The governance structures of state public health systems vary as much as the states themselves, including the existence and role of state boards of health. Understanding these differences is essential to a complete understanding of the governmental public health enterprise. State boards of health are obvious vehicles for public health policy development in some states, where they work closely with or oversee state health agencies. In other states they do not exist or serve only in a non-binding advisory capacity.In this (...) article, we distinguish and identify state boards of health and state public health advisory boards, examine state boards of health in practice, and discuss their role in advocacy and policy development in the context of state politics. We used a set of mixed qualitative methods, including a literature review, online research of state statutes establishing state board of health authorities, and key informant interviews. Informants were five current and former state board of health members, four current and former state health officers, and nine state health agency senior policy staff, spanning 13 states. (shrink)

In this paper we critically evaluate an argument put forward by William Lane Craig for the existence of God based on the assumption that if there were no God, there could be no objective morality. Contrary to Craig, we show that there are some necessary moral truths and objective moral reasoning that holds up whether there is a God or not. We go on to argue that religious faith, when taken alone and without reason or evidence, actually risks (...) undermining morality and is an unreliable source of moral truths. We recommend a viewpoint on morality that is based on reason and public consensus, that is compatible with science, and that cuts across the range of religious and non-religious positions. (shrink)

Pragmatic Genealogy involves constructing fictional, quasi-historical models in order to discover what might explain and justify our concepts, ideas or practices. It arguably originated with Hume, but its most prominent practitioners are Edward Craig, Bernard Williams and Mathieu Queloz. Its defenders allege that the method allows us to understand “what the concept does for us, what its role in our life might be” (Craig, 1990), and that this in turn can ground practical reasons to preserve or further a (...) conceptual practice. In this paper, I argue that none of this is true, and that only a turn to the actual recent history of such practices can reveal those sorts of practical reasons. (shrink)

They are of the Great Comet 1843 I, and provide superb examples of the artistic skill of astronomers of that time and of one of the methods used to record astronomical subjects before the days of photography.

Many want to know what bitcoin is and how it works. But bitcoin is as complex as it is controversial, and relatively few have the technical background to understand it. In this paper, I offer an accessible on-ramp for understanding bitcoin in the form of a model. My model reveals both what bitcoin is and how it works. More specifically, it reveals that bitcoin is a fictional substance in a massively coauthored story on a network that automates and distributes jobs (...) normally entrusted to centralized publishing institutions. My model therefore falsifies a popular view according to which each bitcoin is a chunk of code. (shrink)

“Meta-argument allegations” consist of protestations that an interlocutor’s speech is wrongfully offensive or will trigger undesirable social consequences. Such protestations are meta-argument in the sense that they do not interrogate the soundness of an opponent’s argumentation, but instead focus on external features of that argument. They are allegations because they imply moral wrongdoing. There is a legitimate place for meta-argument allegations, and the moral and epistemic goods that can come from them will be front of mind for those levelling such (...) allegations. But I argue there is a dark side to such allegations, and their epistemic and moral costs must be seriously weighed. Meta-argument allegations have a concerning capacity to derail discussions about important topics, stymieing argumentational interactions and the goods they provide. Such allegations can license efforts to silence, punish and deter—even as they provoke the original speaker to retaliate in kind. Used liberally, such allegations can escalate conflicts, block open-mindedness, and discourage constructive dialogues. In response, I defend “argumentational tolerance”—a principled wariness in employing meta-argument allegations—as a virtue of ethical argument. (shrink)

The logic of the commons is applied to the U.S. labor pool. lt is argued that the labor pool is an “active” commons, a commons in whichthe resource as weil as the users of the resource can change voluntarily. For this commons to be tended properly, technical solutions are ineffective and inappropriate; both employer and employee must have trust in the mechanisms that tie them together. The Aristotelian-Thomist claim is that external actions can be morally evaluated when they are voluntary (which includes being based on reasonably accurate knowledge of what an agent is doing), absent which, in effect, we evaluate outcomes, not acts. Also, in the Aristotelian-Thomist tradition the internal act of the will is paramount. These claims contrast with some current theorizing, e.g., by Judith Jarvis Thomson, that morally evaluates actions separately from agents, downplaying the internal act. Taking cases from current authors that revolve (...) around ignorance of key facts, I critique their theorizing on the basis of the nature of agency, the nature of abstraction, the moral language we use in describing acts, the need for reasonably complete descriptions of acts, and the tendency of act evaluations to “leak” into agent evaluations in objective theories. I then describe how Thomas Aquinas’s account of moral evaluation avoids these problems and provides a superior, multi-dimensional framework for moral evaluation. (shrink)

What critical characteristics do firms have that determine the scale and scope of corporate social responsibility activities they undertake? This paper examines two disparate predictors of corporate social performance. First, using the lens of the resource-based view, we examine the role of alliance network centrality on corporate social performance. We find that centrality enhances corporate social performance. Second, we investigate how board composition affects corporate social performance. Specifically, drawing on stakeholder theory, we find that the percentage of female directors predicts (...) greater corporate social performance. In addition, we look at the influence of outside directors on this relationship. Our findings show that the presence of more outside directors positively moderates the relationship between female directors and corporate social performance. (shrink)

This commentary on Nescolarde-Selva and Usó-Doménech (Found Sci, 2013) raises questions about the dynamic versus static nature of the model proposed, and in addition asks whether the model might be used to explain ethical flexibility and rigidity.

In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 63.3 (2002) 521-537 [Access article in PDF] Two Routes "to Concreteness" in the Work of the Bakhtin Circle Craig Brandist In 1918 the young Georg Lukács published an obituary of the last major Baden School neo-Kantian Emil Lask in which the latter's varied work was commended for being "underlain by an essential common drive [Drang]: the drive to concreteness." 1 This "drive" (...) was especially problematic, however, in the work of thinkers overtly committed to neo-Kantianism, a doctrine that was in its own time a byword for abstruseness and academic abstraction. Just how concrete could a neo-Kantian idealism become without abandoning its core insistence that the world is "produced" by indwelling categories of mind? Lask pursued this problem with a thoroughness unmatched by any other German neo-Kantian, and in doing so he became an important influence on, among others, Lukács, Max Weber, and Martin Heidegger. This article discusses the prevalence of the same "drive" in the varied work of those Russian champions of neo-Kantianism, the Bakhtin Circle, where "concreteness" is invoked so frequently that it almost begins to take on the character of a mantra. The case of the Bakhtin Circle is especially illustrative because the "drive to concreteness," which all members of the Circle shared, resulted in a significant difference of opinion about the extent to which the central theses of neo-Kantianism can be salvaged. Like Lask, Bakhtin was particularly keen to maintain the core of neo-Kantian ideas, while Voloshinov and, following behind him, Medvedev, were much less averse to breaking with the central project of German idealism itself. In each case the Brentanian notion of intentionality, the doctrine that consciousness is always consciousness of something, plays a central role. Consciousness exists in acts directed towards objects, existent or otherwise, that are given to consciousness. Brentano and his followers were invariably anti-Kantian, and they were extremely hostile to the central tenet of neo-Kantian idealism, that objects of consciousness are "produced" from categories dwelling in a transcendental [End Page 521] "consciousness in general" (Bewusstsein überhaupt). While it is far from certain that Brentanian and Kantian principles are incompatible at every level, there is no doubt that any attempt to integrate the notion of intentionality into neo-Kantianism was going to threaten the basis of neo-Kantianism as such. 2 As Gabriel Motzkin notes, Lask's attempt to carry such a project through to its logical conclusion ultimately led to "the destruction of the neo-Kantian empire from within." 3 The Bakhtinian project led in precisely this direction, and this article examines the way in which the work of the Circle shows distinct and ultimately incompatible responses to the crisis of the "empire." Revising neo-Kantianism: Ernst Cassirer and Emil Lask The abstract, or what Bakhtin terms the "theoretist," character of neo-Kantianism derived from two fundamental and interrelated features. The first was a principled opposition to all distinctions between cognition and perception, and the second was an identification of subjectivity with the system of objectifying functions that have their true being in cultural documents. According to neo-Kantian principles, nothing is "given" and everything is posited in an act of subjective spontaneity: objects are constituted from transcendental categories dwelling in "pure consciousness." Summing up the philosophical project of Hermann Cohen, the leader of the Marburg School, Ernst Cassirer noted that "any appeal to a merely given should fall aside; in place of every supposed foundation in things there should enter the pure foundations of thinking, of willing, of artistic and religious consciousness." 4Though seeking to broaden his own enquiry beyond the "trichotomy of the Kantian Critiques," Cassirer, the last major Marburg neo-Kantian, remained wedded to the neo-Kantian project of deriving the transcendental preconditions of the "formations" in which the "objective spirit... consists and exists" and dealt only with a universal subject devoid of practical limitations. 5 Cassirer drew close to phenomenology in the 1920s, when he embarked on his great project The Philosophy of Symbolic Forms, presenting... Alan Hájek has recently argued that certain assignments of vague probability defeat Pascals Wager. In particular, he argues that skeptical agnostics – those whose probability for God''s existence is vague over an interval containing zero – have nothing to fear from Pascal. In this paper, I make two arguments against Hájek: (1) that skeptical agnosticism is a form of dogmatism, and as such should be rejected; (2) that in any case, choice situations with vague probability assignments ought to be treated (...) as second-order cases of choice under uncertainty, with the result that belief in God is the favored option in a very wide range of cases. In a recent article Martha Nussbaum identified three problems with the Stoic doctrine of respect for dignity: its exclusive focus on specifically human dignity, its indifference to the need for external goods, and its ineffectiveness as a moral motive. This article formulates a non-Stoic doctrine of respect for dignity that avoids these problems. I argue that this doctrine helps us to understand such moral phenomena as the dignity of nonhuman animals as well as the core human values of life, freedom, (...) and equality. I end by arguing that Nussbaum underestimates the mutual support between motives of respect and other moral motives such as compassion. (shrink)

There is still very little constitutional control over the decision to use armed force, and very limited domestic implementation of the international principles of jus ad bellum, notwithstanding the increasing overlap between international and domestic legal systems and the spread of constitutional democracy. The relationship between constitutional and international law constraints on the use of armed force has a long history. Aspects of constitutional theory, liberal theories of international law, and transnational process theory of international law compliance, suggest that constitutional (...) design could legitimately be used as a pre-commitment device to lock-in jus ad bellum principles, and thereby enhance compliance with that regime of international law. This paper examines the case of Japan's Constitution to determine the extent to which its war-renouncing provisions incorporated, and are consistent with, international law principles on the use of armed force, and whether the provisions operated to effectively constrain government policy. It concludes that the drafters of the Constitution did incorporate international law principles from jus ad bellum in Art. 9(1), though they also grafted on sui generis prohibitions and rules from jus in bello in Art. 9(2) as well, which complicates the story. The provision was embraced in the ratification process, and became the source of powerful constitutive norms that have helped shape Japan's sense of identity. The paper examines the interpretation of Art. 9, as informed by international law, and concludes that despite deep conflicts over competing narratives and understandings of the provision, the long-standing government interpretation of the provision is consistent with Japan's obligations under the jus ad bellum regime. In looking at the operation of Art. 9, the paper finds that despite the early use of Art. 9 by governments as a pretext behind which it could pursue desired policy objectives, the provision did operate to effectively constrain government policy in times of apparent crisis. During the Gulf War in particular, Art. 9 effectively bound a straining government to the mast, preventing Japan's participation in the war. It did so not only in its operation as a legal norm, effectively enforced by the Cabinet Legislation Bureau, but also as a powerful constitutive and social norm. As such, the experience of Japan with Art. 9 provides support for the argument that it is feasible to incorporate principles of jus ad bellum into national constitutions, so as to effectively constrain government policy with respect to engaging in armed conflict. Broader arguments as to why that might be desirable, or whether it has served Japan well or ill, are left for another day. (shrink)

The practice of psychology in rural areas offers unique challenges for psychologists as they try to provide optimal care, often with a minimum of resources. Psychologists are frequently required to be creative and flexible in order to provide effective services to a wide range of clients. However, these unique challenges often confront psychologists with ethical dilemmas and problems for which their urban-based training has not prepared them. The author examines how certain characteristics of rural communities may lead to specific ethical (...) dilemmas. By being a part of a small community, psychologists will inevitably face multiple relationship dilemmas. Confidentiality is harder to maintain in a small town, particularly with its informal information-sharing network. To provide services to meet community needs, with a limited number of referral options, psychologists typically need to be generalists. This may lead to concerns about scope of practice, training, and experience with diverse populations. Psychologists also face other competency issues, such as a lack of supervision and consultation resources. Other concerns addressed include the psychologist's visibility in the community, having clients know about the psychologist's personal life, and the blurring of professional and personal roles. Suggestions are made for coping with each of these ethical issues, although more quantitative research and discussion are needed on the practice of psychology in rural areas. (shrink)
