Walton offers a comprehensive, flexible model for physician-patient decision making, the first such tool designed to be applied at the level of each particular case. Based on Aristotelian practical reasoning, it develops a method of reasonable dialogue, a question- and-answer process of interaction leading to informed consent on the part of the patient, and to a decision--mutually arrived at--reflecting both high medical standards and the patient's felt needs. After setting forth his model, he applies it to three vital ethical issues: (...) acts of omission, the cessation of treatment, and possible side effects of treatments. In the final chapter, Walton shows how his method functions in light of the real-life complexities of the clinical encounter and how it bears on ethical questions concerning health-care policy, attitudes toward treatment and toward the medical profession, reasonableness of expectations, and the setting of realistic goals of treatment. This paper considers how the terms ‘objection,’ ‘rebuttal,’ ‘attack,’ ‘refutation,’ ‘rebutting defeater’ and ‘undercutting defeater’ are used in writings on argumentation and artificial intelligence. The central focus is on the term ‘rebuttal.’ A provisional classification system is proposed that provides a normative structure within which the terms can be clarified, distinguished from each other, and more precisely defined.

This paper examines the impact of the introduction of Western (European) technical civilization on regional cultures in Nigeria, using Igboland in South-EasternNigeria as a test case. It begins with a discussion of some general features of Western technical civilization whose evolution has been profoundly influenced by technological advances in Europe and her cultural colonies in North America and elsewhere. Consequences of the contact between Western technical civilization and traditional Igbo culture are also examined. Preparatory Principles is not a linear text in the conventional sense, but consists of a series of short passages on a variety of topics, whose themes are summarised in marginal headings. The material constitutes a philosophical commonplace book, compiled by Bentham in the mid-1770s, in which he worked out the foundational ideas for his new science of legislation. He then drew on this material when composing such works as A Fragment on Government and An Introduction to the Principles of Morals (...) and Legislation. Inspired by such figures as John Locke and Claude Adrien Helvetius, Bentham developed an original ontological and epistemological basis for legal terminology, with the aim of replacing the traditional terminology of English law with that of universal jurisprudence. The work that dominates the text, in that Bentham returns to it time and time again in order to offer criticism of it, is William Blackstone's Commentaries on the Laws of England. While unorganized and fragmentary, the material in Preparatory Principles constitutes a remarkable record of the evolving ideas of a major legal philosopher at a formative stage of his career. Partly due to the influence of Tarski's work, it is commonly assumed that any good theory of truth implies biconditionals of the sort mentioned in Convention T: instances of the T-Schema "s is true in L if and only if p" where the sentence substituted for "p" is equivalent in meaning to s. I argue that we must take care to distinguish the claim that implying such instances is sufficient for adequacy in an account of truth from the claim that (...) doing so is necessary. The claim that doing so is sufficient is a common component of deflationary theories of truth, while the claim that it is necessary, though often assumed, must be denied by proponents of rival inflationary theories of truth. I discuss the clarification of the debate between these views of truth that results from distinguishing the necessity and the sufficiency claims, and examine the prospects for its resolution. The nature of the relationship between early modern political philosophy and revealed religion has been much debated. The contributors to Piety and Humanity argue that this relationship is one of dissonance rather than concord. They claim that the early modern political philosophers found revealed religion—especially Christianity—to be a threat to the modern political project, and that these philosophers therefore attempted to transform revealed religion so that it would be less of a threat, and possibly even an aid. Each essay is (...) devoted to a particular work by a single political philosopher; the thinkers and works discussed include Machiavelli's Exhortation to Penitence, Francis Bacon's New Atlantis, Spinoza's Theologico-Political Treatise, and Locke's Reasonableness of Christianity. Each essay is followed by a brief selected bibliography. This book will be of great importance to philosophers, political theorists, and scholars of religion and early modern European history. Contractualists characterize morality as fundamentally concerning how people relate to one another. Insofar as someone treats others in a way that they can accept, her actions are permissible. If someone’s actions cannot be justified to others, she acts wrongly. By relying on this idea of justifiability to others, contractualists can account for the wrongness of acts by appealing to a wide variety of reasons. For instance, contractualists can explain why murder is wrong by appealing to the death of innocents and (...) explain the wrongness of plagiarism in terms of the importance of authenticity and originality. Someone can reasonably reject letting people act on principles that allow murder or plagiarism, at least in part, for those reasons. While this flexibility is a strength of contractualism, it also complicates explaining how the fact that an act is wrong itself provides a reason against doing it. Put differently, if the death of innocents explains the wrongness of murder, why take the .. (shrink)

I highlight a category of experiment-what I am calling 'demonstrations'-that differs in justificatory mode and argumentative role from the more familiar 'crucial tests'. 'Tests' are constructed such that alternative results are equally and symmetrically informative; they help discriminate between alternative solutions within a problem-field, where questions are shared. 'Demonstrations' are notably asymmetrical (for example, "failures" are often not telling), yet they are effective, if not "crucial," in interparadigm dispute, to legitimate questions themselves.
