The DAMA project is an observatory for rare processes and it is operative deep underground at the Gran Sasso National Laboratory of the I.N.F.N. In particular, the DAMA/LIBRA (Large sodium Iodide Bulk for RAre processes) set-up consists of highly radiopure NaI(Tl) detectors for a total sensitive exposed mass of ≃250 kg. Recent results, obtained by this set-up by exploiting the model independent annual modulation signature of Dark Matter (DM) particles, have confirmed and improved those obtained by the former DAMA/NaI experiment. (...) A model independent evidence for the presence of Dark Matter particles in the galactic halo is cumulatively obtained at 8.2 σ C.L. No systematics or side reactions able to account for the measured modulation amplitude and to contemporaneously satisfy all the many specific requirements of the signature have been found or suggested by anyone over more than a decade. An example of one of the many possible model dependent corollary quests for the candidate particles and for the related astrophysical, nuclear and particle physics scenarios is presented considering the whole cumulative exposure. Searches for non-paulian nuclear processes, i.e. processes normally forbidden by the Pauli–Exclusion–Principle (PEP) with highly radiopure NaI(Tl) scintillators allow the test of this fundamental principle with high sensitivity. Status and perspectives are addressed.

The current COVID-19 pandemic and the previous SARS/MERS outbreaks of 2003 and 2012 have resulted in a series of major global public health crises. We argue that in the interest of developing effective and safe vaccines and drugs and to better understand coronaviruses and associated disease mechenisms it is necessary to integrate the large and exponentially growing body of heterogeneous coronavirus data. Ontologies play an important role in standard-based knowledge and data representation, integration, sharing, and analysis. Accordingly, we initiated the (...) development of the community-based Coronavirus Infectious Disease Ontology in early 2020. -/- As an Open Biomedical Ontology (OBO) library ontology, CIDO is open source and interoperable with other existing OBO ontologies. CIDO is aligned with the Basic Formal Ontology and Viral Infectious Disease Ontology. CIDO has imported terms from over 30 OBO ontologies. For example, CIDO imports all SARS-CoV-2 protein terms from the Protein Ontology, COVID-19-related phenotype terms from the Human Phenotype Ontology, and over 100 COVID-19 terms for vaccines (both authorized and in clinical trial) from the Vaccine Ontology. CIDO systematically represents variants of SARS-CoV-2 viruses and over 300 amino acid substitutions therein, along with over 300 diagnostic kits and methods. CIDO also describes hundreds of host-coronavirus protein-protein interactions (PPIs) and the drugs that target proteins in these PPIs. CIDO has been used to model COVID-19 related phenomena in areas such as epidemiology. The scope of CIDO was evaluated by visual analysis supported by a summarization network method. CIDO has been used in various applications such as term standardization, inference, natural language processing (NLP) and clinical data integration. We have applied the amino acid variant knowledge present in CIDO to analyze differences between SARS-CoV-2 Delta and Omicron variants. CIDO's integrative host-coronavirus PPIs and drug-target knowledge has also been used to support drug repurposing for COVID-19 treatment. -/- CIDO represents entities and relations in the domain of coronavirus diseases with a special focus on COVID-19. It supports shared knowledge representation, data and metadata standardization and integration, and has been used in a range of applications. (shrink)

Technostress as an antecedent factor exploring knowledge hiding continues to be seldomly discussed in the digital era. Based on the job demand-resource theory, this article introduces work exhaustion as a mediator variable and constructs a model that the five sub-dimensions of technostress affect knowledge hiding for R&D employees. Similarly, this study analyzes the moderation of workplace friendship as the resource buffering effect. Based on data from the 254 questionnaires of the two-stage survey, empirical results show that: Techno-invasion, techno-insecurity, and techno-complexity (...) have significant positive effects on work exhaustion, and techno-invasion has the greatest effect. However, techno-overload and techno-uncertainty have no significant relationship with work exhaustion. Work exhaustion plays a mediating role in the relationships between the three aspects of technostress and knowledge hiding; However, its mediating effects are insignificant in the relationships between the two aspects of technostress and knowledge hiding. Workplace friendship negatively moderates the relationships between the two aspects of technostress and work exhaustion, leading to less knowledge hiding. Nonetheless, its negative moderation for the relationships between the two aspects of technostress and work exhaustion are insignificant. Empirical results further show that workplace friendship positively moderates the relationship between techno-complexity and work exhaustion. (shrink)

A hybrid preference framework is proposed for strategic conflict analysis to integrate preference strength and preference uncertainty into the paradigm of the graph model for conflict resolution (GMCR) under multiple decision makers. This structure offers decision makers a more flexible mechanism for preference expression, which can include strong or mild preference of one state or scenario over another, as well as equal preference. In addition, preference between two states can be uncertain. The result is a preference framework that is more (...) general than existing models which consider preference strength and preference uncertainty separately. Within the hybrid preference structure, four kinds of stability are defined as solution concepts and a post-stability analysis, called status quo analysis, which can be used to track the evolution of a given conflict. Algorithms are provided for implementing the key inputs of stability analysis and status quo analysis within the extended preference structure. The new stability concepts under the hybrid preference structure can be used to model complex strategic conflicts arising in practical applications, and can provide new insights for the conflicts. The method is illustrated using the conflict over proposed bulk water exports from Lake Gisborne in Newfoundland, Canada. (shrink)

It has been widely assumed and proven that a firm’s research and development investment is limited if the availability of cash flow is constrained. The purpose of this study is to verify the opposite proposition: whether firms invest heavily in R&D when more cash flow is available. This paper discusses the heterogeneous relationship between cash flow from different sources and the R&D investment of firms. The study divides the firm’s cash flow into three categories according to the business activities that (...) generate firm finance: cash flow from operating activities, cash flow from investing activities, and cash flow from financing activities. On this basis, a dynamic R&D investment model is constructed, and the relevant data for Chinese listed firms are used for the empirical research. The study finds that Chinese listed firms do not necessarily spend more cash on R&D investment, even if the availability of cash flow is not constrained. For young firms, CFO and CFI do not significantly correlate with R&D investment, and CFF significantly negatively correlates with R&D investment. For mature firms, the correlations between cash flow generated from different activities and R&D investment are nonsignificant. (shrink)

After the completion of I. Kant’s “Copernican” turn in metaphysics, all subsequent European philosophy to one degree or another was under his influence. The purpose of the article is to consider the reception and transformation of the Kantian theoretical philosophy by the Marburg school of neo-Kantianism. It is necessary to analyze the reasons for H. Cohen's and P. Natorp’s interpretation of Kant's criticism. To do this, one should consider (i) internalist and (ii) externalist factors in the formation of the Marburg (...) School. Neo-Kantianism, on the one hand, emerged as a response to materialism, naturalism, and post-Kantian German idealism. In addition, the Marburg School was strongly influenced by the change in the scientific paradigm in mathematical natural science at the end of the 19th century. The justification by the Marburgers of Kant’s a priori doctrine presupposed thematization, first of all, of: a) purity of thought; b) systematic unity of thought and experience; c) the orientation of philosophy to the “fact of science”; d) transcendental method. As a result, the Marburg School interpreted the Kantian concept of the unity of consciousness; abandoned the principle of synthetic (real) unity of consciousness in favor of systematic (logical) unity; substantiated the purity of scientific thinking; put forward the requirement of orientation of philosophy to the “fact of science”; developed the concept of the origin of thinking (Ursprung); abandoned the idea of “givenness” of the subject of knowledge and proved its “assignment”; changed the understanding of the essence and functions of the transcendental method; put forward the concept of thinking as “generation” (“production”); formulated a new understanding a priori. The changes that took place in the 19th century in philosophy, mathematical natural science and mathematical sciences led to a sharp activation of constructivism. It can be concluded that Kant’s epistemological paradigm was realistic constructivism. Pure constructivism became the paradigm of the Marburg School. (shrink)

The total ideology of the revolutionary-political themes of Ukrainian consciousness of the twentieth century, the poetization of the absurdly inverted hierarchy of values, was opposed by the new generation of artists with their philosophical and ethical orientation of their creativity. As I.Franko notes, they "... sought a completely modern European way to portray the peculiarity of the life of the Ukrainian people," revealing the unique collisionality of human existence, the diversity of psychological types, ideological orientations, and the human experience of (...) its existence on the background of this difficult time. However, Ukrainian writersphilosophers who talently laid the foundations of national culture, but are now returning to the generations of the Shattered Renaissance, filling black and bloody spots of troubled history of Ukraine. Among them are V. Pidmogylny, B. Antonovenko-Davidovich, G. Kosinka, D. Falkivsky, M.Ivchenko, T.Osmachka, E.Pluzhnik. De Jaegher’s (2009) paper argues that Gallagher, who aims to replace traditional theory-of-mind accounts of social understanding with accounts based on direct perception (hereafter DP), has missed an important opportunity. Despite a desire to break faith with tradition, there is a danger that proponents of DP accounts will remain (at least tacitly) committed to an unchallenged, and perhaps unnoticed, sort of individualism inherent in traditional theories (i.e. those that regard our engagement with others as a ‘problem’ to be solved: a (...) problem of other minds). Taking a more root and branch approach, De Jaegher recommends a complete shift of focus. She proposes that a more thoroughgoing and fruitful response to traditional approaches must attend to, and seek to understand, interactional phenomena proper—for it is the nature of interactions themselves that importantly influence individuals. Hence, it is the processes of interacting which ‘span individuals’ and their specific, dynamic evolution over time that should take pride of place in research into social cognition. De Jaegher wants to put interactional processes – those that can ‘take on life of their own’ and ‘influence interactors’ – at the heart of enquiries into intersubjectivity. Citing other recent work she has done with Di Paolo, she bills this as ‘‘the central task of any account of intersubjectivity” (De Jaegher, 2009, p. 2; De Jaegher & Di Paolo, 2007). The trouble is that this way of putting matters can make it look as if there is just one task facing researchers in this area; that we are faced with an either/or choice. But it is clear that any fully illuminated understanding of interactional phenomena will require accounts of what individuals and their sub-personal processes/mechanisms are doing in this larger process and, presumably, how their mechanisms/tendencies of response constrain and shape local bouts of interacting, even if we assume it is the dynamics of such encounters that importantly influence and shape what comes next.. This paper proposes a new system whose potential function is with three types of asymmetric potential wells, driven by trichotomous noise. Firstly, the three types of asymmetric bistable system are described in detail, and the changes of asymmetric bistable system potential function under different asymmetric factors are analyzed. Secondly, the effect of potential function parameters, asymmetric factorα, noise intensity D, and the probability of particle transition q is discussed, using numerical simulation. The detection effects of traditional symmetric SR and three (...) types of asymmetric SR are observed and compared under the driving of trichotomous noise and periodic signals. The mean of signal-to-noise ratio gain is the indicator of the system's effectiveness on enhancing weak signal. The results indicate that it can make the detection effect of the asymmetric system better than that of the traditional bistable system by adjusting the parameters of the asymmetric stochastic resonance system and trichotomous noise. This study investigated the concept of individual differences (IDs) in the use of metacognitive strategies (planning, problem-solving, monitoring, and evaluating) and its relationship with task demand and learner performance within Kormos’ Bilingual Speech Production Model from the lens of Chinese English-as-foreign-language (EFL) learners in the context of integrated L2 speaking assessment. To measure metacognitive strategies, we administered an inventory on 134 Chinese EFL learners after they completed four integrated L2 speaking assessment tasks. Descriptive analysis and multiple linear regression were adopted (...) for data analysis, and results show that: (a) IDs displayed variance in Chinese EFL learners’ metacognitive strategy use; (b) among the four metacognitive strategies under investigation, problem-solving was reported to be used the most frequently in sharp contrast to monitoring, which had the lowest frequency; (c) metacognitive strategies worked interactively, responding to task demands involved in the four integrated L2 speaking assessment tasks; and (d) Chinese EFL learners’ use of metacognitive strategies, in individual and interactive working modes, had no relationship with their speaking performance. These results are expected to present some insights into the role of IDs in metacognitive strategy use during L2 speech production under assessment conditions, which will add robust evidence to the existing literature on L2 speaking, in particular on metacognitive strategy use in L2 speaking assessment. In the meantime, the findings will provide some empirical validation support for Kormos’ model, which will further provide some implications for L2 speaking instruction and L2 assessment. (shrink)

In May 2019, the Vatican held a conference in Rome that focused on perinatal palliative care. In these troubled times, that would seem to be an arcane topic for the church to address. The speeches at the conference made it clear why the topic was timely and relevant. Speakers included scientists, clinicians, theologians, and advocates for a humane approach to clinical decisions in situations of prenatal diagnosis of fetal anomalies. Richard Lamm is an eloquent and insistent advocate for healthcare reform. In his paper, he argues that if reform is to be effective, a radical metamorphosis in the values underlying our present system must take place. “New realities” have made the “old values” unsustainable. Unless they are replaced by “new values,” we face a future of disastrous overspending, gross inequities in accessibility, poorer health for many, and more expensive dying.

?Are the reasons for acting also the causes of action?? When this question was asked in the early 1960s it received by and large a negative reply: ?No, reasons are not causes?. Yet, when the same question ?Are the reasons for acting the causes of action?? is posed some twenty years later, the predominant answer is ?Yes, reasons are causes?. How could one and the same question receive such diverging answers in the space of only a couple of decades? This (...) paper argues that the shift from an anti-causalist to a causalist consensus is not fully accounted for by the results of first-order debates in the philosophy of action and is owing instead to a change in second-order meta-philosophical assumptions concerning the role and character of philosophical analysis. This short paper addresses a well‐known difficulty in the Pure Theory of Law: the definition of a legal wrong. Kelsen was unable to offer a suitable one, critics say. I agree. But the critics misdiagnosed the problem, and prescribed for it a fruitless solution. The reason for Kelsen’s failure, the critics say, was that he thought the law consists only of sanction‐stipulating norms addressed to officials, and does not comprise duty‐imposing norms addressed to citizens. But the critics are wrong, exegetically (...) as well as substantively. Kelsen did not—and indeed could not—deny that there are such duty‐imposing norms; and it is not the case, in any event, that the admission that there are such norms would enable us to explain the notion of a legal wrong. Kelsen failed to provide an adequate characterization of the notion of a legal wrong, yes, but for a different reason. (shrink)

You find yourself in a court of law, accused of having hit someone. What can you do to avoid conviction? You could simply deny the accusation: 'No, I didn't do it'. But suppose you did do it. You may then give a different answer. 'Yes, I hit him', you grant, 'but it was self-defence'; or 'Yes, but I was acting under duress'. To answer in this way-to offer a 'Yes, but...' reply-is to hold that your particular wrong was committed in (...) exceptional circumstances. Perhaps it is true that, as a rule, wrongdoers ought to be convicted. But in your case the court should set the rule aside. You should be acquitted. Within limits, the law allows for exceptions. Or so we tend to think. In fact, the line between rules and exceptions is harder to draw than it seems. How are we to determine what counts as an exception and what as part of the relevant rule? The distinction has important practical implications. But legal theorists have found the notion of an exception surprisingly difficult to explain. This is the longstanding jurisprudential problem that this book seeks to solve. The book is divided into three parts. Part I, Defeasibility in Question, introduces the topic and articulates the core puzzle of defeasibility in law. Part II, Defeasibility in Theory, develops a comprehensive proof-based account of legal exceptions. We do not know whether there are other universes. Perhaps we never shall. But I want to argue that 'do other universes exist?' can be posed in a form that makes it a genuine scientific question. Moreover, I shall outline why it is an interesting question; and why, indeed, I already suspect that the answer may be 'yes'.

Much of modern ethics is built around the idea that we should respect one another’s autonomy. Here, “we” are typically imagined to be adult human beings of sound mind, where the soundness of our mind is measured against what we take to be the typical mental capacities of a neurodevelopmentally “normal” person—perhaps in their mid-thirties or forties. When deciding about what constitutes ethical sex, for example, our dominant models hold that ethical sex is whatever is consented to, while a lack (...) of consent makes sex wrong.1 Consent, in turn, is analysed in terms of autonomous decision-making: a “yes” or “no” that reflects the free and informed will of our idealised, sound-minded adult. Whether such models provide adequate normative guidance for ethical, much less good, sex between neurotypical human adults is an open question.2 3 When it comes to the ethics of sexual activity between humans and non-humans—robots, say—or between humans who don’t fit the rational stereotype, we hardly know where to begin.4–7 It is therefore heartening to see a number of papers in this issue tackling the difficult question how to respectfully facilitate or respond to the needs, desires, and decisions of people with different kinds or degrees of autonomy.8 For example, Sumytra Menon and colleagues9 explicitly discuss the notion of “borderline capacity” and argue, in the medical domain, for shared and supportive decision-making practices to “foster the autonomy of patients with compromised mental capacity while being mindful of the need to safeguard their well-being.” Touching on a similar theme, Zahra Ladan 10 asks how we should conceive of liberty in the case of persons with certain inborn physical or mental limitations. Many natural languages include plural terms, i.e., terms which denote many individuals at once. Are there also superplural terms, i.e., terms which denote many pluralities of individuals at once? Some philosophers say ‘Yes’, citing a range of sentence-types which apparently can’t be analyzed in a first-order plural logic, but which can be analyzed in a superplural one. We argue that all the data presented in favor of the superplural can, in fact, be analyzed using only first-order resources. The key is (...) to add to ordinary plural logic a new notion of a generalized cover. A generalized cover reflects how interlocutors in a conversation may divide a salient plurality into many subpluralities, which can then be involved in reference and predication. With generalized covers in place, all the apparently troublesome sentences can be easily handled. Our approach can also be extended to account, not only for linguistic data which seem to favor the superplural, but also for other phenomena involving plurals. The result is a unified approach to natural language plurals on which superplurals are analyzed away. (shrink)

It’s generally assumed that, if an agent x acts by ϕ-ing, then there occurs an event which is x’s ϕ-ing. But what about when an agent tries to do something? Are there such things as attempts? The standard answer is ‘Yes’. But in a series of articles, and now a book, David-Hillel Ruben has argued that the answer is ‘No’: what happens when x tries to ϕ isn’t that an attempt occurs; rather, what happens is simply that a certain subjunctive (...) conditional fact obtains; x tries to ϕ just in case, had all the necessary conditions for success obtained, x would have intentionally ϕ-ed. I defend the existence of attempts. Following Ruben, I frame the issue in terms of the logical form of trying sentences. Against Ruben’s view that such sentences express subjunctive conditionals, I argue that they express existential quantifications over attempts qua events. CUMMINS Lome Falkenstein's recognition in "Hume and Reid on the Simplicity of the Soul" of the importance of the section of A Treatise of Human Nature entitled "Of the immateriality of the soul" is as praiseworthy as it is uncommon. His suggestion that Reid's intentionalist account of representation was motivated by his (...) desire to save the doctrine of the immaterial self from Hume's demolition of it in "Of the immateriality of the soul," though not proven, is highly provocative. Although I am going to offer a somewhat different reading of "Of the immateriality of the soul" and thereby imply that Falkenstein did not sufficiently appreciate Hume's version of mental-physical dualism, I regard his paper as both informative and insightful and consider my proposed corrections fully compatible with most, if not all, of his substantive claims. Let me begin by contrasting two questions relating to mental-physical dualism. One is whether mental states or properties are irreducibly different from physical states or properties. Materialists generally acknowledge that there is an apparent, putative, or presumed difference between them, only to argue one way or another that the only genuine properties are material ones. Defenders of what I shall call Minimal Mental/Physical Dualism insist that the distinction between two fundamentally different kinds of properties remains at even the deepest levels of metaphysical analysis. One version of the second question is: Are there any immaterial beings? This question really concerns individual subjects, the items to which states or properties are assigned; it asks: do any individual subjects have only mental properties? To answer "yes" is to Phillip D. Kur’ân’da mescid kavramı daha çok Mescid-i Haram bağlamında gündeme gelmekte ve yeryüzünde kurulan ilk evin/maʿbedin Ka’be olduğu ifade edilmektedir. Mescidler, Mescid-i Haram gibi güven, huzur, istikrar veren özgün yapılardır. Mescidler; terbiye, eğitim, irşâd, tefekkür, birlik ve beraberlik, dayanışma, yardımlaşma vurguları ile toplumun sosyal açıdan gelişmesini sağlar. İslâm tarihinde camilerin ifa ettiği vazifeler, İslâm dininin diğer muharref dinler gibi dinle dünya işlerinin arasını ayırmadığını, dini kalbe hapsetmediğini göstermektedir. Hz. Peygamber ve sahabeler döneminde mescidler çok amaçlı mekânlar olarak kullanılmaktaydı. Mescidlerin Hz. Peygamber (...) dönemindeki fonksiyonelliğini kaybetmesi toplum üzerindeki etkinliğini zayıflatmıştır. Mescidler günümüzde sosyal etkinliklerle canlı duruma getirilmeli ve öyle ki mescidler/camiler hayat olmalıdır. Makalemizde mescid kavramın Kur’ân ve hadislerdeki yeri, önemi, işlevi incelenecek ve mescidlerin tarihsel serüveni ve fonksiyonları hakkında bilgi verilecektir. Çalışmamız, ülkemizde camilerin asli fonksiyonlarına dönmesi ve toplumsal alanda etkinliğinin arttırılması hedeflemektedir. Bunun için yapılması gereken bazı iyileştirme faaliyetleri üzerinde durulacak ve çözüm önerileri sunulacaktır. (shrink)

James Thobaben, the dean of Asbury Seminary, provides what he calls a [End (...) Page 203] “comprehensive resource” for evangelicals, and promises better understandings of their perspectives and commitments for those who are baffled or frustrated by the actions and claims of those on the religious right.Thobaben casts a wide net when defining those he includes as “evangelicals”—Southern Baptists, members of Campus Crusade, Pentecostals, the Holiness movement, neoevangelicals, charismatics, and Anabaptists. These diverse groups are evangelicals because of their “consistency on moral choices,” doctrinal orientation, and styles of social advocacy (24). Although they differ in a number of ways, they all share having been influenced in some way by John and Charles Wesley, Jonathan Edwards, and the Reformation. All stress conversion in that “one must say yes to the divine Jesus Christ” and become identified with the community of faithful believers (57). And in recent decades, they have become a potent political force with regard to the issues of abortion and homosexuality.Thobaben covers a wide range of topics in this book: from a general discussion of theodicy and healing to bioethics, disability, sickness, family and congregational care, professional truthfulness, managing care, end-of-life decisions, assisted reproduction, organ donation, and death. Yet, although he claims to provide a “comprehensive resource” on evangelical Christian health care ethics, he fails to provide a thorough examination of his subject matter. For example, Thobaben pays little attention to the historic beginnings of the religious right. One misses any mention of political action groups or the coalitions formed with or by conservative Christian groups to pursue social reforms, or of why such disparate groups have cooperated for political or social goals under the same umbrella. He focuses solely on identifying and articulating the consensus among those who embrace certain moral values on the current scene. Thobaben’s uncritical approach to his subject matter leaves the impression that this book is essentially an apology for evangelical, right-wing Christian social thought. One searches in vain for any critical discussion of the beliefs and values he presents or any thoughtful engagement with those who might view the stances he presents as an assault against women’s rights or an attack on the rights of gays, lesbians, and transsexuals.Moreover, in a book like this, one would have expected a more careful assessment of biblical passages and historical precedents. Thobaben does not provide much rationale for his method for moving from the Bible to current social issues. For example, no prohibition against abortion is found in the Bible and the few passages about homosexual practices hardly add up to the fierce opposition to gays found among strident evangelicals. Moreover, Thobaben does not mention that in 1965 laws against contraceptives were declared unconstitutional by the Griswold vs. Connecticut decision, the Supreme Court’s rejection of a ban supported by an evangelical crusade led by Anthony Comstock. [End Page 204]It is interesting to note that Thobaben holds a strongly qualified commitment to religious liberty and only a “thin” version of the social contract basic to the Bill of Rights (37). He argues that in at least some situations “intolerance is not only morally understandable but strongly preferable,” as in the examples of the “abolition of slavery and prolife/antiabortion advocacy” (29) or, in another context—where he distinguishes between tolerance toward those outside the church and intolerance toward those within it—with regard to homosexuality and alcohol intoxication (30).The task of Christian ethics is to enlighten believers and the general citizenry by a careful exposition of the sources of wisdom available to those who want to think and think morally about issues of importance to human flourishing. Abstract.In evolving to its great size the human brain has retained the distinctive features and chemistry of three kinds of brains that reflect an ancestral relationship to reptiles, early mammals, and late mammals. It constitutes, so to speak, a psychencephalon comprised of three‐brains‐in‐one, a triune brain. In the evolution from reptiles to mammals two key changes were the development of nursing and maternal care. Through the agency of “newer” parts of the brain a parental concern for family eventually generalizes not (...) only to other members of the species but to the entire biosphere, a psychological development that amounts to the evolution of responsibility and what we call conscience. Given our freedom to decide “yes” or “no” on various issues, we need not look beyond the evolving family to find a reason for being, an ethic to live by. (shrink)

Typical discussions of virtual reality (VR) fixate on technology for providing sensory stimulation of a certain kind. They thus fail to understand reality as the place wherein we live and work, misunderstanding it instead as merely a sort of presentation. The first half of the paper examines popular conceptions of VR. The most common conception is a shallow one according to which VR is a matter of simulating appearances. Yet there is, even in popular depictions, a second, more subtle conception (...) according to which VR is a matter of facilitating new kinds of interaction. The latter half of the paper turns to questions about the contemporary technology of Internet chatrooms. The fact that chatrooms can be used in certain ways suggests something about the prospects for VR. The penultimate section asks whether chatrooms may legitimately be thought of as places. (In a sense, they may.) The final section asks whether cybersex may legitimately be thought of as sex. (Again, yes.) Chatroom technology thus provides an argument for the second conception of VR over its much ballyhooed rival. (shrink)

The purpose of this paper is to discuss and to relate to each other two topics: the admissibility of ignorance and mistake of fact as defences against negligence in crime; and the inadmissibility of ignorance and mistake of law as defences against criminal charges. I am in not concerned at all with torts negligence, only with criminal offences which can be committed negligently, where negligence suffices for liability, as in the law of homicide. This produces an untidy classification of elements, (...) one or other of which is needed to provide the required mens rea : intention, knowledge, recklessness and negligence. It is untidy, because the last does not belong on the same list as the other three, each of which can appropriately be called a state of mind in what we might say to be a positive sense, for each of them includes some degree of awareness of and/or attitude to relevant facts. If negligence is to be called a state of mind, it is so in a very stretched and negative way: to be told that a person was not attending to, thinking of or noticing something that he should have been is to be given some information, of a negative sort, about his state of mind, but it tells us very little, for it eliminates only one of an unlimited range of states of mind. His not attending, noticing, etc., is equally compatible with his daydreaming and with his concentrating hard on something else. If negligence requires inadvertence, as is commonly maintained, then there was a state of mind which the agent should have been in but was not; if, as I would argue, it does not require inadvertence, then there was a state of mind which the agent should have been in, and maybe he was not in it, maybe he was in it. would not require it; the definition runs, ‘a person is negligent if he fails to exercise such care, skill or foresight as a reasonable man in his situation would exercise’. However, that is only a proposal; at present advertent negligence is rare in criminal law, although common in torts.) On this view, the questions are whether his performance fell below scratch, what are to be the excusing conditions for such a performance, and if the answer to is yes, whether his performance was covered by the excusing conditions. On the face of it, the answer is "Yes." Hence it is not surprising that many people who say they believe in God like to appeal to Einstein's authority in defense of their own beliefs. It gives them comfort to be able to say that such a great man shared their religious beliefs.

Boxers and healthcare workers alike should be able to exercise their rightsAlthough there are calls elsewhere to ban boxing, the Australian Medical Association advocates a less restrictive rule. Professional boxers would submit to brain scans and MRIs—but what to do with the results of such tests? Critics say that boxers should decide which risks they take, but boxers are not the only ones in the debate. Healthcare workers understandably want some say in which risks people take, because the hospital is (...) where boxers go when injuries occur . These issues of ethics and obligation are not made easier to resolve by the many disputed comparisons in this debate. Is boxing like other risk taking behaviour? Are physicians like other public employees? Until such questions are answered, a compromise would have check ups made mandatory, without forcing boxers to act on any knowledge gained.There is no shortage of comparisons in the debate over boxing. Boxing, we hear, is like fast food: dangerous yes, but it does offer some benefits. No, the opposing side contends, boxing is like a pistol duel: once considered sophisticated, it is now just a ritualistic violence. Perhaps boxing is like smoking: inform boxers of the risks and let them at it. Then again, if boxing is like smoking, people who do not realise how dangerous it is need protection from it. Depending on who you listen to, boxing is an expression of individualism and personal sacrifice—the next best thing to running your own country—or it illustrates the danger in letting concern for autonomy overstretch the social fabric. And so the comparisons continue, without really convincing anyone. Not surprisingly, reformist proposals that could include mandatory brain scans for boxers are viewed as intrusive …. (shrink)

But is it entirely a matter of total exploitation or is the answer to the title’s question more complex than a simple yes? The author is completing his MBA degree at London Business School, is an American citizen and has a background as a consultant in information technology.

In an article in JAPA 64/3, Lawrence Friedman addresses a question he takes as his title: “Is There a Usable Heidegger for Psychoanalysts?” I am happy to report that this question has already been answered in my own work with a resounding “Yes”!
