This article explores the existential conditions for a transition towards socioeconomic degrowth through an analysis of a paradigm shift between two extreme polarities of socio-ecological positioning: the Dominant Social Paradigm (DSP) and the New Ecological Paradigm (NEP). It is suggested that the transition from one to the other – understood as the first collective step towards degrowth – requires a transformation in the way we, in western capitalist society, define ourselves in relation to nature. This identity transformation corresponds with the (...) reconnection between humans and nature that ecopsychology has been calling for since its emergence in the 1970s. However, according to recent empirical studies in existential psychology, such a transformation contains potentially disquieting aspects, since it implies recognising and accepting the idea of our own mortality. Staging a dialogue between ecopsychology and critical degrowth theories, this article argues that the necessary transition towards degrowth requires new ways of dealing with these existential fears – namely, confronting them in a ‘reflexive’ rather than ‘defensive’ way – so as to develop relationships with nature that respect the limits of the biosphere. Attempts to illuminate the nature of “blame” have shaped recent philosophical discussion of free will and moral responsibility. In this paper I show how, in at least one context, this search for a theory of blame has led us astray. Specifically, I focus on the contemporary debate about the “standing” to blame and argue, first, that theorizing about blame-in-general in this context has assumed an impoverished moral psychology that fails to reflect the range of blaming emotions and that conflates these (...) emotions’ distinctive logics; and, second, that such theorizing has encouraged the propagation of misleading theories of blame’s “norms.” Rather than searching for the nature of blame, I employ and defend an alternative methodological approach that focuses on the psychology and ethics of specific reactive emotions. I then show how an agent’s own bad behavior can alter the appropriateness of these various attitudes in distinctive ways. Marking these distinctions leads to some surprising conclusions. For example, it allows us to move beyond the assumption that the wrongness of standingless blame is fundamentally a matter of hypocrisy. (shrink)

This is a study of the political theory of the Enlightenment, focusing on four leading eighteenth-century thinkers: David Hume, Adam Smith, Montesquieu and Voltaire. Dennis C. Rasmussen calls attention to the particular strand of the Enlightenment these thinkers represent, which he terms the 'pragmatic Enlightenment'. He defends this strand of Enlightenment thought against both the Enlightenment's critics and some of the more idealistic Enlightenment figures who tend to have more followers today, such as John Locke, Immanuel Kant and Jeremy (...) Bentham. Professor Rasmussen argues that Hume, Smith, Montesquieu and Voltaire exemplify an especially attractive type of liberalism, one that is more realistic, moderate, flexible, and contextually sensitive than most other branches of this tradition. This paper deals with the question of how norms are to be conceived of in order to understand their role as guidelines for human action within various normative orders, particularly in the context of law on the one hand and conventional morality on the other. After some brief remarks on the history of the term “norm,” the author outlines the most significant general features of actually existing social norms, including legal and conventional norms, from which he arrives at two basic (...) requirements on an appropriate conception of such norms: the actuality and the normativity requirements. On this basis, he enters into a critical discussion of Kelsen's highly influential view of norms, arguing that this view is doomed to failure. In the last part of the paper, the author scrutinizes the more promising “practice theory of norms” by H.L.A. Hart, which, in his view, also suffers from some shortcomings, but may be modified in a way that leads to a conception of social norms providing us with a plausible explication of their actual existence and their normative force. In this paper, I make an attempt to look for a thin and general concept of law that, as far as possible, should be neutral to the more substantial views of legal moralism and legal positivism, so that it is acceptable from both points of view. With this aim in view, I shall begin with a few remarks on concept formation and name a list of necessary requirements on an appropriate concept of law. On this basis, I intend to discuss (...) a number of contemporary legal theories in view to their respective interpretations of the concept of law. Finally, I want to propose a definition of law that not only satisfies the requirements of the concept of law, but is also general enough to be compatible with both camps of legal thinking. (shrink)

The present paper begins with an investigation of Nishida Kitarō’s discussion of love in Zen no Kenkyū. Nishida claims that love is a deep union of subject and object, where the self is casted off and unites with the other. In other words, love is the expression of the self dissolving into the other, in which the self negates itself in order to further the other’s awakening to no-self. This paper then argues that we can carve out an account of (...) forgiveness based on Nishida’s view of love. That if forgiveness is a practice of a higher form of love, then love, as the groundwork of a self-contradictory standpoint, is nothing other than the practice of forgiveness, and forgiveness is nothing other than repeated acts of love. Contemporary human life is one of co-existence, but conflict and divisions seem to be more of the rule of the day, which speaks to the importance of recovering the lost art of forgiveness. This paper seeks to re-assert forgiveness, as drawn from Nishida’s view of love, in the attempt to heal and address the fragmentation that prevents dialogue between warring factions. (shrink)

Gleichwohl sollten wir die narrativen und sinnbildlichen Objektivierungen von Sprache keineswegs nur als defizitäre Vorstufen der begrifflichen ansehen, sondern eher als ergänzende Formen. Die begriffliche Erschließung von Sprache hilft uns, Sprache als Erfahrungsgegenstand kategorial einzuordnen und uns argumentativ über sie zu verständigen. Die narrative hilft uns, das pragmatische Funktionspotenzial der Sprache in konkreten Lebenszusammenhängen kennenzulernen. Die (...) sinnbildliche hilft uns, die komplexen Strukturen und Funktionen von Sprache über Analogien zu empirisch fassbaren Erfahrungsgegenständen in den Blick zu bekommen. Deshalb lassen sich Sinnbilder über Sprache als hermeutisch-heuristische Hypothesen verstehen, die mehr als ornamentale Funktionen haben. The work of the later Schelling seems antithetical to that of Nietzsche: one a Romantic, idealist and Christian, the other Dionysian, anti-idealist and anti-Christian. Still, there is a very meaningful and educative dialogue to be found between Schelling and Nietzsche on the topics of reason, freedom and religion. Both of them start their philosophy with a similar critique of the Western tradition, which to them is overly dualist, rationalist and anti-organic. In response, they hope to inculcate a more lively view (...) of reality in which a new understanding of freedom takes center stage. This freedom can be revealed and strengthened through a proper approach to religion, one that neither disconnects from nor subordinates religion to reason. Religion is the dialogical other to reason, one that refreshes and animates our attempts to navigate the world autonomously. In doing so, Schelling and Nietzsche open up new avenues of thinking about freedom, reason and religion. (shrink)

Genetic engineering often generates fear of out of control scientists creating Frankenstein creatures that will terrorize the general populace, especially in the cases of human-animal chimeras. While sometimes an accurate characterization of some researchers, this belief is often the result of repugnance for new technology rather than being rationally justified. To facilitate thoughtful discussion the moral issues raised by human-animal chimeras, ethicists and other stakeholders must develop a rational ethical framework before raw emotion has a chance of becoming the dominating (...) justification for public opinion and policy. Derek Parfit’s work on lives worth living for human beings can provide valuable insight into the morality of creating chimeras. As long as their lives are overall good, then bringing them into existence does not harm them even if they are used for medical research or procedures, or they are created to carry on the homo sapiens’ “family” line. Starting from the notion of a structural relation between war and rape in patriarchal systems, this article aims at pointing out how this relation is reflected in the co-occurrence of war and marriage metaphors in mergers and acquisitions (M&A) discourse. Critical Discourse Analysis is combined with cognitive metaphor theory to show how metaphors of marriage and romance ("MERGERS ARE MARRIAGES") tend to co-occur with war and various derived metaphors ("M&As ARE BATTLES FOR TERRITORY"). The significance of these co-occurrences is illustrated (...) through corpus data from genres such as newspaper reports and journal articles. Results of additional qualitative analysis are drawn upon to investigate whether the well-established marriage metaphor functions as an ideologically invested euphemism for rape metaphors. Because the latter are more often than not conspicuously absent, the notion of metaphor gaps is introduced and discussed briefly. (shrink)

This article explores the formal and functional characteristics of narratives of ‘good’ and ‘bad’ deaths as they were told by 13 UK-based hospice managers in the course of semi-structured interviews. The interviewees’ responses include a variety of remarkably consistent ‘narratives of successful/frustrated intervention’, which exhibit distinctive formal characteristics in terms of the starting point and core of the action, the choice of personal pronouns and metaphors, and the ways in which positive and negative evaluation is expressed. In functional terms, the (...) hospice managers’ narratives play an important role in representing and constructing their professional views, challenges and identities. Overall, the narratives argue for the role of hospices and professional hospice staff in facilitating a ‘good’ death, and, by presenting a relatively unified view, may potentially preclude alternative perspectives. In this paper, I argue that a constitutionalized Harm Principle could ensure that people are not jailed unless they deserve it. I do not aim to outline every possible type of bad consequence beyond harm that might be sufficiently serious to justify criminalization. Instead, I focus on criminalization that is backed up with jail terms and I argue that wrongful harm to others provides the only moral and constitutional justification for sending people to jail. Imprisonment harms the prisoner, so she (...) should not be imprisoned unless she has caused proportionate harm to others. I argue that the sufficient conditions for sending an offender to jail are: (1) that the offender's actions have (or risk) bad consequences that are sufficiently harmful to make her commensurately deserving of penal detention; and (2) that the offender culpably (that is, with a state of mind somewhere along the intentional/reckless/gross negligence continuum) chose (aimed or attempted) to bring about those bad consequences or did so with reckless indifference. The lawmaker would need to demonstrate from the ex ante perspective that proposed offenses carrying jail sentences are a proportionate and fair way of dealing with the wrongs involved. Because jail (including short sentences of a few days) involves hard treatment (seriously harmful consequences for the prisoner) harm to others would be the only bad consequence of sufficient weight to justify a jail sentence. Jailing people for wrongful behavior that has harmless consequences would be an unjust and disproportionate response. In terms of understanding imprisonment (a physical deprivation of liberty) in the United States, it is better to refer to the Eighth Amendment of the Constitution than to the Due Process Clause. The Eighth Amendment, if read morally, could be invoked to strike down laws that carry prison sentences for wrongs that do not result in harm to others. This is because harming a person by subjecting her to the hard treatment that is involved in serving a jail term would be a disproportionate response unless the wrongdoer inflicted equivalent harm on others. I argue, that the Eighth Amendment should be interpreted in a way that accords with its overall moral aim or purpose. The Amendment's overall moral aim is to ensure that the state does not inflict unjust, oppressive, or disproportional punishments on its citizens. (shrink)

If Solomon is correct in labeling businesses as community citizens because they “are part and parcel of the communities in which they live and flourish, and the responsibilities that they bear are ... intrinsic to their very existence as social entities,” then it follows that other community citizens have reciprocal duties toward them that they, as community citizens, have to any other community citizen. One of these duties is not to harm needlessly another community citizen without its permission. One issue (...) affecting business is genetically engineering children to have characteristics, e.g., deafness, which render them disabled in work environments. Since business is a very large part of society, citizen responsibilities toward it in regard to intentionally creating deaf children should be examined. It is my contention that designing disabled offspring is unethical on the grounds that it causes undue injury to businesses without their permission in any form. (shrink)

No man can live without ideas, for every human action, internal or external, is of necessity enacted by virtue of certain ideas. In these ideas a man believes; they guide his actions, and ultimately his whole life. Study of these ideas and principles is one of the distinctive tasks of the history of philosophy. But were we to restrict the field of interest of the history of philosophy to a mere detached academic "cataloguing" of past ideas, the history of philosophy (...) itself would have joined long ago the interminable line of barren catalogued ideas. The study of the wisdom of past ages, however, is very much alive. Not only is it alive, but in the words ot Wilhelm Dilthey: "What man is, he learns through history. "l Thus, the culture of every generation is inevitably related, whether thetically or antithetically, to the previous one, and the politi cal and economic struggles of any present are always the consequences of an earlier and perhaps even fiercer battle of ideas. I t is imperative to know the history of the philosophies that nourish the present if we wish to know ourselves and the world about us.
