Leurs auteurs: Carnap, Hahn, Neurath, Schlick l'ame du Cercle de Vienne, et Waismann plus proche de Wittgenstein, temoignent d'un courant philosophique constituant aujourd'hui la tradition analytique de source continentale a la fois empiriste et logique. Forme de maniere informelle a Vienne, au coeur de l'Europe, le Cercle reunissait des savants de differentes branches qui voulaient se donner une philosophie susceptible d' unifier leurs vues. Echo (...) aux reves d'unite de la science, cette philosophie en exprime aussi le renversement complet. Veritable Discours de la methode, mais d'esprit anti-cartesien, elle entend reconstruire la science de maniere a evincer la speculation metaphysique, le but etant qu'aucun enonce ne soit laisse a l'exterieur de cette grande architecture de symboles s'il etait pourvu de sens. La declaration de guerre contre la metaphysique est un geste de militance a une epoque riche en differents manifestes. Incomprehensible en dehors du contexte socio-politique viennois de ces annees, elle porte aussi un programme de reconstruction rationnelle qui, au dela du langage de la science, devait toucher tous les secteurs de la vie. Plus complexe qu'il n'y parait, ce programme contient, en reference a Wittgenstein, son prestigieux representant a cote d'Einstein et Russell, une mise en garde contre differentes formes d'irrationalismes, qui est d'actualite. It is virtuous for individual and collective agents to be tolerant. However, toleration is difficult, both in practice and in conceptualization. Firstly, given that toleration can be understood in various ways (Walzer 1997, Forst 2007), it seems that to determine what is the proper conception of toleration would be controversially difficult. Here I shall suggest one particular conception of toleration is more suitable than others. This conception allows, as I shall explain, us to better understandthe difficulties of toleration. Thus, this (...) particular conception of toleration should lead us to see what is more adequate for dealing with the difficulties of toleration. To be more precise, I shall argue for a political conception of toleration, which different from the attitudinal conception of toleration as being indifferent, or the ethical conception of toleration as respect. There is the suggestion of toleration as recognition (Galeotti 2002). These alternative understandings of toleration do not provide better diagnoses of the difficulties of toleration. The political conception of toleration is intended to be grounded on some moral considerations, notpragmatic purpose. It is political in that it recognizes the fact that toleration is essentially practiced to deal with a power relationship among the parties of toleration. Where these is no such power relationship, as I shall argue, there is no issue of toleration. Secondly, this proposed conception of toleration is political in the sense that it shall not deal with differences coming from, to use John Rawls’s phrase, the fact of pluralism by adopting any comprehensive doctrine such as an ethics of respect or recognition. So impassioned is the debate on occasion, and so high the feelings, that even the tools of regulatory analysis have become part of the combat.To some, the term cost-benefit analysis, for example, is virtually a swearword, a nefarious tool used by big business to undermine regulations aimed at benefiting the people at large. To others, it is the mechanism for achieving more effective regulation (...) at less cost.This new book on the subject of reforming regulation is aimed at increasing the light and turning down the heat. It consists of an introduction and nine chapters written by scientists, public policy analysts, and economists on various aspects of regulation and regulatory analysis.The book advances the latest knowledge and evidence on risk analysis, cost-benefit analysis, and related techniques for improving regulation--all based on experience and data accumulated over the quarter century since regulation in the areas of environment, health, and safety became a major player on the governmental stage. The strengths and limitations of those analytical tools are an important part of the portrait that is painted, but a common thesis is that, properly used, the tools can be helpful in getting better regulatory results. In recent years, a considerable amount of research on adapted business for developing countries focused on the impact such endeavours have on the respective companies as well as on the affected people. However, the main emphasis within management sciences was on the economic outcomes or (even more distinct and often) on the question of how to integrate the poor into business models and value chains. Until now, further aspects of a dignified human existence were merely covered as a side note. (...) The article focuses on the influence of inclusive business approaches on various aspects of human dignity and provides explorative insights as a basis for future theory building. The aim is to uncover how human dignity is affected by different business approaches for the poor including and beyond economic outcomes. After giving an insight into the essence and meaning of human dignity in connection to various human rights, the articles refers to a number of illustrative cases of inclusive business. The analysis culminates in the insight that dignity can be (and sometimes already is) assured and promoted by deliberately including the poor into relevant value-added business processes. If this is the case, an enhanced dignity is not merely the result of increased incomes but stems from a variety of effects. However, such positive effects are not an inevitable outcome of any inclusive business initiative. (shrink)

Hierbei hat er die Klassiker der abendländischen Geistesgeschichte nicht in einem kanonisch-schematischen Profil gelehrt, sondern die jeweiligen Themen und Theoreme mit lebensfüllender Leidenschaft vermittelt. Seine Vorlesungen und Seminare an der Universität zeugen, wie auch seine Vorträge und Tagungsbeiträge, von einem streitbaren Geist, der stets auch um die aktualisierende Bezugnahme bemüht war. This Article discusses a triangle of forces that affect the activity of small-medium enterprises. These forces are: limited liability, shareholder guarantees, and bankruptcy. Limited liability encourages entrepreneurship by reducing the personal risks shareholders are exposed to as a result of business failure. However, the limited liability shield creates the potential moral hazard of overinvestment. That is, the entrepreneur may involve the corporation in overly risky projects. To combat this risk, the lending practice requires entrepreneurs to sign a personal guarantee for (...) corporate debt. The guarantee serves as a bonding device that forces the entrepreneur to internalize the costs of the corporate activity. This Article first argues that while personal guarantees can serve this economic goal, the lending industry demands them excessively and they are overused. The overuse of guarantees unnecessarily subjects good corporate borrowers as well as bad ones to this practice and causes underinvestment. The third force of the triangle, a discharge of the shareholder’s debts in bankruptcy, may balance this inefficiency. It potentially softens the effect of the guarantee and thus requires the lender to further gather borrowerspecific information at the lending stage. Unfortunately, personal bankruptcy is underused by individual debtors mainly because of the stigma it implies. To rebalance the triangle, this Article proposes to encourage the shareholder’s partial relief of the guarantee through an amicable procedure. I call this procedure Velvet Bankruptcy. Velvet Bankruptcy would first procedurally consolidate the private collection from the shareholder-guarantor with the pending corporate bankruptcy case, by authorizing the court to extend the automatic stay to protect the shareholder-guarantor. To the extent the court is convinced that the collection would render the shareholder insolvent, it could reduce the guarantor’s liability. This would effectively constitute discharge without officially declaring the shareholder bankrupt. (shrink)

Argumentation is pervasive in everyday life. Understanding what makes a strong argument is therefore of both theoretical and practical interest. One factor that seems intuitively important to the strength of an argument is the reliability of the source providing it. Whilst traditional approaches to argument evaluation are silent on this issue, the Bayesian approach to argumentation (Hahn & Oaksford, 2007) is able to capture important aspects of source reliability. In particular, the Bayesian approach predicts that argument content and source (...) reliability should interact to determine argument strength. In this paper, we outline the approach and then demonstrate the importance of source reliability in two empirical studies. These experiments show the multiplicative relationship between the content and the source of the argument predicted by the Bayesian framework. (shrink)

The statistics of small samples are often quite different from those of large samples, and this needs to be taken into account in assessing the rationality of human behavior. Specifically, in evaluating human responses to environmental statistics, it is the effective environment that matters; that is, the environment actually experienced by the agent needs to be considered, not simply long‐run frequencies. Significant deviations from long‐run statistics may arise through experiential limitations of the agent that stem from resource constraints and/or information‐processing (...) bounds. The article draws together recent work from a number of areas in judgment and decision making ranging from randomness perception (Hahn & Warren, ), information sampling (Hertwig & Pleskac, ; Kareev et al., ), and consequences of choice for exploration or exploitation (e.g., Denrell, ) to demonstrate how proper consideration of these deviations leads to reevaluation of behaviors that are otherwise deemed irrational. This selection of articles by Lewis E. Hahn addresses the philosophical school of contextualism and four contemporary American philosophers: John Dewey, Henry Nelson Wieman, Stephen C. Pepper, and Brand Blanshard. Stressing the relatively recent contextualistic worldview, which he considers one of the best world hypotheses, Hahn seeks to achieve a broad perspective within which all things may be given their due place. After providing a brief outline, Hahn explains contextualism in relation to other philosophies. In his opening (...) chapter, as in later chapters, he expresses contextualism as a form of pragmatic naturalism. In spite of Hahn’s high regard for contextualism, however, he does not think it would be good if we were limited to a single worldview. “The more different views we have and the more different sources of possible light we have, the better our chances that some of these cosmic maps will shed light on our world and our place in it.”. The notion of “the burden of proof” plays an important role in real-world argumentation contexts, in particular in law. It has also been given a central role in normative accounts of argumentation, and has been used to explain a range of classic argumentation fallacies. We argue that in law the goal is to make practical decisions whereas in critical discussion the goal is frequently simply to increase or decrease degree of belief in a proposition. In the latter case, it is (...) not necessarily important whether that degree of belief exceeds a particular threshold (e.g., ‘reasonable doubt’). We explore the consequences of this distinction for the role that the “burden of proof” has played in argumentation and in theories of fallacy. (shrink)

The key weakness of the proposed distinction between rules and similarity is that it effectively converts what was previously seen as a consequence of rule or similarity-based processing, into a definition of rule and similarity themselves – evidence is elevated into a conceptual distinction. This conflicts with fundamental intuitions about processes and erodes the relevance of the debate across cognitive science.

The last decade has witnessed the emergence of a paradox perspective on corporate sustainability. By explicitly acknowledging tensions between different desirable, yet interdependent and conflicting sustainability objectives, a paradox perspective enables decision makers to achieve competing sustainability objectives simultaneously and creates leeway for superior business contributions to sustainable development. In stark contrast to the business case logic, a paradox perspective does not establish emphasize business considerations over concerns for environmental protection and social well-being at the societal level. In order to (...) contribute to the consolidation of this emergent field of research, we offer a definition of the paradox perspective on corporate sustainability and a framework to delineate its descriptive, instrumental, and normative aspects. This framework clarifies the paradox perspective’s contents and its implications for research and practice. We use the framework to map the contributions to this thematic symposium on paradoxes in sustainability and to propose questions for future research. (shrink)
