State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...) wrongdoing by physicians. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Inductively defined structures are ubiquitous in mathematics; their specification is unambiguous and their properties are powerful. All fields of mathematical logic feature these structures prominently: the formula of a language, the set of theorems, the natural numbers, the primitive recursive functions, the constructive number classes and segments of the cumulative hierarchy of sets. -/- This dissertation gives a mathematical characterization of a species of inductively defined structures, called accessible domains, which include all of the above examples except the set of (...) theorems. The concept of an accessible domain comes from Wilfried Sieg's analysis of proof-theoretic practices, starting with his dissertation. In particular, he noticed the special epistemological character of elements of an accessible domain: they can always be uniquely identified with their build-up. Generally, the unique build-up of elements justifies the principles of induction and recursion. -/- I use category theory to give an abstract characterization of accessible domains. I claim that accessible domains are all instances of initial algebras for endofunctors. Grounded in the historical roots of Sieg's discussions, this dissertation shows how the properties of initial algebras for endofunctors and accessible domains coincide in a satisfying and natural way. -/- Filling out this characterization, I show how important examples of accessible domains fit into this broad characterization. I first characterize some accessible domains by relatively simple functors (e.g. finite, polynomial, those that preserve certain colimits) where we can see how iterating the functor can produce the accessible domain. Then I describe accessible domains that result from more involved specifications (e.g. ordinals and segments of the cumulative hierarchies associated with CZF, IZF, and ZF) by relying heavily on algebraic set theory. David Lewis insists that restrictivist composition must be motivated by and occur due to some intuitive desiderata for a relation R among parts that compose wholes, and insists that a restrictivist’s relation R must be vague. Peter van Inwagen agrees. In this paper, I argue that restrictivists need not use such examples of relation R as a criterion for composition, and any restrictivist should reject a number of related mereological theses. This paper critiques Lewis and van Inwagen (and others) on (...) their respective mereological metaphysics, and offers a Golden Mean between their two opposite extremes. I argue for a novel account of mereology I call Modal Mereology that is an alternative to Classical Mereology. A modal mereologist can be a universalist about the possible composition of wholes from parts and a restrictivist about the actual composition of wholes from parts. I argue that puzzles facing Modal Mereology (e.g., puzzles concerning Cambridge changes and the Problem of the Many, and how to demarcate the actual from the possible) are also faced in similar forms by classical universalists. On my account, restricted composition is rather motivated by and occurs due to a possible whole’s instantiating an actual type. Universalists commonly believe in such types and defend their existence from objections and puzzles. The Modal Mereological restrictivist can similarly defend the existence of such types (adding that such types are the only wholes) from similar objections and puzzles. (shrink)

In this paper, I develop an argument for the thesis that ‘maximality is extrinsic’, on which a whole physical object is not a whole of its kind in virtue of its intrinsic properties. Theodore Sider has a number of arguments that depend on his own simple argument that maximality is extrinsic. However, Peter van Inwagen has an argument in defence of his Duplication Principle that, I will argue, can be extended to show that Sider's simple argument fails. However, van Inwagen's (...) argument fails against a more complex, sophisticated argument that maximality is extrinsic. I use van Inwagen's own commitments to various forms of causation and metaphysical possibility to argue that maximality is indeed extrinsic, although not for the mundane reasons that Sider suggests. I then argue that moral properties are extrinsic properties. Two physically identical things can have different moral properties in a physical world. This argument is a counterexample to a classical ethical supervenience idea (often attributed to G.E. Moore) that if there is identity of physical properties in a physical world, then there is identity in moral properties as well. I argue moral value is ‘border sensitive’ and extrinsic for Kantians, utilitarians, and Aristotelians. (shrink)

This is an open access book which explores phenomenology as both an exceptionally diverse movement in philosophy as well as an active research method that crosses disciplinary boundaries. The volume brings together lively overviews of major areas and schools of phenomenology, as well as the most recent applications across a range of fields. The first part reviews the state-of-the-art in various areas of contemporary phenomenology, including several distinct schools of Husserl and Heidegger scholarship, as well as approaches derived from Merleau-Ponty, (...) de Beauvoir, Fanon, and others. An innovative quantitative analysis of citation networks provides rich visualizations of the field as a whole. The second part showcases phenomenology as a living discipline that can advance research in other areas. After a skillful interweaving of the ideas of past philosophers, which have been rapidly, but for the most part fairly, run through under his critical glance, Walsh concludes that Metaphysics as the explication of the first principles of discourse is not only possible, but unavoidable if one is to be a serious philosopher. But having accepted this much of the Aristotelian notion of Metaphysics-as-analysis, Walsh registers a modernized Kantian caveat in which he rejects the Ontological pretensions that some (...) metaphysicians have entertained: e.g., Aristotle's conception of Metaphysics as being also the science of separate substance. Consistent with this rejection is a rejection of a meaningful isomorphism between the first principles of discourse and the first principles of being. Thus, the former are in no way absolute, but must be seen in the context of the cultural and linguistic community in which they occur. In taking up the question of the justification of a set of metaphysical principles, Walsh avoids the fashionable but impossibly vague umbrella-term, "pragmatic justification," which he recognizes is a relic from the brasher days of Verificationism; but he still concludes that metaphysical statements can be neither true nor false, but, at best, consistent. There is much to take issue with in this book, but its clear style and frank but judicious appraisals of the opinions of other philosophers make it both a stimulating and informative introduction to the subject.—E. This is the sixth volume in the Oxford Classical Texts series of Livy and contains a Latin text, together with full apparatus criticus and Latin introduction, of Books 36-40, which cover the period from 192 to 179 BC. This momentous era in the history of Republican Rome begins with the war with Antiochus, which resulted in Rome's indirect control of Greece and Asia, and concludes with the death of Philip V of Macedon, foreshadowing the Third Macedonian War. During these years (...) Rome also struggled for the increasing dominance of northern Italy and Spain. On the domestic front, Livy depicts this period as the beginning of Roman moral decline, as reflected in such events as the trials of the Scipios, the censorship of Cato, and the Bacchanalia. Our ultimate purpose is to give an axiomatic treatment of recursion theory sufficient to develop the priority method. The direct or abstract approach is to keep in mind as clearly as possible the methods actually used in recursion theory, and then to formulate them explicitly. The indirect or experimental approach is to look first for other mathematical theories which seem similar to recursion theory, to formulate the analogies precisely, and then to search for an axiomatic treatment which covers not only (...) recursion theory but also the analogous theories as particular cases.The first approach is more general because it does not depend on the existence of analogues. A concrete mathematical theory, it seems, need have no such analogues and still be important, as e.g. classical number theory. In such a case, an axiomatic treatment may still be useful for exhibiting the mathematical structure of the theory considered and the assumptions on which it rests. However, it will lack one of the most heavily advertised advantages of the axiomatic method, namely, the “economy of thought” which results from an uniform theory for several different and interesting cases: we cannot hope for this if, by hypothesis, we know of only one particular case. In contrast, the second approach, if successful at all, is bound to achieve such “economy” because we start out with several interesting particular cases. Another possible virtue of the second approach is that of field work over insight: the abstract pattern that we are looking for and hoping to formalize in axioms, may not be evident in any one mathematical theory, but may spring to the eye if one happens to look simultaneously at several theories which happen to realize the pattern. In this paper I shall venture into an area with which I am not very familiar and in which I feel far from confident; namely into phenomenology. My main motive is not to get away from standard, boring, methodological questions like those of induction and demarcation; but the conviction that a phenomenological account of the empirical basis forms a necessary complement to Popper's falsificationism. According to the latter, a scientific theory is a synthetic and universal, hence unverifiable proposition. In fact, (...) in order to be technologically useful, a scientific hypothesis must refer to future states-of-affairs; it ought therefore to remain unverified. But in order to be empirical, a theory must bear some kind of relation to factual statements. According to Popper, such a relation can only be one of potential conflict. Thus a theory T will be termed scientific if and only if T is logically incompatible with a so-called basic statement b, where b is both empirically verifiable and empirically falsifiable. In other words: T is scientific if it entails ¬b; where b, hence also ¬b, is an empirically decidable proposition. (shrink)

In this thesis I argue for the following theory: constitutive Russellian phenomenal bonding panpsychism. To do so I do three main things: 1) I argue for Russellian panpsychism. 2) I argue for phenomenal bonding panpsychism. 3) I defend the resultant phenomenal bonding panpsychist model. The importance of arguing for such a theory is that if it can be made to be viable, then it is proposed to be the most promising theory of the place of consciousness within nature. This is (...) because constitutive Russellian panpsychism has all the theoretical virtues of physicalism and dualism but does not face the problems they do. The combination problem, however, is the most significant problem for the Russellian panpsychist, and, hence, in order to show the viability of the theory I address this problem. Moreover, I present a novel ”mereological argument’ for panpsychism which makes it necessary that the Russellian panpsychist addresses the combination problem. The focus of this thesis is therefore addressing this problem. I argue that the combination problem can indeed be solved. To do so I argue for the phenomenal bonding solution proposed by Goff. I argue that this solution works and that we can form a positive concept of the phenomenal bonding relation. This forces the panpsychist to make sense of how experiencing subjects can be proper parts of other experiencing subjects. I then argue that this can indeed be made sense of and show that we can indeed be composite subjects made of other subjects. To show that we can be subjects made up of other subjects I defend this proposal from various objections from throughout the literature. All these objections can be responded to by the constitutive Russellian phenomenal bonding panpsychist. Ultimately this leaves us with a novel and interesting account of what conscious subjects are, and what the material world is: they are both composite entities made wholly of conscious matter. This article presents evidence supporting the claim that ethical reasoning is a skill that can be taught and assessed. We propose a working definition of ethical reasoning as 1) the ability to identify, analyze, and weigh moral aspects of a particular situation, and 2) to make decisions that are informed and warranted by the moral investigation. The evidence consists of a description of an ethical reasoning education program—Ethical Reasoning in Action —designed to increase ethical reasoning skills in a variety of (...) situations and areas of life. ERiA is housed at a public, major comprehensive U.S. university—James Madison University—and assessment of the program focuses on interventions delivered prior to and during orientation for incoming first-year students. Findings indicate that the interventions measurably enhance the ability of undergraduate students to reason ethically. ERiA’s competency-targeted program and positive student learning outcomes offers a promising model for higher education ethics programs seeking to connect classroom learning in ethics to decision-making in everyday life. Negotiation is a complex and dynamic decision process during which parties perceptions, preferences, and roles may change. Modelling such a process requires flexible and powerful tools. The use of rule-based formalism is therefore expanded from its traditional expert system type technique, to structuring and restructuring non-trivial processes like negotiation. Using rules we build a model of a negotiation problem. Some rules are used to infer positions and reactions of the parties, other rules are used to modify problem representation when such (...) a modification is necessary. We illustrate the approach with a contract negotiation case between two large companies. We also show how this approach could help one party to realize that negotiations are being carried on against their assumptions and expectations. (shrink)

These notes of G. E. Moore's lectures for the three terms of 1934-1935 were compiled by Alice Ambrose, then Student of Newnham College, and Margaret Macdonald, then Fellow of Girton College. Wegner (2002) fails to (1) distinguish conscious will and voluntariness; (2) account for everyday willed acts; and (3) individuate thoughts and acts. Wegner incorrectly implies that (4) we experience acts as willed only when they are caused by unwilled thoughts; (5) thoughts are never true causes of actions; and (6) we experience ourselves as first performing mental acts which then cause our intentional actions.

This article deals with the relationship between the thought of Michel Foucault and that of Axel Honneth, arguing in favour of the former against the latter. I begin by considering Honneth’s early engagement in The Critique of Power with Foucault’s thought. I rebut Honneth’s criticisms of Foucault here as a misreading, one which prevents Honneth from coming to grips with Foucault’s position and hence the challenge that it poses to Honneth’s project. I then move on to offer a Foucauldian critique (...) of Honneth’s own position, arguing for a Foucauldian alternative to Critical Theory. (shrink)

The process of integration of digital technologies into the structure of social production and distribution leads to a series of definite trends in capitalist development. These trends are regular and interdependent. The acceleration of information exchange provides an opportunity to replace the Fordism with a thriftier network model, which involves outsourcing and reducing the longevity of contractual obligations and hiring relationships, which leads to the precarization of labor of a certain social group, which can be described as “precariat”. The change (...) in working conditions leads to the change in ways of increasing labor productivity, which is the reason for the emergence of “societies of control” characterized by: distributed power, embedding previously external coercion into the personality, affective engineering, prolongation of the educational process, increasing tempo and rhythm of work, spreading the project as the form of work replacing routine forms, and the emergence of a liquid short-term identity inherent in representatives of the precariat. This article aims to discover and demonstrate the interconnection between these processes. Achieving this goal will open the way to a more thorough separate study of each of these processes in the future but this research will be made from the perspective of their systemic unity. According to the purpose of the article, the structure of work is the following: the first section is devoted to the acceleration of social time, which is connected with the compression of social space and with the change in scale in which commercial and state enterprises can operate. Quick positive feedback, which is provided by the digital network, leads to changes in the infrastructure of enterprises and the transformation of production and logistics models. In addition, the acceleration of the feedback between the employee and the employer leads to the precarization of labor, which is accompanied by the appearance of “societies of control”. (shrink)

I discuss the treatment by Chisholm of the problem posed by the fact that one can produce some neuro-physiological changes by moving a limb, namely the ones which cause the motions. I concentrate largely on the treatment Chisholm gave to this question before Person and Object, and I compare it with von Wright's discussion of it, I conclude that there are correct elements about both but that both are unsatisfactory, Chisholm's because it entails that we must know something which we (...) manifestly need not know when we move. A semantics for quantified modal logic is presented that is based on Kleene's notion of realizability. This semantics generalizes Flagg's 1985 construction of a model of a modal version of Church's Thesis and first-order arithmetic. While the bulk of the paper is devoted to developing the details of the semantics, to illustrate the scope of this approach, we show that the construction produces (i) a model of a modal version of Church's Thesis and a variant of a modal set theory (...) due to Goodman and Scedrov, (ii) a model of a modal version of Troelstra's generalized continuity principle together with a fragment of second-order arithmetic, and (iii) a model based on Scott's graph model (for the untyped lambda calculus) which witnesses the failure of the stability of non-identity.
