Samuel Freeman was a student of the influential philosopher John Rawls, he has edited numerous books dedicated to Rawls' work and is arguably Rawls' foremost interpreter. This volume collects new and previously published articles by Freeman on Rawls. Among other things, Freeman places Rawls within historical context in the social contract tradition, and thoughtfully addresses criticisms of this position. Not only is Freeman a leading authority on Rawls, but he is an excellent thinker in his own (...) right, and these articles will be useful to a wide range of scholars interested in Rawls and the expanse of his influence. Business is undergoing a conceptual revolution. Since the Global Financial Crisis there are many new ideas and proposals to make capitalism more responsible. The purpose of this paper is to identify key flaws in the “old story” of capitalism. Six principles are explained that taken together form the basis for a new story of business, one of responsible capitalism.

The purpose of this essay is to suggest that one of the dominant modes of thought in our society is a profound mistrust and misunderstanding of the role of business. A dominant myth in society is that business occupies the moral low ground, separate from ethics or a moral point of view. This position is characterized as the “business sucks” story, and the essay shows how the enactment of this story underlies business thinking among managers and business theorists. Abstract:The purpose of this paper is to suggest that at least one strain of what has come to be called “stakeholder theory” has roots that are deeply libertarian. We begin by explicating both “stakeholder theory” and “libertarian arguments.” We show how there are libertarian arguments for both instrumental and normative stakeholder theory, and we construct a version of capitalism, called “stakeholder capitalism,” that builds on these libertarian ideas. We argue throughout that strong notions of “freedom” and “voluntary action” are the (...) best possible underpinnings for stakeholder theory, and in doing so, seek to return “stakeholder theory” to its managerial and libertarian roots found in Freeman (1984). The purpose of this paper is to enter the conversation about stakeholder theory with the goal of clarifying certain foundational issues. I want to show, along with Boatright, that there is no stakeholder paradox, and that the principle on which such a paradox is built, the Separation Thesis, is nicely self-serving to business and ethics academics. If we give up such a thesis we find there is no stakeholder theory but that stakeholder theory becomes a genre that is quite rich. (...) It becomes one of many ways to blend together the central concepts of business with those of ethics. Rather than take each concept of business singly or the whole of “business” together and hold it to the light of ethical standards, we can use the stakeholder concept to create more fine-grained analyses that combine business and ethics; or more simply, we can tell many more, and more interesting, stories about business. This paper presents a stylized bioeconomic model of hunter-gatherer foraging effort designed to study the process of intensification on open-access resources. A critical insight derived from the model is that the very success of an adaptation at the level of an individual forager group can create system-level vulnerabilities that subsequently feed back to cause emergent social change. The model illustrates how the intensification of harvest time by individuals within a habitat creates a forager-resource system that becomes vulnerable to perturbations. When (...) the system is vulnerable, it is characterized by two resource harvest equilibria: a sustainable, low-effort equilibrium and a degraded, high-effort equilibrium. In this situation, the forager-resource system can be shocked back and forth between these different equilibria by perturbations, generating considerable risk for foragers. We use the model to isolate the ecological conditions under which the instability of the system generates the risk that foragers will experience a shortfall of resources, and we suggest a mechanism that might lead foragers to adopt social institutions that regulate who can access a habitat as an adaptive response. As an illustration of the potential utility of the insights drawn from the model, comparisons are made with a substantial ethnographic data set. (shrink)

In particular, I want to examine the ways (...) in which Woolf’s “A Sketch of the Past”—it is the longest essay in the collection and presumably incomplete, since Woolf wrote the last entry shortly before killing herself in 1941—sets up a complex relationship between beating, writing, and compulsion. For the text in which the phrase “moment of being” first occurs also reveals that the activity of writing, to which Woolf was addicted, has the symbolic valence of beating and functions at the level of language in the same ways that beating functions on the body. I will begin to unpack this perhaps obscure equation by focusing upon the relationship between being and beating in the experiences that define Woolf’s “moments of being.” 1In the opening pages of “A Sketch,” Woolf describes the routine, eminently forgettable aspects of daily life as “a kind of nondescript cotton wool”; the phrase is her “private shorthand” for the general and diffuse “moments of non-being” that predominate in daily life and in which, by contrast, “moments of being” are “embedded” [70]. “Every day,” Woolf notes, “includes much more non-being than being”; and although “the real novelist can somehow convey both sorts of being” [70], Woolf believes that “behind the cotton wool is hidden a pattern” [72] and that her vocation as a writer is to discover and communicate it.Though occasionally “moments of being” produce the experience of rapture or ecstasy, an aspect of beating I will presently explore, most frequently they name moments that entail negation and self-shattering. “Moments of being” are moments of extreme violence that “remain interesting” [78] not because they lead to self-transcendence or discovery, but because they provoke a sense of utter helplessness and paralysis. With one exception, Woolf’s “moments” involve memories of being beaten up by life: “a sudden violent shock” occurs “when something happened so violently that I have remembered it all my life” [71]. Woolf’s submission to her brother Thoby’s beating remains in her memory as inaugural:The first: I was fighting with Thoby on the lawn. We were pommelling each other with our fists. I first argue that Aristotelian intellectual intuition generates basic beliefs which are not inferred — inductively or deductively — from other beliefs. Both involve synthetic intuitive insight. Epagoge grasps a connection and nous sees its general applicability. I next argue that such beliefs are properly basic by adapting an argument made by Hilary Kornblith. According to Kornblith, the world is objectively divided into natural kinds. We humans perceive the world divided into natural kinds. There is empirical evidence suggesting that we (...) divide the world not only as it is objectively divided, but in making inductive inferences, that is, in inferring that an object will have certain properties on the basis of its having others. This grounds the reliability of inductive inferences. But the leading principles of these inferences are basic beliefs generated through intellectual intuition. COVID-related racial disparities represent a spectrum of injustices and inequalities. Focusing on food oppression, this essay argues that racism infuses food law and policy in ways that contribute to racially disparate COVID deaths and severe illnesses. USDA nutrition program participants were at a nutritional disadvantage when COVID hit. Yet, government responses focused on food insecurity, not nutritional quality. Racism against a predominantly Black and brown labor force of essential food workers — from fields to meat plants to grocery stores — (...) created tolerance for the administration’s failure to protect or compensate some of the country’s most vulnerable workers. When COVID-driven supply issues threatened to narrow white people’s activities and choices, the favored response was to keep their options open by sacrificing Black and brown workers. Our typology is based on two ground adequacy factors, one logical and one epistemic. Logically, the step from premises to conclusion may be conclusive or only ceteris paribus. Epistemically, warrants may be backed a priori or a posteriori. Hence there are four types of arguments: conclusive a priori, defeasible a priori, defeasible a posteriori, and prima facie conclusive a posteriori. We shall give an example of each and compare our scheme with other typologies.

In this article, we will outline the principles of stakeholder capitalism and describe how this view rejects problematic assumptions in the current narratives of capitalism. Traditional narratives of capitalism rely upon the assumptions of competition, limited resources, and a winner-take-all mentality as fundamental to business and economic activity. These approaches leave little room for ethical analysis, have a simplistic view of human beings, and focus on value-capture rather than value-creation. We argue these assumptions about capitalism are inadequate and leave four (...) problems in their wake. We wish to reframe the narrative of capitalism around the reinforcing concepts of stakeholders coupled with value creation and trade. If we think about how a society can sustain a system of voluntary value creation and trade, then capitalism can once more become a useful concept. (shrink)

Lilian Bermejo-Luque has posed these questions:1.What is the relationship between presumption and presumptive inference? 2.What are the correctness conditions for presumptions and presumptive inferences? Cohen’s method of relevant variables, Toulmin’s model, and Rescher’s theory of plausibility suggest answers. An inference is presumptive just in case its warrant transfers presumption from its premises to its conclusion. A warrant licencing an inference from the claim that an empirical property φ holds to the claim that some other property ψ holds is backed by (...) observation of a constant conjunction of those properties. The stronger the backing, the stronger the warrant. Warrants may be defeated by instances of φ holding in conjunction with some property χ and ψ not holding. The method of relevant variables directs us to organize such defeating properties into relevant variables. We then test the strength of a warrant by seeing how many variables fail to have a value which defeats the warrant. The more variables with no defeater, the stronger the warrant. We may construct a canonical ordering of the relevant variables by ranking them according to the plausibility of their including defeating values. We may evaluate the strength not only of empirically backed warrants, but warrants backed by institutional rules, such as a branch of law, or by a priori intuited connections between properties. The publicity of a moral conception is a central idea in Kantian and contractarian moral theory. Publicity carries the idea of general acceptability of principles through to social relations. Without publicity of its moral principles, the intuitive attractiveness of the contractarian ideal seems diminished. For it means that moral principles cannot serve as principles of practical reasoning and justification among free and equal persons. This article discusses the role of the publicity assumption in Rawls’s and Scanlon’s contractualism. I contend that (...) a regard for publicity and a moral conception’s potential to provide a public basis for justification and agreement account for much of the evolution of Rawls’s account of justice after A Theory of Justice . I also discuss whether contractualism can provide a basis for justification and general agreement under the social conditions that it endorses. I contend that it cannot, and conclude with a discussion showing why this should not be a problem for contractualism. Despite appearances, contractualism is a distinctive form of contractarianism, substantially different from Rawls’s position and the social contract tradition out of which it evolved.
