This article describes the experience of five high school seniors in a discussion-based, Advanced Placement Government course, in which the teacher of the course frequently implemented controversial public issues (CPI) discussions. By analyzing the ways in which students experienced CPI discussion in their government classroom, the author seeks to better understand the ways in which discussion strategies support the aims of disciplinary literacy in civics. Overall, the discussion-based strategies were successful in supporting the development of disciplinary literacy (...) in civics; however, more intentional connections between CPI discussion and the aims of disciplinary literacy may further enhance the effectiveness of this practice. This study is aimed at exploring how teacher preparation programs in Taiwan—both traditional and alternative— prepare teachers for teaching controversial public issues specific to Taiwan (e. g., national identity, sovereignty, and ethnic issues). Using a case study design, this study documents six social studies teachers’ readiness and attitudes about whether to teach controversial public issues or not. This study explores teachers’ personal practical knowledge and curricular-instructional gatekeeping as they relate to the teaching of controversial issues in public elementary school settings, particularly the issue of immigration. The study took place in the urban setting of Houston and, using a case study design, documented how three elementary school teachers made curricular-instructional decisions by making use of their personal practical knowledge. Findings illuminate that personal practical knowledge plays a role in teacher's curricular-instructional gate keeping in socially (...) divisive contexts. And, the findings indicate that these three elementary school teachers make curricular-instructional decisions to effectively address controversial public issues in their classrooms through curriculum choosing, assignments creating, and conflict dialogue building. This study examines high school students’ responses to a public policy discussion on the topic of Internet privacy. Specifically, students discussed the question of whether search engines and social media sites should be permitted to monitor, track, and share users’ personal data or whether such practices violate personal privacy. We observed discussions of the topic in four high school classrooms in 2015–2016, prior to the presidential election in 2016. We first explain why the topic failed to work as a (...) controversial public issue with high schoolers. We then explain their responses to the issue. We found (1) students displayed a surprising trust in Facebook and Google; (2) students framed the issue of Internet Privacy as a conflict in values and a set of trade-offs; and (3) students tended to put more weight on personal responsibility than implications for democracy in their assessment of the (acknowledged) erosion of privacy as a result of social media and Internet search engines. The roles digital media-technologies play in raising public issues relating to emerging technologies and their potential for engaging publics with science and policy assessments is a lively field of inquiry in Science and Technology Studies (STS). This paper presents an analysis of controversies over proposals for the large-scale removal of atmospheric carbon dioxide (CDR). The study combines a digital method (web-querying) with document analysis to map debates about two CDR approaches: bioenergy with carbon capture and storage (BECCS) and (...) afforestation. In the first step, we locate actors using the web to engage with BECCS and afforestation and map their alignments in relation to competing framings of CDR. In a second step, we examine the devices deployed by UK-based actors to evidence and contest the feasibility of BECCS and afforestation. Our analysis shows that policy distinctions between “natural” and “engineered” CDR are used flexibly in practice and do not map neatly onto actor engagement with BECCS and afforestation. We highlight the predominance of cross-cutting techno-economic expertise and argue that framings of CDR as a solution to governing climate change may contribute to public disengagement from climate policy processes. The paper reflects on methods for studying controversies, publics, and issues emerging around processes of technoscientific assessment. (shrink)

The struggle stems from attempting to satisfy the need to maintain a life outside of work while having the professional obligation to follow the American Psychological Association’s (APA’s) Ethical Principles of Psychologists and Code of Conduct (Ethics Code) to prevent their personal lives from interfering with their professional roles and relationships. Although the APA Ethics Code does not restrict how psychologists conduct themselves during their personal time, taking a public stance on a controversial issue could potentially strain professional relationships and inadvertently reflect negatively on the profession. The ability of the medical profession to sustain life, or more appropriately, to prolong dying, in patients with terminal illness, creates a most complex and controversial situation for all involved: the patient, if mentally alert; the patient's family; and the medical care team including physicians, nurses and attendants. This situation is especially complex in large acute care hospitals where medical and nursing students, residents and house officers receive advanced medical training. A major problem, prolonging the dying of the terminally (...) ill, with its medical, legal, ethical and economic complexities now confronts American society. The problem is particularly acute in teaching hospitals, in which one finds a disproportionate number of terminally ill patients. The ability to work at these questions as a community rather than as adversaries will determine much about the ability of the health care system to respect the dignity and autonomy of those who seek aid and comfort when faced with serious illness and impending death. Better communication between the physicians, health care providers, the lawyers and ethicists must be developed in order to solve these problems. Over the next ten years society and our elected representatives will be making very demanding decisions about the use of the health dollar. One possible way to prevent increasing costs is to reach significant agreement on the proper care of the dying. Proper care for the dying is being considered, discussed, and evaluated by very thoughtful people. It is not governments which should decide who is to live or who is to die. There is the serious problem of the 'slippery slope' to euthanasia by omission if cost containment becomes the major force in formulating policy on the proper care of the dying. (shrink)

The purpose of this study was to explore the views of members of the general public regarding ethical issues in adult predictive genetic testing. The literature pertaining to ethical issues regarding to adult predictive genetic testing is largely restricted to the views of ‘experts’ who have emphasized informed consent, patent issues, and insurance discrimination. Occasionally the views of patients who have undergone genetic counselling and testing have been elicited, adding psychosocial and family issues. However, the (...) general public has not had the opportunity to contribute. In order to explore theatre as a health policy research tool, 1,200 audience members attended the play ‘Sarah’s Daughters’ in seven Canadian cities, following which audience discussions were audiotaped. This study performed a secondary qualitative analysis of the data to identify the ethical issues of adult predictive genetic testing important to members of the general public. The identified issues were: (1) need for public education; (2) choice to undergo genetic counselling and testing; (3) access to genetic counselling and testing; and (4) obligations regarding the handling of genetic information. Audience members emphasized public education and access to information regarding potential choices, which was different from the emphasis on informed consent and other ethical issues prominent in the literature. Members of the general public emphasized ethical issues that were different than those identified by experts and patients. It is essential that members of the public be included in complex and controversial public policy decisions. (shrink)

However, mass vaccination has also been the subject of various ethical controversies for decades. The ‘participatory turn’ in science and technology governance has resulted in the growth of initiatives designed to engage lay people in consultation and decision-making on controversial matters. Almost from the start there has been both enthusiasm and serious critique of these exercises, from scholars and activists. The gaps and challenges are well known. In this paper we indicate the limitations of deliberative mechanisms as regards how they cope with familiar forms of people’s engagement with a given matter. We examine (...) how this phenomenon unfolded at the Barcelona Citizen Conference on the Digitalization of Society; a participatory exercise inspired by the model of consensus conferences that took place in 2014 in Barcelona. Our perspective on the topic is inspired by Sociology of Engagements. Focusing on how participants and organizers deal with individual anecdotes, worries and testimonies reported during the conference, the analysis shows how these formats are ignored, externalized, banned and re-formed during deliberations. The use of foster children as subjects in the pediatric HIV/AIDS clinical trials has been the subject of media controversy, raising a range of ethical and social dimensions. Several unsettled issues and debates in research ethics underlie the controversy and the lack of consensus among professional researchers on these issues was neither adequately appreciated nor presented in media reports. These issues include (1) the tension between protecting subjects from research risk while allowing them access to the possible (...) benefits of research; (2) the blurring of the potentially conflicting roles of investigator and physician and the boundaries between research and therapy; (3) the adequacy of Institutional Review Board oversight; and (4) trust and the relationships among physicians, investigators and industry. The media controversy about the pediatric HIV/AIDS clinical trials can be seen as a means of “manufacturing mistrust” in health care, research and social services that have not always met the needs and expectations of the public. In an era of emerging infections, it is critical to the public’s health that people understand the role of rigorous and ethical research in the development of safe and effective care. Investigators, journalists and the public need to become knowledgeable about major ethical issues in the conduct of research in order to engage in dialogue about balancing research risks and benefits and to be able to distinguish fact from distortion in an era of multiple and rapid transmission of information. Issues of style in art are fundamental issues of modern aesthetics, since style is put forward in a number of main categories of art, acting as a principle of the organization of aesthetic form. It is no coincidence that over the past century, the attention of numerous researchers has been drawn to the XVII century - the beginning of the history of aesthetics of modern times, in which, perhaps, the root of modern problems lies. In this respect, the (...) XVII century seems to be the most grateful material for a discussion about style, since in the XVII century great styles arise that will develop and transform in the following centuries and will determine the development of art for many decades - classicism and Baroque. Since the 30s of the XX century, in studies devoted to the study of literature and art of the XVII century, a departure from the theory of classicism of the XIX century is planned. The first stage of this turn is the study of the creativity of the "pillars of classicism", which demonstrated that it has nothing to do with hierarchized academicism and reverence for norms. The desire to please the public, which was initially perceived as the main paradox in the theory of classicism, is further formulated by researchers as the presence of a different aesthetic. The next stage - the term "classicism" itself is criticized as late, evaluative, giving this era the meaning of the absolute. As a result, many researchers come to the conclusion that in France of the XVII century there was no literary and aesthetic doctrine as a single and "classical" one. Finally, the third stage of the study - the appeal to a single anthropo-socio-cultural concept of history, the use of sociological methods to highlight the gallant ethos allows us to conclude that classicism is a phenomenon in the field of art, gallantry is not only an artistic phenomenon, but also a social one. This article discusses the debate about vaccination as a case of public scientific technological controversy. In the vaccination controversy there is a scientific question, the effectiveness of vaccines in the elimination of diseases; a question of risk assessment, possible adverse effects and the possibility that immunization causes idiopathic diseases; an ethical question, the balance of rights between the two groups and the limits of the freedom of choice of treatment; and a political issue, who must take decisions about immunization (...) and whether immunization should be mandatory. The results of the analysis of the controversy suggest that the attitudes of the anti-vaccination groups towards vaccination are largely explained by their worldview which comes majorly from New Age beliefs. This worldview causes differences in the interpretation of evidence, law, risk and science. (shrink)

Contemporary theory of argumentation offers many insights about the ways in which, in the context of a public controversy, arguers should ideally present their arguments and criticize those of their opponents. We also know that in practice not all works out according to the ideal patterns: numerous kinds of derailments are an object of study for argumentation theorists. But how about the use of unfairstrategiesvis-à-vis one’s opponents? What if it is not a matter of occasional derailments but of one (...) party’s systematic refusal to take other parties seriously? What if one party continually forgoes any form of critical testing and instead resorts to threats or blackmail? Can this be countered by the tools of reason? Or should one pay one’s opponent back in the same coin? To gain some grasp of these issues, we describe a number of strategies used in the public controversy about induced earthquakes in Groningen. We check whether these strategies arefair,i.e.balanced, transparent,andtolerant.We also investigate the effects of the choice for a particular kind of strategy. It appears that, in circumstances, choosing a fair strategy may be detrimental for resolving the controversy and choosing an unfair one beneficial. Following up ideas from social psychology and political science, we formulate some guidelines for the choice of strategies. At the end, we stress the importance — especially for those whose opinions carry little weight — of having a society in which the knowledge and skills needed for assessing the fairness of strategies are widespread. While the teaching of controversial issues has generally been supported by schools and education scholars, new laws and public outcry have impacted whether and how controversial issues are taught. Calls to ban or limit teaching of controversial issues have largely been spurred by conservative parents, policymakers, and political groups. Some teachers and many education scholars are deeply concerned and want to preserve teaching about controversial issues. This situation suggests that inquiry is (...) needed into changes in the educational aims held and practices endorsed by various stakeholders. This article reconsiders the aims used to justify teaching controversial issues and situates them within larger understandings of good citizenship, revealing important differences in the explanations and values endorsed by opposing groups. It categorizes the aims more generally held by teachers, philosophers of education, and citizenship education scholars as: reasoning, engaging, communicating, and sustaining democratic communities. Then, those aims are compared to aims circulating within the discourse of opposing parents, policymakers, and political organizations. Finally, this article argues that pragmatic adjustments to educational aims held by many teachers and education scholars are both warranted and wise. It provides potential ways to better justify the teaching of controversial issues, including through approaches that more strongly ground teaching in American principles, historical examples, and a commitment to living together well. Using CiteSpace 6.1 software and information visualization analysis, we performed a search of literature in the Web of Science core collection database using thematic words such as “public health”, “ethics” and “autonomy”, we found that from January 1, 2020 to May 14, 2022, discussions on the (...) concept of “autonomy” within the field of bioethics/public health ethics were generally focused on the following topics: “informed consent”, “health care policy”, “health quality”, “information technology”, “ageism” and “elderly group”. In this paper, we distill and analyze four controversial issues: how can we avoid excessive restrictions on autonomy in the name of public health/public interest? How can we protect autonomy when using digital technology? How can we protect the autonomy and rights of the elderly? How can we advance the goals of public health by promoting autonomy? The COVID-19 pandemic is a unique historical opportunity to reshape the concept of autonomy within the field of public health ethics. Although the virus has bound the fate of humanity together, a reinvented concept of autonomy based on care and community ethics holds the promise of bringing solidarity, comfort, and hope to the world in the midst of the pandemic. The mission of public health is to assure the conditions in which people can be healthy and to reduce the occurrence of death and disability attributable to disease and injury. From the distinctive perspective of public health, the target is the health of the population as a whole, with a particular concern for vulnerable populations within the whole. Although public health is grounded in science, the mission and perspective of the field are shaped by the ever-evolving values (...) of the society. Ethics and law are therefore constituent disciplines of public health policy and practice. One of the major challenges confronting contemporary practitioners of public health is the need to broaden and deepen their understanding of legal and ethical aspects of their work. This special issue of the Joumal of Law, Medicine & Ethics responds to this challenge. This article describes how the mission of public health has come to encompass the prevention and treatment of injury and highlights some of the political and ethical controversies now confronting the field. The controversies over genetically modified crops in India involve what Gieryn refers to as ‘boundary work’ in the ongoing competition for credibility and trustworthiness among claimsmakers with opposing points of view. Discourse about GM crops involves extensive drawing of boundaries by actors including policymakers, technocrats, NGOs, scientists, industrialists, and farmers. The issues raised range from governmental processes to moral and ethical implications, from environmental consequences to integration into the global economy. Those involved in these discussions frequently invoke the idealized (...) notions of farmers and farming in order to situate themselves within the boundary of a particular social category which may lend credibility to their claims. While Gieryn has focused primarily on scientists’ attempts to construct a boundary between science and non-science in order to establish themselves as experts, strengthen the credibility of their claims and avoid political interference in their intellectual activities, this article focuses on a different way in which knowledgeable and influential actors lay claim to trustworthiness by drawing a different kind of social boundary around themselves. This article will especially focus on the ways in which the category of farmers is used in the GM crop controversies by actors who are in a position to influence public policies regarding GM crops, especially in their efforts to justify their policy prescriptions. The thesis here is that GM crop controversies in India reflect elite actors’ attempts to compete for a shared social identity with farmers, thus constructing a context for the particular public policy prescriptions they support. The thesis is supported by a lexical item frequency analysis of discussion related to genetically modified cotton in India which demonstrates that boundary work using social identity of farmers plays a significant role in shaping the discourse surrounding the adoption and governance of GM crops. Parental surrogacy remains a highly controversial issue in contemporary ethics with considerable variation in the legal approaches of different jurisdictions. Finding a societal consensus on the issue remains highly elusive. John Rawls’ theory of public reason, first developed in his A Theory of Justice (1971), offers a unifying model of political discourse and engagement that enables reasonable citizens to accept policies that they do not necessarily support at a personal level. The theory established a promising framework for private (...) citizens with distinct moral positions on the subject to find common ground and, in doing so, to negotiate a consensus regarding the degree and nature of regulation that is palatable to all rational citizens. One of Mill’s main arguments for free speech springs from taking disagreement as an epistemically valuable resource for fallible thinkers. Contemporary conciliationist treatments of disagreement spring from the same motivation, but end up seeing the epistemic implications of disagreement quite differently. Conciliationism also encounters complexities when transposed from the 2-person toy examples featured in the literature to the public disagreements among groups that give the issue much of its urgency. Group disagreements turn out to be in some ways more (...) powerful defeaters of rational belief, even when opposing groups are comparable in size and epistemic credentials. _Legitimate Differences_ challenges the usual portrayal of current debates over thorny social issues including abortion, pornography, affirmative action, and surrogate mothering as _moral_ debates. How can it be said that our debates oppose principles of life to those of liberty, principles of liberty to those of equality, principles of equality to those of fairness, and principles of fairness to those of integrity, when we as Americans share all these principles? Debates over such issues are not, Georgia Warnke argues, (...) moral debates over which principles we should adopt. Rather, they are interpretive debates over the meanings of principles we already possess. Warnke traces the structure of these debates with reference to the work of Jane Austen, Hans-Georg Gadamer, Jürgen Habermas, and Bernard Williams. In separate chapters on surrogate mothering, affirmative action, abortion, and pornography she articulates new understandings of the meanings of some of our principles and shows the equal legitimacy of some different interpretations of the meanings of others. Finally, she suggests that the orientation of American public policy ought to be directed less at finding single canonical interpretations of our principles than at accommodating different legitimate understandings of them. Although the ban had not been enforced in recent centuries, and was only questionably enforced in its immediate aftermath, this episode at a prominent university in the French philosopher's adopted country rightly (...) qualifies as one of the seventeenth century's most scandalous affairs. Despite the centrality of Cartesianism to "the quarrel," existing scholarship has not captured its full significance to the emergence of Cartesian philosophy. Even Jonathan Israel and Theo Verbeek, the two scholars who have contributed the most to our historical knowledge of the quarrel, tend to characterize its drama as an external annoyance brought upon Descartes because of peculiar features of the Dutch academic-religious landscape rather than an incident deliberately shaped by his own actions.1 [End Page 749]While it is undeniable that Descartes felt persecuted by his Dutch antagonists, this article argues that Descartes's involvement in, and ultimate responsibility for, the quarrel requires reassessment. Moreover, in a letter exchange deserving more attention than it has yet received, Descartes would advocate the wider usage of certain writing techniques to neuter the objections of institutional gatekeepers.2 Even at this well-developed stage of Descartes studies, the extent to which the very appearance of the Cartesian writings was determined by such strategic considerations remains underappreciated. [End Page 750]Careful comparison of the developments of the quarrel with Descartes's own statements helps reveal the intimate relation he perceived between sociopolitical authority in seventeenth-century Europe and the philosophical practices of Scholasticism. His formative role in the quarrel thus merits reexamination not only as a pivotal moment in the emergence of Cartesian philosophy but also as an occasion for further questions regarding the status of the Cartesian writings as strategic documents, including their influence upon later public controversies.3 For these reasons, Descartes's account of his actions during the quarrel deserves a large audience among philosophers, political theorists, and intellectual historians interested in the conflicts that would eventually characterize the Enlightenment.4THE QUARREL UNFOLDS: JUDGMENT OF MARCH 1642In late 1641, almost immediately following publication of the Meditations, a dispute over Cartesian philosophy emerged among the theologians at Utrecht University. In the years following World War II, and increasingly during the 1960s and 1970s, professional scientific societies developed internal sub-committees to address the social implications of their scientific expertise. This article explores the early years of one such committee, the American Society of Human Genetics’ “Social Issues Committee,” founded in 1967. Although the committee’s name might suggest it was founded to increase the ASHG’s public and policy engagement, exploration of the committee’s early years reveals a more complicated reality. (...) Affronted by legislators’ recent unwillingness to seek the expert advice of human geneticists before adopting widespread neonatal screening programs for phenylketonuria, and feeling pressed to establish their relevance in an increasingly resource-scarce funding environment, committee members sought to increase the discipline’s expert authority. Painfully aware of controversy over abortion rights and haunted by the taint of the discipline’s eugenic past, however, the committee proceeded with great caution. Seeking to harness interest in and assert professional control over emerging techniques of genetic diagnosis, the committee strove to protect the society’s image by relegating ethical and policy questions about their use to the individual consciences of member scientists. It was not until 1973, after the committee’s modest success in organizing support for a retrospective public health study of PKU screening and following the legalization of abortion on demand, that the committee decided to take a more publicly engaged stance. The University of Minnesota organized a conference ("Evolution and Public Education," December 5, 1981) to help clarify issues in the creation/evolution controversy and to examine arguments of the proponents of scientific creationism. This six-part book, a revised version of a resource manual compiled for the conference: (1) discusses the theory of evolution and its place in science education; (2) examines the creationist movement; (3) states the position of scientific creationists; (4) responds to creationists' arguments against evolution; (5) explores (...) legal issues in the controversy; and (6) provides some perspectives on attempts to treat the Genesis creation account as science. The fifth section, on legal issues, includes Judge Overton's decision striking down the Arkansas Creationism Act, as well as pieces of legislation which reveal the changing tactics of creationists, who first sought to ban the teaching of evolution in the 1920s, then sought equal time for biblical creationism in the late 1960s and early 1970s, and now seek a two-model approach to earth science/biology teaching (evolution as one model, scientific creationism as the other). ArgumentThe article is based on the controversies relating to conducting experiments and licensing AIDS treatments in France in the 1980s and 1990s. We have identified two political operators, i.e. two issues around which tensions have grown between the different generations of actors involved in these controversies: 1) the way of thinking about patient autonomy, and 2) the way in which objectivity regarding medical decisions is built. The article shows that there are several regimes of objectivity and autonomy, and that (...) it is at the meeting point of the two dimensions that very different political forms of medicine have developed. In the case of AIDS, the article identifies four of these forms (liberal and conservative clinical traditions and therapeutic modernity – enclosed, then participative) and analyzes the dynamics of their emergence and opposition. We discuss an “objectivity/autonomy” diagram as a conceptual framework which enables us (above and beyond AIDS) to think about changes in contemporary medicine. (shrink)

The public visibility of Islam reveals new political stakes in European democracies around issues of immigration and citizenship. By focusing on the societal debates and the controversies around the construction of mosques and minarets, this article explores the ways in which Islamic difference is manifested, perceived and framed in public life. The ‘visibility’ of Islam in public is conceptualized as a form of agency, a manifestation of religious difference that cannot be thought independent of the materiality (...) of culture, namely aesthetic forms, dress codes, or architectural genres. It is argued that the debates for or against the banning of the construction of mosques and/or minarets reveal the tumultuous transition of Muslims from the status of the invisible migrant-worker to that of visible Muslim citizenship. The public visibility is approached therefore as a radically disruptive, transgressive, provocative form of transformative agency that is intrinsically related to the political process of becoming citizens. This social phenomenon consists in the collective use of shared cognitive patterns based upon dichotomous schemati-zation of knowledge, values, and affection. In Legitimate Differences, Georgia Warnke argues that we can make important progress in resolving a number of seemingly intractable political debates about various contested social issues if we stop viewing them as debates between defenders of different moral principles, and start seeing them as debates among defenders of different interpretations of the same set of moral principles. Competing interpretations of literary texts can differ and disagree and yet all be legitimate. Thus, if debates about social policy questions turn out (...) to be merely debates about how to interpret moral principles, Warnke claims, then it will be possible for citizens on different sides of these issues to recognize the legitimacy of the positions of their opponents. Through extensive discussions of the public debates in the U.S. about abortion, surrogacy, affirmative action, and pornography, she argues that taking such an interpretive turn will allow us to appreciate that it is possible for many sides in such debates to be defending legitimate positions. A wealth of research suggests the importance of classroom discussion of controversial issues for adequately preparing students for participation in democratic life. Teachers, and the larger public, however, still shy away from such discussion. Much of the current research seeking to remedy this state of affairs focuses exclusively on developing knowledge and skills. While important, this ignores significant ways in which students? beliefs about the concept or nature of controversy itself might affect such discussions and potentially, the (...) sort of citizen that educators are fostering. We argue that examining the concept of ?controversy? is central to conducting such discussions and propose a framework of four crucial virtues or habits of mind that can be developed through such an examination. We illustrate how these four habits of mind are essential for establishing classroom ?counterpublics? that aim to develop more justice-oriented democratic citizens. (shrink)

In this article, we address the public issue of mandatory Genetically Modified Organism (GMO) retail food labeling in the U.S., first by reviewing the policy arguments both in support and against labeling food containing GMOs; second, by describing the existing U.S. federal regulatory system pertaining to GMO labeling, and why it does not presently require labeling of food containing GMOs; third, by reviewing and interpreting the results of studies of American consumer attitudes toward mandatory GMO retail food labeling; fourth, (...) by evaluating, through the utilization of issue life cycle analysis in the nonmarket environment, where the issue of GMO retail food labeling stands in the national public policy process; fifth, summarizing the state of scientific evidence addressing the safety of GMO foods and the existing regulatory and public policy environment for this issue; and sixth, offering legislative and litigation strategies for the mainstream food nonmarket strategy framework to formally assess the GMO industry to protect their interests and those of American consumers not concerned with GMO food ingredients, while offering a voluntary labeling strategy for firms responding to and recognizing the “rights” of American consumers who “choose” to purchase non‐GMO food products. This article explores decision making about social-ethical values issues by members of the public in the context of the recent Canadian federal election, held in late June 2004. All of these issues are sensitive and controversial, and I hesitated to address them in an article that I dedicate, with respect and admiration, to my friend and fellow medical lawyer-ethicist, Bernard Dickens. Over the years Bernie and I have discussed, debated and disagreed on many of them. Can Rawlsian public reason sufficiently justify public policies that regulate or restrain controversial medical and technological interventions in bioethics (and the broader social world), such as abortion, physician aid-in-dying, CRISPER-cas9 gene editing of embryos, surrogate mothers, pre-implantation genetic diagnosis of eight-cell embryos, and so on? The first part of this essay briefly explicates the central concepts that define Rawlsian political liberalism. The latter half of this essay then demonstrates how a commitment to Rawlsian public reason can (...) ameliorate (not completely resolve) many of the policy disagreements related to bioethically controversial medical interventions today. The goal of public reason is to reduce the size of the disagreement by eliminating features of the disagreement that violate the norms of public reason. The norms of public reason are those norms that are politically necessary to preserve the liberal, pluralistic, democratic character of this society. What remains is reasonable disagreement to be addressed through normal democratic deliberative processes. Specific issues addressed from a public reason perspective include personal responsibility for excessive health costs, the utility of a metaphysical definition of death for organ transplantation, and the moral status of excess embryos generated through IVF and/or their use in medical research. The ethics of biobanking is one of the most controversial issues in current bioethics and public health debates. For some, biobanks offer the possibility of unprecedented advances which will revolutionise research and improve the health of future generations. For others they are worrying repositories of personal information and tissue which will be used without sufficient respect for those from whom they came. Wherever one stands on this spectrum, from an ethics perspective biobanks are revolutionary. Traditional ethical safeguards (...) of informed consent and confidentiality, for example, simply don’t work for the governance of biobanks and as a result new ethical structures are required. Thus it is not too great a claim to say that biobanks require a rethinking of our ethical assumptions and frameworks which we have applied generally to other issues in ethics. This paper maps the key challenges and controversies of biobanking ethics; it considers; informed consent (its problems in biobanking and possibilities of participants’ withdrawal), broad consent, the problems of confidentiality, ownership, property and comercialisation issues, feedback to participants and the ethics of re-contact. Transgender issues and transgender rights have become increasingly a matter of media attention and public policy debates. Reflecting changes in psychiatric perspectives, the diagnosis of “trans‐sexualism” first appeared in the International Statistical Classification of Diseases and Related Health Problems in 1975 and shortly thereafter, in 1980, in the Diagnostic and Statistical Manual of Mental Disorders. Since that time, international standards of care have been developed, and today those standards are followed by clinicians across diverse cultures. In many instances, (...) treatment of older adolescents and adults is covered by national health care systems and, in some cases, by private health insurance. Most recently, the Medicare ban on coverage for gender reassignment surgery was lifted in 2014.In contrast to the relative lack of controversy about treating adolescents and adults, there is no expert clinical consensus regarding the treatment of prepubescent children who meet diagnostic criteria for what was referred to in both DSM‐IV‐TR and ICD‐10 as gender identity disorder in children and now in DSM‐5 as gender dysphoria. One reason for the differing attitudes has to do with the pervasive nature of gender dysphoria in older adolescents and adults: it rarely desists, and so the treatment of choice is gender or sex reassignment. On the subject of treating children, however, as the World Professional Association for Transgender Health notes in their latest Standards of Care, gender dysphoria in childhood does not inevitably continue into adulthood, and only 6 to 23 percent of boys and 12 to 27 percent of girls treated in gender clinics showed persistence of their gender dysphoria into adulthood. Further, most of the boys’ gender dysphoria desisted, and in adulthood, they identified as gay rather than as transgender.In an effort to clarify best treatment practices for transgender individuals, a recent American Psychiatric Association Task Force on the Treatment of Gender Identity outlined three differing approaches to treating prepubescent gender dysphoric children. Open any standard bioethics textbook, and therein can be found a host of subjects ranging from the abortion rights controversy to the morality of xenographic tissue transplantation. Just as there is a wide scope to the subject matter of bioethics, its practitioners come from a multitude of disciplines, including law, medicine, nursing, theology, philosophy, sociology, and anthropology. And yet, despite a rich variety of investigators and methods, bioethicists overlook numerous subjects that deserve to be addressed. In particular, they neglect (...) class='Hi'>issues of public health, preventive medicine, and social medicine. Although topics such as physician-assisted suicide, prenatal genetic testing, and the ethics of new reproductive technologies constitute the contemporary canon of bioethics and deserve sustained analysis, these subjects are not so significant that they should eclipse other issues. For example, gun control policies, the regulation of food additives. immunization programs, prenatal care, leave programs enabling employees to care for dying relatives, the provision of nutrition and medical care to the homeless, and the use of emergency rooms by the most impoverished citizens are all topics neglected by bioethicists. The clash between religious freedom and equality for lesbians and gay men has become a controversial legal issue in the United Kingdom. Increasingly, claims are made that compliance with anti-discrimination norms impacts upon conscientious, faith-based objectors to same-sex sexual acts. This article explores this issue and draws insights from North American case law, where this question has been considered in the context of competing constitutional rights. It raises far-reaching issues concerning the distinction between belief and practice, as well (...) as the role of identity in the public sphere. The author advocates that courts and tribunals should adopt a fact-specific approach which is sensitive to the rights in a particular context, and which focuses upon the values of accommodation, tolerance and mutual respect. Biological development is about history, the history of an individual through time. Historically, the dominant epigenetic tradition has seen the developmental process as an unfolding of potential or in terms of the emergence of new organization that becomes an individual organism over time. The concept of development has included differentiation, growth, and morphogenesis; since the mid-nineteenth century, it has been seen in terms of cell division. Along the way have come explorations of such issues as the extent to which (...) development is driven by hereditary determination rather than flexible regulation in response to changing conditions. Some researchers have focused specifically on examining the capacity for regeneration in response to injury or loss, or on the extent to which parts are self-organizing individually rather than determined segments of a whole. Improving public understanding and acceptance are critical for promoting coronavirus vaccination. However, how to promote COVID-19 vaccine programs remains controversial due to various ethical issues. This study, thus, aimed to survey the acceptance of COVID-19 vaccines among Japanese citizens and discuss relevant ethical issues. A cross-sectional survey was conducted via an online platform. An anonymous, quantitative, self-administered online questionnaire was sent to 6965 registered Japanese residents, which included questions regarding the respondent’s general knowledge, experience, and opinions (...) of vaccines, vaccine development, COVID-19, and COVID-19 vaccines. Of the 1569 respondents, 730 and 839 were categorized into the younger and older groups, respectively. Most of the respondents possessed general knowledge of COVID-19 vaccines and their features. Of the respondents, 57.8% definitely agreed or somewhat agreed to receive COVID-19 vaccines. The older group showed significantly greater willingness to receive vaccines and higher literacy regarding vaccines in general. Possible reasons for the older group’s greater willingness to receive COVID-19 vaccines are a high risk of severe COVID-19 infection and their past accumulated experience of receiving various vaccinations. Although active public intervention could increase vaccination rates, most of the respondents did not agree with mandatory vaccination. Furthermore, a gap between the participants in the COVID-19 vaccine trials and the prioritized population in real-world vaccination should be adjusted in future vaccine development. (shrink)

When a new, brain-based definition of death was proposed fifty years ago, no one realized that the issue would remain unresolved for so long. Recently, six new controversies have added to the debate: whether there is a right to refuse apnea testing, which set of criteria should be chosen to measure the death of the brain, how the problem of erroneous testing should be handled, whether any of the current criteria sets accurately measures the death of the brain, whether standard (...) criteria include measurements of all brain functions, and how minorities who reject whole-brain-based definitions should be accommodated. These controversies leave little hope of consensus on how to define death for social and public policy purposes. Rather, there is persistent disagreement among proponents of three major groups of definitions of death: whole-brain, cardiocirculatory or somatic, and higher-brain. Given the persistence and reasonableness of each of these groups of definitions, public policy should permit individuals and their valid surrogates to choose among them. (shrink)

The online space has become a digital public square, where individuals interact and share ideas on the most trivial to the most serious of matters, including discussions of controversial ethical issues in science, technology and medicine. In the last decade, new disciplines like computational social science and social data science have created methods to collect and analyse such data that have considerably expanded the scope of social science research. Empirical bioethics can benefit from the integration of such (...) digital methods to investigate novel digital phenomena and trace how bioethical issues take shape online.Here, using concrete examples, we demonstrate how novel methods based on digital approaches in the social sciences can be used effectively in the domain of bioethics. We show that a digital turn in bioethics research aligns with the established aims of empirical bioethics, integrating with normative analysis and expanding the scope of the discipline, thus offering ways to reinforce the capacity of bioethics to tackle the increasing complexity of present-day ethical issues in science and technology. This July 2020 issue of JME introduces a new section, “COVID-19 Current Controversies,” which will be a recurring section in each issue for the foreseeable future. This issue reflects on some of the most pressing ethical issues that have arisen roughly 6 months into the pandemic. Kathleen Liddell and colleagues examine important legal considerations at play in ventilator allocation decisions raised by the pandemic.1 They point out that ethics-based triage protocols that argue from the principle of “saving the most (...) lives” by withholding or withdrawing ventilators from certain patients could violate the law (U.K. and elsewhere). Patients’ legal rights are not suspended during this crisis, they remind us. The mere action of ventilator removal (extubation and proning) may constitute battery without consent, for example. Moreover, there may be problems with “evidentiary weakness” in some of the prognostic models used to inform such decisions. And, decisions that are inconsistent, subjective, and/or discriminatory may be deemed illegal. Those developing policies need to consider and consult various areas of law including criminal law (eg, murder, battery, negligence, manslaughter), human rights law, civil law (eg, battery, negligence, duty of care, consent), public and administrative law (eg, discrimination, case law), law on decision-making for incapacitated adults, professional regulations, and derogations from current law (eg, immunities and indemnities). Liddell et al offer 10 concrete, legally informed recommendations for those developing triage-policies to consider. Michael Parker and colleagues take on the issue of contact tracing using mobile apps and point out that such apps can enable people to emerge more safely from lockdowns, which provides a strong autonomy-based argument in favour …. When the utility of masks or vaccinations became politicized during the COVID-19 pandemic and lost its mooring in scientific evidence, an already-developing crisis of expertise was exacerbated. Those who believe in consensus science wondered: “How can ‘those people’ not see the truth?” With a foreword by Harry Collins, this book shows that the crisis is not a scientific controversy, but an ideological dispute with believers on both sides. If the advocates for consensus science acknowledge the uncertainties involved, rather than insisting (...) on cold, hard facts, it is possible to open a pathway towards interaction and communication, even persuasion, between world views.
