Every healthcare organisation enacts a multitude of policies, but there has been no discussion as to what procedural and substantive requirements a policy writing process should meet in order to achieve good outcomes and to possess sufficient authority for those who are asked to follow it.Using, as an example, the controversy about patient’s refusal of blood transfusions, I argue that a hospital wide policy is preferable to individual decision making, because it ensures autonomy, quality, fairness, and efficiency.Policy writing for morally (...) controversial medical practices needs additional justification compared to policies on standard medical practices and secures legitimate authority for HCO members by meeting five requirements: all parties directed by the policy are represented; the deliberative process encompasses all of the HCO’s obligations; the rationales for the policy are made available; there is a mechanism for criticising, and for evaluating the policy. In the Philosophical Investigations, Wittgenstein contrues psychological facts as patterns exhibited by `weaves' which include a person's behaviour as well as her temporal and social surroundings. Avowals, in being linguistic elements of such patterns, come to be taken as expressing psychological facts in a way that given the general liberty in pattern description, is normal with all conspicuous elements of behavioural patterns. Speakers come to be taken to express psychological facts because avowals are semantically self-predicating (which is understandable in the (...) light of the normal ways they are learnt). That avowals come to be reliable expressions of their psychological facts is anything but surprising, given normal human capacities of learning to behave in patterns; furthermore, avowals can supplement incomplete patterns and thus define them because articulated sentences add high amounts of complexity. Der Frage, welche Deutungen die öffentliche Diskussion dieses Problems dominieren und welche Akteure maßgeblich zu dieser Etablierung beigetragen haben, wird ebenso Aufmerksamkeit geschenkt wie der Frage nach der im Zuge steigender Drittmittelbedeutung zunehmend interessengetriebenen Position des Wissenschaftlers. Zusammenfassung Der Einfluss von sozialer Ungleichheit auf Sportverhalten und motorische Leistung wird in der Literatur kontrovers diskutiert und dargestellt. Gerade die Effekte bei Kindern und Jugendlichen, deren Sozialstatus von den Eltern abgeleitet ist, werden in diesem Kontext nur unzureichend thematisiert. Anhand einer Stichprobe von Schülern im Saarland soll der Frage nachgegangen werden, inwieweit das Geschlecht sowie der von den Eltern abgeleitete Sozialstatus sowohl Sportverhalten als auch motorische Leistungen determinieren. Von 1286 Schülern wurden die Eltern zum Sozialstatus sowie zu Aspekten des (...) Sportverhaltens der Kinder gefragt. 887 dieser Schüler wurden mit dem DMT 6-18 motorisch getestet. Vor allem das Sportengagement in Sportvereinen sowie die Beteiligung an Wettkämpfen hängen deutlich vom Geschlecht ab, während allgemein das Sportengagement geschlechtsunspezifisch ist. Sowohl Sportengagement als auch motorische Leistungen werden vom Sozialstatus der Eltern determiniert. (shrink)

Zusammenfassung Zum organisationalen Wandel existieren verschiedene theoretische Ansätze, welche sich u.a. durch ihren Umweltbezug unterscheiden. Der populationsökologische Ansatz erweitert diese intraorganisationale Perspektive um die Analyseebene des Kollektivs gleichartiger Organisationen. Auf dieser theoretischen Grundlage wird systematisch zwischen den drei Analyseebenen des einzelnen Sportvereins, dem Kollektiv bestehender Sportvereine sowie der Sportvereinspopulation unterschieden und werden Paneldaten aus zwei Befragungen pfälzischer Sportvereine hypothesengeleitet analysiert. Die Ergebnisse bestätigen zum einen die populationsökologischen Annahmen stabiler Kernmerkmale bei hochgradig wandlungs-, d.h. anpassungsfähigen peripheren Merkmalen in bestehenden Sportvereinen. In their recent book Buchanan and Powell claim that there is moral progress. Their analysis focuses on increasing inclusiveness, yet they also suggest other dimensions as possible indicators-improvements in the concept of morality and refinements in moral motivation. In the following I present empirical data on changes in moral understanding that occurred during the second half of the 20th century in Germany. These changes concern an increasing delimitation of the moral realm, the rise of an ethics of responsibility, the displacement (...) of an orientation to super ego dictates by a more ego-syntonic type of moral motivation. This research largely follows the ‘cognitivist’ paradigm which I start off defending against Haidt’s counter proposal of moral intuitionism. Feasible explanatory factors for the changes documented are put forward-processes of secularization and changes in socialization styles-and their interpretation as indicators of moral progress is discussed. The paper ends with brief speculations concerning possible reasons for current moral regressions. (shrink)

ArgumentThis paper provides an introduction to three translations of articles by Soviet philosopher Boris Hessen: “Mechanical Materialism and Modern Physics,” “On Comrade Timiryazev’s Attitude towards Contemporary Science” and “Marian Smoluchowski (On the Tenth Anniversary of His Death)”. It begins by presenting a central tension in Hessen’s work; namely, how even though he is better known for the externalism of his 1931 Newton paper, much of his work has been considered exemplary of an internalist approach. I then show that for Hessen, (...) the history of modern science was defined by the discovery of the dialectical unity in opposition between dynamic and statistical regularity. This not only sheds important light on Hessen’s understanding of causation, but also reconciles the aforementioned tension by showing his approach to the relationship between individuals and collectives in the study of physical phenomena, along with the relationship between individual scientists and socioeconomic conditions. Monitoring and assistive technologies (MATs) are being used more frequently in healthcare. A central ethical concern is the compatibility of these systems with the moral preferences of their users—an issue especially relevant to participatory approaches within the ethics-by-design debate. However, users’ incapacity to communicate preferences or to participate in design processes, e.g., due to dementia, presents a hurdle for participatory ethics-by-design approaches. In this paper, we explore the question of how the value preferences of users in the field of dementia (...) care can be integrated into AI-based MATs. First, we briefly introduce different ethics-by-design approaches and explain the challenges they face in dementia care. Next, we introduce a novel approach for addressing these challenges. Through a qualitative content analysis of interviews with persons with dementia and their family caregivers (n = 27), we identified multiple ideal–typical value preference profiles. We then applied these profiles in a computer simulation, by which we also introduce the concept of ethical compliance quantification to scale the moral preferences of the interviewees for the simulation. Finally, we discuss study results, the advantages of using computer simulations, and general study limitations before drawing conclusions for further research. The study contributes to the ongoing debate on participatory ethics-by-design by defining on the basis of empirical data ideal–typical value preference frameworks that can be used to guide MAT actions and their outcomes. Going forward, MAT end-users with dementia and other communication-impaired persons could be enabled to choose a value profile that best fits their moral preferences. (shrink)

Zusammenfassung Die Zeitschrift Sportwissenschaft besteht seit 1971. Als älteste und einzige interdisziplinäre Zeit­schrift für das Fach Sportwissenschaft genießt sie hohe fachliche Reputation. Im letzten Jahr kam es zu einer vorzeitigen Ablösung und Neubesetzung des Herausgeberkollegiums durch die institu­tioneilen Herausgeber Deutscher Olympischer Sportbund, Bundesinstitut für Sportwissen­schaft und Deutsche Vereinigung für Sportwissenschaft. Hintergrund war ein Konflikt über die Bewertung von Publikationsleistungen in der Sportwissenschaft im Zusammenhang mit dem Universitäts-Ranking des Centrums für Hochschulentwicklung. Der Beitrag untersucht die Hintergründe dieses Konflikts, indem zunächst die (...) universitären Rah­menbedingungen dargestellt werden, die die Entwicklung des Faches und der Zeitschrift Sportwis­senschaft begleiteten. Die Geschichte der Zeitschrift bildet einen weiteren Schwerpunkt des Artikels, und schließlich geht es auch um ihre Einordnung in den nationalen und internationalen Markt für sportwissenschaftliche Fachzeitschriften. Am Ende stellt sich die Frage nach der Zukunft eines in­terdisziplinären Konzepts für die Sportwissenschaft. (shrink)

In 1958, one of the first projects to carry out a systematic archaeological campaign underwater began off the coast of Asia Minor. At Cape Gelidonya, the wreck of a Bronze Age ship was investigated. To understand the concrete problems and working methods of underwater archaeology, it is important to account not only for the tangible objects of research and the technical aids used, but also the natural features and the political framework in which actors operated. Situated in the years between (...) the end of the colonial era and the Cold War, this article traces the biographical paths that brought together central actors at the site of the discovery. This perspective is necessary for understanding why divers who were not established archaeologists initiated and carried out the campaign. The article also analyzes the research of the campaign carried out 1960 and explores some of the difficulties and solutions encountered in working underwater. The article is a contribution to the still unwritten history of underwater archaeology. (shrink)

Court-ordered caesarean sections against the explicit wishes of the pregnant woman have been criticised as violations of the woman's fundamental right to autonomy and to the inviolability of the person--particularly, so it is argued, because the fetus in utero is not yet a person. This paper examines the logic of this position and argues that once the fetus has passed a certain stage of neurological development it is a person, and that then the whole issue becomes one of balancing of (...) rights: the right-to-life of the fetal person against the right to autonomy and inviolability of the woman; and that the fetal right usually wins. The article investigates the astonishing volte-face that Timon performs in Shakespeare and Middleton's Timon of Athens. The main character is not, as is often claimed, unaware of what is going on around him, he is not simply the naïve victim of his avaricious guests, but rather complicit in his own delusions. My reading is informed by two different theoretical concepts: Thorstein Veblen’s concept of “conspicuous consumption” on the one hand, and Octave Mannoni’s concept of “croyance” on the other. By combining (...) these two distinct theories, I want to account for the characteristics of both Timon’s individual and public behaviour, and its radical change between Acts 1–2 and Acts 3–5 of the play. I argue that in Timon of Athens, Shakespeare and Middleton explore the different forms of capital and its limited convertibility in the early modern mercantilist society. (shrink)
