Climate change can be interpreted as a unique case of historical injustice involving issues of both intergenerational and global justice. We split the issue into two separate questions. First, how should emission rights be distributed? Second, who should come up for the costs of coping with climate change? We regard the first question as being an issue of pure distributive justice and argue on prioritarian grounds that the developing world should receive higher per capita emission rights than the developed world. (...) This is justified by the fact that the latter already owns a larger share of benefits associated with emission generating activities because of its past record of industrialisation. The second question appears to be an issue of compensatory justice. After defining what we mean by compensation, we show that different kinds of compensatory principles run into problems when used to justify payments by historical emitters of the North to people suffering from climate change in the South. As an alternative, we propose to view payments from wealthy countries for adaptation to climate change in vulnerable countries rather as a measure based on concerns of global distributive justice. The recent legal dispute about medical treatment for a 19-year-old patient, Sudiksha Thirumalesh, (known initially by the Court of Protection as ‘ST’) in A NHS Trust versus ST & Ors (2023) raised several challenging ethical issues. While Sudiksha’s case bears similarities to other high-profile cases in England and Wales, there are key differences. Crucially, Sudiksha herself was part of the disagreement. She was alert, communicative and sought to advocate for herself. Furthermore, this case was framed in the courts as pivoting (...) not on considerations of best interests but on a determination of decisional capacity. Sudiksha was deemed to lack capacity because she did not believe her doctors’ view of her prognosis.While the legal questions in the case were central to a recent Court of Appeal decision (which overturned the original finding), in this commentary, we focus on the ethical questions therein. We start by describing Sudiksha’s court case and the initial judgment. We then offer an ethical analysis of the relationship between false beliefs, values and the ‘capacity’ to make decisions, arguing for a need for particular care when judging patients to lack capacity based purely on ‘false and fixed beliefs’. After briefly noting the legal basis for the appeal finding, we offer ethical implications for future cases. Although it appears that Sudiksha had decision-making capacity, this did not settle the ethical question of whether health professionals were obliged to continue treatment that they believed to have no prospect of success. The social science approach to risk has matured over the past two decades, with distinct paradigms developing in disciplines such as anthropology, economics, geography, psychology, and sociology. Social Theories of Risk traces the intellectual origins and histories of twelve of the established and emerging paradigms from the perspective of their principal proponents. Each contributor examines the underlying assumptions of his or her paradigm, the foundational issue it seeks to address, and likely future directions of research. Taken together, these essays illustrate (...) that the principal achievement of social sciences has been to broaden the debate about risk beyond the narrow, technical considerations of engineers and the physical and life sciences. The need for research to advance scientific understanding must be balanced with ensuring the rights and wellbeing of participants are safeguarded, with some research topics posing more ethical quandaries for researchers than others. Moral injury is one such topic. Exposure to potentially morally injurious experiences can lead to significant distress, including post-traumatic stress disorder (PTSD), depression, and selfinjury. In this article, we discuss how the rapid expansion of research in the field of moral injury could threaten the wellbeing, dignity and (...) integrity of participants. We also examine key guidance for carrying out ethically responsible research with participants’ rights to self-determination, confidentiality, non-maleficence and beneficence discussed in relation to the study of moral injury. We describe how investigations of moral injury are likely to pose several challenges for researchers including managing disclosures of potentially illegal acts, the risk of harm that repeated questioning about guilt and shame may pose to participant wellbeing in longitudinal studies, as well as the possible negative impact of exposure to vicarious trauma on researchers themselves. Finally, we offer several practical recommendations that researchers, research ethics committees and other regulatory bodies can take to protect participant rights, maximise the potential benefits of research outputs and ensure the field continues to expand in an ethically responsible way. ABSTRACT This introduction argues for competing diachronic and synchronic accounts of melancholy in European and American culture. Taking the pioneering and yet belated work Saturn and Melancholy (1964) of Erwin Panofsky, Fritz Saxl, and Raymond Klibansky as its starting point, this article situates melancholy as at once its own, often local and non-specialist discourse as well as a conceptual web binding together medical, artistic, and social innovations, competitions, and turmoil. As a subject, melancholy demands interdisciplinary study, as Dürer’s print Melencolia (...) I continues to prove. As a locus of methodological innovation, melancholy in the wake of Panofsky, Saxl, and Klibansky continues to yield the alternative genealogies, conceptual histories, and formal artistic vocabularies of this volume’s contributions whether moving backwards from Dürer to Homer or forward to the present day with Lars von Trier and major European novelists. The conceptualisation of schooling is often based on “ideal children” in “ideal situations.” However, in determining the level of participation for children who are considered vulnerable in schooling, it is important to understand the lived experiences of these children. In this study, migrant children (particularly undocumented ones) in South Africa are the focus, and their lived experiences were considered through reflections from their parents and teachers. Data were collected using semi-structured interviews, and analysed using a constant comparative method of qualitative (...) analysis within a grounded theory approach. The study found that challenges affecting migrant children’s schooling include the lack of documentation, language barriers, issues of transition and adaptation (discrimination), and the inability to access further education. Strategies were identified to address the challenges, including schools liaising with the Department of Home Affairs, implementing cultural diversity programmes within the school, and through deliberate inclusive programmes. Parents who are facing decisions about life-sustaining treatment for their seriously ill or dying child are supported by their child's doctors and nurses. They also frequently seek other information sources to help them deal with the medical and ethical questions that arise. This might include written or web-based information. As part of a project involving the development of such a resource to support parents facing difficult decisions, some ethical questions emerged. Should this information be presented in a strictly neutral fashion? (...) Is it problematic if narratives, arguments or perspectives appear to favour stopping over continuing life-sustaining treatment? Similar questions might arise with written materials about decisions for adults, or for other ethically contentious decisions. This paper explores the meaning of ‘balance’ in information provision, focusing particularly on written information about life-sustaining treatment for children. We contrast the norm of non-directiveness in genetic counselling with the shared decision-making model often endorsed in end-of-life care. We review evidence that parents do not find neutrality from medical professionals helpful in discussions. We argue that balance in written information must be understood in the light of the aim of the document, the most common situation in which it will be used, and any existing biases. We conclude with four important strategies for ensuring that non-neutral information is nevertheless ethically appropriate. (shrink)

Vast research has sought to better understand the origins and development of rape myth beliefs given the problematic influence of such misconceptions throughout global societies and criminal justice pathways. The current research aims to build on this body of literature by examining the contribution that psychopathic personality traits (affective responsiveness, cognitive responsiveness, interpersonal manipulation, egocentricity) and emotional intelligence may have upon rape myth beliefs. Furthermore, this study will investigate the extent to which sociodemographic characteristics (age, gender, ethnicity, education), and prior (...) experience of sexual victimisation, contribute to variance in rape myth acceptance scores. In total 251 participants (M Age = 31.66) completed an online, self-report questionnaire which included contemporary measures of psychopathy and rape myth acceptance, never previously tested in combination. Results of a hierarchical multiple regression analysis indicate that egocentricity, age, and gender were significantly associated with rape myth beliefs. Emotional intelligence, as well as affective and interpersonal traits of psychopathy, were not directly related with rape mythology. Findings are interpreted alongside previous research, where we suggest there is an urgent need for larger, nationally representative samples, systematically recruited from the general population to help clarify uncertainty in existing literature emerging from small-scale opportunistic datasets. Abstractabstract:Recent clinical trials of psychedelic drugs aim to treat a range of psychiatric conditions in adults. MDMA and psilocybin administered with psychotherapy have received FDA designation as "breakthrough therapies" for post-traumatic stress disorder (PTSD) and treatment-resistant depression (TRD) respectively. Given the potential benefit for minors burdened with many of the same disorders, calls to expand experimentation to minors are inevitable. This essay examines psychedelic research conducted on children from 1959 to 1974, highlighting methodological and ethical flaws. It provides ethics and (...) policy recommendations for psychedelics research involving children and adolescents, including recognizing that the psychedelic experience is an ineffable one that makes informed proxy consent for parents, guardians, and others especially challenging. Psychedelic experiences are associated with novel benefits and risks, such as significant personality changes, shifts in fundamental values, and possible re-exposure to traumatic memories. These effects may alter the process of personality development in minors. Recommendations for ethically sound psychedelics research in minors include strict adherence to eligibility criteria, including a comprehensive family and individual psychiatric, substance use, and trauma history. An age-appropriate assent process that includes considerations related to the use of therapeutic touch should be developed. In addition, oversight by data safety monitoring boards and patient and family advocates, coupled with the adoption of pharmacoequity best practices, will help to ensure safety and fairness of psychedelics research in children. Will the ecological crises of our time be resolved using the same form of thought that has brought them about? Are technological prowess and political power the proper tools to address them? This article examines the translator, Rongzom’s, scholastic philosophical defense of early Dzokchen or “Great Perfection.” As our earliest instance of religious apologia in Tibet, this examination contributes to a growing body of knowledge about the Tibetan assimilation of post-tenth century of Vajrayāna Buddhism and the indigenous response to the forces of cultural transformation shaping the late eleventh/early twelfth century Tibet. Traditional authorities and academics have identified Dzokchen as a Tibetan tradition of Buddhism that drew intense criticism at the time from (...) renaissance agents. This paper explores the primary Tibetan response by describing Rongzom’s philosophical defense of Great Perfection. As such, it illuminates the intellectual and ideological context of the milieu as it evinces Rongzom’s innovation and mastery of Indian systems of logic, language, and epistemology in the Dzokchen approach to the Buddhist path. In recent decades, social psychology has produced an expansive array of studies wherein introducing a seemingly morally innocuous feature into the situation a subject inhabits often yields morally questionable, dubious, or even appalling behavior. Several fascinating lines of philosophical enquiry issue from this research, but the most pragmatically salient question concerns how we ought most effectively to develop and maintain the virtues so that such putatively morally problematic behavior is less likely to occur. In this paper, I examine four empirically (...) embedded accounts of virtue cultivation: Hagop Sarkissian’s social signaling, Mark Alfano’s virtue labeling, Nancy Snow’s self-punishment, and Peter Railton’s implementation intentions. But none of these accounts of virtue cultivation provides adequate resources for regulating our affective states, whose attention-constricting and behavior-priming functional roles are likely at the root of much of our less than virtuous behavior. Instead, I defend an account of virtue cultivation that proceeds via meditation, which can help us to identify and regulate our emotions and moods. Further, meditation enables us to develop the attentional focus, emotional intelligence, and sense of social connection that ground the virtues and, thus, our virtuous behavior. (shrink)

The virtues are under fire. Several decades’ worth of social psychological findings establish a correlation between human behavior and the situation moral agents inhabit, from which a cadre of moral philosophers concludes that most moral agents lack the virtues. Mark Alfano and Christian Miller introduce novel versions of this argument, but they are subject to a fatal dilemma. Alfano and Miller wrongly assume that their requirements for virtue apply universally to moral agents, who vary radically in their psychological, physiological, and (...) personal situations; I call this the ‘content problem.’ More troubling, however, the content problem leads to what I call the ‘structural problem:’ Alfano and Miller each structure their argument against the virtues as a modus tollens argument and, owing to the breadth of the content problem, each must constrain their argument with a ceteris paribus clause. But the ceteris paribus clause precludes each argument’s validity. More important, however, the resulting conception of virtue implicitly endorsed by Alfano and Miller holds that virtues are idealized models; but since idealized models do not even purport accurately to describe the world, neither novel version of EAV gains any empirical traction against the virtues. The upshot is an old story whose moral has yet, within the empirical study of the virtues, adequately to be internalized: it is imperative that the empirical observation of character traits proceed via longitudinal studies. What makes for a good book on ethics in medicine? Given that no one can do another’s moral thinking for them, this much at least: it should stimulate in the reader an inclination to critical reflection that will persist when the book goes back on the shelf. And, since no one can do another’s philosophical thinking for them either, this requirement is doubly true when the basis of the work lies in moral philosophy. In addition, where the book is likely (...) to be used as an introduction, it has to achieve this for readers who may have little experience of philosophy or natural sympathy with its problems and methods. No doubt there are various ways of attempting this task, but one is to try to draw readers into the subject by giving them a sense of what it is to be involved in doing philosophy, with all its characteristic difficulties and doubts, rather than merely studying the results of some that was done earlier. I think that Jennifer Jackson has produced an excellent book of this kind; one that should engage the interest of anyone prepared to make a little effort. It is a lively and refreshing work, full of argument and comprising a good mixture of scholarly caution and forthright commitment. Rather than looking at the many specific issues, however, I will concentrate on the philosophical position that underlies the work as a whole.The book begins by taking seriously the doubts that exist about the place of philosophy in medical ethics and does particularly well in making the appropriate concessions, while still giving a firm defence of its …. In this paper I attempt a new reading of the passage found in 1 Timothy 2.8-15, to try to show how it might be read by women today. The difficulties of reading such patriarchal texts from the canon of biblical literature are not trivialized or overlooked, and are addressed by a selective survey of how this passage has been read in different contexts through the history of interpretation. The resulting reading neither removes this problematic material from the canon, nor denies (...) the oppressive uses it has been put to in keeping women out of positions of power in various church communities. Character traits have several vital functions. They should enable us to assess others morally, inform us of others’ behavioral tendencies, and accurately explain and predict others’ behavior. But traits of character, as they have traditionally been understood, cannot adequately serve these purposes. For character traits are traditionally thought to be context-insensitive. The Contextual Account of Character Traits, which I here develop and defend, posits traits that are context-sensitive. Context-sensitive character traits are more receptive to the complexity of human psychology and (...) behavior and, hence, they not only adequately, but excellently, satisfy their theoretic and pragmatic functions. Democracy surrounds us like the air we breath, and is normally taken very much for granted. Across the world democracy has become accepted as an unquestionably good thing. Yet upon further examination the merits of democracy are both paradoxical and problematic, and the treasured values of liberty and equality can be used to argue both for and against it. Technological advancements, especially with regard to enhancements of human capacities and powers, have instigated a collision between opposing views of the human person. I begin with the premise that the predominant classical view of the human person attained its clearest and most cogent expression in the philosophy of Thomas Aquinas and can be termed the theory of the homo integralis. The human person is, for Thomas, the integrated being par excellence: he is a union of the material (body) and the (...) immaterial (soul); his freedom is guided by a normative nature; he is himself a product of and participant in nature; he is a member of a common species from which he draws his identity; and he balances the needs of his embodied state with a recognition that his existence is not limited to it. Due to the philosophical and technological revolutions of the modern period, themselves an outgrowth perhaps of earlier attitudes, a contrasting view of the human person emerged: the homo technologicus. Technological man, unlike his classical predecessor, is marked by fundamental disintegration: he is divided in himself, between mind and body; he is dissociated from a normative human nature; he is divided from nature itself as he sets himself against it through technological means; he is divided from the human community in radical, self-determining autonomy; and he is severed from any sense of transcendent purpose or value aside from that which can be attained through his own powers, technological or otherwise. By recovering a sense of the homo integralis as articulated by Thomas Aquinas, a fresh appraisal of contemporary issues regarding the human relationship to technology, human capacities and powers as evaluated by movements like transhumanism, and ultimately, human meaning and value, is made possible and is shown to provide a consistent and appealing rejoinder to the disintegrated vision of man that emerges in a technologized world. ABSTRACT This paper takes issue with the idea that there is a variety of moral theories available which can in some way usefully be applied to problems in ethics. The idea is reflected in the common view that those favouring a systematic approach would do well to abandon consequentialist thinking and turn to some alternative theory. It is argued here that this is not an option, since each of the usual supposed alternatives lacks the independent resources to meet the minimal (...) requirements of being a moral theory at all. The aim is to demonstrate that virtue ethics, rights theory and deontology lack the different forms of explanation that would make them genuinely alternative theories. The conclusion is that this part of ethics is much more of a unity than is standardly assumed and that, far from our being able to move on from consequentialism, certain problems that arise from its very nature are bound to remain central to any attempt at moral theory.
