbers (...) to sets – should the number 2 be identified with the set Ø or with the set Ø, Ø? An “argument from arbitrary identification” is formulated with the conclusion that propositions (and perhaps numbers) cannot be reduced away. Various responses to this argument are considered, but ultimately rejected. The paper concludes that the argument is sound: propositions, at least, are sui generis entities. (shrink)

This essay involves exploration of certain repercussions of Bernard Williams’ view that there is, in Wittgenstein’s later work, a transcendental idealism akin to that found in the Tractatus—sharing with it the feature that it cannot be satisfactorily stated. It is argued that, if Williams is right, then Wittgenstein’s later work precludes a philosophically substantial theory of meaning; for such a theory would force us to try to state the idealism. In a postscript written for the reprint of the essay, reasons (...) are given for thinking that Williams is not right: Wittgenstein’s later work actually helps us to repudiate as ill-conceived all those questions whose answers invite us to embrace any such idealism. But the main thesis of the essay remains intact. Indeed the idea that Wittgenstein’s later work precludes a philosophically substantial theory of meaning is reinforced. (shrink)

In this article I argue that the proper subjects of intangible property claims include medical records, genetic profiles, and gene enhancement techniques. Coupled with a right to privacy these intangible property rights allow individuals a zone of control that will, in most cases, justifiably exclude governmental or societal invasions into private domains. I argue that the threshold for overriding privacy rights and intangible property rights is higher, in relation to genetic enhancement techniques and sensitive personal information, than is commonly suggested. (...) Once the bar is raised, so‐to‐speak, the burden of overriding it is formidable. Thus many policy decisions that have been recently proposed or enacted – citywide audio and video surveillance, law enforcement DNA sweeps, genetic profiling, national bans on genetic testing and enhancement of humans, to name a few – will have to be backed by very strong arguments. It is argued that, although there are no ineffable truths, the concept of ineffability nevertheless does have application—to certain states of knowledge. Towards the end of the essay this idea is related to religion: it is argued that the language that results from attempting (unsuccessfully) to put ineffable knowledge into words is very often of a religious kind. An example of this is given at the very end of the essay. This example concerns the Euthyphro question: whether what is right (...) is right because God wills it, or whether God wills it because it is right. (shrink)

The paper builds on the postulate of “myths we live by,” which shape our imaginative life (and hence our social expectations), but which are also open to reflective study and reinvention. It applies this principle, in particular, to the concepts of love and vulnerability. We are accustomed to think of the condition of vulnerability in an objectifying and distancing way, as something that affects the bearers of specific (disadvantaged) social identities. Against this picture, which can serve as a pretext for (...) paternalist and controlling attitudes to the groups in question – notably to women – Anderson urges us to reimagine our vulnerability as a condition not merely of exposure to violence but of openness to mutual affection, love, and friendship. Hegel’s celebrated image of the owl of Minerva, which takes wing only with the coming of dusk, suggests an association of (philosophical) wisdom with negativity – with the experience of death or loss. Anderson, by contrast, proposes an alternative and more hopeful image of the dawn of enlightenment, in the guise of new ethical dispositions shaped by an emancipatory (and so, no longer an oppressive or sexist) conception of our capacity for love. In 1887 Georg Cantor gave an influential but cryptic proof of theimpossibility of infinitesimals. I first give a reconstruction ofCantor's argument which relies mainly on traditional assumptions fromEuclidean geometry, together with elementary results of Cantor's ownset theory. I then apply the reconstructed argument to theinfinitesimals of Abraham Robinson's nonstandard analysis. Thisbrings out the importance for the argument of an assumption I call theChain Thesis. ABSTRACT Land is essential to actually built utopias. Literature regarding built utopias pays next to no attention to the land under them or how it was obtained. Currently Canada's national conversation increasingly pivots around colonization by Europeans and the still unresolved takeover of lands of long-resident Indigenous peoples. The article's objective is to explore a present-centered approach to studying built utopias for its potential to explain how a Eurocentric conception of utopia was invested in the land. The approach draws on (...) James Holstun's 1987 study of Puritan utopias to analyze the circumstances utopists encountered contemporaneously with building and maintaining settlements. The test case of 7,000 Mennonite biblical pacifists left detailed information about how actualized utopia works. The expectation is that research from many such past concrete experiences could astutely and practically inform the next inevitably land-related utopian vision, which, it seems, will be ecologically inspired. This paper contrasts the normative foundations of the stakeholder and shareholder theories of the firm. It demonstrates how the shareholder theory of the firm appears to have at least as much normative support as stakeholder theory and suggests that a way forward may be for a variant of pure shareholder theory to emerge.

How do you connect the discipline of anthropology to both philosophy and geography? What about history, sociology, and other applied and theoretical forms of knowledge? In Earth Ways: Framing Geographical Meanings, Gary Backhaus and John Murungi challenge contributors to find the organizing component, or "framings," that enables them to bridge their own work to philosophy and geography. What emerges are truly creative contributions to interdisciplinary thought.

Two of Quine's most familiar doctrines are: that there is a distinction between underdetermination and indeterminacy; and that there is no distinction between analytic and synthetic truths. An argument is given that these two doctrines are incompatible. In terms wholly acceptable to Quine and based on the underdetermination/indeterminacy distinction, an exhaustive and exclusive distinction is drawn between two kinds of true sentences, which, it is argued, corresponds to the traditional analytic/synthetic distinction. An appendix is used to develop one aspect of (...) the underdetermination/indeterminacy distinction, as construed here, and to discuss, in passing, some of Quine’s more general views on truth. I present an annotated development of the basic ideas of the Geneva School approach to the foundations of physics and the structures which emerge as mathematical representations of the physically dual notions of state and property.

An interpretation of Kant's first antinomy is defended whereby both its thesis and its antithesis depend on a common basic principle that Kant endorses, namely that there cannot be an ‘infinite contingency’, by which is meant a contingent fact about how an infinite region of space or time is occupied. The greatest problem with this interpretation is that Kant explicitly declines to apply counterparts of the temporal arguments in the antinomy to the world’s future, even though, if the interpretation is (...) correct, such arguments are clearly there to be applied. Medical decisions, including diagnosis, prognosis, and disease classification, must often be made on the basis of incomplete or unsatisfactory information. Data which are essential to the care of one patient may be unobtainable for technical or ethical reasons in another patient. For this reason the principles of controlled experimentation may be impossible to satisfy in human studies. In this paper, some formal aspects of medical decision making are discussed. Special operators for the intuitive concepts of certainty, demand, and effort, akin (...) to the operators of modal logic, are used to accommodate the technical and ethical limitations on human studies. Theorems are stated and proved which show how this system handles incomplete information. The embryogenesis of the human heart is presented as a sample problem in classification. (shrink)

Paul Grice’s account of the nature of intentional communication has often been supposed to be cognitively too complex to work as an account of the communicative interactions of pre-verbal children. This chapter is a (fairly uncritical) review of a number of responses to this challenge that others have developed. I discuss work on Relevance Theory (by Sperber and Wilson), Pedagogy Theory (by Gergely and Csibra), and Expressive Communication (by Green and Bar-On). It has been demonstrated that death certificates do not accurately record the actual cause of death in up to one-fourth of cases, as determined from subsequent autopsy findings. The purpose of this study was to explore the use of natural language autopsy data bases as an automated quality assurance mechanism. We translated the account of the major process leading to death, or the primary diagnosis, from all 45,564 narrative autopsy reports obtained at The Johns Hopkins Hospital between May 28, 1889, (...) and June 30, 1987, into the hierarchical system of Medical Subject Heading (MeSH) titles. We obtained a total of 125,772 MeSH title translations, 1,563 of them distinct (average 2.8 per case), ranging in frequency from 6,029 occurrences of LUNG to 1 occurrence apiece of 357 MeSH titles. The natural-language-to-MeSH translations showed expected trends over the past century: fewer infectious diseases; more cardiovascular and neoplastic disease among adults; and more respiratory diseases and congenital malformations in the pediatric age group. The greater availability of autopsy documents in electronic form should increase the value of this resource for quality assurance. (shrink)

Mathematical naturalism forbids philosophical interventions in mathematical practice. This principle, strictly construed, places severe constraints on legitimate philosophizing about mathematics; it is also arguably incompatible with mathematical realism. One argument for the latter conclusion charges the realist with inability to take a truly naturalistic view of the Gödel Program in set theory. This argument founders on the disagreement among mathematicians about that program's prospects for success. It also turns out that when disagreements run this deep it is counterproductive to take (...) too narrow a view of how philosophers of mathematics may legitimately proceed. (shrink)

Can a scientific naturalist be a mathematical realist? I review some arguments, derived largely from the writings of Penelope Maddy, for a negative answer. The rejoinder from the realist side is that the irrealist cannot explain, as well as the realist can, why a naturalist should grant the mathematician the degree of methodological autonomy that the irrealist's own arguments require. Thus a naturalist, as such, has at least as much reason to embrace mathematical realism as to embrace irrealism.
