With regard to current debates on the ethical implementation of AI, especially two demands are linked: the call for explainability and for ultimate human responsibility. In the medical field, both are condensed into the role of one person: It is the physician to whom AI output should be explainable and who should thus bear ultimate responsibility for diagnostic or treatment decisions that are based on such AI output. In this article, we argue that a black box AI indeed creates a (...) rationally irresolvable epistemic situation for the physician involved. Specifically, strange errors that are occasionally made by AI sometimes detach its output from human reasoning. Within this article it is further argued that such an epistemic situation is problematic in the context of ultimate human responsibility. Since said strange errors limit the promises of explainability and the concept of explainability frequently appears irrelevant or insignificant when applied to a diverse set of medical applications, we deem it worthwhile to reconsider the call for ultimate human responsibility. Nietzsche's notion of the Übermensch is one of his most famous. While he himself never defined or explained what he meant by it, many philosophical interpretations have been offered in secondary literature. None of these, however, has examined the significance of the notion for Nietzsche the man, and this essay therefore attempts to address this gap.The idea of the Übermensch occurred to Nietzsche rather suddenly in the winter of 1882-1883, when his life was in turmoil after yet another deep personal (...) setback. The early loss of his father had deprived Nietzsche of a meaningful “mirroring” and a chance to experience realistic, age appropriate disappointment. This left him with a lifelong tendency towards idealisation. It became his proverbial Achilles’ heel and the source of repeated disillusionments and sorrow. The Übermensch may thus have been a culmination of his impulse to create altars and worlds before which he could kneel. Trying to cope with his own vulnerability, Nietzsche evoked an ideal of the Übermensch, a mask of hardness that was designed, if unconsciously, to ward off any future assaults on his fragile self.The double aspect of Nietzsche's personality is explored in this essay. While a highly provocative, belligerent and uncompromising Nietzsche often emerges from his published works, a vulnerable, lonely and sometimes self-pitying Nietzsche lurks in his letters and the accounts of his friends and acquaintances. But could an “ideal of strength”, such as the Übermensch, serve as a protective mask for someone with a sensitive, passionate interior? Nietzsche's descent into madness would suggest that no ideal can be a substitute for human, all too human, compassion. (shrink)

Can the evidence provided by software systems meet the standard of proof for civil or criminal cases, and is it individualized evidence? Or, to the contrary, do software systems exclusively provide bare statistical evidence? In this paper, we argue that there are cases in which evidence in the form of probabilities computed by software systems is not bare statistical evidence, and is thus able to meet the standard of proof. First, based on the case of State v. Loomis, we investigate (...) recidivism predictions provided by software systems used in the courtroom. Here, we raise problems for software systems that provide predictions that are based on bare statistical evidence. Second, by examining the case of People v. Chubbs, we argue that the statistical evidence provided by software systems in cold hit DNA cases may in some cases suffice for individualized evidence, on a view on which individualized evidence is evidence that normically supports the relevant proposition (Smith, in Mind 127:1193–1218, 2018). Carolyn Korsmeyer has offered some compelling arguments for the role of disgust in aesthetic appreciation. In the course of this project, she considers and holds up for justifiable criticism the account of emotional conversion proposed by David Hume in “Of Tragedy”. I will consider variant interpretations of Humean conversion and pinpoint a proposal that may afford an explanation of the ways in which aesthetic absorption can depend on and be intensified by the emotion of disgust.

BackgroundResearch using data from medical care promises to advance medical science and improve healthcare. Academia is not the only sector that expects such research to be of great benefit. The research-based health industry is also interested in so-called ‘real-world’ health data to develop new drugs, medical technologies or data-based health applications. While access to medical data is handled very differently in different countries, and some empirical data suggest people are uncomfortable with the idea of companies accessing health information, this paper (...) aims to advance the ethical debate about secondary use of medical data generated in the public healthcare sector by for-profit companies for medical research (ReuseForPro).MethodsWe first clarify some basic concepts and our ethical-normative approach, then discuss and ethically evaluate potential claims and interests of relevant stakeholders: patients as data subjects in the public healthcare system, for-profit companies, the public, and physicians and their healthcare institutions. Finally, we address the tensions between legitimate claims of different stakeholders in order to suggest conditions that might ensure ethically sound ReuseForPro.ResultsWe conclude that there are good reasons to grant for-profit companies access to medical data if they meet certain conditions: among others they need to respect patients’ informational rights and their actions need to be compatible with the public’s interest in health benefit from ReuseForPro. Conscientious objection has spurred impassioned debate in many Western countries. Some Norwegian general practitioners (GPs) refuse to refer for abortion. Little is know about how the GPs carry out their refusals in practice, how they perceive their refusal to fit with their role as professionals, and how refusals impact patients. Empirical data can inform subsequent normative analysis.

Bodies in China uses Chinese philosophy to reframe Western scholarship on gender, body, and aesthetics. Does Confucianism rule out the capacity of women as moral subjects and hence as aesthetic subjects? Do forms of Chinese philosophy contribute or correspond to patriarchal Confucian culture? Can Chinese philosophy provide alternative perspectives for Western feminist scholars? The first section considers theoretical and philosophical discussions of Western traditions and how the ideas offered by Confucians and Daoists can provide alternative body ontologies for critical feminist (...) practices. The second section reviews female aesthetical representations ranging from The Book of Songs to the work of the controversial body artist He Chengyao. The third section traces changing perceptions of femininity from imperial to its current cosmopolitan era using a range of case studies including Ming dynasty literature, Hong Kong women's fashion in the 1960s, and the 2008 Summer Olympics in Beijing. Overall, this book discusses new conceptual models that feminist scholars are using to displace dualism and emancipate notions of the body from Cartesian models and metaphors. (shrink)

ZusammenfassungBei den meisten Patienten, die heute erwartet an einer unheilbaren Krankheit versterben, wird vor ihrem Tod eine bewusste Entscheidung zum Therapieverzicht getroffen. Während dem Therapieverzicht auf Wunsch des Patienten ein wichtiger Stellenwert in der medizinethischen Diskussion zukommt, hat der Umgang mit Forderung nach „unangemessener“ Maximaltherapie bislang weniger Beachtung gefunden. In einer empirischen Studie zur Einbeziehung von Patienten in Entscheidungen zum Therapieverzicht konnten wir zeigen, dass etwa ein Drittel der Patienten auch bei infauster Prognose Lebenszeit durch Maximaltherapie gewinnen möchte. Diese Patienten (...) wurden im Gegensatz zu Patienten mit palliativem Therapieziel häufig nicht in Entscheidungen zur Therapiebegrenzung einbezogen. Hier werden die ethischen Implikationen dieser Praxis untersucht und gefragt, ob ein Therapieverzicht am Lebensende auch gegen den Wunsch des Patienten ethisch zu rechtfertigen ist oder ob Ärzte dem Wunsch des Patienten nach Lebenszeitgewinn auch bei infauster Prognose durch Maximaltherapie nachkommen sollen. Vor dem Hintergrund der gängigen Konzepte zur Rechtfertigung eines einseitigen Therapieverzichts, die für sich genommen zu kurz greifen, wird ein alternatives Entscheidungsmodell vorgestellt, das vier bewertungsrelevante Kriterien vorsieht: die Wirksamkeit einer Maßnahme, die Autonomiefähigkeit des Patienten, die patientenseitige Nutzenbewertung und die Kosten für die Solidargemeinschaft. Je nachdem, welche Kriterien erfüllt sind, rechtfertigen sie eine Entscheidung zum Therapieverzicht oder eine Fortsetzung der Therapie entsprechend dem Patientenwillen. (shrink)

A new study of the 87 coins (29 silver and 58 bronze) of Apollonia in Illyria which comprise the Dimalla treasure. The silver coins have as types a head of Apollo on the right and three nymphs dancing around the hearth of the Nymphaeon on the reverse, with names of mint officers (which are not those of the prytaneis), and having the same weight as the Roman denier. The bronze coins revert to the types that preceded the great 1st c. (...) monetary reform, but with different mint officers, names and above all different weights, which are exactly the same as those of the Roman bronze coins, and probably struck at Corinth by the praefectus of Antonius' fleet, Atratinus. This shows that Apollonia created its own monetary system between 38 and 36 BC, adapting it to the standards of the denier and the new Roman bronze coinage. (shrink)

Hobbes’s theory of authorisation poses numerous puzzles to scholars. The weightiest of these conundrums is a supposed contradiction between chapter 17 of Leviathan, that calls for unconditional submission to the sovereign, and chapter 21, that defends the liberties of the subject. This article offers a fresh perspective on the theory’s consistency, function and addressees. While existing research doubts the theory’s consistency, focuses on its immunisation function and on the subjects as the theory’s main addresses, the paper argues that Hobbes’s theory (...) of authorisation is consistent with the doctrine of the liberty of subjects, and that it serves the dual purpose of immunising the sovereign against criticism and disciplining the sovereign via a counsel of memento mori: A hitherto underexplored element of authorisation theory is a reminder of the mortality of sovereignty directed at the sovereign to convince him to make restricted use of his absolute right to rule. Hobbes’s theory of authorisation can thus be read as part of a complex argumentative strategy for peace, rooted in a ‘liberal absolutism’ which is not as paradoxical as it sounds, and which is reflected in the frontispiece by the friendly smile of the sovereign. The Yugoslav wars of secession in the 1990s left traces of the past among the societies living in the successor states. Those traces can be found within the collective memory of these societies, and are transmitted through various communication channels to the next generation. Today, this post-war and post-Yugoslav generation, born during or shortly after the violent conflicts, are young adults dealing with the recent past. Based on findings from life-story interviews that are examined and interpreted using the approach of (...) sequence analysis, I elaborated a model of the transregional post-Yugoslavs’ communication system regarding the wars. I identified three communication practices on war-related topics by actively reflecting on the “Other,” which I present in this paper. During their adolescent years, post-Yugoslavs created their own narratives, and thus their own, authentic communication strategies in response to the “invisible war,” which still continues today, according to the post-Yugoslav generation. Christine de Pizan da vida a su gobernante ideal a partir de la tradición medieval del aristotelismo político y su noción de lo “arquitectónico”. Construido a modo de una arquitectura viviente de ciencias, el rey sabio aparece dominando la paleta de saberes, que va desde la episteme hasta los conocimientos más prácticos. Teoría y práctica se encuentran, así, en la base de su construcción de lo político. Pero ¿en qué medida la autora se consagra a brindar una explicación del pasaje (...) de las ciencias, sobre todo, aquel que va de las especulativas al registro práctico de la ciencia política? Si el rey se distingue por ser un sabio al tiempo que un experto en las diversas ciencias, cabe preguntarse si acaso la autora teoriza sobre dicho pasaje de lo teórico a lo práctico que constituye la esencia de su pensamiento. ¿Cuál es el canal para volcar la episteme al servicio del Estado? Al respecto, sostengo la hipótesis de que tanto la prudencia como el entendimiento o intelecto parecen ser los dos componentes de la sabiduría perfecta que la escritora aúna en una perfecta díada; operación, esta, que le permite explicar el pasaje de todas las ciencias al plano de lo contingente. ¿Acaso no es, gracias a esta operación, que el rey sabio de Christine de Pizan aparece como el intelecto supremo de la comunidad política, encarnada en el reino de Francia? ¿No son las ciencias, de este modo, redituables en servicio del Estado? This article explores the question of what a concept of postautonomy, as opposed to one of heteronomy, might do to describe current trends in contemporary literature. It is argued that a reading of contemporary literature and literariness benefits from being tied to earlier theoretical and literary conceptions of the relationship between aesthetics and society.

What distinguishes aesthetic thinking from other forms of thinking, such as logical, for instance? In order to clarify this question, the following contribution deals with a reception-aesthetic problem that has been controversially discussed in English-language aesthetics for decades as the ‘paradox of fiction’. It will be shown that the intentional orientation of mind and imagination towards the non-existent, the counterfactual, and the fictive belongs to the decisive peculiarity of aesthetic thinking. Its productivity consists in the process of playing through the (...) possible and imaginable and thereby transcending and thwarting the given and the existing. (shrink)

Durch die Entdeckung und das vertiefte Verständnis der sogenannten „Genscheren“ CRISPR/Cas9 rücken Eingriffe in das Genom zukünftiger Menschen in greifbare Nähe und erfordern mit neuer Dringlichkeit die Beantwortung einer fundamentalen politiktheoretischen Frage: Können Eingriffe in die genetische Ausstattung zukünftiger Menschen im Namen der Gerechtigkeit erlaubt oder gar geboten sein? Rawls’sche Theorieelemente haben in der Debatte um Keimbahneingriffe – trotz Rawls’ vergleichsweise spärlicher eigener Bemerkungen zu eugenischen Fragen – erstaunliche Prominenz entfaltet. Unter Rekurs auf die Rawls’sche Theorie der Grundgüter wird in (...) der Debatte argumentiert, dass Eingriffe im Namen der Chancengleichheit geboten sind und/oder keine Einschränkung der Freiheiten zukünftiger Personen vorliegt, sofern nur sogenannte „genetische Grundgüter“ nicht minimiert oder vermehrt werden. Ich argumentiere für die These, dass diese Argumente einer „liberalen Eugenik“ auf einer verkürzten Rezeption der Rawls’schen Grundgütertheorie basieren. Rawls selbst sah sich nach seiner Veröffentlichung der Theorie der Gerechtigkeit dazu veranlasst, Missverständnisse in Bezug auf seine Grundgütertheorie auszuräumen, und konzedierte, dass seine Darstellung in der Theorie möglicherweise missverständlich gewesen sei. Eine Rekonstruktion der komplexen Theorie der Grundgüter, wie sie in der Theorie angelegt ist, und später von Rawls weiterentwickelt wurde, kann daher die brandaktuelle Debatte um Keimbahneingriffe informieren, indem sie erstens zeigt, dass die gängigen Argumente für Eingriffe sich nicht in der üblichen Form auf Rawls’ Grundgütertheorie stützen können und zweitens Möglichkeiten aufzeigt, mit Rawls ein Argument gegen eine weitgehende Freigabe von Keimbahneingriffen zu formulieren, das die Begründungspflicht wieder zulasten interventionistischer Positionen verschiebt. Meinem Aufsatz liegt folgende Struktur zugrunde: Zuerst rekonstruiere ich zwei Hauptargumente „liberaler Eugenik“ und zeige, dass und wie beide Argumente auf die Rawls’sche Idee der Grundgüter zurückgreifen und breite Verwendung in der bioethischen Debatte gefunden haben (1). In einem zweiten Schritt skizziere ich eine komplexere Version von Rawls’ Grundgütertheorie, die bereits in der Theorie der Gerechtigkeit angelegt ist, aber auch für spätere Schriften wichtig bleibt (2). Danach zeige ich, dass sich die Argumente der „liberalen Eugenik“ nicht auf diese komplexere Version der Theorie der Grundgüter stützen können und dass sich mithilfe der komplexen Theorie der Grundgüter sogar ein Argument gegen eine umfassende Freigabe von Keimbahneingriffen formulieren lässt, das die Begründungspflicht für interventionistische Positionen vergrößert (3). Ich schließe mit einem kurzen Fazit zur Relevanz von Rawls’ Theorie im biotechnischen Zeitalter (4). (shrink)

​This book gathers research and writings that reflect on traditional and current global issues related to art and aesthetics, gender perspectives, body theories, knowledge and learning. It illustrates these core dimensions, which are bringing together philosophy, tradition and cultural studies and laying the groundwork for comparative research and dialogues between aesthetics, Chinese philosophies, Western feminist studies and cross-cultural thought. Pursuing an interdisciplinary approach, the book also integrates philosophical enquiries with cultural anthropology and contextual studies. As implied in the title, the (...) main methodologies are cross-cultural and comparative studies, which touch on performances in art and aesthetics, social existence and education, and show that philosophical enquiries, aesthetical representation and gender politics are simultaneously historical, living and contextual. The book gathers a wealth of cross-cultural reflections on philosophical aesthetics, gender existence and cultural traditions. The critical thinking within will benefit undergraduates, postgraduates and researchers in the area of comparative philosophies. It blends academic rigor with personal reflection, which is a critical practice in feminist philosophy itself. (shrink)

The gendered assumptions embedded in the construction of the rational individual are well established in Western feminist thought but inapplicable to describe societies operating on different principles, such as East European state socialism. This article identifies the communist subject as the building block of communist political ideology and argues that this formulation was no less male biased than its counterpart, the rational individual under liberal capitalism. In state socialist Hungary this male bias came to be expressed differently: Women were integrated (...) into society through membership in a social group perceived as relatively homogeneous regarding interests and obligations and with gender-specific qualities and privileges. These qualities were considered inferior to men's since women—because of household responsibilities—were not capable of total devotion to the communist party. The author explores this construction of the female communist subject through a content analysis of classified materials from the archives of the Hungarian Socialist Workers' Party. (shrink)

An increasing number of studies indicate that changes in cytosolic free Ca2+ ([Ca2+]c) mediate specific types of signal transduction in plant cells. Modulation of [Ca2+]c is likely to be achieved through changes in the activity of Ca2+ channels, which catalyse passive influx of Ca2+ to the cytosol from extracellular and intracellular compartments. Voltage‐sensitive Ca2+ channels have been detected in the plasma membranes of algae, where they control membrane electrical properties and cell turgor. These channels are sensitive to 1,4‐dihydropyridines, which in (...) animal cells specifically affect one class of voltage‐regulated plasma membrane Ca2+ channel. Ca2+‐permeable channels with different pharmacological properties have been found in the plasma membrane of higher plants. Recent evidence suggests the existence of two discrete classes of Ca2+ channel co‐resident in the vacuolar membrane (tonoplast) of higher plants. The first is gated by inositol 1,4,5‐trisphosphate, and bears a number of similarities to its animal counterpart which is located in the endoplasmic reticulum (ER). The second tonoplast Ca2+ channel is voltage‐operated. However, the specific roles of these tonoplast channels in signal transduction have yet to be elucidated. (shrink)

Nach Platon „vermittelt“ die Philosophie als Kunst der Dialektik durch Dialog zwischen Begriffen und Disziplinen. Um dies zu zeigen, wird hier eine Lektüre von Platons Symposion vorgestellt, in der das Verhältnis der Disziplinen mit Wissens- und Erziehungsanspruch in Platons Zeit beleuchtet wird. Jede Rede des Symposions ist wie eine Stellungnahme in einem Dialog zu verstehen, so dass das Gesamtwerk als sieben Reden zu lesen sind, die dialogisch aufeinander verweisen. Die Grundannahme dieser Lektüre besagt, dass den einzelnen Reden verschiedene Wissenschaften oder (...) Künste zuzuordnen sind, die einen Wissens- und Erziehungsanspruch vertreten, und dass der in der Rede vorgestellte und verteidigte Liebesbegriff jeweils der dieser Disziplin entsprechende ist. Die unterschiedliche Begriffsbestimmung in den einzelnen Wissenschaften und Künsten nehmen indirekt aufeinander Bezug, widersprechen sich und ergänzen sich. Die Fragen, welche Platon im Symposion diskutiert, betreffen nicht nur die Erkenntnistheorie, Ideenlehre, Rolle des Dialogs für die Philosophie, Fragen der Erziehung und der Kreativität, sondern auch ein Problem, das sich durch die bereits in Platons Zeiten aufkommende Ausdifferenzierung der Disziplinen und Wissenschaften ergibt. Welcher der Disziplinen mit Wissens- und Erziehungsanspruch kommt der Führungsanspruch in Bezug auf die Jugend und damit die Gesellschaft sowie das Wissen zu? Das Angebot Platons um diese Frage zu beantworten und die unterschiedlichen Begriffsbestimmungen und Begriffsangebote zu vereinen, besteht in einer komplizierten Konstruktion. Ein Teil der Antwort bezieht die Philosophie (Eros, Sokrates) und den philosophischen Dialog, für den der Eros unabdingbar ist, direkt mit ein. Im philosophischen Dialog sollten die Begriffsmerkmale ausfindig gemacht werden, die für einen Begriff und seine Bedeutung unabdingbar ist. Dieser Dialog wird aber nicht ausschließlich zwischen Diotima und Sokrates geführt. Er hat ebenso wie die dialogisch aufeinander bezogenen Reden der gesamten Schrift eine Vorbildfunktion. Dieser indirekte Dialog, der durch Abstimmung der Reden zueinander „geführt“ wird, enthält einen weiteren Tel der Antwort. Der eigentliche „Dialog“ muss aber schließlich zwischen der Leserin und dem „Symposion“ stattfinden. (shrink)

In the De Pythiae oraculis (397e) Plutarch mentions, according to the manuscript tradition, a bronze column of Hiero I of Syracuse, which stood in the sanctuary of Delphi and fell down on the day of his death. After retracing the interpretations of this passage both in the philological and archaeological studies and pointing out their problematic aspects, the author proposes a new reading of the text, suggesting that the monument involved was a statue of Hiero I instead of a column.

Socially responsible business and ethical behaviour of companies have been of interest to academia and practice for decades. But the focus has almost exclusively been on large corporations while small- and medium-sized enterprises (SME) have not received as much attention. Thus, this paper focuses on socially responsible business practices of SME entrepreneurs or owner–managers in Germany. Based on the assumption that decision-makers in SMEs are the central point where all business activities start, members of a German entrepreneurs association were approached (...) in the course of a qualitative and quantitative survey. They were asked to assess in what way their social responsibility is expressed in specific management practices towards selected stakeholder groups. These practices in turn were assumed to result in perceived positive reactions of the respective stakeholders and subsequently to positively influence the firm's financial performance, i.e. cost reductions and increase in profits. In the paper, a research model is presented that elaborates the relationship between an SME executive's social responsibility and the value creation of a firm, i.e. whether (personal) values create (economic) value. It was found that socially responsible management practices towards employees, customers and to a lesser extent society have a positive impact on the firm and its performance. As such, values can create additional value. (shrink)
