ZusammenfassungWährend die juristische und medizinethische Rechtfertigung des Verzichts auf Wiederbelebung in Deutschland akademisch hinreichend geklärt ist, zeigen sich doch erhebliche Unterschiede und zahlreiche Probleme bei der praktischen Umsetzung in der Klinik. Innerhalb des interdisziplinären Behandlungsteams gehören Kommunikationsdefizite und die Intransparenz der ethischen Entscheidungsprozesse zu den häufigsten Schwierigkeiten, die in der Medizinischen Klinik für Nephrologie und Hypertensiologie am Klinikum Nürnberg mit der Implementierung einer hausinternen Leitlinie, der Anordnung zum Verzicht auf Wiederbelebung, behoben werden sollten.Die Evaluationsstudie, die 118 VaW-Anordnungen bei 4718 Behandlungsfällen (...) im Zeitraum von November 2004 bis Juli 2005 einschloss, verfolgte einen dualen Forschungsansatz. Eine quantitative Dokumentationsanalyse aller VaW-Protokolle wurde mit der leitfadengestützten Befragung von 16 Ärzten und Pflegekräften kombiniert.Teambesprechungen waren in 62,4 %, Entscheidungsgründe in 74,6 % aller VaW-Protokolle dokumentiert. Die Interviews ergaben eine positive, aber berufsgruppendifferente Bewertung der Kommunikation, wobei die Pflegenden kritischer eingestellt waren als ihre medizinischen Kollegen. Die VaW-Dokumentation bewirkte nach Auffassung aller Befragten eine hohe Nachvollziehbarkeit und Transparenz. Die VaW-Anordnung wurde darüber hinaus als gut anwendbar und praxistauglich betrachtet. Nahezu alle Befragten sprachen sich für eine Beibehaltung des VaWVerfahrens in der Klinik aus.Die Implementierung der VaW-Anordnung als hausinterne Leitlinie und Dokumentationsstandard hat zu einer Förderung des interdisziplinären Dialogs und zu einer erheblichen Verbesserung der Transparenz der ethischen Entscheidungsprozesse im Rahmen des Verzichts auf Wiederbelebung geführt. Hilfreich und praxistauglich erfreut sich die VaW-Anordnung einer hohen Akzeptanz bei Pflegenden und Medizinern und wird seit drei Jahren in der Nephrologie am Klinikum Nürnberg konsequent angewendet. This paper examines from a cognitive perspective the rhetorical and epistemic advantages that can be gained from the use of (extended) metaphors in political discourse. We defend the assumption that extended metaphors can be argumentatively exploited, and provide two arguments in support of the claim. First, considering that each instantiation of the metaphorical mapping in the text may function as a confirmation of the overall relevance of the main core mapping, we argue that extended metaphors carry self-validating claims that increase (...) the chances of their content being accepted. Second, we show how the recognition of an extended metaphor’s sophistication and relevance (on behalf of the addressee) can benefit the speaker’s perceived competence (ethos). We then assess whether these two arguments measure against the dual epistemic monitoring postulated in the notion of epistemic vigilance (i.e., assessment of the source of a message and assessment of the message) and conclude that extended metaphors may fulfil the requirements of epistemic vigilance and lead to the stabilisation of a belief. We illustrate our account with an analysis of the extended metaphor of the USA as an empire found in a political pamphlet written by the Swiss politician Oskar Freysinger. (shrink)

Although he does not provide a general analysis of argumentation, Aristotle is a highly influential source of modern argumentation theory. In his treatises the Topics, the Sophistical Refutations and the Rhetoric, Aristotle presents complementary aspects of a theory of sound arguments that are seen as the most effective means of persuasion. Aristotle’s central notion of a deductive argument (sullogismos) does not include references to an addressee, the situative context or non-verbal aspects of communication, and thus differs from some modern views (...) on argumentation. A deductive argument in the Aristotelian sense is a sequence of intellectual steps where the conclusion follows of necessity from the premises. Aristotle does not relativize or relax this notion but takes other factors into account by providing supplementary theoretical elements. For example, he reflects on acceptable premises (endoxa), the adjustment of rhetorical arguments to the horizon of the audience, methods of finding premises on the basis of argumentative schemes (topoi), the use of non-argumentative means of persuasion, and a framework of implicit discourse rules. Many of these themes are, albeit under a different name, still discussed in modern argumentation theory. (shrink)

Natural disaster events such as drought affect the broader economy and inflict adverse consequences for firms because of spill-over effects in an integrated economy. Contrary to the expectation that firms would engage in higher levels of corporate tax avoidance strategies when they experience a negative cash flow shock, we document consistent evidence that firms engage in less corporate tax avoidance when their headquarter states experience drought. Reduced tax avoidance is more pronounced among firms with higher CSR performance and among firms (...) operating in states that experience a GDP decline. Collectively, the findings of our study demonstrate prosocial and ethical behavior of U.S. firms when they experience natural disaster events. (shrink)

Many people all over the world are convinced that cloning human beings is unethical and should be outlawed through prohibitions in criminal law. In spite of this, debate flares up repeatedly whenever experiments with human embryonic cells are carried out somewhere in the world. This will continue to happen as long as the conviction that cloning human beings is unethical lacks a logical philosophical-ethical foundation, which is still the case1,2. In addition, a foundation that could be more permanent against the (...) background of different cultural traditions is particularly absent. The standard justification for the prohibition of human cloning is derived from the complex of arguments on the status of the embryo, the so-called ICP arguments. According to these arguments, from the time the egg cell is fertilized and onwards, the human embryo is and remains genetically identical (I) with the subsequent unique (individual) person and there is an unbroken continuous (C) development from the fertilized egg cell through birth to the death of every single person that is born. Above all, it is claimed that there is an irrevocable potential (P) for human individuality, which is why every embryo means human life, possibly even a living development not only into a person but as a person. Oswald Hanfling discusses such ideas as the 'verification principle' ('the meaning of this statement is the method of its verification') and the 'elimination of metaphysics, ' an attempt to show that metaphysical statements, for example about God, are unverifiable and therefore meaningless.

This volume contains surveys of the main issues in philosophical aesthetics, as discussed by thinkers from ancient Greece to modern times.

Scholars strive, in their treatment of Stein’s work, to express both a phenomenological concept of the human person, characterized by conscious and free spiritual activity, and a metaphysical concept of the person, seen as an individual essence unfolding throughout life. In Stein’s work, the two concepts are not simply juxtaposed, nor is there a shift from one to the other. Stein integrates her phenomenological research into a metaphysical framework. In the present contribution, I endeavor to show that Stein’s interpretation of (...) Husserl’s concept of constitution focuses on the question of whether this constitution is to be understood realistically or idealistically and on the question of the constituting subject. I shall argue that Stein’s interpretation of constitution is closely linked to the lived experience she calls already in her early writings “self-discovery” and “awakening.”. (shrink)

This article addresses two questions: How should a ‘practical political theory’ approach the ideological struggle between advocates of critical social justice and defenders of free speech? And, what does this conflict tell us about the deficits of one particular tradition of practical political theory — namely, agonistic democracy? The paper’s purpose, then, is to illuminate a concrete contemporary phenomenon through the lens of agonistic theory and, conversely, to use this struggle as an impetus to carve out and address weaknesses in (...) the theory of agonism.I defend an ‘agonistic approach’ to the struggle against two alternatives — first, the claim that there is, conceptually, no ‘real’ conflict between social justice and free speech, and second, the strategy to ‘take sides’ in the conflict. By taking seriously the agonistic core idea that struggle and conflict can be valuable and productive expressions of plurality and inclusivity, I argue that this struggle should be approached as an agonistic conflict — as the welcome and important expression of a diversity of views on central social, moral and political questions.I also show, however, how retaining the focus on the real-life struggle between advocates of critical social justice and free-speech sheds light on the inconsistencies of much agonistic thought. In particular, I will criticize those agonists who limit their conception of the ‘agon’ to respectful struggles, and those who see the agon merely as a tool of emancipation for oppressed groups. Against these visions of agonism, I develop an anti-perfectionist, yet radical, account of agonism with the potential to serve as a guide in complex social and political conflicts. (shrink)

Pour mettre en honneur la dimension relationnelle et dialogique de la personne humaine, beaucoup d’exégètes et de théologiens, surtout depuis Karl Barth, refusent une interprétation structurelle de l’imago Dei. Ma contribution propose plutôt de montrer qu’une interprétation relationnelle de l’image doit être articulée avec une interprétation structurelle et que toutes les deux sont marquées par une tension téléologique. Edith Stein concrétise cette thèse dans sa réflexion sur l’individualité de la personne humaine qui, dans sa perspective, est condition d’un enrichissement mutuel (...) qui ne concerne pas seulement la diversité des vécus, mais l’enrichissement par les personnes elles-mêmes. La thèse de Stein pourrait être énoncée de la manière suivante : pour valoriser une approche relationnelle et communionnelle, il faut en même temps valoriser une approche ontologique et structurelle de la personne humaine, plus particulièrement en ce qui concerne son individualité qualitative. English Title: Structural and Relational Interpretation of the imago Dei: A proposal of Articulation from Edith Stein and Her Conception of the Human Person’s Individuality English Abstract: To appreciate the relational and dialogical dimensions of the human person, many exegetes and theologians, especially after Karl Barth, have refused a structural interpretation of the imago Dei. My contribution proposes rather to show that a relational interpretation of the image must be articulated with a structural one and that both are marked by a teleological tension. Edith Stein concretises this thesis in her reflections on the individuality of the human person which, in her perspective, is a condition for the possibility of mutual enrichment, concerning not only the diversity of lived experiences, but also enrichment by other persons themselves. Stein’s thesis could be enunciated as follows: to valorise a relational and communal approach, one mustvalorise at the same time an ontological and structural approach to the human person, particularly with respect to qualitative individuality.
