Donald Davidson once suggested that a liar ?must intend to represent himself as believing what he does not?. In this paper I argue that, while Davidson was mistaken about lying in a few important respects, his main insight yields a very attractive definition of lying. Namely, you lie if and only if you say something that you do not believe and you intend to represent yourself as believing what you say. Moreover, I show that this Davidsonian definition can handle counter-examples (...) that undercut four prominent definitions of lying: viz., the traditional intend-to-deceive definition, Thomas Carson's definition, Don Fallis's definition, and Andreas Stokke's definition. In light of recent doctrinal changes, we examine the confused state of U.S. insider trading law, identifying gaps that permit certain market participants to trade on the basis of material nonpublic information, and contrast U.S. insider trading doctrine with the European approach. We then explore the ethical implications of the status quo in the U.S., explaining why the dominant legal justifications for prohibiting classical insider trading and misappropriation—the fiduciary duty and property rights theories—fail to account for the wrongfulness of insider (...) trading by eavesdroppers and certain tippees. We refute common arguments for legalizing insider trading, including arguments that insider trading is a victimless crime and that the practice promotes efficiency. We explain why insider trading constitutes the moral wrong of cheating, grounding our theory in the legitimate expectations of market participants. Having considered Kantian deontology in other work, we find that virtue ethics theory offers a helpful albeit rough framework for assessing the morality of insider trading independent of its legality. We also find that social contract theories, with norms of equality of opportunity and moral desert, provide a compelling ethical basis for retaining, clarifying and broadening current legal prohibitions against insider trading. This qualitative study examines the moral courage of leaders working for democracy and human rights in Burma. As Burma transitions to democracy moralcourage will be essential for leaders of civil society organizations as they face corruption, cronyism, and resistance to change. From interview data with nineteen leaders in Burma and Thailand, and a review of the literature we developed a conceptual model of moral courage that suggests that the relationship between moral motivation and the demonstration of moral courage was mediated (...) by political, social, and individual level factors including the activists’ knowledge and experiences. In addition to applications for leadership in civil society organizations in emerging democracies, results suggest individuals in private, public, or non-governmental organizations, when confronted with coercion, corruption, exploitation, or denial of due process can act with moral courage by engaging their moral principles, commitment, compassion, and sense of urgency while recognizing risks and potential hardship. As regimes move from illiberal to liberal, post-transition justice methodology has been employed to engender truth and reconciliation. These normative concepts have evolved into a policy of creating truth and reconciliation commissions that trade civil and criminal amnesty with applicants in exchange for information. This bargained-for exchange can be analyzed as an imperfect information game, where the commission attempts to maximize information while the applicant seeks amnesty for the lowest possible price. Using game-theoretic analysis, the authors model the truth-amnesty game (...) and predict the optimal commission strategy. The analysis leads to the recommendation that future transitional justice commissions employ various specific lexicographic ordering strategies to minimize dead weight loss in the transaction. In this paper, which was among Don Browning's last writings before he died, we review and evaluate the main arguments against the United Nations Convention on the Rights of the Child (the “CRC”) that conservative American Christians in particular have opposed. While we take their objections seriously, we think that, on balance, the CRC is worthy of ratification, especially if it is read in light of the profamily ethic that informs the CRC and many earlier human rights instruments. In this study, we explore the relationship between perceived CEO greed and workplace safety. Drawing on insights from the social psychology literature, we theorize that CEOs are cognizant that their perceived greed has implications for how observers respond to failures in workplace safety. Our theorizing points to a somewhat counterintuitive positive relationship between perceived CEO greed and workplace safety. Consistent with our theorizing, we find that the relationship is attenuated when the CEO is insulated from how observers respond to firm (...) conduct and is amplified when the CEO’s characteristics have a larger impact on how observers respond to adverse firm-level events. We contribute to business ethics research on executive greed, on the relationship between CEO traits and (ir)responsible corporate conduct, and on the antecedents of workplace safety. (shrink)

_Expanding Hermeneutics_ examines the development of interpretation theory, emphasizing how science in practice involves and implicates interpretive processes. Ihde argues that the sciences have developed a sophisticated visual hermeneutics that produces evidence by means of imaging, visual displays, and visualizations. From this vantage point, Ihde demonstrates how interpretation is built into technologies and instruments.

What distinguishes deception from manipulation? Cohen (Australasian Journal of Philosophy, 96, 483 and 2018) proposes a new answer and explores its ethical implications. Appealing to new cases of “non‐deceptive manipulation” that involve intentionally causing a false belief, he offers a new definition of deception in terms of communication that rules out these counterexamples to the traditional definition. And, he leverages this definition in support of the claim that deception “carries heavier moral weight” than manipulation. In this paper, I argue that (...) these cases of “non‐deceptive manipulation” are even more prevalent than Cohen suggests—especially in the digital world. Thus, if his moral claim were correct, a lot of what is happening on the internet these days would constitute moral improvement over old‐fashioned deception. Fortunately, we are not forced to accept this counterintuitive conclusion. Cohen's definition must be rejected because it incorrectly rules out clear instances of deception. In this paper, I defend a definition of deception in terms of evidence that does correctly distinguish between deception and non‐deceptive manipulation. Moreover, it does not support Cohen's claim that deception is morally worse than other forms of manipulation. (shrink)
