Conwy Lloyd Morgan (1852–1936) is widely regarded as the father of modern comparative psychology. Yet, Morgan initially had significant doubts about whether a genuine science of comparative psychology was even possible, only later becoming more optimistic about our ability to make reliable inferences about the mental capacities of non-human animals. There has been a fair amount of disagreement amongst scholars of Morgan’s work about the nature, timing, and causes of this shift in Morgan’s thinking. We argue that Morgan underwent two (...) quite different shifts of attitude towards the proper practice of comparative psychology. The first was a qualified acceptance of the Romanesian approach to comparative psychology that he had initially criticized. The second was a shift away from Romanes’ reliance on systematizing anecdotal evidence of animal intelligence towards an experimental approach, focused on studying the development of behaviour. We emphasize the role of Morgan’s evolving epistemological views in bringing about the first shift – in particular, his philosophy of science. We emphasize the role of an intriguing but overlooked figure in the history of comparative psychology in explaining the second shift, T. Mann Jones, whose correspondence with Morgan provided an important catalyst for Morgan’s experimental turn, particularly the special focus on development. We also shed light on the intended function of Morgan’s Canon, the methodological principle for which Morgan is now mostly known. The Canon can only be properly understood by seeing it in the context of Morgan’s own unique experimental vision for comparative psychology. (shrink)

“D-linked” wh-phrases such as 'which car' are known to increase the acceptability of sentences with island violations. One influential account of this attributes the effect to working memory: the D-linked filler is easier to retrieve at the site of the gap and this leads to the amelioration in acceptability. Such an account predicts that this effect should occur in general with non-trivial wh-dependencies, not just in island environments. An experiment is presented here to test this prediction. Wh-questions with both D-linked (...) and bare wh-phrases and with both island and non-island embedded clauses are presented to participants, who rate their acceptability on a 7-point scale. Results show that D-linking significantly increases acceptability in both island and non-island environments, in accord with analyses that attribute the effect to working memory. In addition, the increase in acceptability is uniform in both types of environments, suggesting that the island effect itself may not be attributable to working memory. (shrink)

This paper discusses the puzzle of blackmail, i.e. the way in which the threat of an otherwise legally permissible action can in some cases constitute blackmail. It argues that the key to understanding blackmail is in terms of coercion and threats, and the effect such threats have on the validity of a victim’s consent. The nature of coercion and of coercive threats is considered in detail to support the thesis that threats are prima facie impermissible, though often justified all-things-considered. The developmental properties of organisms play important roles in the generation of variation necessary for evolutionary change. But how can individual development steer the course of evolution? To answer this question, we introduce developmental channeling as a disposition of individual organisms that shapes their possible developmental trajectories and evolutionary dappling as an evolutionary outcome in which the space of possible organismic forms is dappled—it is only partially filled. We are moral equals, but in virtue of what? The most plausible answers to this question have pointed to our higher agential capacities, but we vary in the degrees to which we possess those capacities. How could they ground our equal moral standing, then? This chapter argues that they do so only indirectly. Our moral equality is most directly grounded in a social practice of equality, a practice that serves the purpose of mitigating our tendencies toward control and domination that (...) interpreters of Rousseau call “inflamed amour-propre.” We qualify as participants in this practice of equality by possessing certain agential capacities, but it is our participation in the practice, and not the capacities themselves, that makes us moral equals. This chapter thus proposes moving from a capacity-based to practice-based view of moral equality. Doing so avoids problems for other accounts that, like the one defended here, ignore (above a threshold) the varying degrees to which we possess the pertinent agential capacities, such as Ian Carter’s account of “opacity respect.”​. This essay explores the intersection of racism, racial embodiment theory and the recent hostility aimed at immigrants and foreigners in the United States, especially the targeting of people of Latin American descent and Latino/as. Anti-immigrant and anti-foreigner sentiment is racist. It is the embodiment of racial privilege for those who wield it and the materiality of racial difference for those it is used against. This manifestation of racial privilege and difference rests upon a redrawing of the color line that is (...) meant towards preserving exclusive categories of political membership. The charge of racism, however, is elided by the fact that this hostility takes the form of a specious embracement of law and lawfulness. “Illegal” in this sense not only captures the actions of those who enter the United States through clandestine or informal means, but, in light of the history of immigration and citizen- ship law, the term operates as a racial trope that designates non-white status, thus marginalizing and alienating certain immigrants from ongoing nation-formation processes. I explain the source for anti-immigrant hostility in the United States, which I take to be connected to the longevity of white normativity as the basis for American identity. I then critically assess how the idea of national belonging is crucial to the perpetuation of white-ways-of-being, especially when citizenship has historically been a venue for the embodiment of racial and even colonial privilege. I conclude by posing several questions about the nature of racial identities and racism that suggest new avenues for further research on racial embodiment in a “postracial” era. pp. 65–90. (shrink)

To deserve credit for doing what is morally right, we must act from the right kinds of motives. Acting from the right kinds of motives involves responding both to the morally relevant reasons, by acting on these considerations, and to the morally relevant individuals, by being guided by appropriate attitudes of regard for them. Recent theories of the right kinds of motives have tended to prioritize responding to moral reasons. I develop a theory that instead prioritizes responding to individuals (through (...) appropriate attitudes of regard for them) and argue that it better accounts for the basic features of the right kinds of motives – what we most fundamentally care about in judging whether persons deserve moral credit. This study examines the impact of corporate tax avoidance on board of directors and chief executive officer reputation. Our regression results show that when firms engage in tax avoidance, both directors and CEOs, on average, are rewarded by improvements in their reputations as proxied by an increased number of outside board seats. In particular, both independent directors and non-CEO executive directors undergo positive changes in reputation. We also find that CEOs of tax-aggressive firms experience enhanced reputations by gaining extra board (...) seats. Our main regression results hold based on additional analyses. Overall, this study provides important empirical evidence confirming an association between tax avoidance and the individual reputations of directors and CEOs. (shrink)

This article discusses the nature of persuasive authorities in the common law, and argues that many of them are best understood in terms of their (being regarded) as having theoretical rather than practical authorities for the courts that cite them. The contrast between theoretical and practical authority is examined at length in order to support the view that the treatment of many persuasive authorities by courts is more consistent with this view. Finally, it is argued that if persuasive authorities are (...) best understood as theoretical authorities, this raises difficulties for both positivistic and interpretivist theories of law. (shrink)

In a recent paper, Nicholas Stang argues that artworks are not valuable for their own sake in virtue of their artistic value, artworks have artistic value in virtue of the final value of the experiences they afford, and the only appropriate objects of appreciation are worktypes. All of these arguments rest on claims about the artistic value of copies of artworks that provide a radical challenge to the views that many philosophers have about copies. Here I argue that Stang's arguments (...) are unsuccessful. The argument for is mistaken about what one is committed to if one thinks artworks are valuable for their own sake in virtue of their artistic value. The defense of fails to explain what it is supposed to explain. The argument for overgeneralizes from one kind of case. Finally, the basic claim Stang makes about the artistic value of copies is false. I defend an alternative view. I conclude by discussing the implications of my arguments for experientialism ). Reflection on the cases Stang considers, far from leading us to embrace experientialism, in fact reveals problems that experientialists need to confront. (shrink)

There is a puzzle about the very possibility of foreseen but unintended side effects, and solving this puzzle requires us to revise our basic picture of the structure of practical deliberation. The puzzle is that, while it seems that we can rationally foresee, but not intend, bringing about foreseen side effects, it also seems that we rationally must decide to bring about foreseen side effects and that we intend to do whatever we decide to do. I propose solving this puzzle (...) by rejecting the idea that we intend to do whatever we decide to do. My solution involves taking account of the underappreciated role that qualified intentions play in deliberation. I also argue that this solution fares better than those that instead reject the idea that we rationally must decide to bring about foreseen side effects, for these solutions are committed to rejecting the even more compelling idea that decisions rationally serve as the conclusions of practical deliberation. In this paper, we distinguish two different approaches to cultural evolution. One approach is meme-centered, the other organism-centered. We argue that in situations in which the meme- and organism-centered approaches are competing alternatives, the organism-centered approach is in many ways superior. Furthermore, the organism-centered approach can go a long way toward understanding the evolution of institutions. Although the organism-centered approach is preferable for a broad class of situations, we do leave room for super-organismic or sub-organismic explanations of some cultural phenomena.

In response to concern over the numeracy skills deficit displayed by student nurses, an online computer programme, ?Authentic World??, which aims to simulate a real-life clinical environment and improve the medication dosage calculation skills of users, was developed (Founded in 2004 Authentic World Ltd is a spin out company of Glarmorgan and Cardiff Universities, Cardiff, Wales UK.). Two randomised controlled trials were conducted, each at a UK University, in order to investigate the impact of Authentic World? on student nurses? general (...) numeracy abilities. All first year nursing students who gave consent were randomised equally into an intervention or control group. The intervention group were given access to Authentic World?. The primary outcome measure was the students? scores on a general numeracy test. The Intention to Treat (ITT) analysis in both trials revealed a small negative effect of Authentic World? on general numeracy, which was statistically significant in one trial. However, compliance with the intervention was very low in both trials, with only 24 and 12% of students allocated to the intervention groups spending more than 15 minutes using the programme. Providing nursing students with access to Authentic World? is not an effective use of resources since use of the programme appears to be very low. (shrink)

Precedent is a central feature of legal practice, requiring courts to follow decisions reached in earlier cases, thereby transforming the decisions in individual cases into a source of law. This article examines two major questions associated with precedent: (a) how to characterise the way that precedent operates as a source of law; and (b) how to justify the requirement that courts follow earlier decisions regardless of the merits of those decisions. Precedents are often thought to create general legal rules, but (...) it is controversial whether this is the best way to understand their role in legal reasoning. Equally, it is unclear that the most common justifications for precedent unequivocally vindicate the practice. (shrink)

The ideal of relating as equals is, in part, an ideal of virtue – the attitudes and dispositions that support social relations of equality. These are standardly taken to involve accepting the Equal Authority of other persons, giving other persons Equal Consideration, and treating the interests of other persons as having Equal Importance. But why does relational equality involve these attitudes and dispositions, and what exactly do they entail? I aim to make progress on answering these questions by focusing on (...) adult autonomy, using the workplace as an apt setting for exploring the resulting autonomy-focused conception of relational egalitarian virtue. I first consider and reject an interest- focused conception of relational egalitarian virtue, which treats Equal Importance as central. This view allows for a paternalistic stance that is incompatible with social relations of equality. I then develop an autonomy-focused view that treats Equal Authority as central, what I call the “Authority-Centered Relational Egalitarian” virtue (ACRE). ACRE avoids the paternalistic implications of the interest-focused view. I conclude by exploring how managers can sustain and enact ACRE in exercising organizational authority over employees. In the Letter to the Galatians, Paul and Peter seem like rivals when Paul recounts "opposing Peter to his face" (Gal. 2:11). The key theological discoveries in the fourth and fifth century are mostly borne of rivalry: (...) Eunomius versus the Cappadocians, and Pelagius versus Augustine. The Middle Ages contain the Eucharistic controversies between Pascasius and Ratramnus, and later controversies about the nature of authority in the theology between Abelard and Lombard. By the sixteenth century, not only the history of theology but the history of the Western churches seems to be intertwined with rivalry, with the Protestant Reformation being the most obvious example. One could also tell the history of religious orders as a history of rivalries between, among others, Franciscans and Dominicans, and later Jesuits. The teachings on justification arose from rivalries, and most of modern Catholic ecclesiology arose from Bellarmine's disputatious interactions with leading Lutherans like Flacius [End Page 163] and Chemnitz. In the past century, much of the theological terrain seems to be shaped by disputes between figures who had once been aligned: Barth and Brunner, Balthasar and Rahner, Cone and Jones.In retrospect, the nineteenth century seemed primed for theological rivalry. Due to social, political, and institutional factors, the nineteenth century was profoundly destabilizing for theology, particularly in Germany, where political realignment threatened to unsettle whatever truce had emerged after the conclusion of the Thirty Years' War in 1648. A number of factors contributed to this climate; perhaps foremost among them was the rapid expansion of academic journals. Without being in the same room, scholars could argue and respond to one another in what must have felt like "real time." Journals, to put it crudely, were the online comment section of their day, and they provided a new medium for theological dispute. Although public debate still figured prominently in the sixteenth century, even as the printing press was making it less central to theological argument, in the nineteenth century, one could escalate debate through asynchronous modes of communication.Both political destabilization and technological innovation made possible a range of intraconfessional disputes: among both Protestants—between mediating and confessing, Kantian and Hegelian, authoritarian, and scientific theologies—and Catholics—between scholastic and modern, German and Roman, Gallican and ultramontanist theologies. These circumstances also occasioned a redoubling of confessional identity. Olaf Blaschke has described the nineteenth century as a "second confessional age."1 By this he means that the nineteenth century, on the scale of confessional identity, looked more like the sixteenth century than the eighteenth did; instead of manifesting an increase in secularizing and nationalizing forces that downplayed religious identities, the nineteenth, according to a variety of measures, witnessed an upsurge in confessional identity.2 This upsurge affected Württemberg, the primarily Protestant territory in the southwestern part of Germany, where Tübingen was located. The newly constituted Württemberg combined a number of tiny, mono-confessional states into a larger, multi-confessional state as part of the reconfigurations brought about by Napoleon. Practically, this meant a loss in political autonomy for Catholic areas within Württemberg.According to one account, the confessional conflicts that memorably marked the 1870s (the Kulturkampf) and also the 1830s and 1840s (the Cologne Troubles and the Kniebeugungsstreiten) were already on the increase in the 1810s in Württemberg, in part due to the massive anniversary celebrations (Wartburgfeier) of the Reformation in 1817.3 This was the same year that the government relocated the newly established Catholic theological faculty from Ellwangen [End Page 164] to Tübingen, a long-time Protestant stronghold with a reputable theological faculty.The Catholic theologians in Tübingen were eager to engage critically with the leading theological issues of the day, resisting the urge to hide behind confessional barriers or pious pretenses. It is striking that Deleuze expresses a strong affinity between his work and that of Jung in several texts; Jung’s influence on Deleuze has not tended to be emphasised by scholars, though there is a rapidly growing ‘Jungian turn’ in Deleuze and Guattari studies.
