La recaudación tributaria es una tarea fundamental para el financiamiento del Estado, pero cuando los contribuyentes no con cumplen con dicha obligación el Servicio de Rentas Internas se ve forzado a iniciar el proceso de ejecución coactiva, es en esa instancia donde la falta de claridad y consistencia de la normativa tributaria se transforma en un problema tanto para el contribuyente como para la administración, pues queda a discrecionalidad de esta última actuaciones fundamentales como la disposición de medidas cautelares, mismas (...) que pueden afectar derechos constitucionales del usuario. El estudio tiene como propósito primordial evaluar la efectividad de los procesos de ejecución coactiva sustanciados por el SRI en la protección del derecho a la propiedad y seguridad jurídica, para lo cual se aplicó el método mixto, a través de la implementación de encuestas a cien usuarios del sistema tributarios y entrevistas semiestructuradas a profesionales del Derecho. Tras el procesamiento de los datos se evidencia una postura de rechazo por parte de la población ante la actuación de los funcionarios ejecutores del proceso coactivo, pues la disposición desproporcionada de medidas como la retención o la prohibición de enajenar afectan significativamente sus derechos. Como conclusión se determina que la falta de claridad y armonización de la norma tributaria posibilita que los funcionarios públicos quebranten el principio de buena fe y rebasen con sus actuaciones los límites del derecho de propiedad y seguridad jurídica de los afiliados al sistema tributario. El estudio analiza un curso Blended Learning para identificar patrones de interacción didáctica que favorecen la construcción del conocimiento y por ende, del aprendizaje. La investigación muestra en la transición hacia la virtualidad desde la presencialidad, una apropiación gradual del aprendizaje y una orientación hacia la autonomía. Las transiciones indican mayor elaboración de contenidos significativos en lo virtual, señalando una relación entre interacción virtual intensificada, aprendizaje y menor dependencia docente. El análisis de la práctica educativa en Blended Learning promueve autonomía, (...) logros y participación mediante colaboraciones entre pares y mayor interacción social, conduciendo a resultados notables. This study offers a proposal about which competencies should be fostered in organizations to promote a culture in favor of sustainability in line with Pope Francis' encyclical letter Laudato Si. As a result, seven main competencies are proposed, with their interpretation in the light of the encyclical letter, and some suggestions on how to implement them in organizations are presented. The competencies are systemic vision, critical thinking, capacity for dialog, inclusion, proper use of goods, creativity, and spirituality. In addition, the (...) study offers a discussion of the relevance of these competencies in today's business context. This study offers a novelty with respect to other theoretical proposals on competencies for sustainability since it includes competencies that require an authentic concern for other people and for a vision of the human being open to transcendence, thus breaking with instrumentalism and technocratic paradigm that underlies other proposals. In this way, it also offers a new key to interpreting the integral ecology proposed by Pope Francis, which goes beyond other approaches to sustainability in that it includes not only the person–nature relationship but also the person–person and person–transcendence or person–God relationships. The conclusions of this theoretical research can be especially useful for those who intend to promote a culture of sustainability inspired by the Catholic Social Teaching, also making use of the knowledge and good practices of competency-based management. Este trabajo busca presentar el debate alrededor de la materialidad del cuerpo en dos grandes teorías feministas, a saber, las teorías feministas de la diferencia sexual y la teoría feminista alrededor del género. En ese sentido, mi interés es mostrar cómo, desde una distinta aproximación al concepto de cuerpo, se articulan unas diferencias para reivindicar las luchas feministas. Quisiera en particular acercarme a las pensadoras Judith Butler y Rosi Braidotti, que tienen una articulación distinta del sujeto-cuerpo del feminismo y el (...) lugar que este debe ocupar en las transformaciones sociales y políticas. In a large Colombian teaching hospital, a fifty-five-year-old woman complaining of stomach pain is examined by a foreign-exchange medical student from the United States. Speaking in Spanish, the student elicits a medical history that suggests a possible recurrence of gallstones, but nothing further. Upon discussing the patient's case in private with the attending physician, the student is shocked to learn that the patient is suffering from terminal, metastatic gastric cancer but is unaware of her diagnosis. The attending physician explains that (...) the patient's husband instructed the health care providers not to tell the patient what her diagnosis is. The medical student feels uncomfortable withholding the diagnosis from the patient. The thought of disclosure feels equally uncomfortable, however, as it would mean contradicting the instructions of the attending physician at the host hospital as well as violating what the student suspects, but is not sure, may be acceptable medical practice in Colombia. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

Abstract:Facial transplantation is emerging as a therapeutic option for self-inflicted gunshot wounds. The self-inflicted nature of this injury raises questions about the appropriate role of self-harm in determining patient eligibility. Potential candidates for facial transplantation undergo extensive psychosocial screening. The presence of a self-inflicted gunshot wound warrants special attention to ensure that a patient is prepared to undergo a demanding procedure that poses significant risk, as well as stringent lifelong management. Herein, we explore the ethics of considering mechanism of injury (...) in the patient selection process, referring to the precedent set forth in solid organ transplantation. We also consider the available evidence regarding outcomes of individuals transplanted for self-inflicted mechanisms of injury in both solid organ and facial transplantation. We conclude that while the presence of a self-inflicted gunshot wound is significant in the overall evaluation of the candidate, it does not on its own warrant exclusion from consideration for a facial transplantation. El pensamiento está relacionado con un modo de ser. La forma de pensar que privilegia la ciencia pasa por alto el contexto, pareciera que eso es irrelevante, pues se cree que el pensamiento está alejado de la realidad natural e histórica. Sin embargo, el cómo se piensa incide en la relación que los sujetos mantienen con las cosas, los objetos, las situaciones y también entre sí. La razón moderna en cuanto científica y dominante, no sólo ha permitido el desarrollo técnico, (...) también objetualiza lo diferente a sí misma, ese es el punto desde el cual filosofa Esther Díaz, dicho filosofar es recuperado e interpretado en este documento. La crítica a la ciencia en cuanto dominante y unívoca no invalida a los conocimientos dados a partir de ella, no se aboga por una clausura de la razón, sino que se confía en ella, siempre y cuando, sea capaz de abrirse a las distintas perspectivas. La apertura repercutiría a nivel político, en el sentido de que los sujetos se curarían del delirio de la dominación. Assessing physical fitness has emerged as a proxy of the health status of children and adolescents and therefore as relevant from a public health point of view. DAFIS is a project included in Plan Galicia Saudable of the regional government of Galicia. DAFIS consists of an on-line software devoted to record the results of a standard physical fitness protocol carried out as a part of the physical education curriculum. The aims of this study were: to obtain normative values of physical (...) fitness of the Galician school population evaluated in the DAFIS project, and to identify a reduced number of components and tests able to capture a significant amount of the variability in the physical fitness of children and adolescents. From an initial sample of 27784 records, 15287 cases were considered after filtering. Generalized Additive Models for Location, Scale and Shape were used for obtaining percentile curves and tables for each sex. Furthermore, a principal components analysis was performed, selecting the number of components by applying the Kaiser’s rule and selecting a subset of variables considering the correlation between each variable and the components. Percentile curves and normative values are reported for each test and sex. Physical fitness was better in boys than in girls throughout age groups, except for flexibility that was consistently higher in girls. Two main components were detected throughout age groups: the first one representing body composition and partially cardiorespiratory fitness and the second one muscular fitness. For boys and girls, waist to height ratio had the highest correlations with the first component in four out of six age groups. The highest correlation with the second component, was most frequently observed for the handgrip test both in boys and girls. This study provides evidence about the utility of school community actions like DAFIS aimed to track the health-related fitness of children and adolescents. The results suggest that fat mass distribution and muscular performance concentrate a high proportion physical fitness variance. (shrink)

RESUMEN Una vez que el foco de la reflexión pasa de las teorías ideales a la aplicación de la justicia social, centrada en las instituciones de las sociedades democráticas, se requiere prestar especial atención a los estilos de vida. Estos tienen una alta incidencia en cómo la justicia es realizada y afectan tanto a la desigualdad económica como a la disponibilidad de los recursos naturales. En nuestras sociedades es posible establecer restricciones a los estilos de vida, especialmente en aquellos casos (...) en que, por el efecto de algunas dinámicas sociales, aquellos se desacoplan de las concepciones del bien. Se defiende que, en tales casos, la base normativa que permite exigir el respeto a los estilos de vida se disuelve y por ello es posible justificar su restricción. ABSTRACT Now that the focus of reflection has shifted from ideal theories to the application of social justice, centered on the institutions of democratic societies, it is necessary to pay special attention to lifestyles, since they not only influence the realization of justice, but also have an effect on economic inequality and the availability of natural resources. In our societies, it is possible to place restrictions on lifestyles, especially in those cases in which, influenced by certain social dynamics, they disengage from conceptions of the good. The article argues that, in those cases, the normative base grounding the demand that lifestyles be respected is dissolved, thus justifying their restriction. (shrink)

In this article, we will present a number of technical results concerning Classical Logic, ST and related systems. Our main contribution consists in offering a novel identity criterion for logics in general and, therefore, for Classical Logic. In particular, we will firstly generalize the ST phenomenon, thereby obtaining a recursively defined hierarchy of strict-tolerant systems. Secondly, we will prove that the logics in this hierarchy are progressively more classical, although not entirely classical. We will claim that a logic is to (...) be identified with an infinite sequence of consequence relations holding between increasingly complex relata: formulae, inferences, metainferences, and so on. As a result, the present proposal allows not only to differentiate Classical Logic from ST, but also from other systems sharing with it their valid metainferences. Finally, we show how these results have interesting consequences for some topics in the philosophical logic literature, among them for the debate around Logical Pluralism. The reason being that the discussion concerning this topic is usually carried out employing a rivalry criterion for logics that will need to be modified in light of the present investigation, according to which two logics can be non-identical even if they share the same valid inferences. In some recent articles, Cobreros, Egré, Ripley, & van Rooij have defended the idea that abandoning transitivity may lead to a solution to the trouble caused by semantic paradoxes. For that purpose, they develop the Strict-Tolerant approach, which leads them to entertain a nontransitive theory of truth, where the structural rule of Cut is not generally valid. However, that Cut fails in general in the target theory of truth does not mean that there are not certain safe instances of Cut (...) involving semantic notions. In this article we intend to meet the challenge of answering how to regain all the safe instances of Cut, in the language of the theory, making essential use of a unary recovery operator. To fulfill this goal, we will work within the so-called Goodship Project, which suggests that in order to have nontrivial naïve theories it is sufficient to formulate the corresponding self-referential sentences with suitable biconditionals. Nevertheless, a secondary aim of this article is to propose a novel way to carry this project out, showing that the biconditionals in question can be totally classical. In the context of this article, these biconditionals will be essentially used in expressing the self-referential sentences and, thus, as a collateral result of our work we will prove that none of the recoveries expected of the target theory can be nontrivially achieved if self-reference is expressed through identities. In this paper, we present a non-trivial and expressively complete paraconsistent naïve theory of truth, as a step in the route towards semantic closure. We achieve this goal by expressing self-reference with a weak procedure, that uses equivalences between expressions of the language, as opposed to a strong procedure, that uses identities. Finally, we make some remarks regarding the sense in which the theory of truth discussed has a property closely related to functional completeness, and we present a sound and (...) complete three-sided sequent calculus for this expressively rich theory. Rejecting the Cut rule has been proposed as a strategy to avoid both the usual semantic paradoxes and the so-called v-Curry paradox. In this paper we consider if a Cut-free theory is capable of accurately representing its own notion of validity. We claim that the standard rules governing the validity predicate are too weak for this purpose and we show that although it is possible to strengthen these rules, the most obvious way of doing so brings with it a serious (...) problem: an internalized version of Cut can be proved for a Curry-like sentence. This article focuses on Karl Jaspers’s notion of the Axial Age, some of its critical appropriation, and how in particular Habermas has returned to this idea, after several critical engagements with Jaspers’s work through his long scholarly productivity. The article, however, centers on Habermas’s selective and critical use of Jaspers’s notion in his own latest and extensive engagement with what he calls “a genealogy of postmetaphysical thinking.” The goal of the article is to identify the ways in which Habermas is (...) refurbishing Jaspers’s generative concept, but at the same time, how his work on postsecular consciousness opens itself to some liabilities by not taking enough distance from the concept. Until now, North American and European philosophies have been engaged in debates about the possibility of a postmetaphysical philosophy and the consequences of the linguistic turn for the assessment of modernity; they have done so, however, without departing from the narrow horizons of their respective nationalistic perspectives. In this incisive critique, Dussel demonstrates how most of thse philosophies have either failed to give historically faithful analyses of the genesis of the "myth" of modernity, or have never engaged in a serious (...) questioning of their own Eurocentric presuppositions. He shows how North American and European philosophers have presupposed a no-longer-acceptable philosophy of history that has led them to fall into a "developmental fallacy," the belief that there is a linear sequence that moves from the premodern, underdeveloped, or on the way to industrialization, to the modern, developed, and industrialized. In this paper we develop a general representation theory for MV-algebras. We furnish the appropriate categorical background to study this problem. Our guide line is the theory of classifying topoi of coherent extensions of universal algebra theories. Our main result corresponds, in the case of MV-algebras and MV-chains, to the representation of commutative rings with unit as rings of global sections of sheaves of local rings. We prove that any MV-algebra is isomorphic to the MV-algebra of all global sections of (...) a sheaf of MV-chains on a compact topological space. This result is intimately related to McNaughton’s theorem, and we explain why our representation theorem can be viewed as a vast generalization of McNaughton’s theorem. In spite of the language used in this abstract, we have written this paper in the hope that it can be read by experts in MV-algebras but not in sheaf theory, and conversely. (shrink)

In The Adventures of Transcendental Philosophy, critical theory scholar Eduardo Mendieta examines the philosophical origins of discourse ethics through the prism of Apel's thought. Mendieta finds that Apel fundamentally transformed German philosophy, which had become stagnant in the years before World War II, and deeply influenced later thinkers such as JYrgen Habermas.

Relatedly, society has been directly confronted by issues of ‘Global health,’ both in terms of awareness of health conditions and health systems resiliency all around the world, as well as in terms of governance of the worldwide response and its implications at national and local levels. While Global health is often used as a cosmetic label for neocolonial approaches, it is really an interdisciplinary approach consisting of the interaction between globalization and the determinants of health. Thus, it involves the ecosystem and its transformation and implies a systemic ‘One Health’ decolonized approach in the definition of its strategies. The Covid-19 pandemic has highlighted the inequities and the limits of the current hegemonic Global health system governance; calling for ethics to provide a renewed, comprehensive, inclusive, and decolonized conceptualization of Global health. In this article I study Kant's doctrine of the power of judgement. I focus on its main function of rendering possible the transition from the lawfulness of nature to the realization of practical ends. In order to do so, I analyze the concept of “spontaneity” and the principle of “purposiveness of nature”, understood as a “principle of contingency”, according to Kant's explanation in the Critique of the Power of Judgement.

Neste artigo, discutiremos e contextualizaremos a noção de democracia selvagem dentro da teoria democrática de Claude Lefort. O texto será dividido em três partes. Primeiramente, apresentaremos as ideias fundamentais do pensamento político do autor. Em seguida, analisaremos o papel da ideia de democracia selvagem em três textos de Lefort: dois dedicados ao evento de Maio de 68, A desordem nova e Releitura, além do prefácio à segunda edição da obra Éléments d'une critique de la bureaucratie. Por último, apresentaremos a discussão (...) recente nos estudos lefortianos sobre a fecundidade do termo "democracia selvagem", relacionando, principalmente, dois temas importantes para Lefort: a dimensão do conflito nas democracias e a relação do direito com as lutas democráticas. El objetivo del artículo es describir rasgos estructurales de la comprensión de metáforas mediante una comparación con la comprensión de otras culturas, tal como ésta ha sido comentada por Wittgenstein y Geertz. El fenómeno de estudio es la comprensión enfática de metáforas fuertes. La comparación entre ambos tipos de comprensión sirve para plantear y dar respuesta a tres preguntas desatendidas en la profusa literatura sobre la metáfora: 1) ¿En qué sentido nos sorprenden las metáforas fuertes? 2) ¿En qué sentido pueden (...) ser profundas? 3) ¿En qué sentido hablamos de la riqueza de este fenómeno lingüístico? /// This paper sets out to describe the structural features of metaphor comprehension through a comparison with the process of understanding other cultures construed along the lines proposed by Wittgenstein and Geertz. The phenomenon under analysis is the emphatic understanding of strong metaphors. The comparison between understanding metaphors and cultures serves to raise and answer three questions that have been neglected in the vast literature on metaphors: 1) In which sense do strong metaphors surprise us? 2) In which sense can a metaphor be profound? 3) In which sense do we speak of the richness of this linguistic phenomenon? This article takes up the work of Bottici, Cornell, and Perez in order to expand on Lugones's inchoate notion of a decolonial feminist imaginary. The claim is that decolonial feminism is also the elaboration of a decolonial feminist imaginary that challenges the colonial/modern imaginary of global capitalism. The article also takes up Lugones's critique of Mignolo's notion of “colonial difference,” which is found to be incoherent and even dangerous.

En este trabajo se analiza la relación entre los conceptos de fetichismo y lucha de clases en el particular marxismo de Slavoj Žižek. Žižek comprende el fetichismo marxiano a través del psicoanálisis y en el marco de la concepción de Marx de la religión en dos sentidos: como ideología y como fundamento. Esto le permite mostrar que el fetichismo y en general el hecho religioso, no es únicamente «falsa conciencia» sino que también funciona como el elemento constitutivo e insuperable de (...) lo real, lo que, a su vez permite repensar la lucha de clases. Desarrollo en este artículo tres planteamientos en torno a la cuestión del sentido de la vida, cada uno de ellos asociado a las nociones que figuran en su título: ambigüedad, disolución y latencia. 1) La expresión “sentido de la vida” posee al menos cuatro significados y de ello se siguen consecuencias no menores. 2) En su acepción habitual, la pregunta por el sentido puede disolverse o dejar de plantearse, cuando es sustituida por la pregunta práctica por la vida buena. 3) (...) Ello no significa que la pregunta por el sentido desaparezca del todo: ella continua latente. Pero cuando vuelve a tornarse manifiesta, ya no demanda de nosotros una respuesta. In this paper I criticize Comesaña's point of view on Putnam's model-theoretic argument. I claim that there is an interesting point made by the argument that Comesaña has not taken into account: if we want our semantic assertions to be at ali justified, the externalist claim according to which justification requires the God 's Eye View has to be given up.
