The first comprehensive analysis of the philosophical issues raised by the hijab controversy in France, this book also conducts a dialogue between contemporary Anglo-American and French political theory and defends a progressive republican solution to so-called multicultural conflicts in contemporary societies. It critically assesses the official republican philosophy of laïcité which purported to justify the 2004 ban on religious signs in schools. Laïcité is shown to encompass a comprehensive theory of republican citizenship, centered on three ideals: equality (secular neutrality of (...) the public sphere), liberty (individual autonomy and emancipation) and fraternity (civic loyalty to the community of citizens). Challenging official interpretations of laïcité, the book then puts forward a critical republicanism which does not support the hijab ban, yet upholds a revised interpretation of three central republican commitments: secularism, non-domination and civic solidarity. Thus, it articulates a version of secularism which squarely addresses the problem of status quo bias - the fact that Western societies are historically not neutral towards all religions. It also defends a vision of female emancipation which rejects the coercive paternalism inherent in the regulation of religious dress, yet does not leave individuals unaided in the face of religious and secular, patriarchal and ethnocentric domination. Finally, the book outlines a theory of immigrant integration which places the burden of civic integration on basic socio-political institutions, rather than on citizens themselves. Critical republicanism proposes an entirely new approach to the management of religious and cultural pluralism, centred on the pursuit of the progressive ideal of non-domination in existing, non-ideal societies. This book articulates a cosmopolitan theory of the principles which ought to regulate belligerents' conduct in the aftermath of war. Throughout, it relies on the fundamental principle that all human beings, wherever they reside, have rights to the freedoms and resources which they need to lead a flourishing life, and that national and political borders are largely irrelevant to the conferral of those rights. With that principle in hand, the book provides a normative defence of restitutive and reparative justice, the (...) punishment of war criminals, the resort to transitional foreign administration as a means to govern war-torn territories, and the deployment of peacekeeping and occupation forces. It also outlines various reconciliatory and commemorative practices which might facilitate the emergence of trust amongst enemies and thereby improve prospects for peace. Should religion be singled out in the law? This Article evaluates two influential theories of freedom of religion in political theory, before introducing an alternative one. The first approach, the Substitution approach, argues that freedom of religion can be adequately expressed by a substitute category: typically, freedom of conscience. The second, the Proxy approach, argues that the notion of religion should be upheld in the law, albeit as a proxy for a range of different goods. After showing that neither approach (...) adequately meets crucial desiderata for an inclusive theory of religious freedom, the Article sets out the Disaggregation approach and defends against the alternatives. Egalitarian theories of religious freedom deny that religion is entitled to special treatment in law above and beyond that granted to comparable beliefs and practices. The most detailed and influential defense of such an approach is Christopher Eisgruber and Lawrence Sager's Religious Freedom and the Constitution (2007). In this essay I develop, elucidate, and show the limits of the strategy adopted by Eisgruber and Sager. The strategy requires that religion be analogized with other beliefs and practices according to a robust (...) metric of comparison. I argue that Eisgruber and Sager fail to develop a consistent and coherent metric and I further suggest that this failure is symptomatic of the broader difficulty encountered by liberal theory in fitting the concept of religious freedom into a broadly egalitarian framework. In Aristotle's Ethics as First Philosophy Claudia Baracchi demonstrates the indissoluble links between practical and theoretical wisdom in Aristotle's thinking. Referring to a broad range of texts from the Aristotelian corpus, Baracchi shows how the theoretical is always informed by a set of practices, and specifically, how one's encounter with phenomena, the world, or nature in the broadest sense, is always a matter of ethos. Such a 'modern' intimation can, thus, be found at the heart of Greek thought. Baracchi's (...) book opens the way for a comprehensively reconfigured approach to classical Greek philosophy. (shrink)

In this paper I expose and criticise the distinction between pure indexicals and demonstratives, held by David Kaplan and John Perry. I oppose the context of material production of the utterance to the “intended context” (the context of interpretation, i.e. the context the speaker indicates as semantically relevant): this opposition introduces an intentional feature into the interpretation of pure indexicals. As far as the indexical I is concerned, I maintain that we must distinguish between the material producer of the utterance (...) containing I and the “intended agent of the context” - i.e. the individual designated by the material producer as the responsible for the utterance. In this contribution to philosophical ethics, Claudia Card revisits the theory of evil developed in her earlier book The Atrocity Paradigm, and expands it to consider collectively perpetrated and collectively suffered atrocities. Redefining evil as a secular concept and focusing on the inexcusability - rather than the culpability - of atrocities, Card examines the tension between responding to evils and preserving humanitarian values. This stimulating and often provocative book contends that understanding the evils in terrorism, torture and genocide enables (...) us to recognise similar evils in everyday life: daily life under oppressive regimes and in racist environments; violence against women, including in the home; violence and executions in prisons; hate crimes; and violence against animals. Card analyses torture, terrorism and genocide in the light of recent atrocities, considering whether there can be moral justifications for terrorism and torture, and providing conceptual tools to distinguish genocide from non-genocidal mass slaughter. In the present interview, Jürgen Habermas answers questions about his wide-ranging work in philosophy and social theory, as well as concerning current social and political developments to whose understanding he has made important theoretical contributions. Among the aspects of his work addressed are his conception of communicative rationality as a countervailing force to the colonization of the lifeworld by capitalism and his understanding of philosophy after Hegel as postmetaphysical thinking, for which he has recently provided a comprehensive historical grounding. The mental representation of one’s own body does not necessarily correspond to the physical body. For instance, a dissociation between perceived and actual reach-ability has been shown, that is, individuals perceive that they can reach objects that are out of grasp. We presented participants with 3D pictures of objects located at four different distances, namely near-reaching space, actual-reaching space, perceived-reaching space and non-reaching space. Immediately after they were presented with function, manipulation, observation or pointing verbs and were required to judge (...) if the verb was compatible with the object.Participants were faster with function and manipulation verbs than with observation and pointing verbs. Strikingly, with both function and manipulation verbs participants were faster when objects were presented in actual than the perceived reaching space. These findings suggest that our knowledge of the world is implicitly built online through behaviour, and is not necessarily reflected in explicit estimates or conscious representations. (shrink)

The book theoretically examines the recent and topical debates over democracy and social rights, arguing that there are four fundamental rights that should be constitutionalized; minimum income; housing; healthcare; and education. The theoretical discussion is explored within an analysis of important legal cases.

Sculptors, architects, and painters are three professional groups that require a comprehensive understanding of how to manipulate spatial structures. While it has been speculated that they may differ in the way they conceive of space due to the different professional demands, this has not been empirically tested. To achieve this, we asked architects, painters, sculptors, and a control group questions about spatially complex pictures. Verbalizations elicited were examined using cognitive discourse analysis. We found significant differences between each group. Only painters (...) shifted consistently between 2D and 3D concepts, architects were concerned with paths and spatial physical boundedness, and sculptors produced responses that fell between architects and painters. All three differed from controls, whose verbalizations were generally less elaborate and detailed. Thus, for the case of sculptors, architects, and painters, profession appears to relate to a different spatial conceptualization manifested through a systematically contrasting way of talking about space. This article asks whether discrimination law should be symmetrical: whether it should offer the same level of protection to dominant and dominated groups. It articulates a structural inequality theory of the moral foundations of discrimination law and defends it against prominent alternatives, such as the view that discrimination is wrong because it is irrational or disrespectful. The paper then argues that while direct discrimination is symmetrical, indirect discrimination is asymmetrical. It cannot be claimed by those – men, or white persons (...) – who are not at the sharp end of structural inequality. Furthermore, even dominated groups cannot claim to be indirectly discriminated against by just any law that has a disparate impact on them. If the structural inequality view is correct, the protectorate of discrimination law is not as extensive as is commonly assumed. (shrink)

Although emotions play a crucial role in understanding and encouraging sustainable behavior and decision-making, many open questions currently remain unanswered. In this review, we advance three broad areas of particular theoretical and applied importance that affective science and emotion researchers could benefit from engaging with: (1) “ sustainable emotions” or empirically testing the possibility of positive reinforcing feedback loops between anticipatory and experienced emotions following the adoption of sustainable behaviors, (2) “ non- Western emotions” or exploring the extent to which (...) people's understanding and experience of climate-relevant emotions differs across non-WEIRD populations, and (3) “ impactful emotions” or the need to carefully differentiate the conceptual and empirical role of emotions in encouraging the adoption of low-impact (e.g., recycling) versus high-impact (e.g., flying less) environmental behaviors. The literature on reparative justice focuses for the most part on the grounds and limits of wrongdoers’ duties to their victims. An interesting but relatively neglected question is that of what – if anything – victims owe to wrongdoers. In this paper, I argue that victims are under a duty to accept wrongdoers’ apologies. I claim that to accept an apology is to form the belief that the wrongdoer’s apologetic utterance or gesture has the requisite verdictive, commissive and expressive dimensions; (...) to communicate as much to him; and to recognise that his apology changes one’s normative status in relation to him, and to comport oneself accordingly. I then offer a Kantian argument for the duty to accept and qualify that argument in the light of some hard cases. I end the paper by addressing the objection that victims do not owe it to wrongdoers to engage in any form of reparative encounter. (shrink)

Many believe that agent-centred considerations, unlike agent-neutral reasons, cannot show that victims have the right to kill their attackers in self-defence, let alone establish that rescuers have the right to come to their help. In this paper, I argue that the right to kill in self- or other-defence is best supported by a hybrid set of reasons. In particular, agent-centred considerations account for the plausible intuition that victims have a special stake, which other parties lack, in being to thwart the (...) attackers. That special stake plays an important part justifying victims' right to obtain help, and rescuers' right to give it. (shrink)

Recent decades have seen a dramatic transformation in the mode of governing, with government increasingly outsourced to a network of private actors, spanning education, prisons, regulation, arbitration, the military, and access to healthcare and welfare. Chiara Cordelli’s The Privatized State probes the ethical and philosophical questions raised by this transformation, and develops a distinctive account of the wrong of privatization: that a privatized government cannot be a legitimate government. In so doing, Cordelli engages and advances not only pressing questions about (...) privatization, but also broader questions about public administration, political representation, democratic authority, and neorepublicanism. This symposium brings together scholars for a wide-ranging discussion of this transformation in governance and the deep and challenging questions it raises. (shrink)

Seulement, nous rencontrons ici un paradoxe, car c’est aussi l’ingénuité technique qui est chargée de surmonter la crise écologique. Dans (...) le présent texte, nous tenterons de dénouer ce paradoxe par le biais des Deux leçons sur l’animal et l’homme de Gilbert Simondon, en revenant sur deux motifs qui s’opposent seulement en apparence : d’un côté, la vision démiurgique de l’homme comme grand artisan, ancrée dans le mythe platonicien du Timée, et de l’autre, la vision axiologique et éthique de l’homme, rendue emblématique par le sermon aux oiseaux de Saint François d’Assise. L’importance de la légende de Saint François d’Assise pour le canon apocalyptique du xiii ème siècle nous permettra de relier cette vision éthique au mythe platonicien, nous amenant, au final, à suggérer une alternative aux visions apocalyptiques de l’Anthropocène, appuyée sur l’originalité de la conception de la nature dans la pensée simondonienne. ». In Friendship, Italian philosopher Claudia Baracchi explores the philosophical underpinnings of friendship. Tackling the issue of friendship in the era of Facebook and online social networks requires courage and even a certain impertinence. The friendship relationship involves trust, fidelity, and availability for profound sharing. Sociologists assure us this attitude was never more improbable than in our time of dramatic anthropological reconfiguration. Research on friendship cannot therefore ignore ancient thought: with unparalleled depth, Friendship examines the broader implications of relationship, both (...) emotional and political. Today, the grand socio-political structures of the world are trembling. The hold of valued paradigms that traditionally positioned individuals, determined their destinies, and assigned them their roles and reciprocal responsibilities is becoming uncertain. In these many global shifts, previously unforeseen possibilities for individual and collective becoming are unleashed. Perhaps friendship has to do with worlds that are not: that are not yet, and that should be desired all the more. Focusing on the works of Aristotle, Baracchi explores ancient reflections on friendship, in the belief that they have much to teach us about our relationships in the present day. (shrink)

This article presents the results of a journey into the work of French philosopher Simone Weil, Oppression and liberty and The Need for roots, in order to identify the conditions and limits to the implementation of freedom of expression. This research project aims at identifying the ethical foundations of freedom of expression in a contemporary context where globalization, the media and social networks facilitate a fast dissemination of numerous individual and collective expressions, while the law cannot discern when to privilege (...) freedom of expression over other human rights. The result of our analysis of Weil notions of “need of the soul” and “obligations towards human being” enable to understand why freedom of expression is individual and not collective and under which conditions it should be protected: as an essential need of our intelligence, rooted in every human being, that must be respected absolutely at an individual level. This principle also makes it possible to legitimize the limitation of certain collective expressions conveyed by organizations, in their external and internal communication, and the authorization of the individual voice of certain stakeholders when they speak out in favor of justice and truth. The contributors to this Special Issue all suggest that Christianity is compatible with political liberalism. In this paper, I first illuminate the grounds of this compatibility. I then focus on one distinctive—yet unexplored—premise of the compatibility argument. This is the thought that religious and secular reasons are essentially on a par, in terms of their contribution to public reasoning. I critically examine Christopher Eberle’s claim that, as their epistemological status is equivalent, both secular and religious reasons may play a decisive (...) role in justifying coercion-related state policies, including in contexts of war. Basing its understanding on the two uses of the notion of violence in Honneth’s theory of recognition, this paper aims at developing a framework for the analysis of the thesis of the moral justification of political violence, whenever forms of political violence can be defined as legitimate struggles of recognition. Its contention is that the requalification of some forms of collective violence as recognition conflicts makes it possible to establish a hierarchy of justification for forms of violence which cannot be (...) constructed through a priori criteria, but should rather be the result of a descriptive social philosophy enquiry. By reference to the Aristotelian meditation, this essay undertakes to articulate an understanding of phronesis and sophia, praxis and theoria, in their belonging together. In so doing, it strives to overcome the traditional opposition of these terms, an opposition preserved even by those thinkers, such as Gadamer and Arendt, who have emphasized the practical over against the theoretical simply by inverting the order of the hierarchy.What is at stake, ultimately, is thinking ethics as first philosophy, i.e., seeing the philosophical articulation (...) of scientific knowledge, even of ontology, as resting on (belonging in) living-in-action, as phenomenologically, phenomenally, sensibly grounded. Of course, “ethics as first philosophy” here can mean neither a normative-prescriptive compilation nor a self-founding, autonomous discourse. Rather, the phrase names the comprehensiveness of ethics vis-à-vis all mannerof human endeavor and the openness of ethics vis-à-vis that which exceeds it, that which is irreducible to discourse and in which the ethical discourse belongs. Esto podría dar lugar a pensar que, en esta obra, se opera una transformación del modo en que el autor concibe la causalidad general, ya que, en las primeras dos Críticas, existe una tendencia a identificar el principio mecanicista con el principio de la segunda analogía de la experiencia. En este trabajo, intentaré mostrar que la presentación del principio que Kant hace en la (...) tercera Crítica es totalmente coherente con las tesis que desarrolla en sus otras obras, y que no supone otra modificación de su teoría más que aquella que surge de dirigir la atención sobre el operar de la facultad de juzgar reflexionante y sobre los problemas con los que este operar se relaciona.
