This open access book provides original, up-to-date case studies of “ethics dumping” that were largely facilitated by loopholes in the ethics governance of low and middle-income countries. It is instructive even to experienced researchers since it provides a voice to vulnerable populations from the fore mentioned countries. Ensuring the ethical conduct of North-South collaborations in research is a process fraught with difficulties. The background conditions under which such collaborations take place include extreme differentials in available income and power, as well (...) as a past history of colonialism, while differences in culture can add a new layer of complications. This open access book offers insights into the development of the ground-breaking Global Code of Conduct for Research in Resource-Poor Settings (GCC) and the San Code of Research Ethics. This study explored how women with a diagnosis of cancer (lymphoma) deal with moral concerns related to their responsibility as parents. Ten women with cancer and who had children living at home were interviewed. The interviews were analysed according to the constant comparative method used in grounded theory. In order to provide a focus for the analysis, the ethics of care and the concept of mothering were used as sensitizing concepts. The core concept ‘experience of dealing with moral responsibility of (...) being a parent with cancer by redefining oneself as a mother’ was identified. The processes involved were: interrupted mothering; facing the life-threatening illness and children’s reactions; striving to be a good mother; attempting to deal with moral responsibility; and coming to terms with being a mother. Diese Untersuchung wird von dem Gedanken geleitet, dass die Totalität menschlicher Selbstverhältnisse auf einen jeweils Anderen angewiesen ist, um sich entfalten und im Extremfall erhalten zu können. Dies gilt sogar mit Hinsicht auf das phänomenale Erleben. Dabei wird zum einen eruiert, wie sich anthropologische Grundkonstellationen mit ethisch relevanten Fragen der Lebensführung und Daseinsbewältigung verbinden, und zum anderen eine Technik der Lebensführung und der ethischen Vervollkommnung in den Blick genommen. Um den phänomenalen Gehalt menschlicher Selbstverhältnisse zu erfassen, werden insbesondere emotionale und (...) affektive Selbstverhältnisse untersucht. Im ersten Abschnitt des Beitrages wird ein Modell vorgestellt wie ein Innenleben und damit ein Selbst in dialogischen Strukturen entsteht. Im zweiten Teil wird eine traditionelle Technik des Selbstgesprächs als Dialog mit sich selbst beschrieben, mit Hilfe dessen ein Innenleben weiter entwickelt und entfaltet wird. Die Ausführungen zum Begriff der Liebe in Hegels Ästhetik lassen sich als Spuren der Auseinandersetzung Hegels mit der Vereinigungsphilosophie lesen. Nach der These dieses Aufsatzes enthält die Ästhetik diese Spuren also noch, obgleich Hegels Abschied von der Vereinigungsphilosophie längst vollzogen war, als die Vorlesungen zur Ästhetik entstanden sind. Die Begriffe Philosophie der Vereinigung und Vereinigungsphilosophie bezeichnen Positionen in der Philosophie des 18. Jahrhunderts, die sich mit der Selbstwerdung des Subjekts oder des Bewußtseins befassen und mit der für die Selbstwerdung erforderlichen (...) Hingabe an ein Äußeres, Anderes. Infolge der Hingabe an ein Äußeres, Anderes werden dem Selbst die Grenzen und der Grund seines Selbst bewußt. Das Selbst benötigt demnach das Andere, um zu sich selbst zu kommen. Die Hingabe an das Endliche außer uns, die erforderlich ist, um in Abgrenzung zum Anderen zu einem Selbst zu werden, wird als Liebe im Sinne des Eros bestimmt. Diese Liebe ist der Antrieb, die Vereinigung mit dem Erstrebten zu suchen und die Erkenntnis des Wahren zu fin Für die Selbstwerdung oder Selbsterkenntnis werden dabei, je nach philosophischer Konzeption, unterschiedliche Bereiche als Ort der Vereinigung angenommen: Der Bereich der Religion, der auf die Erkenntnis Gottes und der Seele abhebt, die nur in der Wiedervereinigung der Seele mit Gott im Jenseits zu erlangen ist. Oder der Bereich des Schönen, der für Hölderlins Philosophie der Vereinigung zentral ist. Die allen Formen der Vereinigungsphilosophie zugrundeliegende Frage ist die nach dem Verhältnis zwischen dem Selbst (oder der Seele) und dem Begehrten, das zur Selbstwerdung gebraucht wird. Das Projekt der Selbstwerdung stellt aber nicht nur das erklärte Anliegen der Vereinigungsphilosophie dar, sondern auch das der romantischen Kunst, die, so Hegel, zur reinen unendlichen Identität mit sich selbst führt und nur noch einen Gott, einen Geist, eine absolute Selbstständigkeit kennt. Es ist für diese Periode nach Hegel geradezu die Aufgabe der Kunst, den Prozeß hin zur Subjektivität darzustellen. (shrink)

Codes of ethics and conduct typically demand the highest standard of ethical behaviour from every single employee. This implies a democratic or lobbyist understanding of ethics in business. The contrasting view would argue that business ethics is an elitist undertaking that can only be instigated from the top, by managing directors or owner managers. This article looks at three types of ethical businesses, three types of approaches to ethical problem‐solving, and three possible incentives for ethical business to see which of (...) the above is more convincing. It will be argued that the impulse for value‐driven business has to come from the top. Only top management and owner managers have the opportunity to foster major change in business practice. This book offers a unique and insightful analysis of Western and Middle Eastern concepts of dignity and illustrates them with examples of everyday life. Dignity in the 21st Century - Middle East and West is unique and insightful for a range of reasons. First, the book is co-authored by scholars from two different cultures (Middle East and West). As a result, the interpretations of dignity covered are broader than those in most Western publications. Second, the ambition of the book is (...) to use examples from everyday life and fiction to debate a range of dignity interpretations supplemented by philosophical and theological theories. Thus, the book is designed to be accessible to a general readership, which is further facilitated because it is published with full open access. Third, the book does not defend one superior theory of dignity, but instead presents six Western approaches and one based on the Koran and then asks whether a common essence can be detected. -/- The answer to the question whether a common essence can be detected between the Koranic interpretation of dignity and the main Western theories (virtue, Kant) is YES. The essence can be seen in dignity as a sense of self-worth, which persons have a duty to develop and respect in themselves and a duty to protect in others. The book ends with two recommendations. First, given the 7 concepts of dignity introduced in the book, meaningful dialogue can only be achieved if conversation partners clarify which variation they are using. Second, future collaborations between philosophers and psychologists might be helpful in moving theoretical knowledge on dignity as a sense of self-worth into practical action. The “scourges” of a sense of self-worth and dignity are identified by psychologists as violence, humiliation, disregard and embarrassment. To know more about how these can be avoided from psychologists, is helpful when protecting a sense of self-worth in others. (shrink)

In 2006, the Indonesian government decided to withhold avian flu samples from the World Health Organization. They argued that even though Indonesian samples were crucial to the development of vaccines, the results of vaccine research would be unaffordable for its citizens. Commentaries on the case varied from alleging blackmail to welcoming this strong stance against alleged exploitation. What is clear is that the concern expressed is related to benefit sharing.Benefit sharing requires resource users to return benefits to resource providers in (...) order to achieve justice. One benefit sharing tool within health research is the duty to provide a health care intervention which has been proven to be beneficial (or alternative benefits) to research participants after a study has been concluded. This duty is generally known as a post-study obligation. It was enshrined in the Declaration of Helsinki in 2000 and re-emphasized in 2008. Yet, there are few, if any, examples of good practice.In this article, we analyse the obstacles to giving more bite to benefit sharing provisions in health research through ethical review. We conclude that the provision of post-study access to healthcare interventions is not a promising mechanism when monitored through research ethics committees. Alternative benefit provision is preferable if one focuses on achieving compliance. However, even the latter faces challenges, which we address in specific recommendations. (shrink)

Médecins Sans Frontières is one of the world’s leading humanitarian medical organizations. The increased emphasis in MSF on research led to the creation of an ethics review board in 2001. The ERB has encouraged innovation in the review of proposals and the interaction between the ERB and the organization. This has led to some of the advances in ethics governance described in this paper.

Conceptual discussion is an often underrated but important matter: Concepts provide the vantage point from which we identify and sort relevant aspects of reality. For political theorists – and political scientists more generally – “power” and “freedom” are especially important concepts for making sense of political phenomena. One important contribution to the debate regarding these concepts is Ruth Zimmerling’s book Influence and Power.

In this methodological reflection, I describe the multidisciplinary hermeneutic process of philosophizing about teacher dissatisfaction. I discuss how philosophy serves as a starting point for interpretive work based on interviews with former teachers and readings of qualitative and quantitative research on teacher attrition and dissatisfaction. The result has been a project that enabled me to offer new descriptions of phenomena and to develop concepts that can be used to interpret the moral dimensions of teacher dissatisfaction. The fact that I return (...) to language and concepts as my research outcomes is why, despite my multidisciplinary approach, I continue to describe my work as philosophical. I suggest that philosophical enquiry pursued through empirical research has the potential to inform larger empirical studies, serve as a “sensitizing instrument” for empirical analysis, and to open discursive spaces where common understandings limit interpretive possibilities. The highest attainable standard of health is a fundamental human right, which has been part of international law since 1948. States and their institutions are the primary duty bearers responsible for ensuring that human rights are respected, protected, and fulfilled. However, more recently it has been argued that pharmaceutical companies have a coresponsibility to fulfill the human right to health. Most prominently, this coresponsibility has been expressed in the United Nations Millennium Goal 8 Target 4. “In cooperation with pharmaceutical companies, (...) provide access to affordable essential drugs in developing countries.”. ABSTRACT Benefit sharing aims to achieve an equitable exchange between the granting of access to a genetic resource and the provision of compensation. The Convention on Biological Diversity (CBD), adopted at the 1992 Earth Summit in Rio de Janeiro, is the only international legal instrument setting out obligations for sharing the benefits derived from the use of biodiversity. The CBD excludes human genetic resources from its scope, however, this article considers whether it should be expanded to include those resources, so (...) as to enable research subjects to claim a share of the benefits to be negotiated on a case‐by‐case basis. Our conclusion on this question is: ‘No, the CBD should not be expanded to include human genetic resources.’ There are essential differences between human and non‐human genetic resources, and, in the context of research on humans, an essentially fair exchange model is already available between the health care industry and research subjects. Those who contribute to research should receive benefits in the form of accessible new health care products and services, suitable for local health needs and linked to economic prosperity (e.g. jobs). When this exchange model does not apply, as is often the case in developing countries, individually negotiated benefit sharing agreements between researchers and research subjects should not be used as ‘window dressing’. Instead, national governments should focus their finances on the best economic investment they could make; the investment in population health and health research as outlined by the World Health Organization’s Commission on Macroeconomics and Health; whilst international barriers to such spending need to be removed. Achieving equity in international research is a pressing concern. Exploitation in any scenario, whether of human research participants, institutions, local communities, animals or the environment, raises the overarching question of how to avoid such exploitation. Agreed principles can be universally applied to research in any discipline or geographical area, whatever methodologies are employed. This chapter introduces a collection of case studies, presenting a range of up-to-date examples of exploitation in North-South research collaborations, in order to raise awareness of ethics dumping.

The 1992 Convention on Biological Diversity (CBD) and its 2010 Nagoya Protocol brought about a breakthrough in global policy making. They combined a concern for the environment with a commitment to resolving longstanding human injustices regarding access to, and use of biological resources. In particular, the traditional knowledge of indigenous communities was no longer going to be exploited without fair benefit sharing. Yet, for 25 years after the adoption of the CBD, there were no major benefit sharing agreements that led (...) to significant funding streams for indigenous communities. This changed with the signing of the Rooibos Benefit Sharing Agreement in South Africa, described in this paper. As the authors report, the Rooibos Agreement is a superlative in two respects. It is the biggest benefit sharing agreement between industry and indigenous peoples to date. It is also the first industry-wide agreement to be formed in accordance with biodiversity legislation. This article is a co-production between traditional knowledge holders, the lawyer who represented their interests, the Co-Chair of the Nagoya Protocol negotiations, and an ethicist who analyzed the major challenges of this historic agreement. With no precedent in the benefit sharing world, the agreement stands as a concrete example of the ‘art of the possible.’ Although the rooibos case is unique in a number of aspects, the experience offers many transferable insights, including: patience; incrementalism; honesty; trust; genuine dialogue; strong legal support; a shared recognition that a fair, win-win deal is possible; government leadership; and unity amongst indigenous peoples. Keats also died of tuberculosis, aged 25. “The bloom, whose petals nipped before they blew, died on the promise of the (...) fruit” is how Percy Bysshe Shelley expressed his grief over Keats’ death. This paper analyzes agency in Pettit’s republican conception of freedom. By understanding freedom intersubjectively in terms of agency, Pettit makes an important contribution to the contemporary debate on negative liberty. At the same time, some of the presumptions about agency are problematic. The paper defends the thesis that Pettit is not able to provide the sufficient conditions for freedom as non-domination that he sets out to do. In order to show why this is the case and how we can address (...) this shortcoming, a distinction is introduced between a thick and a thin intersubjective account of agency. It is argued that while Pettit’s freedom presupposes a thin account, he would need a thick account in order to elaborate not only the necessary but also the sufficient conditions of freedom as non-domination. Responsible innovation is an approach to business that can both incur and save costs. Some company leaders are concerned that it is yet another administrative and financial burden on their commercial operations. Others can see its financial advantages, e.g. avoiding the development of products the market will not accept, or reducing costs through sustainability measures. Building on the corporate responsibility and management advice literature, this chapter indicates a number of areas where RI can create a competitive advantage for SMEs. Real (...) life case studies provide examples of reduced costs, reputational gains, employee retention, faster market entry, access to previously unavailable stakeholders, higher acceptability of end products, and higher innovation potential through diverse employees. Success cannot be guaranteed, but the willingness of an SME to innovate in areas that have positive societal impact in addition to profits can bring business benefits. (shrink)

Decision-making capacity in children and adolescents in healthcare requires thorough assessment: the minor's maturity, understanding of the decision, risk of the situation and contextual factors needs to be explored. The intention was to design and validate a test—the Maturtest—to assess the maturity of minors in decision-making processes in healthcare. A reasoning test on moral conflicts for adolescents was designed to infer the degree of maturity of minors applied to decision-making regarding their own health. The test was completed by a sample (...) of 441 adolescents aged from twelve to sixteen, with a corresponding analysis of their psychometric skills to measure feasibility, viability, reliability, validity, and sensitivity to change. Psychometric test results showed viability, reliability, validity, and sensitivity to change. High correlation between the test score and the reference method were notable. A high stability was obtained with an intraclass correlation coefficient. The average response time of the test was twenty-three minutes. This test measures the moral maturity of adolescents. It is presented as an objective, useful, valid, reliable tool, easy to fill out, edit and apply in a healthcare context. It helps to assess the maturity of minors faced with a decision. (shrink)

The aim of this paper is to connect the traditional epistemological issue of justification with what one might call the “new reasons paradigm” coming from the philosophy of action and metaethics. More specifically, I will show that Conee and Feldman’s mentalism, a version of internalism about justification, can profitably be spelled out in terms of subjective normative reasons. On the way to achieving this aim, I will argue that it is important to ask not just the oft-discussed ontological question about (...) epistemic reasons—what kind of entities are they?—but also: Reasons in which sense are fundamental to justification? An evaluation of scientific contributions in international congresses of fundamental anthropological sciences (philosophy, psychology, psychosomatics, physiology, genito-urology, radio-oncology, etc.) demonstratesevidence of large discrepancies in the participation not only of developing and industrial countries, but also between the last ones themselves. New models for scientific education, beginning with philosophy, followed by philosophical, pedagogical, medical, theological anthropology, and research are necessary tosupport Agenda 21 and prevent misuse of science. According to proposals on foundation of experimental schools (Immanuel Kant) and international universities (Bertrand Russell) the International Academy of Science/ICSD supports these ideas and initiated the creation of first (interdisciplinary) International Faculties forAnthropology as paradigm for humanization, higher effectiveness and pluralistic internationalization of science, leading to better education ("Erziehung und Ausbildung") and research in all countries, i.e. decrease of the gap between industrial and developing countries. CONCLUSION: Foundation of international institutes for general (philosophy, pedagogy, medicine) as well as for special anthropology (theology, informatics-logic-mathematics, culture, biology, (bio-) physics/chemistry) in context of an integralanthropology via networks of national ones from selected countries of Africa, America, Asia, Australia, Europe can permit the necessary implication of philosophy in education of anthropological sciences as well as research and education (post graduate) by common international research and educational programmes, lecturers, students, etc. in one country. This project needs political and financial support by UNO, European Union, governments, banks, industries to support the education of a homo sanus, humanus et spiritualis for the future humanity. This chapter explores whether a version of causalism about reasons for action can be saved by giving up Davidsonian psychologism and endorsing objectivism, so that the reasons for which we act are the normative reasons that cause our corresponding actions. We address two problems for ‘objecto-causalism’, actions for merely apparent normative reasons and actions performed in response to future normative reasons—in neither of these cases can the reason for which the agent acts cause her action. To resolve these problems, we (...) move from objecto-causalism to ‘objecto-capacitism’, which appeals to agential competences manifest-ed in acting for a reason.
