Considerando la disciplina degli effetti civili del matrimonio canonico, improntata a diversi “sistemi matrimoniali”, il volume ripercorre le vicende politiche e culturali che hanno segnato la storia dei rapporti tra le autorità statali e le autorità ecclesiastiche, lungo un periodo che copre circa due secoli, dal Code civil napoleonico del 1804 ai Codici degli Stati preunitari, dal Codice civile del 1865 del Regno d’Italia ai Patti Lateranensi stipulati dal regime fascista nel 1929, dalla discussione nell’Assemblea costituente nell’Italia repubblicana alle vicende (...) politiche degli anni Cinquanta e Sessanta, sino ai negoziati bilaterali che portarono all’Accordo di Villa Madama, ratificato il 25 marzo 1985. Esaminando le innovazioni formali e sostanziali introdotte nella riforma del matrimonio concordatario, si evidenziano le questioni che continuano a essere oggetto di controversie dottrinali e di sentenze delle corti di giustizia, volte a colmare le lacune e contraddizioni dell’attuale normativa matrimoniale. L'uomo non si può compiere, per il teologo francese Henri de Lubac, se non in Dio, sia Origine (creatore) e Fine ultimo. Qualunque meta finita quindi è destinata a rivelarsi come non appagante. Lo sostenevano già non solo Agostino e i Padri della Chiesa, ma anche Tommaso d'Aquino , col concetto di “desiderium naturale videndi Deum”, poi dimenticato dai tomisti moderni, e riscoperto appunto da de Lubac.

According to historical theories of biological function, a trait's function is determined by natural selection in the past. I argue that, in addition to historical functions, ahistorical functions ought to be recognized. I propose a theory of biological function which accommodates both. The function of a trait is the way it contributes to fitness and fitness can only be determined relative to a selective regime. Therefore, the function of a trait can only be specified relative to a selective regime. Apart (...) from its desirable pluralism, only this view of relational function can support the function/accident and function/malfunction distinctions commonly thought to be part of the concept of function. Il saggio discute la lettura proposta da Francesco Novati della figura di san Francesco d’Assisi, a partire dalla interpretazione di quelle di Dante e Giotto. Alla luce dei rapporti con Gabriele d’Annunzio, la lettura novatiana di Francesco rivela una prospettiva che tende a offrire una visione estetizzante, dannunziana e decadente, immagine della modernità e non sempre aderente al messaggio originario. In questo modo Francesco diviene sostenitore di un progetto di riforma interno alla Chiesa che, con spirito dannunziano, supera il (...) dualismo tra materia e spirito per arrivare quasi a un elogio dell’immanenza. Attraverso una sorta di mitizzazione della figura di Francesco, Novati parla del proprio tempo più che di un personaggio vissuto nel passato. The essay discusses Francesco Novati’s reading of the figure of St. Francis of Assisi, starting from the interpretation of those of Dante and Giotto. In the light of the relationship with Gabriele d’Annunzio, the Novati’s reading of St. Francis reveals a perspective that tends to offer an aestheticising view, which is “dannuntian” and decadent, image of modernity that not always adheres to the original message. In this way, St. Francis purposes an inside reform project of the Church, which, with a “dannuntian” spirit, goes beyond the matter-spirit dualism in order to arrive almost to a praise of the immanence. Through such a mythologisation of the figure of St. Francis, Novati talks about his own time more than about a man who lived in the past. (shrink)

Lisa Cahill's Love Your Enemies: Discipleship, Pacifism and Just War Theory provides an excellent introduction to questions of peace-making and war-making in the history of Western Christianity. Cahill canvasses the standard sources for her history: the generally pacifist period of the New Testament and the early church (chapters two and three); the emergence of the just war tradition with Augustine and Aquinas (chapters four and five); just war, crusade, and pacifist responses during the Reformation period (chapters six through eight); and just war and pacifist responses in the twentieth -century American debate (chapters nine and ten). Love Your Enemies is relatively comprehensive, even-handed, and well-written. Beyond its general competence, Love Your Enemies provides rich theological fare, situating questions on war and peace in the context of Christian discipleship as a whole. One result of using discipleship as the organizing motif is that pacifism gets an unusually sympathetic and fair hearing. Cahill serves as an excellent reporter on these contentious questions. While often intimating her sympathies, she consistently avoids taking decisive positions or closing avenues of exploration. The title of her final chapter -the "Fragility of the Gospel"-reflects this approach. In this chapter Cahill emphasizes that Christian communities must continuously challenge themselves and their society to live out the gospel of peace (239-44). BOOK REVIEWS 323 What does it mean to live as a follower of Jesus today (ix)? This is Cahill's central question. To this end she asks two further questions. First, what is the way of discipleship established by Jesus with regard to doing violence? Second, to what extent can Christians hope to apply this ethic of discipleship to the wider civil society (40)? These questions arise in a variety of forms throughout the book. For instance, Cahill elegantly shows how a Christian's eschatological commitments (i.e., beliefs about the extent to which God's peaceful rule can be established by a community of believers and/or the extent to which this can be realized in "the world") can affect her response to the possibility of doing violence. While setting as one's task the attempt to find a way to combine Christian discipleship with public responsibility has many strengths, it is not without possible pitfalls. Typically, "Christian responsibility" is contrasted with "the evangelical imperative of non-violence" (see 55-56). But this notion of "responsibility" often begs the central question-i.e., for the Christian, can the most "responsible" stance be anything but what Cahill proclaims to be the evangelical stance of non-violence? While Cahill does acknowledge the strength of the argument by advocates of "responsibility" (i.e., those ~ho set up the non-violent stance in opposition to the faithful following of Jesus), she does not explicitly endorse their move. From her self-professed Catholic context, Cahill strives fo harmonize a neo-Thomist understanding of natural law-that there is "an objective moral order, knowable by reason, that yields universal moral laws by which all human persons and communities should abide" (3)-with a more particularistic... Necessaria è la prospettiva della piena integralità umana delle persone omosessuali, che interroghi il loro amore in tutta la sua complessità. La psicoanalisi, per prima, può contribuire a elaborare una visione dell’affettività omosessuale complessiva, integrale e positiva. La teologia può ascoltarne (...) le conclusioni, senza rinunciare alle sue categorie etiche, ma aggiornando la propria posizione, proponendo una visione pienamente cattolica della persona e della sua sessualità. Visione che si traduce in indicazioni pastorali in grado di aiutare una persona omosessuale a vivere in serena pienezza la propria situazione, la propria affettività e spiritualità cristiana. Nonostante non tutti gli studiosi concordino sul valore e sulla validità della testimonianza di Agostino, non si può oggi mettere in dubbio che questi ebbe una conoscenza molto precisa non solo della dottrina manichea, ma anche delle pratiche rituali in uso nelle comunità delle sette, e in modo particolare di quelle che si imponevano agli Uditori. Del resto, egli stesso non manca di definirsi esperto dell’affare manicheo al fine di affermare l’autorità del suo modo di procedere nella polemica.Certo non si (...) può cercare in questi testi antimanichei un’esposizione serena né uno studio sistematico del catechismo manicheo poiché tali scritti hanno il carattere di un’“opera d’assalto” che Agostino, al di là degli aspetti anche caricaturali che mette in luce esponendo la dottrina avversa, dedica a quanti, come lui, corrono il rischio di essere sedotti e intrappolati da tale dottrina eretica.Quella lunga permanenza nella setta, nove anni come lui stesso afferma, e l’attività dispiegata al suo servizio permise ad Agostino di avere una larga conoscenza dell’organizzazione interna delle comunità, delle riunioni liturgiche e della catechesi, infine dei rapporti tra le due professiones che costituivano la chiesa manichea, i laici, Uditori o Catecumeni da una parte e, dall’altra, i religiosi, Eletti o Santi, tenuti, quest’ultimi, ad osservare rigide regole ascetiche raggruppate sotto tre capi, tria signacula appunto, relativi a tre ordini di attività, corrispondenti ad altrettanti organi quali bocca, mano, seno, ai quali il perfetto manicheo apporrà come un sigillo che rispetterà scrupolosamente.In particolare, lo studio del “sigillo della bocca”, quello, cioè, che ordina di astenersi dalle cibarie carnee e sanguinolente; dal vino; dalle bevande fermentate come la birra; nonché dai pensieri malvagi; dai discorsi menzogneri, violenti o blasfemi , permette di ricostruire, sempre attraverso la polemica agostiniana, la problematicità degli aspetti legati alle pratiche e alle abitudini alimentari della setta.Apporre un sigillo alla bocca, così come alla mano o al seno, significa chiudere, per usare una metafora cara al medioevo, le porte dei sensi: occhi, orecchie, naso, bocca, mani. Viceversa, aprirle o lasciarle aperte equivale a provocare e a permettere l’irruzione al proprio interno dei “demoni esteriori”, e, quindi, esporsi a peccare. Operare la “chiusura dei sensi” significa perciò sottrarsi alle sollecitazioni della carne e del mondo, rifiutando il male e conservando, così, la propria anima integralmente pura e buona quale essa è per essenza.Di fatto, la regola dei “tre sigilli” non viene osservata nel suo rigore più stretto che dai fedeli giunti o chiamati alla perfezione, dagli “Eletti” e dai “Santi”. Meno severe sono, infatti, le leggi che regolano il comportamento dei semplici credenti, degli “Uditori” o dei “Catecumeni”. La delineazione di quella che senza dubbio si potrebbe definire una sorta di “doppia morale”, una duplice regola di condotta, emerge chiaramente nei passi relativi alle pratiche alimentari, laddove, per esempio, Agostino fa notare come agli Uditori, per esempio, sia permesso persino dedicarsi ad attività profane quali l’agricoltura e tutto ciò che ad essa consegue come seminare e raccogliere, operazioni ritenute sacrileghe dagli Eletti, o, ancora, poter mangiar carne e bere vino.Diversamente vanno, invece, le cose per i “Perfetti”, il cui regime di sussistenza è ridotto allo stretto indispensabile secondo uno stile di vita improntato al digiuno, alla preghiera e all’astinenza. Sono così loro proibiti i cibi grassi, le bevande inebrianti ed ogni gesto dannoso perpetuato nei confronti dei vegetali.Tali proibizioni alimentari, discussi da Agostino nell’oris signaculum, la cui critica occupa da sola i tre quarti dello sviluppo dedicato ai tre sigilli nel suo De moribus manichaeorum, sono fonte di grande interesse per il vescovo d’Ippona il quale non manca di prendere in esame, spesso con tono sarcastico, ciascun aspetto di questi rigidi precetti rivelandone quelle che per lui sono immancabili contraddizioni: «Smettete ... di lusingare gli ignoranti celebrando il sigillo della bocca come qualcosa di grande. A meno che per caso non riteniate il mangiare crne e il non bere vino un sigillo della bocca degno di ammirazione e lode».Il colore, l’odore e il sapore, tre criteri che guidano e orientano i manichei nella scelta dei cibi e che corrispondono ad altrettanti organi sensoriali, la vista, l’olfatto sentinella del terzo dei sensi chiamati in causa, quello del gusto, divengono per Agostino occasione non solo di riflessione ma di spunto polemico al fine di dimostrare come, spesso, limitarsi a giudicare la bontà o meno di un cibo servendosi di solo uno di questi sensi alla volta , porti a cadere in terribili errori di giudizio. Del resto, Dio non è qualcosa di materiale che possa essere percepito con i sensi ed è, dunque, assurdo ritenere che lo si possa scoprire con la vista, con l’olfatto, o con il gusto. (shrink)

Several authors, including Thomas Nagel and David Gauthier, have defended the view that reasons of self-interest (prudential reasons) are rationally binding. That is, there is always a reason, bearing on the rational advisability, based on one's self-interest and, as a result, a person may act irrationally by knowingly acting against such reasons regardless of the person's desires or values. Both Nagel and Gauthier argue from the rationally mandatory nature of prudential reasons to the conclusion that moral reasons can be rationally (...) mandatory, challenging the neo-Humean position that practical reasons that bear on an agent's rationality are essentially grounded on the agent's subjective, contingent, conative states. I argue, pace Nagel and Gauthier, that prudential reasons are not rationally mandatory--that the rational requirement to act in one's own interest, when it exists, is, as the neo-Humean insists, grounded on one's subjective, contingent, conative states. Prudential reasons are not reasons for every (conceivable) agent--not in the sense that bears on the rational advisability of action. (shrink)

It is widely held that quantum mechanics is the first scientific theory to present scientifically internal, fundamental difficulties for a realistic interpretation (in the philosophical sense). The standard (Copenhagen) interpretation of the quantum theory is often described as the inevitable instrumentalistic response. It is the purpose of the present article to argue that quantum theory doesnot present fundamental new problems to a realistic interpretation. The formalism of quantum theory has the same states—it will be argued—as the formalisms of older physical (...) theories and is capable of the same kinds of philosophical interpretation. This result is reached via an analysis of what it means to give a realistic interpretation to a theory. The main point of difference between quantum mechanics and other theories—as far as the possibilities of interpretation are concerned—is the special treatment given tomeasurement by the “projection postulate.” But it is possible to do without this postulate. Moreover, rejection of the projection postulate does not, in spite of what is often maintained in the literature, automatically lead to the many-worlds interpretation of quantum mechanics. A realistic interpretation is possible in which only the reality ofone (our) world is recognized. It is argued that the Copenhagen interpretation as expounded by Bohr is not in conflict with the here proposed realistic interpretation of quantum theory. (shrink)

Dopo gli annunci della 'morte dell'uomo', la dissoluzione del soggetto e la decostruzione dell'io, l'Autore, senza 'minimamente nascondere la sua identità di presbitero della Chiesa cattolica', ha messo a punto il suo impegnativo lavoro di docente e di raffinato studioso, per affrontare il gravoso e urgente problema della ricostruzione dell'io. Spesso la nostra cultura si limita a prendere atto della crisi antropologica e non propone vie d'uscita, alimentando un individualismo esasperato e la frattura interna dell'uomo. Con grande coraggio teoretico (...) e il pensare 'alto' l'Autore ci offre, attraverso un lungo percorso storico-filosofico, 'la rielaborazione e la messa a punto di uno sguardo non unilaterale e tendente alla riunificazione dell'essere umano, frantumato nell'estrema modernità con esiti che arrivano ai nostri giorni'. Il percorso ricostruttivo è alimentato nella prima parte del lavoro dalla rivisitazione e dalla lettura originale non solo di filosofi (Bergson, Husserl, Stein, Guardini, Karol Wojtyla), ma anche di artisti come Ungaretti e Stravinsky, scelti perché hanno contribuito 'ad uscire--per lo meno, ad indicare la strada per farlo--dalle secche del positivismo e della frantumazione dell'io'. La radice filosofica della scelta di questi autori sta 'nel nucleo concettuale generatore della coscienza, intenzionata verso ciò che è altro da sé'. Nella seconda e conclusiva parte, l'Autore mette sinteticamente in luce alcuni risultati rilevanti per delineare una visione antropologica, che affermi l'unicità e la dignità di ogni persona. Nella problematica generale dei rapporti tra Dio e l'uomo rientra il problema del diritto naturale. Tale problema si e manifestato in modo particolare nel secolo XVII come dimostra lo studio di Ugo Grozio (1583-1645). L'attualita delle sue idee e vivo anche oggi sia in Italia che all'estero; Grozio e ricordato soprattutto dai giuristi, nonostante la sua attivita si sia svolta anche in altri campi come dimostra l'opera bibliografica di Meulen J. Ter e Diermanse. Molti studiosi elogiano le sue impostazioni giuridiche (...) come per esempio G.B. Vico che lo chiama iurisconsultus generis humani. D'altra parte ci sono anche molti critici poco entusiasti del suo pensiero e che anzi lo accusano considerandolo l'iniziatore di una nuova corrente dottrinale che rompe la vera linea del diritto naturale iniziata dai greci, perfezionata dai romani e ripresa dalla scolastica. Da tutto questo appare chiaro che non e facile entrare nel pensiero del giurista di Delft. Questo lavoro vorrebbe dare una risposta al problema del diritto naturale e del suo rapporto con Dio. Si vuol vedere come si puo accordare la famosa affermazione una sola volta nel Prolegomena 11 del De iure belli ac pacis, che le norme del diritto naturale alocum aliquem haberent etiam daremusanon esse Deum, aut non curari a beo negotia humanaa la quale sembra separare il diritto dalla Divinita con la convinzione veramente religiosa di Grozio e con i suoi continui richiami all'autorita delle Sacre Scritture, dei Padri della Chiesa e dei teologi. Inappropriate authorship is a common problem in biomedical research and may be becoming one in bioethics, due to the increase in multiple authorship. This paper investigates the authorship policies of bioethics journals to determine whether they provide adequate guidance for researchers who submit articles for publication, which can help deter inappropriate authorship. It was found that 63.3% of bioethics journals provide no guidance on authorship; 36.7% provide guidance on which contributions merit authorship, 23.3% provide guidance on which contributions do not (...) merit authorship, 23.3% require authors to take responsibility for their contributions or for the article as a whole, 20% provide guidance on which contributions merit an acknowledgement but not authorship, 6.7% require authors to describe their contributions, and only 3.3% distinguish between authorship in empirical and conceptual research. To provide authors with effective guidance and promote integrity in bioethics research, bioethics journals should adopt authorship policies that address several important topics, such as the qualifications for authorship, describing authorship contributions, taking responsibility for the research and the difference between authorship in empirical and conceptual research. Chronic pain patients often miss receiving acknowledgement for the multidimensional struggles they face with their specific conditions. People suffering from chronic pain experience a type ofinvisibilitythat is also borne by other chronically ill people and their respective medical conditions. However, chronic pain patients face both passive and active exclusion from social participation in activities like family interactions or workplace inclusion. Although such aspects are discussed in the debates lead by the bio-psycho-social model of pain, there seems to be a lack (...) of a distinct interest in assessing more specifically the social aspects regarding chronic pain. As a result, the social aspects have yet to be taken into a more thorough theoretical consideration of chronic pain and to be practically implemented to help affected patients. By addressing chronic pain patients’ struggle for recognition, this paper attempts to shed light on some of these social aspects. We base this attempt on a theoretical framework that combines patients’ statements with an adaptation of Axel Honneth’s social-philosophical work onrecognition. Thus, this paper tries to make a suggestion on how the bio-psycho-social model of pain can live up to its name by helping to address more adequately some of the more neglected aspects in chronic pain patients’ suffering than has been possible to date. A study was carried out from October, 2020 to September, 2021to investigate the diversity of fishes and the conservation status of Chittaura Jheel (Bahraich), Uttar Pradesh. During the study period, 38 fish species belonging to 28 genera, 14 families and 7 orders have been identified. The order Cypriniformes was found the dominated order with 15 species(39.47%) followed by Siluriformes 10 species (26.31%), Perciformes 4 species (10.52%), Ophiocephaliformes 4 species (10.52%), Synbranchiformes2 species (5.26%), Osteoglossiformes 2 species (5.26%) and Clupiformes 1 species (...) (2.63 %), The present investigation showed that the wetland, Chittaura Jheel possesses rich fish biodiversity but proper conservation measures are required to maintain sustainability and richness of the fish species diversity of that wetland of U.P. According to IUCN, 30 were enlisted as Least Concern (LC), 2 species as near endangered (NE), 3 species as near threatened (NT), 2 listed as Endangered (EN) and 1 species was listed as Vulnerable (VU). There is a need of conservation of fish diversity of this natural wetland. The pressure is increasing day by day due to increasing population, leading to loss of fish diversity hence identifying the problem and making a better management plan is the way for conservation of the fish diversity of the Chittaura Jheel, a wetland of Bahraich district of Uttar Pradesh. In philosophical interpretations of the Laozi the function of the ‘sage’ is a relatively under concentrated on topic. Although nearly every scholar does have something to say about the sage, comments are usually brief and often revolve around the sage as some particular character-type; for example highlighting the sage as a ‘sage-ruler’. In this article we will argue that the sage serves as a tool for understanding the major concepts, thinking, and logic of the Laozi. While the sage does often (...) refer to the sage-ruler this does not mean all references are politically orientated, and even those that are can easily be applied to a host of social situations. This paper thus seeks to appreciate the context for what the Laozi says by looking at how the text itself envisions the embodiment of its ideas through reference to the sage. (shrink)

?Are the reasons for acting also the causes of action?? When this question was asked in the early 1960s it received by and large a negative reply: ?No, reasons are not causes?. Yet, when the same question ?Are the reasons for acting the causes of action?? is posed some twenty years later, the predominant answer is ?Yes, reasons are causes?. How could one and the same question receive such diverging answers in the space of only a couple of decades? This (...) paper argues that the shift from an anti-causalist to a causalist consensus is not fully accounted for by the results of first-order debates in the philosophy of action and is owing instead to a change in second-order meta-philosophical assumptions concerning the role and character of philosophical analysis. There is a common view in medical ethics that the patient's right to be informed entails, as well, a correlative right not to be informed, i.e., to waive one's right to information. This paper argues, from a consideration of the concept of autonomy as the foundation for rights, that there can be no such ‘right’ to refuse relevant information, and that the claims for such a right are inconsistent with both deontological and utilitarian ethics. Further, the right to be informed (...) is shown to be a mandatory right (though not a welfare right); persons are thus seen to have both a right and a duty to be informed. Finally, the consequences of this view are addressed: since the way in which we conceptualize our problems tends to determine the actions we take to resolve them, it is important properly to conceptualize patients' requests not to be informed. There may be many reasons for acting in accord with such a request, but it is a mistake to conceptualize one's act as ‘respecting a right possessed by persons’.
