Children and individuals with developmental disabilities compared to typical participants are disadvantaged not only by virtue of being vulnerable to risks inherent in research participation but also by the higher likelihood of exclusion from research altogether. Current regulatory and ethical guidelines although necessary for their protection do not sufficiently ensure fair distributive justice. Yet, in view of disproportionately higher burdens of co-occurring physical and mental disorders in individuals with DD, they are better positioned to benefit from research by equitable participation. (...) Greater elucidation of this ethical dilemma is called for by researchers, institutional review boards, and funding agencies to urgently redress the imbalance. This article discusses many of the regulatory principles to ensure better research participation of children and individuals with DD: human rights, validity, distributive justice, beneficence/nonmaleficence, and autonomy. This paper proposes a solution to David Miller's Minnesotan-Arizonan demonstration of the language dependence of truthlikeness (Miller 1974), along with Miller's first-order demonstration of the same (Miller 1978). It is assumed, with Peter Urbach, that the implication of these demonstrations is that the very notion of truthlikeness is intrinsically language dependent and thus non-objective. As such, truthlikeness cannot supply a basis for an objective account of scientific progress. I argue that, while Miller is correct in arguing that the number of (...) true atomic sentences of a false theory is language dependent, the number of known sentences (under certain straightforward assumptions) is conserved by translation; degree of knowledge, unlike truthlikeness, is thus a linguistically invariant notion. It is concluded that the objectivity of scientific progress must be grounded on the fact (noted in Cohen 1980) that knowledge, not mere truth, is the aim of science. (shrink)

This paper addresses the alleged tension between the kind of strong apophaticism endorsed by Maimonides and his view of worshiping God. After considering some extant resolutions to this problem, I offer a proposal that utilizes the role of silence and imitative activity in Maimonides. While this solution may not have been one that Maimonides would have offered, I argue that Maimonides had conceptual resources for offering a promising solution within his theological framework.

International borders concentrate opportunities in some societies while limiting them in others. Borders also prevent those in the less favored societies from gaining access to opportunities available in the more favored ones. Both distributive effects of borders are treated here within a comprehensive framework. I argue that each state should have broad discretion under international law to grant or deny entry to immigration seekers; but more favored countries that find themselves under immigration pressure should be legally obligated to fund development (...) assistance for countries that generate immigration pressure. Funding should be subject to conditions of fair and effective use in recipient countries, and should aim at a near-term target of immigration-pressure equilibrium. Equilibrium obtains between two countries when, given appropriate background circumstances, the same proportion of individuals in each manifests a preference to migrate to the other. If meeting the equilibrium target in the short term would be to the long-term disadvantage of the worst-off countries, then a Pareto-superior alternative target supersedes. It mandates development assistance at the level that yields the most favorable human development projections for the worstoff countries. An implementable set of institutions is described that can achieve the equilibrium goal in the long term without unduly sacrificing other important ends, including economic growth, political stability, cultural integrity, the political autonomy of distinct societies, and their proper accountability for policy choices. Subsequent consent can be morally efficacious. First, it licenses nostalgia and dismissiveness no more than its prior cousin does. Second, it's coherent because linked to the mental state of not minding. Third, it's just as vulnerable to bilking as prior consent is, as is clear once we distinguish between basing moral assessments on expectations versus on actual outcomes. Fourth, mind control is illegitimate because it short circuits the subject's will, not because its consent is subsequent. Finally, our intuitions about rape (...) show that dissent sometimes outweighs consent in matters of sex, not that subsequent consent is always inefficacious. (shrink)

Part I of this essay supports the anti-egalitarian conclusion that individuals may readily become entitled to substantially unequal extra-personal holdings by criticizing end-state and pattern theories of distributive justice and defending the historical entitlement doctrine of justice in holdings. Part II of this essay focuses on a second route to the anti-egalitarian conclusion. This route combines the self-ownership thesis with a contention that is especially advanced by G.A. Cohen. This is the contention that the anti-egalitarian conclusion can be inferred from (...) the self-ownership thesis without the aid of additional controversial premises. Cohen advances this contention, not because he wants to support the anti-egalitarian conclusion, but rather because he wants to emphasize the need for one to reject the self-ownership thesis if one is to reject the anti-egalitarian conclusion. In Part II of this essay, I support this second route to the anti-egalitarian conclusion by reinforcing Cohen's special contention while rejecting his challenges to the self-ownership thesis. Cohen's special contention is reinforced by way of an explanation of why the redistributive state must trench upon some people's self-ownership rights. One important challenge to the self-ownership thesis is answered through the articulation of a new and improved Lockean proviso. Another challenge offered by Cohen is answered by arguing that the philosophical costs of denying the self-ownership thesis are as great as the self-ownership libertarian maintains. Thus, I defend both of the key elements of self-ownership libertarianism, the self-ownership thesis and the anti-egalitarian conclusion. (shrink)

Bellʼs 1964 theorem causes a severe problem for the notion that correlations require explanation, encapsulated in Reichenbachʼs principle of common cause. Despite being a hallmark of scientific thought, dropping the principle has been widely regarded as much less bitter medicine than the perceived alternative—dropping relativistic causality. Recently, however, some authors have proposed that modified forms of Reichenbachʼs principle could be maintained even with relativistic causality. Here we break down Reichenbachʼs principle into two independent assumptions—the principle of common cause proper and (...) factorization of probabilities. We show how Bellʼs theorem can be derived from these two assumptions plus relativistic causality and the law of total probability for actual events, and we review proposals to drop each of these assumptions in light of the theorem. In particular, we show that the non-commutative common causes of Hofer-Szabó and Vecsernyés fail to have an analogue of the notion that the common causes can explain the observed correlations. Moreover, we show that their definition can be satisfied trivially by any quantum product state for any quantum correlations. We also discuss how the conditional states approach of Leifer and Spekkens fares in this regard. (shrink)

Uncertainty and affect are fundamental and interrelated aspects of the human condition. Uncertainty is often associated with negative affect, but in some circumstances it is associated with positive affect. In this paper, we review different explanations for the varying relationship between uncertainty and affect. We identify “mental simulation” as a key process that links uncertainty to affective states. We suggest that people have a propensity to simulate negative outcomes, which results in a propensity towards negative affective responses to uncertainty. We (...) also propose the existence of several important moderators of this process, including context and individual differences such as uncertainty tolerance, as well as emotion regulation strategies. Finally, we highlight important knowledge gaps and promising areas for future research, both empirical and conceptual, to further elucidate the relationship between uncertainty and affect. (shrink)

Arnauld äußert sich besorgt darüber, daß Leibniz 'Theorie der vollständigen Begriffe in dieser Hinsicht keinen Raum für Gottes Freiheit zu lassen scheint. Ich behaupte, daß Leibniz Arnauld eine zweigeteilte Antwort anbietet, deren zweiter Zweig bislang unterschätzt worden ist. Ich werde zeigen, daß Leibniz' Unterscheidung zwischen primären und sekundären Entscheidungen Gottes von wesentlicher Bedeutung ist für den zweiten Zweig seiner Antwort an Arnauld. Außerdem kann (...) diese Unterscheidung helfen, Leibniz' Lehre von der unendlichen Analyse zu verstehen und zudem verdeutlichen, inwiefern nach Leibniz' Ansicht Gott nun in der Lage ist, individuelle Substanzen begrifflich getrennt voneinander zu betrachten - was eine Schwierigkeit zu sein scheint, wenn von der Theorie vollständiger Begriffe ausgegangen wird. The law of desire has been proposed in several forms, but its essential claim is that agents always act on their strongest proximal action motivation. This law has threatening consequences for human freedom, insofar as it greatly limits agents’ ability to do otherwise given their motivational state. It has proven difficult to formulate a version that escapes counterexamples and some categorically deny its truth. Noticeable by its absence in the literature is any attempt to provide an argument for the law (...) of desire – I propose such an argument here. It is noted that Sripada's “divided mind” theory of willpower provides a counterexample to the version of the law of desire my argument defends, but I note that a reformulated version of the law of desire survives this critique. I conclude that there is a serious case for the law of desire, and note the broader implications of this. (shrink)

This paper summarizes paired courses, a technique that is being used to incorporate the benefits of liberal arts into the business curriculum. This technique pairs a required business course with a liberal arts course that students take concurrently during a semester. The courses have overlapping themes and activities to build specific competencies that are desired by organizations, such as communication, critical thinking and problem solving, emotional intelligence, and organizational professionalism. These competencies are identified by exploring national surveys and conducting a (...) local survey of business professionals. The paired courses utilize a variety of exercises with the ultimate goals of building desired workplace-related skills in students and improving their practical reasoning ability. The exercises do this by strengthening students’ analytical thinking, understanding of multiple framing, and reflective exploration of meaning through various techniques. Predictivism asserts that novel confirmations carry special probative weight. Epistemic pluralism asserts that the judgments of agents (about, e.g., the probabilities of theories) carry epistemic import. In this paper, I propose a new theory of predictivism that is tailored to pluralistic evaluators of theories. I replace the orthodox notion of use-novelty with a notion of endorsement-novelty, and argue that the intuition that predictivism is true has two roots. I provide a detailed Bayesian rendering of this theory and argue that pluralistic (...) theory evaluation pervades scientific practice. For over 700 years scholastic theologians of varying degrees of allegiance to the text(s) of Thomas Aquinas have discoursed on the mystery of Christ's being (esse): Did Christ have one or two acts of existence? Yet despite this frequent and recurring quaestio, nevertheless only a handful of scholastic commentators pause to note that this is not simply a debate between rival scholastic ‘schools’ in regard to a theological mystery, but that in fact there is an inconsistency within the Angelic doctor's (...) own texts. And while in more recent scholarship this discrepancy has not only been noticed but explicated in various ways, nevertheless it is the contention of this paper that a satisfactory exposition of the meaning of esse secundarium has not yet been achieved. Consequently, I propose in this paper that esse secundarium is the created, substantial, but absolutely supernatural participation of the human nature of Jesus in the uncreated communication of the divine esse of the Word and provide a robust textual defense of this interpretation. Recently improved understanding of evolutionary processes suggests that tree-based phylogenetic analyses of evolutionary change cannot adequately explain the divergent evolutionary histories of a great many genes and gene complexes. In particular, genetic diversity in the genomes of prokaryotes, phages, and plasmids cannot be fit into classic tree-like models of evolution. These findings entail the need for fundamental reform of our understanding of molecular evolution and the need to devise alternative apparatus for integrated analysis of these genomes. We advocate the development (...) of integrative phylogenomics for analyzing these genomes and their histories, with tools suited to analyzing the importance of lateral gene transfer (LGT) and of DNA evolution in extra-cellular mobile genetic elements (e.g., viruses, plasmids). These phenomena greatly increase the complexity of relationships among interacting genetic partners, as they exchange functional genetic units. We examine the ontology of functional genetic units, interacting genetic partners, and emergent genetic associations, argue that these three categories of entities are required for a successful integrated phylogenomics. We conclude with arguments to suggest that the proposed new perspective and associated tools are suitable, and perhaps required, as a replacement for the bifurcating trees that have dominated evolutionary thinking for the last 150 years. I aim to show that one way of testing the mettle of a theory of scientific explanation is to inquire what that theory entails about the status of brute facts. Here I consider the nature of brute facts, and survey several contemporary accounts of explanation vis a vis this subject. One problem with these accounts is that they seem to entail that brute facts represent a gap in scientific understanding. I argue that brute facts are non-mysterious and indeed are even (...) explainable by the lights of Salmon's ontic conception of explanation. The plausibility of various models of explanation, I suggest, depends to some extent on the tendency of their proponents to focus on certain examples of explananda - I ponder brute facts qua explananda here as a way of helping us to recognize this dependency. We present an axiomatic model of preferences over menus that is motivated by three assumptions. First, the decision maker is uncertain ex ante (i.e., at the time of choosing a menu) about her ex post (i.e., at the time of choosing an option within her chosen menu) preferences over options, and she anticipates that this subjective uncertainty will not resolve before the ex post stage. Second, she is averse to ex post indecisiveness (i.e., to having to choose between options that (...) she cannot rank with certainty). Third, when evaluating a menu she discards options that are dominated (i.e., inferior to another option whatever her ex post preferences may be) and restricts attention to the undominated ones. Under these assumptions, the decision maker has a preference for commitment in the sense of preferring menus with fewer undominated alternatives. We derive a representation in which the decision maker’s uncertainty about her ex post preferences is captured by means of a subjective state space, which in turn determines which options are undominated in a given menu, and in which the decision maker fears, whenever indecisive, to choose an option that will turn out to be the worst (undominated) one according to the realization of her ex post preferences. In one of their arguments against the radical neuron doctrine, Gold & Stoljar (G&S) use the idea that, in certain situations, equivalent terms may not be substitutable into statements that regard properties of the objects to which the terms refer. This device allows G&S to refute the necessity of the conclusion that “the science of the mind equals the science of the brain” even though they take as a premise that the mind equals the brain. I argue, however, that this (...) practice leaves the meaning of the “science of the mind” and the “science of the brain” indeterminate. (shrink)

When you discover that an epistemic peer disagrees with you about some matter, does rationality require you to alter your views? Concessivists answer in the affirmative, but their view faces a problem in special cases. As others have noted, if concessivism itself is what’s under dispute, then concessivism seems to undermine itself. But there are other unexplored special cases too. This article identifies three such special cases, and argues that concessivists in fact face no special problem.

Our world can be a bewildering place. The sense of awe and wonder at the states of affairs in which we find ourselves immersed give rise to philosophical questions. Philosophical reflection is a critical attempt to come to grips with our place in the world and the various problems we encounter in respect to the complexities encountered in everyday life. In the most basic terms, phenomenology is the study of the structures and relations of phenomena. Phenomenology begins from a descriptive (...) analysis of our experiences of the world. It grants precedent to the first person perspective-how phenomena appear to consciousness. There are any number of problems related to the plenitude of kinds of experiences which confront us through the course of our lives, in addition to the structure of consciousness itself. This volume presents a variety of views on a number of the phenomena of our everyday lives, offering positions on such things from the nature of consciousness to the structures of religious or political experiences. Its appeal, however, should not be limited to philosophers alone-given that all persons can relate to the subject matter of the essays. For instance, one author asks, "what is friendship?" The present work may also be understood as a gesture toward bridging the division between the valuable insights of continental and analytic philosophical traditions. The authors include a combination of established academics, such as Jeffrey Wattles-the best-selling author of The Golden Rule-and young scholars from varied philosophical backgrounds. This collection is divided into four sections: (I) Foundational Elements of Experience; (II) The Experiencing Subject: What is it to be a Subject?; (III) Amongst Others: The Social World; and (IV) Social Objects and Institutions. Each section represents a level of experience, from the most basic structures of experience, to the subject's experience of the world and objects in it, to experiences and interactions with others, ending at the results of the codifications of certain social practices and beliefs. The sections treat their respective topics principally, even if they share material with other essays. Our experiences of the life-world, the world of human praxis, contain a multiplicity of elements; the divisions of this work are meant to demarcate various types of phenomena, not to offer any definitive thesis regarding a hierarchy or structure of relations. In this paper, I argue that Louis Pojman fails to justify his conception of a moderate cosmopolitan world government. I illustrate this by highlighting the fact that Pojman fails to articulate adequate justifications for his Principle of Humanity (POH) and Principle of Equality (POE). This is problematic because the POH and POE ground his conception of human rights, which, in turn, grounds his conception of a moderate cosmopolitan world government. Hence, since he fails to justify the POH and the POE, (...) I conclude that his conception of a cosmopolitan world government ultimately fails. But, before I launch this attack on Pojman, I offer substantial philosophical analyses of Hobbes's arguments for the state of nature, human rights, and the establishment of the commonwealth. I do so because Hobbes provides the philosophical basis for Pojman's philosophy of world government. I show that by understanding the philosophical problems inherent in Hobbes we gain better understanding of the philosophical problems at the basis of Pojman. (shrink)

We readily recognize the concept of an inner life as a moral category. We struggle to say what an inner life is, though. This essay examines and rejects naturalistic attempts to either dismiss the idea of an inner life or make it a matter of brain states, a sort of efficient causality to behaviour. Relying on Simone Weil's distinction between “the language of the market place and the language of the nuptial chamber,” it distinguishes, as she did, between levels of (...) value.
