The dominant language of politics in the United States has been political individualism, with minimal restrictions on property and personal, voluntary conduct. But there are second languages of community that stress cooperation and group action. These second languages include the constitutional tradition for public health. Public health offers a community justification for paternalistic measures that, for example, discourage smoking or require seatbelts.

We have some of our properties purely in virtue of the way we are. (Our mass is an example.) We have other properties in virtue of the way we interact with the world. (Our weight is an example.) The former are the intrinsic properties, the latter are the extrinsic properties. This seems to be an intuitive enough distinction to grasp, and hence the intuitive distinction has made its way into many discussions in philosophy, including discussions in ethics, philosophy of mind, (...) metaphysics, epistemology and philosophy of physics. Unfortunately, when we look more closely at the intuitive distinction, we find reason to suspect that it conflates a few related distinctions, and that each of these distinctions is somewhat resistant to analysis. Some medical services have long generated deep moral controversy within the medical profession as well as in broader society and have led to conscientious refusals by some physicians to provide those services to their patients. More recently, pharmacists in a number of states have refused on grounds of conscience to fill legal prescriptions for their customers. This paper assesses these controversies. First, I offer a brief account of the basis and limits of the claim to be free to act on (...) one’s conscience. Second, I sketch an account of the basis of the medical and pharmacy professions’ responsibilities and the process by which they are specified and change over time. Third, I then set out and defend what I call the “conventional compromise” as a reasonable accommodation to conflicts between these professions’ responsibilities and the moral integrity of their individual members. Finally, I take up and reject the complicity objection to the conventional compromise. Put together, this provides my answer to the question posed in the title of my paper: “Conscientious refusal by physicians and pharmacists: who is obligated to do what, and why?”. (shrink)

This book argues that political libertarianism can be grounded in widely shared, everyday moral beliefs--particularly in strictures against shifting our burdens onto others. It also seeks to connect these philosophical arguments with related work in economics, history, and politics for a wide-ranging discussion of political economy.

In a range of contexts, individuals arrive at collective decisions by sharing confidence in their judgements. This tendency to evaluate the reliability of information by the confidence with which it is expressed has been termed the ‘confidence heuristic’. We tested two ways of implementing the confidence heuristic in the context of a collective perceptual decision-making task: either directly, by opting for the judgement made with higher confidence, or indirectly, by opting for the faster judgement, exploiting an inverse correlation between confidence (...) and reaction time. We found that the success of these heuristics depends on how similar individuals are in terms of the reliability of their judgements and, more importantly, that for dissimilar individuals such heuristics are dramatically inferior to interaction. Interaction allows individuals to alleviate, but not fully resolve, differences in the reliability of their judgements. We discuss the implications of these findings for models of confidence and collective decision-making. (shrink)

While much ink has been spilt over the political importance of speech, much less has been dedicated to the political importance of silence. This article seeks to fill that gap. We propose the need for a robust, democratic right to silence in public life and argue that there are politically salient epistemic reasons for recognising that right. We begin by defining what silence is and what a robust right to silence entails. We then argue that the right to silence offers (...) two politically salient epistemic benefits. The first is that, if the right to silence is maintained, we can avoid the epistemic harm that may be caused when an individual is compelled to lie in public. The second is that the right to silence can protect marginalised individuals against the epistemic injustices that may arise when others are likely to misconstrue their speech. (shrink)

Most research on student plagiarism defines the concept very narrowly or with much ambiguity. Many studies focus on plagiarism involving large swaths of text copied and pasted from unattributed sources, a type of plagiarism that the overwhelming majority of students seem to have little trouble identifying. Other studies rely on ambiguous definitions, assuming students understand what the term means and requesting that they self-report how well they understand the concept. This study attempts to avoid these problems by examining student perceptions (...) of more complex citation issues. We presented 240 students with a series of examples, asked them to indicate whether or not each should be considered plagiarism, and followed up with a series of demographic and attitudinal questions. The examples fell within the spectrum of inadequate citation, patchwriting, and the reuse of other people’s ideas. Half were excerpted from publicized cases of academic plagiarism, and half were modified from other sources. Our findings indicated that students shared a very strong agreement that near verbatim copy and paste and patchwriting should be considered plagiarism, but that they were much more conflicted regarding the reuse of ideas. Additionally, this study found significant correlation between self-reported confidence in their understanding and the identification of more complex cases as plagiarism, but this study found little correlation between academic class status or exposure to plagiarism detection software and perceptions of plagiarism. The latter finding goes against a prevailing sentiment in the academic literature that the ability to recognize plagiarism is inherently linked to academic literacy. Overall, our findings indicate that more pedagogical emphasis may need to be placed on complex forms of plagiarism. (shrink)

Brock (bio)IntroductionShared treatment decision making, with its division of labor between physician and patient, is a common ideal in medical ethics for the physician-patient relationship.1 Most simply put, the physician's role is to use his or her training, knowledge, and experience to provide the patient with facts about the diagnosis and about the prognoses without treatment and with (...) alternative treatments. The patient's role in this division of labor is to provide the values—his or her own conception of the good—with which to evaluate these alternatives, and to select the one that is best for himself or herself. As a rough guide to practice, this is a reasonable conception; most of the time it is likely to produce sound treatment decisions. However, as an ideal it is too simplistic, and is subject to several challenges that I will explore in this paper.Some challenges relate to the physician's role. This facts/values division of labor seems to assume that the physician can and should provide the facts about treatment alternatives in a value-neutral form. But some have questioned whether the sciences on which medicine is based are, or can be, value free. Moreover, the concepts of health and disease, and of the normal and pathological, are held by many to be value laden. And even if it is possible for physicians to provide only value-neutral facts to the patient, should the physicians' role be restricted in this way?Other challenges that I will present in the paper are to the patient's role [End Page 28] as provider of the values for the evaluation of the different treatment alternatives. One defense of this role is based on the claim that physicians are not in a position to know reliably what is in a patient's best interests (Buchanan, forthcoming). I believe at least as influential—even if often not explicitly stated—is an extreme subjectivism about values that assumes that the patient's own ultimate values, which define his or her own conception of the good, are incorrigible. By incorrigible, I mean they cannot be mistaken. In the standard case in which treatment is pursued for the patient's benefit, this extreme subjectivism is thought to support the patient's values guiding treatment decision making and treatment. I will explore this incorrigibility claim and will argue that on each of the main philosophical conceptions of the good for persons it is indefensible and should not be the basis for shared treatment decision making.Underlying this view of the physician-patient division of labor are assumptions and beliefs about the nature and relation of facts and values, and science and ethics, that are largely the legacy of a logical positivism that has long since been rejected by most philosophers. The leading account of intrinsicality over the last thirty years has arguably been David Lewis's account in terms of perfect naturalness. Lewis's account, however, has three serious problems: i) it cannot allow necessarily coextensive properties to differ in whether they are intrinsic; ii) it falsely classifies non-qualitative properties like being Obama as non-intrinsic; and iii) it is incompatible with a number of metaphysical theories that posit irreducibly non-categorical properties. I argue that, as a result of these problems, Lewis's account should (...) be rejected and replaced with an alternative account, which also analyses intrinsicality in terms of perfect naturalness, but which avoids these problems. Careerism refers to an individual’s propensity to achieve their personal and career goals through nonperformance-based activities. We investigated the role of several dispositional predictors of careerism, including Five-factor model personality traits, primary psychopathy, and exchange ideology. Based on data from 131 respondents, as expected, we observed that emotional stability was negatively correlated with careerism. Primary psychopathy and exchange ideology explained additional variance in careerism after accounting for FFM traits. Relative importance analyses indicated that psychopathy and exchange ideology were equally important (...) in predicting careerism. We highlight the need for future research efforts investigating the combined effects of contextual factors—particularly, human resource practices—and individual differences to understand careerism in the workplace. Some influential interpreters of Dharmakīrti have suggested understanding his thought in terms of a ‘sliding scale of analysis.’ Here it is argued that this emphasis on Dharmakīrti's alternating philosophical perspectives, though helpful in important respects, obscures the close connection between the two views in play. Indeed, with respect to these perspectives as Dharmakīrti develops them, the epistemology is the same either way. Insofar as that is right, John Dunne's characterization of Dharmakīrti's Yogācāra as ‘epistemic idealism ’ may not, after all, (...) distinguish this perspective from Sautrāntika; indeed, epistemic idealism can be understood as just the view these positions share. Thus, what distinguishes the ‘Yogācāra’ section of Dharmakīrti's texts is simply his making explicit that epistemological commitments the Sautrāntika does hold are already compatible with idealism. When it has addressed justice or equity, it has focused on access to health care and on defending a general moral right to health care. This dual focus on establishing a right to health care and on health care rather than health has left bioethics largely silent on two issues of fundamental importance for a full account of justice and health. First, the focus on establishing a right to (...) health care has contributed to a failure to address difficult issues in developing ethical standards for equitably prioritizing limited resources in health care. Second, the focus on inequalities in access to health care has ignored the much greater impact of social determinants of health, in particular socioeconomic class and inequality, on health and health inequalities. Organizational citizenship behaviors (OCBs) are essential for effective organizational functioning. Decisions by employees to engage in these important discretionary behaviors are based on how they make sense of the organizational context. Using fairness heuristic theory, we tested two important OCB predictors: manager trustworthiness and interactional justice. In the process, we control for the effects of dispositional factors (propensity to trust) and for system-based organizational fairness (procedural and distributive justice). Results, based on surveys collected from 120 employee–supervisor dyads, indicate that manager (...) trustworthiness explains variance in OCBs over and above the variance accounted for by interactional fairness. This paper is an application of the principles of individuality found in Guay and Pradeu to illuminate biological individuality in mushrooms. I begin with the distinction between logico-cognitive individuals and ontological individuals, and then I argue for genidentity plus material continuity, as a minimum conception of ontological individuality in biology. Of the many materially-continuous genidenticals found in fungi, only those with functional roles in biological theory, either evolutionary or physiological, warrant consideration. In the lengthy debate over the question of scientific realism one of the least discussed positions is structural realism. However, this position ought to attract critical attention because it purports to preserve the central insights of the best arguments for both realism and anti-realism. John Worrall has in fact described it as being ‘the best of both worlds’ that recognizes the discontinuous nature of scientific change as well as the ‘no-miracles’ argument for scientific realism. However, the validity of this claim (...) has been called into question by Stathis Psillos. In this paper I argue against Nancy Cartwright's claim that we ought to abandon what she calls "fundamentalism" about the laws of nature and adopt instead her "dappled world" hypothesis. According to Cartwright we ought to abandon the notion that fundamental laws apply universally, instead we should consider the law-like statements of science to apply in highly qualified ways within narrow, non-overlapping and ontologically diverse domains, including the laws of fundamental physics. For Cartwright, "laws" are just locally applicable refinements of (...) a more open-ended concept of capacities. By providing a critique of the dappled world approach's central notion of open ended capacities and substituting this concept with an account of properties drawn from recent writing on the subject of structural realism I show that a form of fundamentalism is viable. I proceed from this conclusion to show that this form of fundamentalism provides a superior reading of case studies, such as the effective field theory program in quantum field theory, than the "dappled world" view. The case study of the EFT program demonstrates that ontological variability between theoretical domains can be accounted for without altogether abandoning fundamentalism or adopting Cartwright's more implausible theses. Abstract:This paper examines two recent trends relative to boards of directors’ compensation, and their potential incompatibility. There has been some progress in increasing board diversity, specifically the inclusion of women and minorities on boards. The increasing trend requiring directors to hold/purchase equity as a requirement of board membership may seriously compromise further improvements in diversifying boards. Also, an increasing number of companies compensate directors partially or fully in stock grants and options. These compensation policies may be exclusionary, especially for women (...) and minorities, impacting the quality of boardroom discussions and decisions. This study systematically examines whether corporations requiring director equity are exclusionary toward women and minority directors. Contrary to being exclusionary, companies with director stock requirements and annual stock awards have greater representation by women and minorities on their board. Moreover, larger companies are both more likely to have such policies and have higher proportions of women and minorities on the board. (shrink)

We present a novel generative model for natural language tree structures in which semantic (lexical dependency) and syntactic (PCFG) structures are scored with separate models. This factorization provides conceptual simplicity, straightforward opportunities for separately improving the component models, and a level of performance comparable to similar, non-factored models. Most importantly, unlike other modern parsing models, the factored model admits an extremely effective A* parsing algorithm, which enables efficient, exact inference.

This essay reconsiders Jean-Jacques Rousseau’s debt to Jean Bodin, on the basis of Daniel Lee’s recent revision of Bodin as a theorist of popular sovereignty. It argues that Rousseau took a key feature of his own theory of democratic sovereignty from Bodin—namely, the dual identity of political members as both citizens and subjects of the state. It further makes the case that this dual identity originates in medieval corporatist law, which Bodin was summarizing. Finally, it demonstrates the lasting impact of (...) corporatist law in eighteenth-century France, highlighting Rousseau’s direct borrowings from the corporatist language and logic of contemporary commercial societies. In this regard, the article revisits and updates Otto von Gierke’s classic argument about the origins of the state in corporatist thought. (shrink)

The intense and extensive debate over human embryonic stem cell research has focused primarily on the moral status of the human embryo. Some commentators assign full moral status of normal adult human beings to the embryo from the moment of its conception. At the other extreme are those who believe that a human embryo has no significant moral status at the time it is used and destroyed in stem cell research. And in between are many intermediate positions that assign an (...) embryo some degree of moral status between none and full. This controversy and the respective positions, like the abortion controversy, is by now well understood, despite the lack of progress in resolving it. I have argued briefly elsewhere that early embryos do not have significant moral status, but I do not want to reenter that debate here. Instead, I want to focus on an issue that has had relatively little explicit and separate attention, but is likely to loom larger in light of the Obama administration’s partial lifting of the Bush administration’s restriction on the embryos that can be used in stem cell research that receives federal funding. Data science is not simply a method but an organising idea. Commitment to the new paradigm overrides concerns caused by collateral damage, and only a counterculture can constitute an effective critique. Understanding data science requires an appreciation of what algorithms actually do; in particular, how machine learning learns. The resulting ‘insight through opacity’ drives the observable problems of algorithmic discrimination and the evasion of due process. But attempts to stem the tide have not grasped the nature of data science as (...) both metaphysical and machinic. Data science strongly echoes the neoplatonism that informed the early science of Copernicus and Galileo. It appears to reveal a hidden mathematical order in the world that is superior to our direct experience. The new symmetry of these orderings is more compelling than the actual results. Data science does not only make possible a new way of knowing but acts directly on it; by converting predictions to pre-emptions, it becomes a machinic metaphysics. The people enrolled in this apparatus risk an abstraction of accountability and the production of ‘thoughtlessness’. Susceptibility to data science can be contested through critiques of science, especially standpoint theory, which opposes the ‘view from nowhere’ without abandoning the empirical methods. But a counterculture of data science must be material as well as discursive. Karen Barad’s idea of agential realism can reconfigure data science to produce both non-dualistic philosophy and participatory agency. An example of relevant praxis points to the real possibility of ‘machine learning for the people’. (shrink)

In my work on Kant’s Transcendental epistemology, I criticize his three Critiques and show that none of them can solve the problems that Kant endeavored to solve; and he even, in a way, admitted it. In the first Critique, Kant attempts to solve the difficulties of the Cartesian Idealism and Humean Empirism, in combining them mechanically in his own Transcendental formalism and Sensual matter without being able to bridge the gap between them. In the second Critique, Kant endeavored to make (...) his Practical Reason of the a priori pure fact of formal morality into free moral conduct to materialize his ideal commonwealth of ends, but he could not bridge this gap. In his third Critique, Kant attempted to make the aesthetic reflective judgment of beauty objective, including of artworks, but failed to do so. The Peircean pragmaticist method can save the theory of knowledge both from the dogmatism of the metaphysical realists and from the inconsistency of the phenomenalists and holists. Peirce developed his epistemological realism in response to the difficulties of Kant’s transcendental epistemology, especially that of his three Critiques. It seems that in his late research Kant tries to follow Spinoza in the distinction between the causality in nature and the human inner causality as one’s Moral freedom and yet for Kant they operate in different domains to keep human freedom absolute, while the Spinozist conception of human freedom is in Nature and relative to human knowledge of reality and one’s relative power in Nature. Kant’sAnthropology from a Pragmatic Point of Viewis a continuation of his Transcendental critical philosophy, but also his intended empirical epistemology by which to develop a practical deviation from his Copernican Revolution in the direction of the Peircean contra-revolution in Pragmaticist epistemology. In this essay I challenge the idea that political agency must be central to the concept of citizenship. I consider this question in relation to whether or not domesticated animals can be understood as our fellow citizens. In recent debates on this topic, both proponents and opponents of animal citizenship have taken political agency to be central to this question. I advance two main arguments against this position. First, I argue against the orthodox view that claims political agency is a (...) requirement of citizenship. This position ignores both how citizenship is understood in practice by modern, liberal democracies, as well as the separate functions of citizenship. Further, there are no plausible ways we can consistently extend citizenship to humans regardless of intellectual ability, while denying it to domesticated animals. Nevertheless, I argue that it is important to distinguish two ways in which citizenship is enacted: Citizenship as Membership and Citizenship as Responsible, Political Agent. Domesticated animals should be understood as citizens, despite the fact that they are not responsible, political agents. Second, I challenge the view, put forward by Donaldson and Kymlicka, that animals are capable of certain forms of political agency. I argue that political agency is not crucial to whether, and how, the preferences of these animals matter for political decision-making. The upshot of my argument is that political agency matters much less to debates about the citizenship of non-human animals than both sides of this debate have been inclined to think. (shrink)

This paper presents a novel approach to the unsupervised learning of syntactic analyses of natural language text. Most previous work has focused on maximizing likelihood according to generative PCFG models. In contrast, we employ a simpler probabilistic model over trees based directly on constituent identity and linear context, and use an EM-like iterative procedure to induce structure. This method produces much higher quality analyses, giving the best published results on the ATIS dataset.
