Business ethics can be regarded as a field dealing with corporate _self-regulation_ as it relates to the treatment of stakeholders. However, a concern for corporate stakeholders need not take a corporate-centric perspective, as shown by recent efforts (especially Singer in Bus Ethics Q 25(1):65–92, 2015) to situate corporate conduct within Rawls’ political theory. Although Rawls was largely mute on the subject himself, his theory has implications for business ethics and corporate governance more specifically. Given an understanding of a “Rawlsian society” (...) as a whole—where corporations as associations are a part—this paper addresses how a Rawlsian perspective would safeguard against corporate harms in society. We argue that a Rawlsian society would primarily regulate corporate conduct through exogenous constraints in the form of legislation. To the extent that business ethics is concerned with endogenous constraints in the form of corporate-centric self-regulation regarding _stakeholders_, to adopt a Rawlsian perspective is to assume instead a society-centric perspective and to impose exogenous constraints on corporate conduct in the form of legislation for the benefit of _citizens_. In the context of Rawls’ political liberalism, normative concerns in business are accounted for through legislation and the system of background justice. In a clear departure from Singer (Bus Ethics Q 25(1):65–92, 2015, Bus Ethics J Rev 6(3):11–17, 2018a), we further develop our argument to propose that Rawls' theory can be interpreted as providing a rule for corporate governance. The rule—which is imposed exogenously for the good of society—states: After choosing the corporate constraint mechanism (exogenous vs. endogenous) that best promotes the Liberty Principle, choose the corporate control regime (shareholder vs. stakeholder) that maximizes economic efficiency. The aim of this article is to briefly spell out why corporate moral agency is a fallacy and to show how this conclusion should shift the field of business ethics more in the direction of political philosophy and the rule of law. An argument based on a false assumption can be valid, but it cannot be sound. If corporate moral agency is a fallacy, and thus also moral prescriptions for corporations, how do we salvage the field of business ethics? To (...) the extent that business ethics is about corporate behaviour (rather than individual managerial behaviour), the field can shift its foundational paradigm from ethics (which requires the attributes of moral agency) to legal accountability (which can be imposed instrumentally on corporate legal agents). By letting our elected representatives legislate the norms of acceptable corporate behaviour we can hold corporate legal entities legally accountable. It is uncontroversial that corporations are legal agents that may be attributed with legal responsibilities. However, can corporations also be moral agents that are the proper subjects of moral responsibility attributions? The concept of corporate moral agency entails that corporations can be the proper bearers of moral responsibilities in a manner that is distinct from their human members. The paper acknowledges the important work done by Velasquez in debunking the purported intention and action abilities for corporate moral agency, but suggests (...) that a simpler debunking is possible by focusing on the moral agency ability of autonomy. Furthermore, a proper grasp of the autonomy ability provides a greater understanding for why corporations cannot have autonomous intentions nor perform autonomous actions. The autonomy ability demonstrates the fallacy of corporate moral agency because it shows the impossibility of establishing the corporation as the proper bearer of moral responsibility in a manner that is distinct from the corporate members. The “basic debate” in business ethics between shareholder theory and stakeholder theory has underlined the field since its inception, with wide ranging normative, descriptive, and instrumental arguments offered on both sides. We maintain that insofar as this is primarily a normative debate, clarity can be brought by elucidating how it is framed by the political philosophies of liberalism and libertarianism.With liberalism represented by John Rawls’s theory of justice and libertarianism represented by the ideas of Milton Friedman and Robert Nozick, and (...) Edward Freeman, the paper shows that both liberalism and libertarianism can be interpreted to justify shareholder and stakeholder theory respectively. The debate between shareholder theory and stakeholder theory is framed by liberal and libertarian justifications that hinge primarily on whether and to what extent one should have exogenous or endogenous safeguards on corporate behavior. Accordingly, political philosophy turns out to be highly relevant to both business ethics and corporate governance, not because the corporation resembles the state, but because of the potential safeguards placed on the corporation by the state. This paper examines the shareholder primacy norm as a widely acknowledged impediment to corporate social responsibility and explores the role of business schools in promoting the SPN but also potentially as an avenue for change by addressing misconceptions about shareholder primacy and the purpose of business. We start by explaining the SPN and then review its status under US and UK laws and show that it is not a likely legal requirement, at least under the guise of shareholder value maximization. (...) This is in contrast to the common assertion that managers are legally constrained from addressing CSR issues if doing so is inconsistent with the economic interests of shareholders. Nonetheless, while the SPN might be muted as a legal norm, we show that it is certainly evident as a social norm among managers and in business schools—reflective, in part, of the sole voting rights of shareholders on corporate boards and of the dominance of shareholder theory—and justifiably so in the view of many managers and business academics. We argue that this view is misguided, not least when associated with claims of a purported legally enforceable requirement to maximize shareholder value. We propose two ways by which the influence of the SPN among managers might be attenuated: extending fiduciary duties of executives to non-shareholder stakeholders and changes in business school teaching such that it covers a plurality of conceptions of the purpose of the corporation. In an important departure from theories of causation, David Owens proposes that coincidences have no causes, and that a cause is something which ensures that its effects are no coincidence. In Causes and Coincidences, he elucidates the idea of a coincidence as an event which can be analysed into constituent events, the nomological antecedents of which are independent of each other. He also suggests that causal facts can be analysed in terms of non-causal facts, including relations of necessity. Thus, (...) causation is defined in terms of coincidence, and coincidence without reference to causation. David Owens challenges the ideas associated with Hume, Davidson and Lewis, constructing a theory which distinguishes nomological necessity and sufficiency from their logical counterparts. He is able to offer novel solutions to the major problems of causation, including the direction of causation, the logical form of causal statements, the distinction betwen causal connections and logical connections, and the relationship between psychological and physical causation. David Gauthier is one of the most outstanding and influential philosophers working in moral theory today, and his book Morals by Agreement has established him as a preeminent defender of contractarian moral theory. This volume brings together a selection of his best essays on contractarianism, many of which have become difficult to find.

I point out a radical indeterminism in potential-based formulations of Newtonian gravity once we drop the condition that the potential vanishes at infinity. This indeterminism, which is well known in theoretical cosmology but has received little attention in foundational discussions, can be removed only by specifying boundary conditions at all instants of time, which undermines the theory's claim to be fully cosmological, i.e., to apply to the Universe as a whole. A recent alternative formulation of Newtonian gravity due to Saunders (...) pp.22-48) provides a conceptually satisfactory cosmology but fails to reproduce the Newtonian limit of general relativity in homogenous but anisotropic universes. I conclude that Newtonian gravity lacks a fully satisfactory cosmological formulation. (shrink)

The Addresses to the German Nation is one of Fichte's best-known works. It is also his most controversial work because of its nationalist elements. In this book, David James places this text and its nationalism within the context provided by Fichte's philosophical, educational and moral project of creating a community governed by pure practical reason, in which his own foundational philosophical science or Wissenschaftslehre could achieve general recognition. Rather than marking a break in Fichte's philosophy, the Addresses to the (...) German Nation and some lesser-known texts from the same period are shown to develop themes already present in his earlier writings. The themes discussed include the opposition between idealism and dogmatism, the role of Fichte's 'popular' lectures and writings in leading individuals to the standpoint of idealism, the view of history demanded by idealism and the role of the state in history. Business and society (B&S) scholarship that uses the theoretical perspective of institutionalism combines different research approaches to values. Within the B&S literature drawing on institutionalism, we identified and categorized the research on values according to a spectrum of normative and/or descriptive approaches (including both and neither approaches). Primarily, we focused on how the normative and descriptive approaches interrelate and integrate. For over half a century there have been concerns about increases in the occurrence of academic misconduct by higher education students and this is now claimed to have reached crisis proportions (e.g. Mostrous & Kenber, 2016a ). This study explores the extent to which multi-national faculty judge the effectiveness of higher education institutions in dealing with such misconduct. A survey of multi-national higher education faculty was conducted to explore the perceived barriers to the implementation of academic integrity processes. It asked (...) faculty how likely some hypothetical scenarios of failures of such processes were to occur in the real world of higher education institutions. 63% of our participants perceived there to be institutional and/or faculty barriers to effectively dealing with academic misconduct. Mostly, they blamed the higher education model for this which, in the interests of mass education, has come to prioritise the need for institutions to focus more on their quantity of output as corporate business enterprises than on the integrity of their output as educators. In discussing participants’ comments, about the relationship of faculty to their employing institutions, Schein and Scheins’ ( 2016 ) theory of three levels of organisational culture was used. Participants’ comments suggested that, at the deepest level of organisational culture i.e. basic underlying taken-for-granted assumptions about beliefs and values, inadequate integrity measures have tended to become normalised. Despite the often considerable, efforts of the institutions, organisational barriers were noted which mitigate against faculty behaving professionally i.e. from doing a ‘good job’ in respect of student academic misconduct. Some blame was also placed on faculty. We argue that apparent institutional inability to effectively manage the integrity process, has potentially significant consequences for wider society. We discuss ways in which this situation might be improved including a recommendation that governments regulate this aspect of the corporate social responsibility of higher education institutions as they do other aspects, requiring that it be managed effectively. Over the past decade or so, several commentators have called for mission-driven research programs on solar geoengineering, also known as solar radiation management (SRM) or climate engineering. Building on the largely epistemic reasons offered by earlier commentators, this paper argues that a well-designed mission-driven research program that aims to evaluate solar geoengineering could promote justice and legitimacy, among other valuable ends. Specifically, an international, mission-driven research program that aims to produce knowledge to enable well-informed decision-making about solar geoengineering could (1) (...) provide a more effective way to identify and answer the questions that policymakers would need to answer; and (2) provide a venue for more efficient, effective, just, and legitimate governance of solar geoengineering research; while (3) reducing the tendency for solar geoengineering research to exacerbate international domination. Thus, despite some risks and limitations, a well-designed mission-driven research program offers one way to improve the governance of solar geoengineering research relative to the ‘investigator-driven’ status quo. Taking a social identity approach to health behaviors, this research examines whether experimentally “activating” the human identity is an effective public-health strategy to curb the spread of COVID-19. Three goals of the research include examining: whether the human identity can be situationally activated using an experimental manipulation, whether activating the human identity causally increases behavioral intentions to protect the self and others from COVID-19, and whether activating the human identity causally increases behaviors that help protect vulnerable communities from COVID-19. Across (...) two preregistered experiments, results suggest the manipulation of identification with humanity had a significant but small effect on participants’ psychological bond with all humanity, but not their concern for all humanity. However, the manipulation had no causal effect on health-related behavioral intentions or helping behaviors that reduce the spread of COVID-19. In this article we attempt to situate nursing within the interprofessional care team with respect to processes of ethical practice and ethical decision making. After briefly reviewing the concept of interprofessionalism, the idea of a nursing ethic as ‘unique’ within the context of an interprofessional team will be explored. We suggest that nursing’s distinct perspective on the moral matters of health care stem not from any privileged vantage point but rather from knowledge developed through the daily activities of nursing practice. Because of their position vis-à-vis patients and families in everyday clinical care, nurses cultivate ethical knowledge of at least two forms: (1) relational knowledge; and (2) embodied knowledge. This essay offers a fresh interpretation of Bhartr̥hari’s concept of “insight”, and of its identification as the object of a sentence in the second kāṇḍa of the Vākyapadīya. Earlier scholars dealing with this topic disagreed on three main points: whether an epistemologically rigorous concept of insight can be found in Bhartr̥hari’s work, or if the notion remains irrevocably vague and equivocal; whether the concept of pratibhā primarily belongs to linguistics, or to action theory; whether Bhartr̥hari’s identification of insight as the (...) object of a sentence should be taken literally or figuratively. Starting from a close analysis of all passages in Bhartr̥hari’s work mentioning pratibhā, I identify, first of all, a univocal understanding of insight, valid throughout the Vākyapadīya, as immediate cognition informed by verbal transmission, in other words as a form of practical knowledge, non-representational yet essentially productive and dynamic. Showing, on this basis, how Bhartr̥hari’s understanding of language at the level of sentences is pragmatic rather than referential, I demonstrate, against the view prevalent in the late grammatical tradition, that a literal interpretation of his provocative statement on pratibhā as vākyārtha remains perfectly plausible. This thesis is further corroborated by the consideration of post-Bhartr̥hari philosophical sources elaborating on his ideas, which allow us better to understand in what sense pratibhā can legitimately be thought of as cognition “without an object”. We study possible Scott sentence complexities of linear orderings using two approaches. First, we investigate the effect of the Friedman–Stanley embedding on Scott sentence complexity and show that it only preserves $\Pi ^{\mathrm {in}}_{\alpha }$ complexities. We then take a more direct approach and exhibit linear orderings of all Scott sentence complexities except $\Sigma ^{\mathrm {in}}_{3}$ and $\Sigma ^{\mathrm {in}}_{\lambda +1}$ for $\lambda $ a limit ordinal. We show that the former cannot be the Scott sentence complexity of a linear (...) ordering. In the process we develop new techniques which appear to be helpful to calculate the Scott sentence complexities of structures. (shrink)

This article outlines a new theory of humor. The concept of humor is developed in the sense of five dialectical levels, respectively, sequential phenomenalities of humorous consciousness. These range from a level of most inferior humor up to a stage of most sublime humor. Systematically speaking, humor is viewed from an enhanced perspective of transcendental philosophy, namely as a medium of self-unfolding practical reason. It is considered as a complementary potency to the practical force of the latter’s regulative principle, and (...) it fulfils several important functions. The first section provides basic definitions of concepts like humor, sublimity, comicality, etc. Here, the five phenomenalities of humor are introduced. The second section explores and develops these contents more in detail. Some references to the German-speaking tradition in the philosophy of humor provide further input for discussion. A companion to ‘Punishment: Consequentialism’, and also ‘Punishment: The Future’, this paper examines various nonconsequentialist attempts to justify punishment, that is, attempts that appeal to claims concerning the innate worth or intrinsic character of punishment, quite apart from any consequential good or benefit punishment may be thought to produce. The paper starts with retributive theories, and turns then to the denunciation and expressive theories, before considering combined communicative–retributive theories.

The growing interest in Africa as well as concerns about negative deviant behaviors and ethnic structures necessitates examination of the effect of ethnic expectations on behavior of employees. In this study we leverage insight from ethnos oblige theory to propose that centralization of ethnic norms moderates the relationship between benevolence expectations and negative deviant behavior. Using a cross-sectional design and data from two countries as well as moderation and cross-cultural analytic techniques, we find support for three-way interactions where the relationship (...) between benevolence and negative deviant behavior is moderated by centralization and culture. Historically marginalized foods, which occupy the social periphery, and often function as a bulwark in times of hunger, are increasingly being rediscovered and revalued as niche commodities. From açaí to quinoa, the move from marginal to miracle is often tied to larger narratives surrounding sustainable development, resilience to climate change, and traditional foodways. This article analyses the recent move towards millet production and consumption in the southern Indian state of Karnataka. Focusing upon one of the grain’s chief proponents, I explore (...) how narratives surrounding millets are grounded in conceptions of cultural authenticity and bioregionalism. Drawing upon human geographer’s analyses of the turn towards the ‘local’ in food activism, I contribute to the development of critical bioregionalism, an emerging theoretical framework that explores how questions of value, identity, political economy, and histories of land use intersect to structure our understandings of marginal foods and their resurgence.
