In the late summer and fall of 1983 articles appeared in such publications as the New York Times, Fortune Magazine, and Science News telling of attempts to set up an agency for the selling of kidneys from living donors. The shortage of organs, especially of kidneys where the transplantation success has increased quite markedly over the past decade, has become something of a crisis. A situation of increased need and inadequate supply is also becoming a problem for such substances as (...) human bone marrow, for use in the treatment of immune and blood diseases, and large quantities of human plasma for use by hemophiliacs. Obtaining a kidney for a patient in renal failure was difficult in the past because adequate matching is likely only between very close relatives. Now with new immunosuppressant drugs such as cyclosporine, close matches have become less important. Cadaver organs or marrow from unrelated living donors can be used with far greater success. The supply problem is still immense and the literature is filled with suggestions for appropriate and efficient means of organ acquisition. One of the latest suggestions involves a system of salvaging based on implied consent of deceased donors. The organs would be taken without asking directly for permission from family. The relatives would have the right to object to the organ removal, but unless they did so, the organ would be taken when needed. (shrink)

Rationality in medicine is frequently construed as hypotheticodeductive. This article argues that such a model gives a distorted view of the rational character of an enterprise that makes judgments about individual human well-being. Medicine as a science is a practical human science. Seen as such, its rational orientation is one that applies general knowledge to particular situations. It is argued that such an orientation is not deductive but interpretative. The Aristotelian concept of practical wisdom (‘phron sis’) is used as a (...) model of the rational orientation of clinical judgment. Contemporary empiricism has attempted to ground its analysis of science in a falsificationism based in selection theory. This paper links these evolutionary epistemologies with commitments to certain epistemological and ontological assumptions found in the later work of K. Popper, D. Campbell, and D. Hull, I argue that their assumptions about the character of contemporary empiricism are part of a shared paradigm of epistemological explanation which results in unresolved tensions within their own projects. I argue further that their claim to be (...) doing a science of science is not defensible. Hull's selectionism is analyzed to show how this epistemological agenda has played itself out in late empiricism. I suggest some directions that Hull might take toward an historical epistemology. The essay explores the connection between ecological wisdom and feminist spirituality. It takes a careful look at the difficulties that feminist thinkers have had in establishing such wisdom through a tradition of ethics focused on intrinsic value, a tradition of scientific thinking in which the knower is distanced from nature, and Western religious thinking in which both the feminine and nature are taken as profane. The suggestion is made that the resources of American Naturalism may provide a truly spiritual means (...) to the needed transformation. (shrink)

This work contrasts the formalist approach to defining explanation in science, exemplified in the Deductive-Nomenological Model of Carl G. Hempel, with the contextualist approach of Thomas Kuhn. It is argued that both of these attempts to define the explanatory processes of science are inadequate. A connection is made between the view of rationality upon which each view is based and the way that it defines explanation. It is argued that a process of thought, which scientific explanation represents, is considered rational (...) by these thinkers only if it meets the criteria of constraint under a rule, distance from subjective considerations and instrumental connection of method and goal. Given this strong definition of rationality, explanation is defined by both Kuhn and Hempel as thought within the constraint of a theory or a theoretical paradigm. Under this construal, explanation is separated as a process from theory invention which both thinkers hold to involve primarily non-cognitive criteria of choice. It is argued in this work that such a view contradicts the actual practice of science where theory invention seems to be primarily a process of rational explaining. ;A detailed historical case of an attempt to explain organic morphogenesis is given. It centers on the theory of generation of Pierre Louis Moreau de Maupertuis, an 18th Century scientific thinker. This case is meant to illustrate the kinds of cognitive interest and strategies of invention that go into dealing with an explanatory problem in science. ;Finally some general programmatic conclusions are made relating the foregoing arguments and the case, to the need to explore the nature of scientific explanation in the domain of theory invention where the reasoning processes seem to involve analogical reasoning and critical metaphysical thought. This article explores the link between CEOs’ language and hubristic leadership. It is based on the precepts that leaders’ linguistic utterances provide insights into their personality and behaviours; hubris is associated with unethical and potentially destructive leadership behaviours; if it is possible to identify linguistic markers of CEO hubris then these could serve as early warnings sign and help to mitigate the associated risks. Using computational linguistics, we analysed spoken utterances from a sample of hubristic CEOs and compared them with (...) non-hubristic CEOs. We found that hubristic CEOs’ linguistic utterances show systematic and consistent differences from the linguistic utterances of non-hubristic CEOs. Demonstrating how hubristic leadership manifests in CEO language contributes to wider research regarding the diagnosis and prevention of the unethical and potentially destructive effects of hubristic leadership. This research contributes to the wider study of hubris and unethical leadership by applying a novel method for identifying linguistic markers and offers a way of militating against the risk of unethical and destructive CEO behaviours induced or aggravated by hubristic leadership. Robinson explores the tension between Occidental and Oriental elements in the playwright's art, examining both the sources of the conflict and its manifestation in selected plays written between 1916and 1942. Through an examination of O'Neill's cor­respondence, research library, and manuscript materials (some of which have pre­viously been unavailable for study) Robinson is able to reveal the origins of O'Neill's Ori­entalism. An easy familiarity with the com­plex interrelationships of Eastern and West­ern religions and the Oriental thought that underlies the ideas of many Western philoso­phers, allows Robinson to address the in­tricate problem of Oriental influences on O'Neill's favorite Western sources, including Nietzsche, Schopenhauer, Jung, Strindberg, and Emerson. John Macquarrie's Hensley Henson Lectures for 1993-94 delivered at the University of Oxford may serve two different but not mutually exclusive audiences. First, as a brief, concise, reliable, and yet not uncritical survey of Heidegger's thought from Being and Time through his later meditative thinking of Being, this book stands at the top of my list. Following a discussion of Heidegger's career and early writings, Macquarrie devotes two chapters to his major work, Being and Time. He makes it clear that (...) Heidegger was primarily concerned with developing a general ontology, not philosophical anthropology as many persons initially thought. The fourth chapter, entitled "Theology and Metaphysics," focuses in particular on the essay "What Is Metaphysics?" including the later postscript and introduction, Introduction to Metaphysics, and A Letter on Humanism. These works take up some of the issues unfinished in Heidegger's major work and point the way towards a more direct focus on the question of Being itself. Chapter 5 is concerned with Heidegger's reflections on thinghood, technology, and art showing his development beyond the primarily instrumental world of work in his early writings to a much richer, perhaps even spiritual conception of world. In chapter 6 Macquarrie discusses three closely related topics in Heidegger's later work, thinking, language, and poetry. Here we see Heidegger's progression beyond traditional philosophical and metaphysical thinking of Being to what he calls meditative thinking, a kind of thinking and speaking of Being that has much in common with poetic thinking and speaking and an understanding of Being that finds parallels in some western and eastern mystical traditions. For the title of his seventh chapter, Macquarrie chooses the title of the well-known interview with Heidegger, "Only A God Can Save Us," published in Der Spiegel after his death. He is primarily concerned in this chapter with the understanding of Being, theology, and God. Macquarrie delays until his final chapter the discussion of Heidegger's relation to National Socialism which comprises half of the Der Spiegel article. With characteristic balance Macquarrie argues that although Heidegger's conduct at the time should not be excused or glossed over it needs to be seen in the particular historical and political context which he outlines. To this he adds two personal notes based on his experiences with German prisoners following the cessation of hostilities in 1945 and a conversation with Hannah Arendt. The conversation with Hannah Arendt took place at Heathrow Airport on May 19, 1973 where Dr. Arendt was on her way to Europe for her summer holiday. Heidegger had suggested that Edward Robinson and Macquarrie consult with Arendt if they had any special difficulties translating Being and Time, and Macquarrie and she continued to have contacts following the completion of the translation. Their conversation turned to the sales of the translation of Being and Time which had been quite large, and Macquarrie commented that Heidegger must be making a good bit of money from the translation. Arendt replied that Heidegger was not much of a business man and that most of the money went to the publisher. Macquarrie then asked, "Would you say then that it was because he is not a man of affairs that he became so involved with the Nazis in 1933?" "Yes," she said, "quite so.". (shrink)

This is the first collection of essays to evaluate John Dewey's pragmatist philosophy from a feminist perspective. The variety of feminist interpretations offered here ranges from Jane Addams's praise for his collegial efforts to resolve the problems of the inner city to contemporary comparisons of his approach with Addams's own critique of capitalism as patriarchal. In between are essays assessing Dewey's contributions to feminist theory and practice both in his lifetime and in regard to contemporary feminist approaches to education, subjectivity, (...) objectivity and truth, and social and political philosophy. At a time when feminists are questioning and developing alternatives to the scientistic value-free inquiry advocated by logical positivism, the myth of detached observation informing the epistemological turn, rationalistic ethics, and the model of an unattached, nonrelational subject, this book reminds us of Dewey's early and passionate opposition to the same assumptions and his reconstruction of philosophy as a "method of moral and political diagnoses and prognosis." It has often been remarked that Dewey's pragmatism provides a genuine alternative to the usual masculinist biases of Western philosophy, and the various essays in this book develop this claim more extensively. After sketching some aspects of truthmaker doctrines and "truthmaker projects", and canvassing some prima facie objections to the latter, I turn to an issue which might seem to involve confusion about the nature of character of truthmakers if such there be, viz for statements of identity and (specially) distinctness. The real issue here is versions of the Identity of Indiscernibles. I discuss ways of discriminating versions, which are almost certainly true but trivial, which almost certainly substantive but false, and explore (...) an interesting intermediate possibility which might if developed yield a plausibly true yet not-entirely-trivial version of the doctrine: it is equivalent to what I call "the Denial of Bare Distinctness". Throughout all of Deleuze’s work one finds an extended encounter with the Event of Difference. Deleuze’s extraordinary work on Leibniz is no exception. In the ‘later’ work, and regarding Leibniz, Deleuze remarks, “no philosophy has ever pushed to such an extreme the affirmations of one and the same world, and of an infinite difference and variety in this world”. This positive identification with Leibniz is not found in the ‘earlier’ wave of Deleuzian texts from the sixties where Leibniz is captured (...) hesitating over the possible and the virtual. Any such hesitation over the possible and the virtual is “disastrous” for a philosophy of the event and difference since it abolishes the reality of the virtual and subordinates it to the identical, replacing pure immanence with a ‘theological model’ of creation. Is the Leibniz of Deleuze’s early texts compossible with the later? What is the significance of the event of difference or fold that joins and separates Deleuze’s continuing encounter with Leibniz? We will examine what is at stake in these differing understandings of Leibniz to Deleuze’s philosophy of events of difference. (shrink)

I address a question in moral metaphysics: How are conflicts between moral obligations possible? I begin by explaining why we cannot give a satisfactory answer to this question simply by positing that such conflicts are conflicts between rules, principles, or reasons. I then develop and defend the “Dispositional Account,” which posits that conflicts between moral obligations are conflicts between the manifestations of obligating dispositions (obligating powers, capacities, etc.), just as conflicts between physical forces are conflicts between the manifestations of (certain) (...) causal dispositions (causal powers, capacities, etc.). This account combines the so-called “moral forces” interpretation of prima facie obligations with a dispositional moral metaphysic according to which the metaphysical grounds of moral obligations are not rules or laws, but rather real, irreducibly dispositional properties (or powers) of moral agents and patients. My principal aims are to offer a theoretically attractive and suitably metaphysical account of conflicts of obligation, and to show that the dispositional moral metaphysic that grounds the Dispositional Account can explain and accommodate plausible normative views that rule- and law-based alternatives cannot, as well as to answer objections that have been pressed against other accounts of moral conflict (especially Ross’s) that appeal to moral dispositions or forces. In his celebrated work, A Theory of Justice (1971), John Rawls argues that, from behind the veil of ignorance, parties in the original position will employ the maximin decision rule to reason to his two principles of justice. In this journal, Olatunji Oyeshile offers a brief and concise outline of some of the historical criticisms of that argument. Oyeshile offers two important criticisms of Rawls' argument. Both, however, are somewhat misplaced, as I shall show. First, he claims that decision theory (...) offers parties in the original position other decision procedures. In fact, none of the alternatives are suitable, given the situation. And second, parties in the original position would first guarantee some minimum of libertarian goods, and then seek additional profits. This objection demonstrates a misunderstanding of the place of the maximin decision rule, as I shall show. -/- I believe that both criticisms stem from a close and careful reading of Buchanan's essay on Rawls. Unfortunately, Buchanan himself seemed to have misunderstood Rawls' original arguments. I rely on problems in Buchanan's original work to defend Rawls' theory against Oyeshile's criticisms. (shrink)

An attempt is made to identify a concept of ‘downward causation’ that will fit the claims of some recent writers and apply to interesting cases in biology and cognitive theory, but not to trivial cases. After noting some difficulties in achieving this task, it is proposed that in interesting cases commonly used to illustrate ‘downward causation’, (a) regularities hold between multiply realizable properties and (b) the explanation of the parallel regularity at the level of the realizing properties is non-trivial. It is argued that the relation between a realizable property and the property that realizes its effect in a particular case is not usefully regarded as a species of causation and that use of the concept of downward causation deflects our attention from our central explanatory tasks. Prior to August Weismann’s 1889 germ-plasm theory, social reformers believed that humans could inherit the effects of a salubrious environment and, by passing environmentally-induced modifications to their offspring, achieve continuous progress. Weismann’s theory disrupted this logic and caused many to fear that they had little control over human development. As numerous historians have observed, this contributed to the birth of the eugenics movement. However, through an examination of the work of social scientists Lester Frank Ward, Richard T. Ely, Amos Griswold (...) Warner, James Mark Baldwin, Simon Nelson Patten, Alfred Kroeber, Walter Robinson Smith, and Luther Lee Bernard, I demonstrate that Weismann’s ideas also prompted scholars to create of theories of human progress in which the social environment had a central role and biological heredity had a diminished one. Furthermore, in creating a new theory of social progress based on a concept called “social heredity,” the thinkers surveyed in this article separated biological and social thought and asserted the independence of the American social sciences. I argue that this represents an important moment in the maturation of the human sciences, and I suggest that the germ-plasm theory of heredity deserves a larger place in histories of the development of the American social scientific disciplines.
