It is well known that the dominant paradigm underlying the free movement jurisprudence of the Court of Justice has progressively shifted from the ‘market citizen’ to the EU citizen: in order to invoke free movement and equal treatment rights an economic nexus is no longer needed, allowing, for example, students to claim equal treatment with host Member State nationals as regards access to education and the receipt of study grants. Normatively, however, this raises important questions. The classic logic whereby these (...) free movement and equal treatment rights were provided to Member State nationals as a quid pro quo for their contribution to and participation in a project of European integration—the establishment of the common market—is undermined. A new ‘aim’ or ‘rationale’ is thus needed, capable of explaining and informing the citizenship jurisprudence of the Court. The purpose of this article is to construct a conceptual framework for the Court’s EU citizenship jurisprudence by relying on a cosmopolitan vision of citizenship as set out by Immanuel Kant in his seminal work Zum ewigen Frieden. It is submitted in this article that Kant’s cosmopolitan right of hospitality, meant to guarantee interaction between the peoples of the world with a view to developing a shared universal conscience characterised by a desire for peace and prosperity, in essence informs the EU citizenship jurisprudence of the Court. We studied the impact of teachers’ ethical leadership on students’ moral identity and academic citizenship behaviors. Data from 256 student–teacher matching dyads were collected from one of the top 5 Pakistani business schools. Confirmatory factor analysis was used to ensure factorial validity of the measures that were employed, and the hypothesized relationships were tested using structural regression models that utilized structural equation modeling in AMOS with 5,000 bootstrap samples. Based on social learning theory, the results supported the hypothesis that teachers’ (...) ethical leadership had significant direct and indirect positive effects on the students’ academic citizenship behaviors that were directed toward other students and the school. This study contributes to existing literature on ethical leadership and organizational citizenship behavior by highlighting useful implications of these organization-based constructs in an academic context. Extant research indicates a positive and significant relationship between corporate ethical values and employees’ job performance. Furthermore, past studies have empirically demonstrated that perceived fairness moderates the influence of corporate ethical values on employee performance. In other words, high congruity between employees’ and an organization’s ethical values will result in superior employee performance outcome. This research aims to develop a broader perspective on the complex relationship between CEV and employee outcomes. The article will first examine the direct influence of CEV (...) on organizational citizenship behaviors and alienation from work, and then the moderating role of perceived fairness. The researcher found a significant direct effect of CEV on both OCBs and AFW, but that perceived fairness does not moderate these relationships. A key implication of findings of this research is that although perception of fairness may suppress the impact of organizational ethical transgressions on employee performance in the short run, as earlier studies have demonstrated, but in the long term, implications of perceived fairness are multifold. In this book Paul Dragos Aligica revisits the theory of political self-governance in the context of recent developments in behavioral economics and political philosophy that have challenged the foundations of this theory. Building on the work of the 'Bloomington School' created by Nobel Laureate Elinor Ostrom and Public Choice political economy co-founder Vincent Ostrom, Aligica presents a fresh conceptualization of the key processes at the core of democratic-liberal governance systems involving civic competence and public entrepreneurship. The result is not only (...) a re-assessment and re-articulation of the theories constructed by the Bloomington School of Public Choice, but also a new approach to several cutting-edge discussions relevant to governance studies and applied institutional theory, such as the debates generated by the recent waves of populism, paternalism and authoritarianism. Organisational leaders mismanaging business affairs are guided by performance pressures and/or greed while pressurising employees to follow. Unethical activities have led to stakeholder losses, with no accountability by individuals perpetuating the fraud. Corporate governance frameworks and subsequent reforms have been used merely as tick box measures, proving them inefficient in numerous corporate collapses. This study intends to explore and analyse the roles of personal and collective virtues in corporate citizenship. Developing from the virtues theory and using a mixed method of (...) three focus group discussions and a self-administered questionnaire of 119 participants from various organisations, the authors establish that personal virtues are important to portray ethical individualism. However, in a corporate setting, collective virtues are more important to enhance corporate citizenship, through ethical culture and collective accountability. (shrink)

Although foreign workers contribute to the economy and society, their lack of citizenship renders them unequal, vulnerable and exploitable. In this article, I suggest that the citizenship principle of jus domicile can address this aspect of inequality and exploitation experienced by migrant labour. In addition, I argue that the jus domicile principle should be combined with open borders. In making this argument, I draw on a dialectical methodology and a diverse literature on social justice and liberal political theory. The model (...) Recent discussions about global justice have focused on arguments that favor the inclusion of political and social rights within the set of human rights. By doing so, these discussions raise the issue of the existence of specific rights enjoyed exclusively by citizens of a given community. This article deals with the problem of distinguishing between human and citizen rights. Specifically, it proposes a new concept of citizen rights that is based on what I call ‘the stockholder principle’: a principle of (...) solidarity that holds within a specific country. This concept, the paper goes on to argue, is compatible with a broad idea of human rights defined by international law and enforced according to territorial authority. The stockholder principle is further compatible with the psychological concept of citizenship based on a specific collective identity and it leads to fair consequences at the domestic and global levels. Drawing from four Arendtian themes-plurality, the public realm, power, and perspective appreciation-I argue for citizenship as a "politics of enlarged mentality." This term suggests an alternative conception of citizenship that surpasses the limits of both the liberal and civic republican traditions. Unlike the masculinized liberal ideal of the citizen and contrary to the gendered universality that defines the civic republican traditions, a politics based on enlarged mentality combines context sensitivity with principled judgments.

In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Situated at the nexus of political/social theory, mental health law and jurisprudential ethics, (...) the book examines and critiques constructs such as offenders and victims; self and society; therapeutic and restorative; health; harm; and community. So, too, are three "total confinement" case law data sets on which this analysis is based. The volume stands alone in its efforts to systematically "diagnose" the moral reasoning lodged within prevailing judicial opinions that sustain captivity and risk management practices impacting: (1) the rights of juveniles found competent to stand criminal trial, the mentally ill placed in long-term disciplinary isolation, and sex offenders subjected to civil detention and community re-entry monitoring; (2) the often unmet needs of victims; and (3) the demands of an ordered society. Aiming to reduce the difficulty of managing and motivating knowledge workers, and promote the psychological well-being of them in Chinese hospitals, this study examines how k-workers’ leader–member exchange influences their task performance and the mediation effect of organizational citizenship behavior. Through a self-administered survey, valid questionnaires were collected from 384 k-workers in Chinese hospitals, and partial least squares structural equation modeling was employed for data analysis. The findings show that LMX is positively related to OCB and task performance, and that (...) OCB mediates the relationship between LMX and task performance. This research has theoretical implications and also provides practical suggestions on how to manage, motivate, and inspire k-workers, and promote the psychological well-being of them, and finally enhance the organizational performance in Chinese hospitals. When, on December 7, 2000, the European Parliament, the Council and the Commission proclaimed solemnly in Nice the Charter of Fundamental Rights of the European Union, many thought that European integration was practically guaranteed and that the Charter would soon be made into a binding legal text. Since then, the two attempts to enact a European consitution - the Constitutional Treaty for the European Union of 2004 and the arguably less ambitious Treaty of Lisbon of 2007 - both failed. Further (...) efforts at unification have stagnated, in part due to the 2008 economic crisis and the European Union’s inability to coordinate responses to issues as serious as immigration, the refugee crisis, and terrorism. In this paper, I examine a theoretical counterpoint to that bleak perspective for European unification, to wit, Jürgen Habermas’ eurofederalist proposal of the postnational democracy and European constitutional patriotism. The purpose of the article is to discuss the cultural hindrances and assets that promote constructive self-to-others relationships and active citizenship. Building on Carl Schmitt’s friend-enemy distinction, we argue that in contemporary societies the public and the private dimensions of the enemy have conflated, as the result of two concurrent phenomena: the politicization of otherness and the privatization of enemies. An integrated framework including approaches of social psychology and semiotic cultural psychology is proposed to account for both phenomena. Voting advice applications (VAAs) are interactive online tools designed to assist voters by improving the basis on which they decide how to vote. Current VAAs typically aim to do so by matching users’ policy-preferences with the positions of parties or candidates. But this ‘matching model’ depends crucially on implicit, contestable presuppositions about the proper functioning of the electoral process and about the forms of competence required for good citizenship—presuppositions associated with the social choice conception of democracy. This paper aims to (...) make those presuppositions explicit and to contrast them with two possible alternative perspectives on VAAs, associated with deliberative and agonistic conceptions of democracy and citizenship. In this paper, I take up Habermas’s recent writing on Rawls in Inclusion of the Other and focus on an example that Habermas discusses there, the Catholic stance on abortion. He brings in this example to question how such views could be rationally negotiated, under Rawls’s views of political liberalism, prior to arriving at an overlapping consensus. Habermas argues that Rawls must affirm the truth of moral constructivism in order to resolve the question of which conceptions of the good make (...) a valid claim on us. Though I have criticisms of how both Rawls and Habermas cast the issue of abortion, I argue that through properly understanding the role of the political ideal of citizenship in Rawls’s conception of political liberalism, we can find resources to contend with the problem Habermas finds here. I defend the capacity of political constructivism to resolve this issue without affirming the truth of moral constructivism. (shrink)

Islamic values are among the topics that are considered by people in an Islamic society in human and organisational life and paying attention to them can have positive consequences for the individual and the organisation. The purpose of this study is to investigate the effect of Islamic values on citizenship behaviours of Muslim citizens. The research is applied in terms of purpose and descriptive-survey in terms of nature and method. The statistical population of this research includes 2600 Muslim employees of (...) 45 manufacturing Indonesian organisations in 2021. The sample size was estimated to be 335 by simple random sampling. The data collection tool of this study is a questionnaire. The validity of questionnaire was confirmed by confirmatory factor analysis and reliability by Cronbach's alpha coefficient; further, data analysis was performed using linear structural relationships (LISREL) software. The results of structural equations modeling showed that Islamic values have a positive and significant effect on citizenship behaviours of Muslim citizens (p = 0.78; T-Value= 8.62). CONTRIBUTION: The results showed that paying attention to Islamic values in the organisation contributes to citizenship behaviours of people. Therefore, it is suggested that Islamic values be the basis of staff activities and employees who are more committed to these values in the organisation should be encouraged by the management of organisations. Philosophical discussion about citizenship has traditionally focused on the questions of what citizenship is, its relationship to civic virtue and political participation, and whether or not it can be meaningfully exercised at the supra-national level. In recent years, however, philosophers have turned their attention to the legal status attached to citizenship, and have questioned existing principles of citizenship allocation and withdrawal. With regard to the question of who is morally entitled to citizenship, philosophers have argued for principles of citizenship allocation (...) that go beyond birth and lineage, and have focused instead on the value of political attachment and located life plans. These principles have several advantages over existing legal principles, but they suffer from being under-specified, as well as being over and under-inclusive. With regard to loss of citizenship, philosophers have primarily denounced citizenship withdrawal as a form of punishment by appealing to principles of fair and equal treatment. However, theories purporting to show that denationalization is always wrong have trouble explaining why loss of citizenship is so problematic for persons who have committed the most horrendous crimes against their fellow citizens, and who, in so doing, have in effect self-excluded from the political community. Recent medical informatics and sociological literature has painted the image of a new type of patient—one that is reflexive and informed, with highly specified information needs and perceptions, as well as highly developed skills and tactics for acquiring information. Patients have been re-named “reflexive consumers.” At the same time, literature about the questionable reliability of web-based information has suggested the need to create both user tools that have pre-selected information and special guidelines for individuals to use to check the individual (...) characteristics of the information they encounter. In this article, we examine suggestions that individuals must be assisted in developing skills for “reflexive consumerism” and what these particular skills should be. Using two types of data (discursive data from websites and promotional items, and supplementary data from interviews and ethnographic observations carried out with those working to sustain these initiatives), we examine how users are directly addressed and discussed. We argue that these initiatives prescribe skills and practices that extend beyond finding and assessing information on the internet and demonstrate that they include ideals of consumerism and citizenship. This inevitably raises questions about the purpose and aims of education consistent with conceptions of democracy. These ultimately rest on the practical applicability and outcomes of competing visions of democracy without appeal to pre-political or prior goods, nor to certain knowledge (...) about justice or right; that is, to the dominant liberal discourse of citizenship that has become indistinguishable from the citizenship implicit in official policy documents. I argue in favour of a notion of citizenship conceived of in terms of learning processes that have a developmental and transformative impact on the learning subject, and an educational model that is more attuned to the procedural concerns of deliberative democracy than civics and citizenship education which tend to be underpinned by preconceptions of liberal citizenship, values and democracy. Do states have a right to exclude prospective immigrants as they see fit? According to statists the answer is a qualified yes. For these authors, self-determining political communities have a prima facie right to exclude, which can be overridden by the claims of vulnerable groups such as refugees and children born in the state’s territory. However, there is a concern in the literature that statists have not yet developed a theory that can protect children born in the territory from being (...) excluded from the political community. For if the self-determining political community has the right to decide who should form the self in the first place, then that right should count against both newcomers by immigration and newcomers by birth. Or so the concern goes. In this essay, I defend statism against this line of criticism and provide a liberal justification for the inclusion of children born within the state’s borders. My account leads to some surprising implication for citizenship law, as well as immigration arrangements in the area of asylum and unauthorized immigration. (shrink)

Over the last few years there has been a renewed interest in questions of citizenship and in particular its relation to young people. This has been allied to an educational discourse where the emphasis has been upon questions concerned with 'outcome' rather than with 'process' - with the curriculum and methods of teaching rather than questions of understanding and learning. This paper seeks to describe and illuminate the linkages within and between these related discourses. It advocates an inclusive and relational (...) view of citizenship-as-practice within a distinctive socio-economic and political, and cultural milieu. Drawing upon some empirical insights from our research we conclude that an appropriate educational programme would respect the claim to citizenship status of everyone in society, including children and young people. It would work together with young people rather than on young people, and recognise that the actual practices of citizenship, and the ways in which these practices transform over time are educationally significant. This paper addresses the teaching of citizenship in schools and focuses on the monarchy as an example of one issue often ignored within curriculum discourse. We argue that to conflate subjecthood and citizenship in unacknowledged ways may serve to perpetuate the status quo and is potentially unhelpful to the development of young people's critical thinking.

This article examines changing modalities of citizenship in a fast-moving, informationalized and connected world. The argument here is that, in an increasingly globalized economic, social and cultural environment, forms and practices of citizenship inevitably – and increasingly – fragment across space and time. While this tendency for citizenship to ‘shape-shift’ politically and socially is not new – and indeed while the spatial fragmentation of belonging has been frequently commented upon, particularly in relation to the claimed decline of the bordered nation-state (...) – the dimension of time in relationship to citizenship has been rather less well explored. By examining the interplay of space and time in contemporary citizenship, understood here in terms of civic and political engagement, identity and belonging, it becomes possible to understand how citizenship practices operate differentially according to degrees of spatial embeddedness, on the one hand, and degrees of temporal ‘thickness’, on the other. The article discusses some of the major issues which need to be examined in a gendered reading of citizenship. However, its basic claim is that a comparative study of citizenship should consider the issue of women's citizenship not only by contrast to that of men, but also in relation to women's affiliation to dominant or subordinate groups, their ethnicity, origin and urban or rural residence. It should also take into consideration global and transnational positionings of these citizenships. The article challenges (...) the gender-blind and Westocentric character of many of the most hegemonic theorizations of citizenship, focusing in particular on the questions of membership in ‘the community’, group rights and social difference and the ways binaries of public/private and active/passive have been constructed to differentiate between different kinds of citizenships. The article argues that in order to be able to analyse adequately people's citizenship, especially in this era of ethnicization on the one hand and globalization on the other hand, and with the rapid pace at which relationships between states and their civil societies are changing, citizenship should best be analysed as a multi-tiered construct which applies, at the same time to people's membership in sub-, cross- and supra-national collectivities as well as in states. Schools in liberal societies are responsible for producing liberal citizens. However, if they have too robust a view of citizenship, they may find themselves undermining the view of good lives held by many pacific and law abiding groups. Here I argue against treating citizenship as an educational good that simply trumps private values when they conflict and in favor of a view that seeks a context sensitive balance between such conflicting goods. In this article Julian Culp offers a new conceptualization of democratic citizenship education in light of the transformations of contemporary Western societies to which the use of digital technologies has contributed. His conceptualization adopts a deliberative understanding of democracy that provides a systemic perspective on society-wide communicative arrangements and employs a nonideal, critical methodology that concentrates on overcoming democratic deficits. Based on this systemic, deliberative conception of democracy, Culp provides an analysis of the public sphere's normative deficits and argues that (...) current political communication may be systemically distorted. Drawing on this analysis, he suggests that practices of democratic citizenship education in digitized societies must not concentrate narrowly on the effective and responsible use of digital technologies. Instead, these practices should also focus on the economic and cultural conditions that are co-responsible for the structural problems of political communication as well as address the democratic deficits that are reflected in inadequate communicative arrangements. Present study sheds more light on the conceptualization of citizenship and civic engagement among majority and minority youth. In order to understand the meanings of citizenship, fourteen focus groups were conducted with young people aged 16–26, with both civically engaged and disengaged young ethnic Czechs, Roma, and Ukrainians. Results suggest that young people understand the citizenship as having multiple dimensions (legal and personal, and in terms of rights and responsibilities) and civic engagement as being focused on various aspects. Citizenship education in established democracies is challenged by declining youth participation in democracy. Youth disenchantment and disengagement in democracy is primarily evident in formal political behaviour, especially through voting, declining membership of political parties, assisting at elections, contacting politicians, and the like. If citizenship education is to play a major role in addressing these concerns it will need to review the impact it is making on young people in schools. This paper reviews a major national project on youth participation in (...) democracy in Australia set in the context of a national citizenship education programme. The Youth Electoral Study found that citizenship education in Australian schools has at best been marginally successful and substantially more is required to raise levels of democratic engagement. The paper explores many opportunities available to education systems and schools to address these issues through reconceptualising aspects of the formal and the informal curriculum. (shrink)

When can or should citizenship be granted to prospective members of states? When can or should states withdraw citizenship from their existing members? In recent decades, political philosophers have paid considerable attention to the first question, but have generally neglected the second. There are of course good practical reasons for prioritizing the question of when citizenship should be granted—many individuals have a strong interest in acquiring citizenship in particular political communities, while many fewer are at risk of denationalization. Still, loss (...) of membership in a political community is a practice with a long history that continues to take place today. -/- Concerns about national security have recently led several liberal democratic states to pass, strengthen or consider legislation that would empower their governments to denationalize certain persons.] At the international level, formal norms governing denationalization are vague and generally toothless, and there are no international legal norms that restrict denationalization to citizens who hold another citizenship or wish to take up citizenship elsewhere (Worster, 2009). So it is important to determine whether there are conditions under which denationalization can be morally justified and, if so, what those conditions are. We shall argue that while denationalization is ordinarily impermissible, there is a class of crime committed by citizens that may render it not only permissible, but a fitting response on the part of the state. In this paper I examine the meaning of birth in the work of Agamben, Esposito, and Derrida, paying particular attention to how it operates in their analyses of citizenship and national belonging. I show that Agamben views birth as negative, Esposito proposes a positive conception, and Derrida's writings imply an understanding that is ambivalent. Then, by focusing on the phenomenon of multiple citizenship, I argue for the value of the Derridean view.

Commercial companies are increasingly being recognized as agents of societal governance operating alongside the public authorities in their traditional role as governance bodies. In addition, companies are claiming to be ‘corporate citizens’ in the way they deal with their environmental, employment and social/ethical responsibilities. Given the fact that large corporations are now heavily internationalized in their operational characteristics – with branches, subsidiaries, affiliates and extended supply chains operating in multiple jurisdictions – can such organizations be brought into a democratic register? (...) Citizenship and democracy are conventionally associated with a territorial state, national sovereignty and jurisdictional independence. So, how can internationalized companies be subject to democratic forms of governance? An added problem arises with platform companies and blockchain organized digital currency providers whose operations transcend national borders from the start. This contribution discusses the issues of and provides a way for considering corporate democracy afresh in these rapidly evolving contexts. (shrink)

In ethical theory, different concepts of autonomy can be distinguished. In this article we explore how these concepts of autonomy are combined in theory in the citizenship paradigm, and how this turns out in the practice of care for people with acquired brain injury. The stories of a professional caregiver and a client with acquired brain injury show that the combination of various concepts of autonomy in practice leads to tensions between caregivers and clients. These dynamics are discussed from a (...) care ethics perspective, stressing the importance of relationships and interdependence, as well as paying attention to various, sometimes conflicting, perspectives in a deliberative dialogue. One need not look far beyond the titles and distinctive phrases to find a deep and abiding concern for civic virtue in John Rawls’ writings. This chapter provides the necessary account of civic virtue and Rawls's conception of it. For this, it relies most heavily on Rawls's last book, Justice as Fairness: A Restatement. The importance of concepts of citizenship and civility is more evident in Justice as Fairness, than in Rawls's other books. According to Rawls, the most‐advantaged members of (...) a just society would demonstrate their commitment to public culture by inhibiting the wastes of endless self‐ and group‐interested bargaining and offering some hope of realizing social concord and civic friendship. Beyond encouraging civic engagement, Rawls's “political liberalism” has many points of contact with the republican tradition. One such point of contact arises when he indicates the importance to a well‐ordered society of civic education. (shrink)
