The transparency of the judicial process and the consistency of judicial decisions can be improved through their publication. Access to jurisprudence is of paramount importance both for law professionals (judges, lawyers, law students) and for the larger public. However, public access must ensure the preservation of privacy for people involved, in accordance with national and international regulations. This paper presents the work behind building an artificial intelligence system for the anonymization of Romanian jurisprudence, allowing it to be accessed through the (...) The idea that there are some facts that call for explanation serves as an unexamined premise in influential arguments for the inexistence of moral or mathematical facts and for the existence of a god and of other universes. This book is the first to offer a comprehensive and critical treatment of this idea. It argues that calling for explanation is a sometimes-misleading figure of speech rather than a fundamental property of facts.

Review of Philosophy and Psychology has lately published a number of papers that in various ways take issue with and criticize my work on the link between consciousness, self-consciousness and selfhood. In the following contribution, I reply directly to this new set of objections and argue that while some of them highlight ambiguities in my work that ought to be clarified, others can only be characterized as misreadings.

In this chapter we focus on the debate over publicly-maintained racist monuments as it manifests in the mid-2010s Anglosphere, primarily in the US (chiefly regarding the over 700 monuments devoted to the Confederacy), but to some degree also in Britain and Commonwealth countries, especially South Africa (chiefly regarding monuments devoted to figures and events associated with colonialism and apartheid). After pointing to some representative examples of racist monuments, we discuss ways a monument can be thought racist, and neutrally categorize removalist (...) and preservationist arguments heard in the monument debate. We suggest that both extremist and moderate removalist goals are likely to be self-defeating, and that when concerns of civic sustainability are put on moral par with those of fairness and justice, something like a Mandela-era preservationist policy is best: one which removes the most offensive of the minor racist monuments, but which focuses on closing the monumentary gap between peoples and reframing existing racist monuments. Philosophers of physics have long debated whether the Past State of low entropy of our universe calls for explanation. What is meant by “calls for explanation”? In this article we analyze this notion, distinguishing between several possible meanings that may be attached to it. Taking the debate around the Past State as a case study, we show how our analysis of what “calling for explanation” might mean can contribute to clarifying the debate and perhaps to settling it, thus demonstrating the (...) fruitfulness of this analysis. Applying our analysis, we show that two main opponents in this debate, Huw Price and Craig Callender, are, for the most part, talking past each other rather than disagreeing, as they employ different notions of “calling for explanation”. We then proceed to show how answering the different questions that arise out of the different meanings of “calling for explanation” can result in clarifying the problems at hand and thus, hopefully, to solving them. Dan Marshall and Josh Parsons note, correctly. that the property of being either a cube or accompanied by a cube is incorrectly classified as intrinsic under the definition we have given unless it turns out to be disjunctive. Whether it is disjunctive, under the definition we gave, turns on certain judgements of the relative naturalness of properties. They doubt the judgements of relative naturalness that would classify their property as disjunctive. We disagree. They also suggest that the whole idea of (...) judging relative naturalness is a dubious business. We reply that, like them or not, such judgements cannot easily be avoided. (shrink)

Motivated by examples, many philosophers believe that there is a significant distinction between states of affairs that are striking and therefore call for explanation and states of affairs that are not striking. This idea underlies several influential debates in metaphysics, philosophy of mathematics, normative theory, philosophy of modality, and philosophy of science but is not fully elaborated or explored. This paper aims to address this lack of clear explanation first by clarifying the epistemological issue at hand. Then it introduces an (...) initially attractive account for strikingness that is inspired by the work of Paul Horwich and adopted by a number of philosophers. The paper identifies two logically distinct accounts that have both been attributed to Horwich and then argues that, when properly interpreted, they can withstand former criticisms. The final two sections present a new set of considerations against both Horwichian accounts that avoid the shortcomings of former critiques. It remains to be seen whether an adequate account of strikingness exists. (shrink)

[Updated 2/23/21: complete chapter scan] In this chapter I sketch a rightist approach to monumentary policy in a diverse polity beleaguered by old ethnic grievances. I begin by noting the importance of tribalism, memorialization, and social trust. I then suggest a policy which 1) gradually narrows the gap between peoples in the heritage landscape, 2) conserves all but the most offensive of the least beloved racist monuments, 3) avoids recrimination (i.e., “keeps it positive”) and eschews ideological commentary in new monuments (...) or revisions to old ones, 4) as much as politically feasible, recognizes only the offense of willing tribemates, and 5) responds to aesthetic and other “irrational” offenses more than to “objective” historical or philosophical critiques. Epistemologists are engaged, among other things, in the business of formulating epistemic norms. That is, they formulate principles that tell us what we should believe and to what degree of confidence, or how to evaluate such epistemic states. In The End of Epistemology As We Know It, Brian Talbot argues that thus far, most of the theories resulting from these efforts are flawed. In this critical notice I examine three of his arguments.

While there has been much discussion about what makes some mathematical proofs more explanatory than others, and what are mathematical coincidences, in this article I explore the distinct phenomenon of mathematical facts that call for explanation. The existence of mathematical facts that call for explanation stands in tension with virtually all existing accounts of “calling for explanation”, which imply that necessary facts cannot call for explanation. In this paper I explore what theoretical revisions are needed in order to accommodate this (...) phenomenon. One of the important upshots is that, contrary to the current consensus, low prior probability is not a necessary condition for calling for explanation. In the final section I explain how the results of this inquiry help us make progress in assessing Hartry Field’s style of reliability argument against mathematical Platonism and against robust realism in other domains of necessary facts, such as ethics. In a range of contexts, individuals arrive at collective decisions by sharing confidence in their judgements. This tendency to evaluate the reliability of information by the confidence with which it is expressed has been termed the ‘confidence heuristic’. We tested two ways of implementing the confidence heuristic in the context of a collective perceptual decision-making task: either directly, by opting for the judgement made with higher confidence, or indirectly, by opting for the faster judgement, exploiting an inverse correlation between confidence (...) and reaction time. We found that the success of these heuristics depends on how similar individuals are in terms of the reliability of their judgements and, more importantly, that for dissimilar individuals such heuristics are dramatically inferior to interaction. Interaction allows individuals to alleviate, but not fully resolve, differences in the reliability of their judgements. We discuss the implications of these findings for models of confidence and collective decision-making. (shrink)

The purpose of the paper is to discuss whether a particular robot can be said to have an 'inner world', something that can be taken to be a critical feature of consciousness. It has previously been argued that the mechanism underlying the appearance of an inner world in humans is an ability of our brains to simulate behaviour and perception. A robot has previously been designed in which perception can be simulated. A prima facie case can be made that this (...) robot has an inner world in the same sense as humans. Various objections to this claim are discussed in the paper and it is concluded that the robot, although extremely simple, can easily be improved without adding any new principles, so that ascribing an inner world to it becomes intuitively reasonable. In the past two decades, African American filmmakers like Spike Lee have made significant contributions to the dialogue about race in the United States by adapting techniques from classic _film noir _to black American cinema. This book is the first to examine these artistic innovations in detail from a philosophical perspective informed by both cognitive film theory and critical race theory. Dan Flory explores the techniques and themes that are used in black _film noir _to orchestrate the audience’s emotions of (...) sympathy and empathy felt toward morally complex characters whom people might not typically find appealing in real life, such as thugs, drug dealers, or murderers. Using an approach that combines the cognitive insights of theorists like David Bordwell, Noël Carroll, and Murray Smith with the reflective Wittgensteinian methods for considering film employed by Stanley Cavell, Stephen Mulhall, and William Rothman, Flory shows how these films scrutinize the state of race in America, induce their viewers to do so as well, and illuminate the ways in which categories of race have defined and continue to direct much of our vision of the moral self and what counts as appropriate moral sensibility. Several authors believe that metaethicists ought to leave their comfortable armchairs and engage with serious empirical research. This paper provides partial support for the opposing view, that metaethics is rightly conducted from the armchair. It does so by focusing on debunking arguments against robust moral realism. Specifically, the article discusses arguments based on the possibility that if robust realism is correct, then our beliefs are most likely insensitive to the relevant truths. These arguments seem at first glance to be dependent (...) on empirical research to learn what our moral beliefs are sensitive to. It is argued, however, that this is not so. The paper then examines two thought experiments that have been thought to demonstrate that debunking arguments might depend on empirical details and argues that the conclusion is not supported. This book offers a sustained engagement with the political philosophy of Paul Ricoeur and demonstrates both the significance of the political in his own thinking throughout his career, and how his understanding of the political offers something valuable to current discussions of issues in political philosophy.

Over the last three decades, the art market has undergone a remarkable transformation. Before the 1990s, artworks were sold with hardly any concern about whether they had been stolen or looted, whereas now any reputable gallery or auction house checks the “provenance” of any substantial work before sale. This transformation reflects interlocking changes in law, norms, and institutions. New York’s and more broadly the United States’ assertion of jurisdiction and application of U.S. substantive law has destabilized title to stolen and (...) looted goods worldwide because American statutes of limitations generally provide weaker protection for those who possess stolen or looted goods even in good faith. Application of American law has had a profound effect, especially for the high end of the market, because European or Asian investors who purchase art outside of the U.S. may eventually want to sell or display their works in the U.S. Defective title under American law thus affects prices worldwide. The tightening and broader application of American law reflects both longstanding legal principles and changes in social norms towards the redress of historical wrongs, most notably prominent campaigns relating to art confiscated or sold under duress in Nazi Germany. New institutions, most importantly searchable databases recording stolen and looted art such as the Art Loss Register, are also changing perceptions about minimum standards for good faith purchase, which in turn affects both social norms and court cases. These new norms, induced by both legal changes and better information, have influenced the market even for less valuable art, for which sale or display in the U.S. is not a relevant consideration and for which the threat of costly legal action is not credible. The fact that social and institutionalized norms play an important role in protecting original owners is probably good, because norms and institutions can be effective even where law is not and often do so at lower cost. Arguing about Judaism differs from other introductions to Judaism. It is unique, not solely in its engaging dialogues between a Reform rabbi and a humanist, atheist philosopher, but also in its presentation of and challenges to the fundamental religious beliefs of the Jewish heritage and their relevance to today's Jewish community. The dialogues contain both Jewish narratives and philosophical responses, with topics ranging from the nature of God to controversies over sexual relations, animal welfare and the environment -- from antisemitism (...) to the state of Israel and Zionism. Although the rabbi and philosopher argue strongly, clearly enjoying the cut and thrust of debate, they do so with sensitivity, charm and respect, revealing the rich intricacies of the Jewish religion and contemporary Jewish life. While essential reading for those studying Judaism and Jewish history, the book aims to stimulate debate more generally amongst Jews and non-Jews, the religious and the atheist -- all those with a general interest in religion and philosophy. Testimonial knowledge sometimes depends on internalist epistemic conditions, those that thinkers are able to reflect upon. In the testimony literature the only internalist conditions that are considered are those concerning a hearer's knowledge of a speaker's reliability. I argue, however, that the relevant sense of internal"" should not be seen as referring to just the hearer's point of view, but rather to the points of view of both the hearer and the speaker. There are certain cases of testimonial knowledge transmission (...) that depend on the speaker's knowledge of his audience. These include cases of ""engineered knowledge"" in which a speaker deviously manipulates a hearer's beliefs. Such knowledge is therefore internalist because it depends on factors that are internal to the point of view of the speaker, and not merely on externalist factors such as the reliability of the speakers' and hearers' beliefs.". ObjectivesAs the largest cohort of healthcare workers and nurses can practice as psychotherapists to integrate the psychotherapeutic interventions as part of routine care. The present study aims to evaluate the effectiveness of supportive psychotherapy on patients who had been scheduled to undergo a fiberoptic bronchoscopy procedure.MethodsThis study retrospectively analyzed 92 patients who underwent FOB, which was divided into the SPT group and usual-care group based on whether patients were given SPT interventions or not. The Patient Health Questionnaire-9 and Hospital Anxiety (...) and Depression Scale were used to determine the severity of depression and anxiety, as well as the 36-Item Short-Form Health Survey questionnaire to evaluate the health-related quality of life. Moreover, the patients' satisfaction was assessed based on the Likert 5-Point Scale.ResultsThe baseline status of anxiety, depression, and HRQoL in patients was similar in the SPT group and the usual-care group with no significant difference. Both PHQ-9 score and HADS-D score in the SPT group after intervention were lower than that in the usual-care group, accompanied by the deceased HADS-A subscale. Moreover, the improved HRQoL was found in the patients undergoing FOB after SPT interventions as compared to those receiving conventional nursing care using the SF-36 score. Additionally, the patient satisfaction in the SPT group was higher than in the usual-care group.ConclusionsThe study demonstrated that anxiety and depression, as negative emotions, can be reduced by supportive psychotherapy in patients receiving FOB with improved mental health and satisfaction with nursing care. The Golden Rule is (roughly) as follows: treat others as you would have others treat you. Philosophical reactions to it vary; it has both supporters and detractors. In any case, almost nobody who things critically about morality takes the literal version of the Golden Rule seriously, since there are just too many problems with it. To demonstrate this, I will look at a literal version of the Golden Rule espoused by John C. Maxwell, a well-known and influential motivational speaker, and (...) briefly discuss some of the obvious problems that it faces. I will then examine a more sophisticated version of the Golden Rule espoused by philosopher Harry Gensler. While able to overcome some of the problems of the literal Golden Rule, Gensler's version nevertheless shares a common difficulty with it: in both cases, the moral agent is asked to imagine themselves in the place of another. Maxwell things this is easily done, and Gensler asks for vividness and accuracy in this act of imagination. I wish to show that any version of the Golden Rule that takes seriously the need to imagine oneself in the place of another is to ask one to do the impossible, so any versions of the Golden Rule that require this should be rejected. In this article, I will argue against the Orthodox Jewish view that the Torah should be treated as an absolute authority. I begin with an explanation of what it means to treat something as an absolute authority. I then review examples of norms in the Torah that seem clearly immoral. Next, I explore reasons that people may have for accepting a person, text, or tradition as an absolute authority in general. I argue that none of these reasons can justify absolute (...) authority if the authority prescribes norms that we strongly judge to be immoral. I then respond to three objections to my argument. I end with a note explaining why, contrary to a popular trend, the narrative of the binding of Isaac is not a good place to start this discussion. (shrink)

ABSTRACTIn my discussion of Ganeri's [2018] article, I first examine the sense of ownership: Is it post-hoc, backwards directed, and past-oriented? I then consider whether episodic memory, understood as a form of past-directed attention, has to be supplemented by another cognitive mechanism to allow for a sense of ownership, or whether attention in and of itself exemplifies a type of I-consciousness. In the final and most extensive part of my commentary, I discuss whether Ganeri is right in suggesting that a (...) reflexivist account of the subjectivity of experience commits one to a form of solipsism. Neoliberal assaults upon public education have been grounded upon the supposition that schools are failing to prepare students to respond to local and global economic needs and realities. The result has left the relational between pupils and teachers as a taken-for-granted practice. Lived experiences often can show and capture the unexpressed in taken for granted moments. This discussion presents teaching as relational moments, shared between beginning teachers and pupils. We employ a phenomenological sensitivity as we unravel the anecdotal evidence to (...) bring into language a “lived through” dimension of human relations. As teacher educators, we ask: what is experienced when relationality is the focus for beginning teachers? The importance of this question is due to the prevalence of neoliberal forces that now guide, and to large extent, control what it means to teach in schools across Canada. In an effort to understand this emerging view of teaching, we explore what four preservice teachers from Nova Scotia experienced in becoming teachers, as they completed their final Field Experience in Bergen, Norway. We share these anecdotal representations to help teachers see how the relational informs identity in becoming a teacher and allows teacher educators to deconstruct the “taken-for-granted-ness” of teaching stuck in the rational-technical model. Hybrid energy storage system has been widely studied as an important technology for electric vehicles. Since the hybrid energy storage system is a nonlinear and complex system, the modeling of the system and the high-precision nonlinear control strategy are technical difficulties for research. The establishment of a high-precision mathematical model of the hybrid energy storage system is the basis for the study of high-quality nonlinear control algorithms. Fortunately, the theory of fractional calculus can help build accurate mathematical models of hybrid (...) energy storage systems. In order to obtain the high-quality nonlinear control strategy of this complex system, this paper, respectively, carried out fractional-order modeling and analysis on the three basic equivalent working states of the hybrid energy storage system of electric vehicles. Among them, the fractional-order average state space model is carried out for the equivalent Buck and Boost mode. Also, the steady-state analysis of the equivalent Dual-Boost mode is carried out by combining the fractional-order calculus theory with the equivalent small parameter variable method. Finally, the effectiveness and precision of the fractional-order model are proved by simulation and experiment. (shrink)
