The moral expertise of clinical ethicists is not a question of mastering codelike theories and lawlike principles. Rather, ethicists are architects of moral space within the health care setting, as well as mediators in the conversations taking place within that space.

Two studies examined the specificity of effects of explanation on learning by prompting 3- to 6-year-old children to explain a mechanical toy and comparing what they learned about the toy’s causal and non-causal properties to children who only observed the toy, both with and without accompanying verbalization. In Study 1, children were experimentally assigned to either explain or observe the mechanical toy. In Study 2, children were classified according to whether the content of their response to an undirected prompt involved (...) explanation. Dependent measures included whether children understood the toy’s functional-mechanical relationships, remembered perceptual features of the toy, effectively reconstructed the toy, and (for Study 2) generalized the function of the toy when constructing a new one. Results demonstrate that across age groups, explanation promotes causal learning and generalization, but does not improve (and in younger children, can even impair) memory for causally-irrelevant perceptual details. Did the Greeks believe in their mythology? The answer is difficult, for “believe” means so many things… Not everyone believed that Minos continued to be a judge in Hell or that Theseus defeated the Minotaur, and they knew that poets “lie.” Nevertheless, their manner of not believing gave reason for concern, for Theseus was no less real in their eyes. It is simply necessary to “purify myth with reason’“ and to reduce the biography of the companion of Hercules to its (...) historic kernel. As for Minos, after a prodigious mental effort, Thucydides extracts the same kernel from his subject: “Of all those whom we know only by hearsay, Minos was the first to have a fleet.” The father of Phaedra, the husband of Pasiphaë is nothing more than a king who was master of the sea. The purification of the mythical by the logos is not an episode in the eternal struggle, from the beginning to Voltaire and Renan, between superstition and reason, a struggle which was the glory of Greek genius. The myth and the logos, despite Nestle, are not simple opposites like truth and error. Myth was a subject of serious reflections, and the Greeks had not yet finished with it six centuries after the Sophist movement which has been called their Aufklärung. Far from being a triumph of reason, the purging of myth by logos is a very dated program whose absurdity is surprising. Why did the Greeks make themselves unhappy for nothing by seeking to separate the wheat from the chaff instead of rejecting in one gesture the fantasy of both Theseus and the Minotaur, the very existence of a fabulous Minos as well as the implausible qualities with which the myth endows this Minos? This paper is predicated on the understanding that clinical encounters between clinicians and patients should be seen primarily as inter-relations among persons and, as such, are necessarily moral encounters. It aims to relocate the discussion to be had in challenging medical decision-making situations, including, for example, as the end of life comes into view, onto a more robust moral philosophical footing than is currently commonplace. In our contemporary era, those making moral decisions must be cognizant of the existence of perspectives (...) other than their own, and be attuned to the demands of inter-subjectivity. Applicable to clinical practice, we propose and justify a Habermasian approach as one useful means of achieving what can be described as dialogic consensus. The Habermasian approach builds around, first, his discourse theory of morality as universalizable to all and, second, communicative action as a cooperative search for truth. It is a concrete way to ground the discourse which must be held in complex medical decision-making situations, in its actual reality. Considerations about the theoretical underpinnings of the application of dialogic consensus to clinical practice, and potential difficulties, are explored. (shrink)

I argue that if we allow that Moore’s Method, which involves taking an ordinary knowledge claim to support a substantive metaphysical conclusion, can be used to support Moore’s proof an external world, then we should accept that Moore’s Method can be used to support a variety of incompatible metaphysical conclusions. I shall refer to this as “the problem of many proofs”. The problem of many proofs, I claim, stems from the theory-ladenness of perception. I shall argue further that this plethora (...) of proofs for incompatible positions leads to a darker form of skepticism, one which maintains that each of the dogmatic views is probably false. We will conclude by considering various ways a Moorean might respond to these difficulties. (shrink)

Around the world, the population is ageing in ways that pose new challenges for healthcare providers. To date these have mostly been formulated in terms of challenges created by increasing costs, and the focus has been squarely on life-prolonging treatments. However, this focus ignores the ways in which many older people require life-enhancing treatments to counteract the effects of physical and mental decline. Evidence‐based practice (EBP) first appeared on the healthcare horizon just over a decade ago. In 2003 its presence has intensified and extended beyond its initial relation to medicine embracing as it does now, nursing and the allied health disciplines. In this paper, I contend that its appearance and subsequent growth and development are the effects of potent ‘regimes of truth’, four of which bear the names: positivism, empiricism, pragmatism and economic rationalism. My aim is to show how EBP generates the (...) controversy it does because its nature and methods are inextricably interwoven with the way it has become politicised and professionalised. This exegesis is an attempt to outline how the combined effects of the four forms of rationality mentioned above allow for both the methods and objectives of EBP to be constructed as they are, while at the same moment producing the particular effects of knowledge and power in terms of who sells and who buys the idea of EBP in the culture of contemporary healthcare. :This article describes the well-developed and long-standing medical ethics teaching programs in both of New Zealand’s medical schools at the University of Otago and the University of Auckland. The programs reflect the awareness that has been increasing as to the important role that ethics education plays in contributing to the “professionalism” and “professional development” in medical curricula.

Critics of the computational connectionism of the last decade suggest that it shares undesirable features with earlier empiricist or associationist approaches, and with behaviourist theories of learning. To assess the accuracy of this charge the works of earlier writers are examined for the presence of such features, and brief accounts of those found are given for Herbert Spencer, William James and the learning theorists Thorndike, Pavlov and Hull. The idea that cognition depends on associative connections among large networks of neurons (...) is indeed one with precedents, although the implications of this for psychological issues have been interpreted variously — not all versions of connectionism are alike. Objections to uploading may be parsed into substrate issues, dealing with the computer platform of upload and personal identity. This paper argues that the personal identity issues of uploading are no more or less challenging than those of bodily transfer often discussed in the philosophical literature. It is argued that what is important in personal identity involves both token and type identity. While uploading does not preserve token identity, it does save type identity; and even qua token, one may have (...) good reason to think that the preservation of the type is worth the cost. Business scholars pay increasing attention to the expanded influence of stakeholders on firm strategies, legitimacy, and competitiveness. At the same time, analysts have noted that the transformed regulatory and legislative environments of recent decades have encouraged firms to become much more politically active. Surprisingly, relatively little research has tied together these two trends. The present study integrates perspectives on stakeholder management with research on corporate political activity to develop an understanding of the structural sources of stakeholder mobilization in professional grassroots (...) lobbying campaigns. This study employs a unique, original data source to consider how the adoption of grassroots lobbying by a firm relates to its industry, degree of inside lobbying, partisan PAC contributions, and more. This research shows that corporate grassroots lobbying is shaped most significantly by a firm’s degree of inside lobbying, as highly active firms take a diversified strategy for gaining influence. Firms in industries with a heavy public presence as well as those concerned with taxation, government appropriations, and economic development also adopt these strategies readily. PAC contributions to Republican, but not Democratic, candidates also heighten firms’ propensity to lobby the public. (shrink)

In an age where previous frames of reference lose their certainty nurses are finding themselves rethinking their relations to the ‘real’. In this paper I interrogate an empirical ‘text’ of a local nursing cultural practice through a poststructural critique of the ways in which language, discourses, representation and experience intersect to construct ‘reality’ for us with specific consequences. I do this in an attempt to disclose the micro‐politics at work in the processes of signifying and thus representing nursing to a (...) world of potential students. The discourses of science and caring find themselves exposed in particular representational technologies and practices that mark nursing's collusion with the ‘truths’ of science at the expense of those we loosely name ‘caring’. This cultural theoretical work constitutes a provisional and historical fragment of analysis designed to trouble the relations we often unwittingly sustain with dominant ‘regimes of truth’. (shrink)

A claimed benefit of epistemic externalism is that it alone can avoid skepticism. Most epistemic externalists, however, allow a residual amount of internalism in terms of a defeasibility condition. The paper argues that this internal condition is sufficient for skeptics to cast doubt on many claims to justified belief about perceptual matters about the world. Furthermore, the internal defeasibility condition also opens the door to a darker form of skepticism; skeptical dogmatism, which maintains that many of our perceptually based beliefs (...) are probably false. Thus, the claimed benefits of externalism in avoiding skepticism are greatly exaggerated. (shrink)

In this article I consider the uses of the concepts ‘society’ and ‘culture’ in various sociological and anthropological traditions, arguing that sociology needs to learn from the division between social anthropology and cultural anthropology. First I distinguish the social and the cultural sciences: the former use ‘society’ as leading concept and ‘culture’ as a subordinate concept; the latter do the contrary. I discuss the origins of the terms société and Kultur in the classical French and German traditions respectively, and their (...) subsequent uptake in Anglo-American sociology and anthropology, ‘society’ becoming the leading concept for sociology and social anthropology, ‘culture’ the leading concept for cultural anthropology. I contrast the sociology of culture with the cultural anthropological consideration of society. I next examine the terms for ‘society’ in the classical German tradition, especially Weber, pointing to interpretivism as a cultural theory of society. I then consider Weber’s Kultursoziologie, arguing that it is culture (Kultur) not society (Gesellschaft) that is the ultimate object of Weber’s sociology. I conclude that sociology needs to identify classical German sociology and its derivatives as cultural science not social science, and to make comprehensive adjustments to its methodological debates accordingly. The implications of this for the problem of sociology’s encounter with the natural world are noted. (shrink)

This article examines the extent to which the concept of social quality could contribute to a transformation in the debates about the welfare sustainability in Asia and Europe. The article starts by outlining the concept of social quality: its constitutional, conditional and normative components and the origins of its development as a European conceptual framework. Then a bridge is created between Europe and Asia by looking briefly at the similarities and differences between social quality and human security, a concept that (...) is more familiar in the latter region than the former one. is is followed by a critique of the global discourses on 'sustainability' and, in particular, their dominance by economism. The final part of the article utilizes the concept of social quality to propose a more open and balanced approach to sustainability that brings in social and ecological considerations alongside economic ones. Some tentative suggestions are made concerning the operationalisation of a social quality approach to welfare system sustainability. (shrink)

It is commonly thought, in line with the position defended in an influential paper by David Lewis, that the decision problems faced in the prisoner’s dilemma and the Newcomb situation are essentially the same problem. José Luis Bermúdez has recently attacked the case Lewis makes for this claim. While I think the claim is false, I contend that Bermúdez’s reason for rejecting Lewis’s argument is inadequate, and then outline what I take to be a better reason for doing so.

'Dry,obscure...Prolix.' That was Kant's own critique of his first Critique - and exasperated students since having it extended to the rest of his work. Yet despite it's sprawling for and forbidding content, Kant's moral philosophy has continued to compel the attention of every serious thinker in the field. Clear, Concise - and overwhelmingly convinvcing - Ralph Walker's brilliant guide spells out the power and renewed relevance of histhinking : a genuinely objective, absolute basis for a modern moral law.

The article argues for an alliance of the capability approach developed by Amartya Sen with ideas from critical pedagogy for undergraduate university education which develops student agency and well being on the one hand, and social change towards greater justice on the other. The purposes of a university education in this article are taken to include both intrinsic and instrumental purposes and to therefore include personal development, economic opportunities and becoming educated citizens. Core ideas from the capability approach are outlined, (...) with examples, before possible articulations of capability and Sen's notion of process freedom with critical pedagogy are investigated. It is argued that each approach has something to offer when brought alongside as ‘critical capability pedagogies’, which seek to enhance and expand student experiences of learning and their ‘valuable beings and doings’. Finally core capabilities in a university education are considered and some of the problems of domesticating the capability approach addressed. (shrink)

I explore Aristotle’s account in the Nicomachean Ethics of how agents attain self-awareness through contemplation. I argue that Aristotle sets up an account of self-awareness through contemplating friends in Books VIII-IX that completes itself in Book X’s remarks on theoretical contemplation. I go on to provide an account of how contemplating the divine, on Aristotle’s view, elicits self-awareness.

Graham Walker boldly recasts the debate over issues like constitutional interpretation and judicial review, and challenges contemporary thinking not only about specifically constitutional questions but also about liberalism, law, justice, and rights. Walker targets the "skeptical" moral nihilism of leading American judges and writers, on both the political left and right, charging that their premises undermine the authority of the Constitution, empty its moral words of any determinate meaning, and make nonsense of ostensibly normative theories. But he is (...) even more worried about those who desire to conduct constitutional government by direct recourse to an authoritative moral truth. Augustine's political ethics, Walker argues, offers a solution--a way to embrace substantive goodness while relativizing its embodiment in politics and law. Walker sees in Augustinian theory an understanding of the rule of law that prevents us from mistaking law for moral truth. Pointing out how the tensions in that theory resonate with the normative ambivalence of America's liberal constitutionalism, he shows that Augustine can provide successful but decidedly nonliberal grounds for the artifices and compromises characteristic of law in a liberal state. At first approach the use of the word “superstition” is such that it is impossible to apply the term strictly in the human sciences. Its connotation, that is its content, is particularly subjective and negative. And its extension, that is its area of application, is indefinite and makes of it a concept that can refer to just about anything.

Gregory Bateson’s career from anthropologist, through his development of cybernetics and systems theory, to developing ideas around ‘the sacred’, has parallels with Roy Bhaskar’s intellectual journey. This paper proposes that as well as Bateson’s theory of cybernetics and systemic thought making a contribution to basic and dialectic critical realism, his final and posthumously published Angels Fear: Towards and Epistemology of the Sacred adds to our understanding of Bhaskar’s metaReality. Similarities between the development of Bateson’s work from 1936 to 1987 and (...) Bhaskar’s work from 1975 to 2016 enable the development of theory that adds to both of their respective appreciations of metaReality and the sacred. Thus, by starting a conversation between Bateson and Bhaskar, we can develop a higher order understanding of the world than proposed by Bhaskar’s metaReality alone. (shrink)

Lawyers in many jurisdictions are ageing, and yet there is little information concerning the age profile of the legal profession. This paper presents the first consideration of the age profile of lawyers outside of the US, showing that Australian lawyers are ageing and delaying retirement. These findings have serious implications. Problems associated with a growing proportion of older lawyers include an increasing risk of lawyers suffering from age-related cognitive and physical impairment, and the related rise of complaints and malpractice claims (...) against older lawyers. It is also clear that the Australian legal profession is unprepared to address these problems. The legal profession has ignored important gender-specific implications of ageing, such as female lawyers experiencing menopause and the lower savings of female lawyers moving into retirement. Regulatory regimes have not considered the impact of the profession's ageing profile, and there is no mandatory reporting of lawyers suffering from age-related impairment or provisions should a lawyer die. The profession also has not provided strategies to positively transition lawyers into retirement, and there is a lack of flexible working arrangements and succession planning, especially in firms located outside urban centres.
