The social, ethical and legal implications of discoveries in the neurosciences.

On a version of consent theory that tempts many, predatory sexual relations involving significant power imbalances (e.g. between professors and students, adults and teenagers, or employers and employees) are wrong because they violate consent-centric norms. In particular, the wronged party is said to have been incapable of consenting to the predation, and the sexual wrong is located in the encounter’s nonconsensuality. Although we agree that these are sexual wrongs, we resist the idea that they are always nonconsensual. We argue instead (...) that it is possible for students, teenagers, employees, etc. to fully consent to sexually predatory encounters; denying as much renders survivors of predation vulnerable to compounding harms. Survivors face a dilemma: give up either their understanding of their experience as wrong, or their self-conception as an agent capable of consenting. We call the latter phenomenon agential demotion. Many extant theories of placebo focus on their causal structure wherein placebo effects are those that originate from select features of the therapy (e.g., client expectations or “incidental” features like size and shape). Although such accounts can distinguish placebos from standard medical treatments, they cannot distinguish placebos from everyday occurrences, for example, when positive feedback improves our performance on a task. Providing a social-epistemological account of a treatment context can rule out such occurrences, and furthermore reveal a new way to (...) distinguish clinical placebos from standard medical treatments. Superficially, citizenship appears relatively simple: a legal status denoting political membership. However, critical citizenship studies scholars suggest that citizenship is first and foremost a political practice. When non-citizens, such as irregularised migrants, constitute themselves as citizens through their actions, irrespective of legal status, these practices of citizenship have transformational potential because they are extra-legal. Yet, there is an ambivalence here: rights-claiming migrants tend to frame their key demands within the terms of the law often by calling for the regularisation of (...) their status. This article addresses this ambivalence by adopting a ‘deconstructive method’ to investigate the legal dimensions of citizenship as sites of theoretical and political intervention. It is argued that practices of rights-claiming by irregularised migrants are important to grasp because they mobilise the paradoxes inherent to the fact that universal rights are enshrined in the constitutional texts of modern citizenship in order to generate new legal meanings and horizons of justice. This hypothesis is explored through a series of illustrative examples of rights-claiming taking place within and beyond the formal confines of legal orders. In so doing, the article sets out a novel conceptual framework for analysing how migrants’ claims to justice strategically negotiate citizenship in its legal form. (shrink)

Small businesses in developing countries, as part of global supply chains, are sometimes assumed to respond in a straightforward manner to institutional demands for improved working conditions. This article problematizes this perspective. Drawing upon extensive qualitative data from Tirupur’s knitwear export industry in India, we highlight owner-managers’ agency in avoiding or circumventing these demands. The small businesses here actively engage in irresponsible business practices and “evasion” institutional work to disrupt institutional demands in three ways: undermining assumptions and values, dissociating consequences, (...) and accumulating autonomy and political strength. This “evasion” work is supported by three conditions: void, distance, and contradictions. Through detailed empirical findings, the article contributes to research on both small business social responsibility and institutional work. (shrink)

There has never been a time when ‘following the science’ has been more important for humanity. At no other point in history have we had such advanced knowledge and technology at our fingertips, nor had such astonishing capacity to determine the future of our planet. But the decisions we must make on how science is applied belong outside the lab and should be the outcome of wide public debate. For that to happen, science needs to become part of our common (...) culture. Science is not just for scientists: if it were, it could never save us from the multiple crises we face. For science can save us, if its innovations mesh carefully into society and its applications are channelled for the common good. As Martin Rees argues in this expert and personal analysis of the scientific endeavour on which we all depend, we need to think globally, we need to think rationally and we need to think long-term, empowered by twenty-first-century technology but guided by values that science alone cannot provide. Francis Bacon was a genuine midwife of modernity. He was one of the first thinkers to visualise a future which would be guided by a cooperative science-based vision of bettering human welfare. In this the first critical edition of his greatest philosophical work since the nineteenth-century, we find facing-page Latin translations and a thorough and detailed Introduction to the text.

Drawing on early work on ethical leadership, we argue that when leaders engage in leader moral hypocrisy (i.e., ethical promotion without ethical demonstration), followers can experience psychological reactance—a negative response to a perceived restriction of freedom—which can have negative downstream consequences. In a survey of employee–manager dyads (study 1), we demonstrate that leader moral hypocrisy is positively associated with follower psychological reactance, which increases follower deviance. In two subsequent laboratory experiments, we find similar patterns of results (study 2) and explore (...) potential alternative mechanisms (study 3). We demonstrate in a final experiment with working adults that the relationship between leader moral hypocrisy and psychological reactance is partly explained by increased perceptions of a leader’s use of power (study 4). We discuss the implications of our findings and advocate for further understanding of the risks associated with psychological reactance in response to leaders and other workplace situations. An essay about hypochondria, past and present. Beginning with the observation that for centuries hypochondria has been blamed upon various forms of reading, I attempt to take seriously this venerable relationship between hypochondria and literature. By bracketing the medical and moral concerns that encumber most treatments of hypochondria, I instead seek to understand the condition as a method of reading, a close textual engagement that is at once anxious and oddly clear-sighted about its own limits, and which bears some similarities (...) to other, more familiar hermeneutic methods such as paranoid reading and ‘too-close reading’. In the second half of the essay, I draw upon the lives and writings of Maurice Blanchot and Franz Kafka, two writers who were themselves plagued by mysterious and unexplained symptoms, and attempt to show how the imperatives of literature as understood by each writer could meaningfully be described as hypochondriacal. Above all, then, this essay looks more closely at a figure whom it is difficult to take seriously, and asks whether, viewed from a certain angle, the hypochondriac might in fact be said to be endowed with a perspicuous if discomfiting form of insight. Simone Weil was a remarkable woman: a teacher, a factory worker, a field hand, a traveler, and a frontline volunteer in the Spanish Civil War; yet she found time to write and to philosophize about life and religion. Her short life (1909–43) spanned two world wars, al­though she did not live to see the end of the second one. The reac­tions of this French Jewish woman to some of the facets of these conflicts may seem surprising; her sympathies and affirmations (...) were perhaps too extreme, but she did think for herself in an un­orthodox and challenging way and had a passionate sense of justice. Mr. Rees believes that this book may contain more illumina­tion for the present world’s spiritual needs than any other twentieth-­century commentary. Some of Simone Weil’s proposals concerning patriotism, obligations, freedom of expression, and the needs of the soul may seem Utopian, but they would not be unreasonable in a society adopting her moral code. Simone Weil was an intellectual with an essentially tragic view of life, but she was not removed from the everyday life. Her thought was unique and cannot be classified. She was neither a re­actionary nor a progressive but a great soul and a brilliant mind, as T. S. Eliot expressed it, “with a kind of genius akin to that of the saints.” Since she explored problems which confront modern man, the reader will find thoughtful stimulation in her work. In a previ­ous book, Brave Men, the author likened her to D. H. Lawrence—both lonely visionaries suffering from a devouring spiritual hunger. This book gives a condensed but penetrating account of Miss Weil’s interests. Since her writings cover more than philosophy and religion, the reader will feel compelled to become more familiar with her work. (shrink)

The manuscript notes described and trascribed below are unique: they show Bacon in the very act of originating, selecting and developing materials for the natural-philosophical projects of the crucial last years of his life. Many of the notes are drafts of material later incorporated in published texts—notably the Sylva Sylvarum . Examination of the drafts indicates that the Sylva is not a hotch-potch of plagiarized scraps. Bacon took great pains, acknowledged borrowings and drew heavily on his own extensive experimental and (...) observational work. The drafts also show that much of the material was used to display the explanatory power of his ambitious speculative philosophy. Preoccupation with the speculative philosophy is also evidenced in the notes which have no counterpart in the published works. Among these notes is a passage on the size of the universe, the motion of the fixed stars and the hypothesis of the earth's diurnal rotation. In that passage Bacon struggled with threats to his unswervingly geostatic conception of the universe. (shrink)

Unsustainability is an old problem - human societies have collapsed with disturbing regularity throughout history. I argue that a genetic predisposition for unsustainability is encoded in certain human physiological, social and behavioral traits that once conferred survival value but are now maladaptive. A uniquely human capacity - indeed, necessity - for elaborate cultural myth-making reinforces these negative biological tendencies. Our contemporary, increasingly global myth, promotes a vision of world development centered on unlimited economic expansion fuelled by more liberalized trade. This (...) myth is not only failing on its own terms but places humanity on a collision course with biophysical reality - our ecological footprint already exceeds the human carrying capacity of Earth. Sustainability requires that we acknowledge the primitive origins of human ecological dys-function and seize conscious control of our collective destiny. The final triumph of enlightened reason and mutual compassion over scripted determinism would herald a whole new phase in human evolution. (shrink)

For most of the twentieth century, anthropologists understood themselves as ethnographers. The art of anthropology was the fieldwork-based description of faraway others—of how social structures secretly organized the living-together of a given society, of how a people had endowed the world surrounding them with cultural meaning. While the poetics and politics of anthropology have changed dramatically over the course of a century, the basic equation of anthropology with ethnography—as well as the definition of the human as a social and cultural (...) being—has remained so evident that the possibility of questioning it occurred to hardly anyone. In After Ethnos Tobias Rees endeavors to decouple anthropology from ethnography—and the human from society and culture—and explores the manifold possibilities of practicing a question-based rather than an answer-based anthropology that emanates from this decoupling. What emerges from Rees's provocations is a new understanding of anthropology as a philosophically and poetically inclined, fieldwork-based investigation of what it could mean to be human when the established concepts of the human on which anthropology has been built increasingly fail us. Unfortunately, business is often associated with unethical behavior. While research has offered a number of explanations for why business might encourage unethical behavior, we argue that how a person frames a situation may provide important insight. Drawing on the decision frame literature, the goal of the current research is to identify the differences in cognitive processing associated with two decision frames dominant in the business ethics literature—business and ethical—and, with that knowledge, examine ways to mitigate the detrimental influence of frame (...) on unethical behavior. We first demonstrate the causal link between frame and misrepresentation, and then identify several differences in cognitive processing—cost–benefit analyses, concern for others, and construal level—that distinguish business and ethical frames, and investigate their effects on misrepresentation. In our final set of studies, we demonstrate that the influence of these frames on misrepresentation can be altered by manipulating these cognitive processes, both mitigating and exacerbating a decision maker’s engagement in misrepresentation. We conclude by summarizing our findings and their potential impact on unethical behavior more broadly. (shrink)

Widely regarded as the most influential proponent of the truth of original sin in the twentieth century, Reinhold Niebuhr worked hard to excise any "literalistic" element from his interpretation of the doctrine. In his attempt to "correct" the Augustinian tradition on original sin by purging it of all "literalistic errors," however, Niebuhr assumed as his starting point the most characteristically modern objection to the doctrine: that birth is a thoroughly natural, animal, and morally meaningless event. As a result, Niebuhr unnecessarily (...) constrained his vision of the dimensions of human freedom, and hence his description of the dynamic of anxiety and freedom that energizes sin. Through a careful reading of Reinhold Niebuhr's writings on original sin, in light of the truth that the end of human life is inseparable from its origins, a reappraisal and recovery of the meaningfulness of the assertion of original sin as a literal inheritance is possible. The result of such a reappraisal and recovery is an amplified insight into the existential anxiety that Niebuhr otherwise described so convincingly. (shrink)

Automaticity is rapid and effortless cognition that operates without conscious awareness or deliberative control. An action is virtuous to the degree that it meets the requirements of the ethical virtues in the circumstances. What contribution does automaticity make to the ethical virtue of an action? How far is the automaticity discussed by virtue ethicists consonant with, or even supported by, the findings of empirical psychology? We argue that the automaticity of virtuous action is automaticity not of skill, but of motivation. (...) Automatic motivations that contribute to the virtuousness of an action include not only those that initiate action, but also those that modify action and those that initiate and shape deliberation. We then argue that both goal psychology and attitude psychology can provide the cognitive architecture of this automatic motivation. Since goals are essentially directed towards the agent’s own action whereas attitudes are not, we argue that goals might underpin some virtues while attitudes underpin others. We conclude that consideration of the cognitive architecture of ethical virtue ought to engage with both areas of empirical psychology and should be careful to distinguish among ethical virtues. Disclosure in clinical practice is aimed at promoting patient autonomy, usually culminating in patient choice (e.g., to consent to an operation or not, or between different medications). In medical ethics, there is an implicit background assumption that knowing more about (X) automatically translates to greater, or more genuine, autonomy with respect to one's choices involving (X). I challenge this assumption by arguing that in rare cases, withholding information can promote a patient's autonomy (understood as the capacity for rational choice in (...) alignment with one's values and goals). Jürgen Habermas’ discourse theory of morality should be understood, in metaethical terms, as a constructivist theory. All constructivist theories face a Euthyphro-like dilemma arising from how they classify the constraints on their metaethical construction procedures: are they moral or non-moral? Many varieties of Kantian constructivism, such as Christine Korsgaard’s, classify the constraints as moral, albeit constitutive of human reason and agency in general. However, this constitutivist strategy is vulnerable to David Enoch’s ‘shmagency’ objection. The discourse theory of morality, by classifying (...) the constraints on the metaethical construction procedure (principles (D) and (U)) as non-moral, can avoid this problem. (shrink)
