We suggest a fuller understanding of the obligation to respect patient autonomy can be gained by recognizing patients as historically and socially situated agents, whose values are developed, challenged, and changed, rather than merely applied, in their decision-making about their use of preimplantation genetic diagnosis or preimplantation genetic screening (PGD/PGS). We ground this discussion in empirical research on the patients experiences with PGD/PGS, and conclude by suggesting that promoting patients’ self-respect is a useful ethical standard for providers and practices to (...) recognize. This is the introductory essay to a collection commemorating the 100th anniversary of the publication in Mind of Bertrand Russell’s paper ‘On Denoting’.

A growing body of literature has examined managers’ use of restorative practices in the workplace. However, little is currently known about why managers use restorative practices as opposed to alternative responses. We employed a qualitative interview technique to develop an inductive model of managers’ restorative versus punitive response in the context of employee wrongdoing. The findings reveal a set of key motivating and moderating influences on the manager’s decision to respond to wrongdoing in a restorative versus punitive manner. The findings (...) also suggest that managers’ personal needs and perceived duties in the aftermath of employee wrongdoing are generally more consistent with restorative responses than punishment responses, which helps explain managers’ use of restorative workplace practices. The purpose of this study was to identify and describe published research articles that were named in official findings of scientific misconduct and to investigate compliance with the administrative actions contained in these reports for corrections and retractions, as represented in PubMed. Between 1993 and 2001, 102 articles were named in either the NIH Guide for Grants and Contracts (“Findings of Scientific Misconduct”) or the U.S. Office of Research Integrity annual reports as needing retraction or correction. In 2002, 98 of (...) the 102 articles were indexed in PubMed. Eighty-five of these 98 articles had indexed corrections: 47 were retracted; 26 had an erratum; 12 had a correction described in the “comment” field. Thirteen had no correction, but 10 were linked to the NIH Guide “Findings of Scientific Misconduct”, leaving only 3 articles with no indication of any sort of problem. As of May 2005, there were 5,393 citations to the 102 articles, with a median of 26 citations per article (range 0–592). Researchers should be alert to “Comments” linked to the NIH Guide as these are open access, and the “Findings of Scientific Misconduct’ reports are often more informative than the statements about the retraction or correction found in the journals. In this paper, we present the results of a qualitative study that offers insight into a series of key issues related to offender efforts to repair interpersonal harm in the workplace: What factors motivate offenders to make amends with those they have harmed? In what ways do offenders attempt to make amends? What outcomes emerge from attempts to (...) make amends? This book is a consideration of Hegel’s view on logic and basic logical concepts such as truth, form, validity, and contradiction, and aims to assess this view’s relevance for contemporary philosophical logic. The literature on Hegel’s logic is fairly rich. The attention to contemporary philosophical logic places the present research closer to those works interested in the link between Hegel’s thought and analytical philosophy, Koch 2014, Brandom 2014, 1-15, Pippin 2016, Moyar 2017, Quante & Mooren 2018 among others). In this (...) context, one particularity of this book consists in focusing on something that has been generally underrated in the literature: the idea that, for Hegel as well as for Aristotle and many other authors, logic is the study of the forms of truth, i.e. the forms that our thought can assume in searching for truth. I argue that a study of the Nicomachean Ethics and of the Parva Naturalia shows that Aristotle had a notion of attention. This notion captures the common aspects of apparently different phenomena like perceiving something vividly, being distracted by a loud sound or by a musical piece, focusing on a geometrical problem. For Aristotle, these phenomena involve a specific selectivity that is the outcome of the competition between different cognitive stimuli. This selectivity is attention. I argue that Aristotle studied the (...) common aspects of the physiological processes at the basis of attention and its connection with pleasure. His notion can explain perceptual attention and intellectual attention as voluntary or involuntary phenomena. A significant part of recent physical inquiry – especially the physics concerned with investigating the fundamentalbuilding blocks of nature – is grounded on symmetry principles andtheir many and far-reaching consequences. But where these symmetries come from and what their real meaning is are open questions, at the center of a developing debate among physicists and philosophers of science. This article provides a reflection on how Aristotle's virtue ethics can be applied to matters of human life and death.

Grounded in stakeholder theory and a resource-based view of the firm, this longitudinal research demonstrates the evolution of corporate social responsibility (CSR) and firm reputation over time. Drawing on a 5-year sample of 285 major U.S. firms obtained from the KLD database and Fortune’s Most Admired Companies, we find that the proposed dynamic relationship predicts evolving stakeholder expectations to incite organizations to improve their social performance to earn reputational benefits. Contrary to the often labeled stickiness of reputation, we find a (...) “Red Queen” effect that supports reputation as a dynamic construct where the change in CSR does predict a change in corporate reputation. Similarly, we find that the change in reputation over time varies by industry, being most pronounced for manufacturing. From a practical perspective, this relationship across time may incite managers to create sustainable competitive advantage by continuously investing in doing good to reap the benefits of looking good and looking even better with time. In recent years postcolonial and decolonial feminisms have become increasingly salient in philosophy, yet they are often deployed as conceptual stand-ins for generalized feminist critiques of eurocentrism (without reference to the material contexts anti-colonial feminisms emanate from), or as a platform to re-center internal debates between dominant European theories/ists under the guise of being conceptually ‘decolonized’. By contrast, this article focuses on the specific contexts, issues and lifeworld concerns that ground anti-colonial feminisms and provides a brief survey of the literature. (...) Intersectionality is a term that arose within the black feminist intellectual tradition for the purposes of identifying interlocking systems of oppression. As a descriptive term, it refers to the ways human identity is shaped by multiple social vectors and overlapping identity categories (such as sex, race, class) that may not be readily visible in single-axis formulations of identity, but which are taken to be integral to robustly capture the multifaceted nature of human experience. As a diagnostic term, it captures the (...) confluence of power and domination on the social construction of identity in order to remedy concrete harms that result from this convergence. It is not a prescriptive methodology or closed system of analysis, but rather an open-ended hermeneutic lens through which interconnected systems of oppression can come into focus in the fight for social justice. But nothing could be further (...) from the truth. The articles were of such density and their content of such profundity that it took months of interpretation and study, and of bringing my own knowledge up to date, before I was in a position to understand the concepts, adjust my beliefs, and make some comments. I could certainly have delivered some kind of eulogy about the brilliance of their content; I might have countered with my own article. However, what seemed most coherent to me was to meet their arguments head on and deal with what I consider to be their principal weaknesses, leaving the bouquets for the end.The articles set out, as I understand them and within the clinical context, to relate phenomenology, in its most traditional form, with the most current form of Skinnerian behaviorism, situating themselves in a contextualism that is, at the same time, close to and removed from the most radical type of social constructionism.But let us begin by looking more closely at “Phenomenology and Behaviorism.” It is novel for me, though Professor Pérez-Álvarez had already proposed it several years ago (Pérez-Álvarez 1992), to view operant behavior as intentionality, or at least as involving final causality according to the Aristotelian classification. It is a surprising contention, not least because, as I recall, Skinner lived in a time and a context (historical reason) in which the basic goal of psychology was to convert itself into a natural science, comparable in all respects to physics, which it took as a model, focusing therefore on efficient causality (also according to Aristotle’s terminology), so that behavior was considered as the immediate consequence of a stimulus, and the stimulus–response association became the cornerstone of the discipline. It is true that the operant behavior concept refers to the functional relationship between behavior and reinforcement, but it is no less true that Skinner’s definition of reinforcement is totally empirical—“all that which increases or decreases the probability”—meaning that reinforcement can be considered neither as a motive nor as a reason for behavior, unless it be in the eyes of the observer. [End Page 251]Furthermore, even though Yela (1987) refers to Ortega y Gasset’s formula “I am myself and my circumstances” as a Skinnerian approach, the truth is that Yela himself argues that it is precisely the self that constitutes personality, such that I have a personality because I am me, and not vice versa, as Skinner would appear to argue. In this regard, Ortega’s celebrated formula has generally been interpreted, from the most personalist perspectives, as “the circumstances are myself”—to highlight the denial of the psychological subject by radical behaviorism (Mischel’s [1968] criticism of the concept of personality is relevant here). On top of this, Skinner’s rejection of all that was not directly observable, or at least, that could not be operationalized, calls into question the admissibility of anything called final cause or intentionality of behavior. In his philosophy, all the indications are that contingencies are what determine behavior; and that there would be no room for a structural causality, as Althusser would argue, or of a reciprocal determinism, in Bandura’s terms, or even of an interaction between subject and environment, as modern interactionists would maintain. “I am myself and my circumstances” seems in Skinner to become “the circumstances are me”, and indeed, the reinforcement history – which in the article in question is considered as something akin to the Sartrian idea of “life project” – is for Skinner nothing more than a continuous association of events. In my view, Ortega’s perspectivism would perhaps be closer to the sociology of the American action theorists, Merton, Parsons, etc., than to Skinnerian behaviorism, since “action”—as the action theorists... Russian environmental legislation is not effective for transitioning toward sustainable development. The main obstacle is ignoring traditional environmental values, which are not properly incorporated into laws and regulations. However, rich Russian traditions and culture imply a big potential to develop environmental legislation in accordance with sustainable principles. The paper explores areas where environmental regulations should be revised and implemented with adequate legal mechanisms based on traditional values. Slurs have become a big topic of discussion both in philosophy and in linguistics. Slurs are usually characterised as pejorative terms, co-extensional with other, neutral, terms referring to ethnic or social groups. However, slurs are not the only ethnic/social words with pejorative senses. Our aim in this paper is to introduce a different kind of pejoratives, which we will call “ethnic/social terms used as insults”, as exemplified in Spanish, though present in many other languages and mostly absent in English. These (...) are ethnic terms like gitano, ‘Romani’, which can have an extensional and neutral use, but also a pejorative meaning building on a negative stereotypical representation of the Romani community. Systemic epistemic failings in institutions are often explained through settler epistemologies and settler colonial frameworks that both obscure and reproduce the conditions necessary for those failings to endure. What is never questioned in the standard picture of institutional epistemic injustice is the implicit origin myth of an ‘institutional big bang’ that spawned many modern social institutions out of presumably noble orienting goals for a well-functioning society in democratic nation-states. We are concerned with the functional outcomes of institutions in settler colonial (...) societies, and how these outcomes consistently undermine whitewashed narratives of any inherent institutional design allegedly aimed at promoting testimonial justice in settler colonial societies. Institutions are built to target and maintain a status quo, especially (but not only) when they are charged with securing part of the social order or fabric of settler colonial societies. We will illustrate this concern through a discussion of various functional outcomes of the U.S. institution of asylum using Shannon Speed’s (2019. Incarcerated Stories: Indigenous Women Migrants and Violence in the Settler-Capitalist State. The University of North Carolina Press) analysis of the violence Indigenous women migrants from Latin America experience within the complex administrative web of U.S. migration and asylum systems. The use of algorithmic prediction in insurance is regarded as the beginning of a new era, because it promises to personalise insurance policies and premiums on the basis of individual behaviour and level of risk. The core idea is that the price of the policy would no longer refer to the calculated uncertainty of a pool of policyholders, with the consequence that everyone would have to pay only for her real exposure to risk. For insurance, however, uncertainty is not only (...) a problem – shared uncertainty is a resource. The availability of individual risk information could undermine the principle of risk-pooling and risk-spreading on which insurance is based. The article examines this disruptive change first by exploring the possible consequences of the use of predictive algorithms to set insurance premiums. Will it endanger the principle of mutualisation of risks, producing new forms of discrimination and exclusion from coverage? In a second step, we analyse how the relationship between the insurer and the policyholder changes when the customer knows that the company has voluminous, and continuously updated, data about her real behaviour. The justification of democracy, while widely debated, is hindered by a sub-optimal conceptual framework. For a start, there is confusion about the basic terms in the discussion. Many theorists claim to support either the ‘intrinsic’ or the ‘instrumental’ value of democracy, but it is unclear what this exactly means. Can democracy have other kinds of values? What does it mean to value democracy intrinsically? As a result, at certain points, scholars are talking past one another and their assessments of their (...) respective approaches to democracy are less clear than what they intended. This paper develops a conceptual framework of the values of democracy. I use this framework to classify theories of democracy under three main groups: theories that value democracy intrinsically, instrumentally, or contributorily (necessarily and non-necessarily). Through this analysis, the points of engagement among the different approaches will emerge and flawed arguments about democracy will be revealed. (shrink)

In the wake of continued structural asymmetries between women of color and white feminisms, this essay revisits intersectional tensions in Catharine MacKinnon’s Toward a Feminist Theory of the State while exploring productive spaces of coalition. To explore such spaces, we reframe Toward a Feminist Theory of the State in terms of its epistemological project and highlight possible synchronicities with liberational features in women-of-color feminisms. This is done, in part, through an analysis of the philosophical role “method” plays in MacKinnon’s argument, (...) and by reframing her critique of juridical neutrality and objectivity as epistemic harms. In the second section, we sketch out a provisional coalitional theory of liberation that builds on MacKinnon’s feminist epistemological insights and aligns them with decolonizing projects in women-of-color feminisms, suggesting new directions and conceptual revisions that are on the way to coalition. A common approach for measuring the effectiveness of an education system or a school is the estimation of the impact that school interventions have on students’ academic performance. However, the latest trends aim to extend the focus beyond students’ acquisition of knowledge and skills, and to consider aspects such as well-being in the academic context. For this reason, the 2015 edition of the international assessment system PISA incorporated a new tool aimed at evaluating the socio-affective variables related to the well-being (...) of students. It is based on a definition focused on the five dimensions proposed in PISA theoretical framework: cognitive, psychological, social, physical and material. The main purpose of this study is to identify the well-being components that significantly affect student academic performance and to estimate the magnitude of school effects on the well-being of students in OECD countries, the school effect being understood as the ability of schools to increase subjective student well-being. To achieve this goal, we analyzed the responses of 234,000 students from thirty-five OECD countries to PISA 2015 questionnaires. Specifically, we considered non-cognitive variables in the questionnaires and student performance in science. The results indicated that the cognitive well-being dimension, composed of enjoyment of science, self-efficacy and instrumental motivation, as well as the test anxiety all had a consistent relationship with student performance across countries. In addition, the school effect, estimated through a two-level hierarchical linear model, in terms of student well-being was systematically low. While the school effect accounted for approximately 25% of the variance in the results for the cognitive dimension, only 5-9% of variance in well-being indicators was attributable to it. This suggests that the influence of school on student welfare is weak, and the effect is similar across countries. The present study contributes to the general discussion currently underway about the definition of well-being and the connection between well-being and achievement. The results highlighted two complementary concerns: there is a clear need to promote socio-emotional education in schools, and it is important to develop a rigorous framework for well-being assessment. In this article, I consider the possibility of interpreting Hegel’s dialectic as dialetheism. After a first basic recapitulation about the meaning of the words ‘dialetheism’ and ‘dialectic’ and a consideration of Priest’s own account of the relation between dialectical and dialetheic logic in 1989, I discuss some controversial issues, not directly considered by Priest. As a matter of fact, the reflection on paraconsistent logics and dialetheism has enormously grown in recent years. In addition, the reception of Hegel’s logic and metaphysics (...) has also impressively improved. So I suggest that the discussion about the binomial dialectic/dialetheism should be reopened, on these new bases. (shrink)

Fictions feature prominently in several of Hume’s important arguments about the external world. For example, Hume is clear that there would be no belief in the continued existence of objects, were it not for the fictions that are causally responsible for effecting this belief. Interpreters of Hume on the topic of fiction generally argue that the formation of fiction requires the possession of general ideas and the use of language. Drawing upon recent attempts in the literature to advance this claim, (...) I offer reasons for why this general approach is undesirable. By examining Hume’s comments on the capabilities of children, this paper advances a novel approach to the topic of fictions in Hume’s philosophy that separates the matter of fiction formation from the use of language, arguing instead that it is not the use of language that establishes fictions; fictions exert their influence upon the mind before the use of language becomes available to us. Naukovedenie (literarily meaning ‘science studies’), was first institutionalized in the Soviet Union in the twenties, then resurfaced and was widely publicized in the sixties, as a new mode of reflection on science, its history, its intellectual foundations, and its management, after which it dominated Soviet historiography of science until perestroika . Tracing the history of meta-studies of science in the USSR from its early institutionalization in the twenties when various political, theoretical and institutional struggles set the stage for the development (...) of the field, to the sixties when the field resurfaced within the particular political context of the Cold War, and using the history of Moscow Institute for the History of Science and Technology as a case-study, I situate Soviet naukovedenie project within the culture of late-socialism in the Soviet Union during the Cold War, asking what this discourse meant for its creators and practitioners, as well as for the high-ranked Soviet officials who provided the authoritative support for this field. In this paper I argue that Hegel’s treatment of dialectical inferences, in particular of Plato’s dialectics in the Lectures on the History of Philosophy, belongs to the history of the logical rule that, from Gerolamo Cardano to Bertrand Russell, is known as consequentia mirabilis. In 1906 Russell formalises it as follows: and its correspondent positive form as My paper has two parts. First, I show that dialectical inferences, for Hegel, involve sentences of the form and. Hegel, following Plato, stresses that (...) these inferences are das Wunderbare, the marvellous element of dialectical reasoning. In this sense Hegel’s view belongs to the history of CM from a perspective that is both terminological and logical. Second, I stress the peculiarity of Hegel’s CM. One way to track the many critical impacts of women of color feminisms is through the powerful structural analyses of gendered and racialized oppression they offer. This article discusses diverse lineages of women of color feminisms in the global South that tackle systemic structures of power and domination from their situated perspectives. It offers an introduction to structuralist theories in the humanities and differentiates them from women of color feminist theorizing, which begins analyses of structures from embodied and phenomenological st¬¬andpoints--with (...) the day-to-day concerns of our lives. The essay is divided into three sections. In section one, I discuss theories of structure in the humanities and sciences, differentiating them from women of color’s analysis of structure as diagnostic of the ways colonial power relations are functionalized through social structures. In section two, I discuss the diverse contexts of interpretation that background women of color feminisms, outlining key themes and ideas related to theories of structure. I argue against a unified theory of women of color structural feminisms that supplants difference, favoring a rehabilitated concept of structure for the purposes of making targeted interventions in contemporary radical anti-colonial politics. I offer the example of systematic marginalization produced by colonial violence and mythology as one reason to take up this approach. In section three, I outline four provisional characteristics of women of color structural feminisms. I conclude that, when divested from colonial myths that guide mainstream notions of structure, it can be a useful hermeneutic tactic in the fight for liberation from ongoing colonial violence. Bergson's views on communication can be deduced from his theory of selfhood, in which he identifies the human self as heterogeneous duration a complex process that can only be adequately understood from within, when we intuit our own inner life. Another person, accessing us from outside, inevitably distorts and misunderstands our nature because duration is incommunicable. Does Bergsonism assert the failure of communication in principle? No, if we develop Bergson's theory further and identify the process of communication as heterogeneous duration. (...) As such, it is intuited from within by its participants who engage with each other in the process of dealing with the same object. They intuit the process of which they are part and thus intuit each other's involvement in it as well. To appreciate the importance of this implicit mutual communicative engagement we only need to imagine an empty airport with just one passenger or a deserted pleasure beach.Bergson does not have a theory of communication per se but his views on communication can be extracted from his ontology and epistemology. These views may account for some apparent failures of communication conflicts, loneliness, hostility and Bergson uses them to suggest a way out towards better and more harmonious intersubjective relations.Bergson claims that we misunderstand reality in general and each other in particular. Instead of trying to grasp human nature directly in intuition we analyse its being and create a distorted view of one another. If we were able to conceive the human self as it is, we would see it as duration and might be able to reach the state of an open society where people's love towards one another is ontologically backed up by their openness towards each other's being.However, the Bergsonian theory of duration and intuition, promising to resolve the difficulties of communication, reasserts these difficulties metaphysically. The idea of duration entails the impossibility of accessing it from outside, as the genuine view of it is only possible from within. This paper, instead of trying to salvage a model of communication where people strive to intuit each other's uniqueness, locates intuition in the very act of communication. Bergson himself finds intuition in artistic creation where the artist and spectators communicate by intuiting a common object without learning any personal details about each other. We find that communication is itself duration and that the communicating participants are heterogeneous elements of that duration. As such they are subservient to the act of communication that displays features of autonomous existence. Our model of communication, although accepting the impenetrability of one's person for a complete cognitive penetration from outside, allows for the partial fusion of minds engaged in the same act of communication and negotiating the same subject matter.
