Some believe that the mere beneficiaries of wrongdoing of others ought to disgorge their tainted benefits. Others deny that claim. Both sides of this debate concentrate on unavoidable beneficiaries of the wrongdoing of others, who are presumed themselves to be innocent by virtue of the fact they have neither contributed to the wrong nor could they have avoided receiving the benefit. But as we show, this presumption is mistaken for unavoidable beneficiaries who intend in certain ways to benefit from wrongdoing, (...) and who have therefore done something wrong in forming and acting on such an intention. Among the many names violently consigned to oblivion, one cannot omit mentioning the name of Gustav Gustavovich Shpet, a scholar who made a substantial contribution to our country's philosophy, psychology, aesthetics, and linguistics. His rehabilitation in 1956 was not enough to restore his memory in public consciousness, paralyzed by the inertia and fears of the Stalinist years, and the freeze that began soon after, of the sprouts that had just been summoned to life, had its impact in an abrogation of (...) agreements, cessation of publications, and in a number of cases removal of references to the philosopher. And the further thirty years of oblivion that followed were one more period of unjust punishment and a new ordeal in the terrible fate of the scholar and his ideas. His writings, which should have been a new word in science, should have given direction to further investigations, became effectively inaccessible to subsequent generations. References to Shpet in the works of Viach. Vs. Ivanov, Iu. M. Lotman, D. S. Likhachev, A. P. Chudakov, and others, and the article in Philosophical Encyclopedia [Filosofskaia entsiklopediia] written by V. S. Asmus aroused interest in Shpet's writings in Hungary and Germany. In the summer of 1986, an international conference on Shpet was held in Bochum, and his books are being translated. Unfortunately, in his own country the level of research on the philosopher's writings and thoughts is still almost at point zero, but we may hope that interest in Shpet's ideas will grow considerably in connection with the publication of the series From the History of Russian Philosophical Thought [Iz istorii otechestvennoi filosofskoi mysli] and a number of other publications. The principle of wrongful benefits prescribes that beneficiaries from wrongdoing incur duties towards the victims of the wrongdoing. The principle focuses on involuntary beneficiaries, demanding that they disgorge their tainted benefit. However, it overlooks the duties of beneficiaries who are not straightforwardly involuntary. The article addresses this gap in the literature. It explores the duties of ‘voluntary beneficiaries’, who could avoid receiving the tainted benefit; and the duties of ‘welcoming beneficiaries’, who cannot avoid receiving the tainted benefit but welcome it. (...) The article demonstrates that in both cases, the duties of the beneficiary towards the victim of the original wrongdoing are not limited to the disgorgement of the benefit. Rather, voluntary and welcoming beneficiaries are themselves involved in the commission of wrongdoing against the victim of the original wrongdoing, and hence may owe the victim compensation that exceeds the level of their own benefit. This argument has various practical implications, e.g. in specifying the duties of companies who benefit from human rights violations down their supply chain. (shrink)

What does a truly democratic experience of political action look like today? In this provocative new work, Adriana Cavarero weighs in on contemporary debates about the relationship between democracy, happiness, and dissent. Drawing upon Arendt's understanding of politics as a participatory experience, but also discussing texts by Émile Zola, Elias Canetti, Boris Pasternak, and Roland Barthes, along with engaging Judith Butler, Cavarero proposes a new view of democracy, based not on violence, but rather on the spontaneous experience of a (...) plurality of bodies coming together in public. Expanding upon the themes explored in previous works, Cavarero offers a timely intervention into current thinking about the nature of democracy, suggesting that its emergence thrives on the nonviolent creativity of a widespread, participatory, and relational power that is shared horizontally rather than vertically. From digital democracy to selfies to contemporary protest movements, Cavarero argues that we need to rethink our focus on individual happiness and turn toward rediscovering the joyful emotions of birth through plural interaction. Academic dishonesty among students is not confined to the dynamics of the classrooms in which it occurs. The institution has a major role in fostering academic integrity. Ways that institutions can have a significant impact on attitudes toward and knowledge about academic integrity as well as reducing the incidence of academic dishonesty are described. These include the content of an effective academic honesty policy, campus-wide programs designed to foster integrity, and the development of a campus-wide ethos that encourages integrity.

This paper assesses several prominent recent attacks on the view that epistemic justification is conceptually prior to knowledge. I argue that this view—call it the Received View (RV)—emerges from these attacks unscathed. I start with Timothy Williamson’s two strongest arguments for the claim that all evidence is knowledge (E>K), which impugns RV when combined with the claim that justification depends on evidence. One of Williamson’s arguments assumes a false epistemic closure principle; the other misses some alternative (to E>K) explanations of (...) a putative fact about the evidence a particular subject has. Next, I neutralize each of Jonathan Sutton’s three recent arguments to the conclusion that any justified belief constitutes knowledge. Finally, I consider a recent analysis of justification due to Alexander Bird, according to which justified belief is possible knowledge. I argue that Bird’s analysis delivers neither a sufficient nor (more importantly) a necessary condition for justification. [Word count: 149]. (shrink)

A personal view is presented of how metaphysics and ontology stand at the beginning of the twenty-first century, in the light of developments during the twentieth. It is argued that realist metaphysics, with serious ontology at its heart, has a promising future, provided that its adherents devote some time and effort to countering the influences of both its critics and its false friends.

I have stressed here and elsewhere that perspective cannot and need not claim to represent the world "as we see it." The perceptual constancies which make us underrate the degree of objective diminutions with distance, it turns out, constitute only one of the factors refuting this claim. The selectivity of vision can now be seen to be another. There are many ways of "seeing the world," but obviously the claim would have to relate to the "snapshot vision" of the stationary (...) single eye. To ask, as it has so often been asked, whether this eye sees the world in the form of a hollow sphere or of a projection plane makes little sense, for it sees neither. The one point in focus can hardly be said to be either curved or flat, and the remainder of the field of vision is too indistinct to permit a decision. True, we can shift the point of focus at will, but in doing so we lose the previous perception, and all that remains is its memory. Can we, and do we, compare the exact extension of these changing percepts in scanning a row of columns extended at right angles from the central line of vision—to mention the most recalcitrant of the posers of perspectival theory?1 I very much doubt it. The question refers to the convenient choice of projection planes, not to the experience of vision.· 1. Many of those actively involved in the physical sciences adopt a reductionist point of view, in which all aspects of the world are ultimately controlled by physical laws that are expressed in terms of mathematical equations. In this article we adopt a pluralistic approach to human understanding in which mathematically expressed laws of nature are merely one way among several of describing a world that is too vast and complex for our minds to be able to grasp in its entirety.

We discuss the extent to which the visibility of the heavens was a necessary condition for the development of science, with particular reference to the measurement of time. Our conclusion is that while astronomy had significant importance, the growth of most areas of science was more heavily influenced by the accuracy of scientific instruments, and hence by current technology.

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. The purpose of this work is to analyse the cognitive process of the domain theories in terms of the measurement theory to develop a computational machine learning approach for implementing it. As a result, the relational data mining approach, the authors proposed in the preceding books, was improved. We present the approach as an implementation of the cognitive process as the measurement theory perceived. We analyse the cognitive process in the first part of the paper and present the theory and (...) method of the logically most powerful empirical theory discovery in the second. The theory is based on the notion of law-like rules, which conform to all the properties of laws of nature, namely generality, simplicity, maximum refutability and minimum number of parameters. This notion is defined for deterministic and probabilistic cases. Based on the method, the discovery system is developed. The system was successfully applied to many practical tasks. (shrink)
