We systematically examined the content of the websites of 46 agencies that buy and sell human eggs to understand how they market themselves to both donors and recipients. We found that these websites use marketing techniques that obscure the realities of egg donation, presenting egg donation as a mutually beneficial and fulfilling experience. Sites emphasize egg donors' emotional fulfillment and address recipients' anxieties by stressing the ability to find the perfect “fit” or “match”, suiting recipients’“preferences”/“desires”, and even designing/customizing a child. Agencies attempt to create a sense of connection between the recipients and donors by reporting donors' personal characteristics — e.g., interests/hobbies, traits, mood/temperament, and self-reported childhood behavior/memories. Sites present donors as caring/generous and smart/successful/beautiful. These data, the first to examine several key aspects of egg donation agency websites, reveal critical aspects of how these companies communicate to prospective donors and recipients, raising several ethical concerns. Websites frame information in ways that may bias consumers, making emotional appeals that may distract from appropriate risk/benefit assessments and obscure the ethical challenges of egg donation. These data highlight needs for improved practices, adherence to guidelines, and consideration of enhanced guidelines or policy. (shrink)

This paper presents results from a survey of 344 individuals who engage in climate change mitigation action, contributing to debates about whether it is necessary to promote ‘nature experiences’ and biospheric values to encourage pro-environmental behaviour. We investigate three factors – values, motivations and formative experiences – that underlie such behaviour, but that usually have been considered in isolation from each other. In contrast to previous studies of environmentalists’ significant life experiences, outdoor/nature experiences were not frequently mentioned as being influential. (...) Altruistic concerns about climate change impacts on future human generations and on poorer or more vulnerable people were considered more motivating than other reasons for action. There was no significant difference in how respondents rated altruistic and biospheric values. Variations in responses from those involved in ‘biospherically-oriented’ organisations (such as traditional environmental or conservation organisations) versus those involved in climate change groups suggest that there are different routes into climate change mitigation action, and our results show that it is not essential to cultivate biospheric values or the love of nature to encourage such action. This book offers a new approach to the analysis of the multiple meanings of English modals, conjunctions, conditionals, and perception verbs. Although such ambiguities cannot easily be accounted for by feature-analyses of word meaning, Eve Sweetser's argument shows that they can be analyzed both readily and systematically. Meaning relationships in general cannot be understood independently of human cognitive structure, including the metaphorical and cultural aspects of that structure. Sweetser shows that both lexical polysemy and pragmatic ambiguity are shaped by our (...) metaphorical folk understanding of epistemic processes and of speech interaction. Similar regularities can be shown to structure the contrast among root, epistemic and speech act uses of modal verbs, multiple uses of conjunctions and conditionals, and certain processes of historical change observed in Indo-European languages. This book is an unusually readable and lucid account of the development of Derrida's work, from his early writings on phenomenology and structuralism to his most recent interventions in debates on psychoanalysis, ethics and politics. Abstract“Science Is Politics By Other Means” (SIPBOM) was coined in The Pasteurization of France, Latour’s 1984 empirical study of the birth of microbiology. Yet, it encapsulates an outstanding political theory of science that Latour has never formalized and that has remained unnoticed to this day. The theory is comprised of two dimensions. The first one is the ontological labor performed by science, that is, the laboratory production of new nonhumans. The second one is the ability of science to devise and (...) implement novel policies targeted at the new beings it produces. These “other means” are incorporated in political projects and contribute to the shaping of society. Fifteen years later, Latour published Politics of Nature ([1999] 2004), a full-blown political treatise equally devoted to the political character of science. It would be mistaken, however, to assume that it falls in the same SIPBOM paradigm as the Pasteur study. The compositionist theory it offers redefines politics as the institution of the nonhumans that make up external reality, a task that has traditionally been monopolized by Science. In this sense, “science is politics by other means” has become “politics is science by other means,” these “other means” now referring to “cosmopolitics,” that is, the due process advocated by compositionism. The first claim of the present paper is that the respective weight ascribed to politics and ontology is different in The Pasteurization of France and in Politics of Nature. The second claim is that compositionism is not as successful as Latour’s early theory to account for the politicity of science. (shrink)

Sustaining hope in patients is an important element of health care, allowing improvement in patient welfare and quality of life. However in the palliative care context, with patients who are terminally ill, it might seem that in order to maintain hope the palliative care practitioner would sometimes have to deceive the patient about the full nature or prospects of their condition by providing a ‘false hope’. This possibility creates an ethical tension in palliative practice, where the beneficent desire to improve (...) patient welfare through sustaining hope appears to be in conflict with an autonomy-based requirement not to deceive patients about their condition. In order to resolve this ethical tension, we provide an analysis of the concept of hope and argue that there is at least one conception – the ‘absolute’ conception of hope – which when properly understood allows practitioners to foster hope in terminally-ill patients while avoiding any need to deceive them about their condition. Practitioners therefore do not need to shy away from using the language of hope in the palliative setting, as on this understanding of hope it can be used in a way that both promotes patient welfare and respects patient autonomy. ' These are perhaps Kant's most well-known and oft-repeated words. They reflect not only the profound feeling (...) that underlies his technical and abstruse treatises, but also his characteristic preoccupation with law. The "starry heavens" are a synecdoche both for the wonder of nature as we perceive it in all its multiplicity, and for the marvel of science's ability to reduce, order, and subdue that infinite multiplicity into a few elegant laws. These two types of law, natural and moral, define the focus of Kant's critical philosophy, and metaphors drawn from jurisprudence pervade all three critiques. In the context of controversial statements on the role of metaphor in philosophical texts by Jacques Derrida, Paul Ricoeur, and Richard Rorty, I will analyze the legal metaphors in the prefaces and Transcendental Deductions of the Critique ofPure Reason. My goal in engaging Kant's texts in this controversy over metaphor is twofold: on the one hand to assess experimentally the value of these positions on metaphor in the history of philosophy, and, on the other hand, to examine the relations between critical conceptualization and insurgent metaphoricity in Kant's carefully elaborated and systematized text. In a textwhose key words are "universal and necessary for all possible experience," contingentand ambiguous metaphors might be expected to cause problematic unravelings. Richard Rorty has argued recently that "the history ofscience, culture and politics" should be viewed "as a history of metaphor rather than of discovery." 2 He compares the creations of new vocabularies to the 245 246Philosophy and Literature invention of "new tools" ("CL," p. 5), alluding to "Nietzsche's definition of truth as a mobile army of metaphors" (p. 6). From Plato's figures of the world as cave and the mind as charioteer with unruly horses, we shift to Locke's view of mind as tahda rasa and Descartes's description of the world as a machine. Rorty's paradigm of cultural history as a history of metaphor enters into an earlier, unresolved debate between Jacques Derrida and Paul Ricoeur over the relationship between metaphor and philosophical discourse. Like Derrida, Rorty follows Nietzsche's claims about metaphor in the history of philosophy, a view Ricoeur wants to disprove so that he can recover the privileged univocity of speculative discourse. However Rorty has nothing in common with die complexity and "invaginated" ambiguities, the dazzling multivocity of Derrida's writing on the economics of metaphor. Although Rorty appears at first to agree with Derrida that there is no truth or reality apart from the linguistic tropes which dominate different epochs and cultures, he retains a metaphysical distinction between literal reference and figurative play. Rorty adopts Donald Davidson's theory that metaphors do not have "meaning" precisely because diey have no place in the language game into which they are inserted. They produce an effect, but it is not meaning: "One can only savour it or spit it out"; it is not a " 'truth-value candidate' " ("CL," p. 6). However, through repeated use, the metaphor will find a role in the language game; dying as a metaphor, it will live as a literal statement. Therefore Rorty agrees with Ricoeur that a moribund metaphor is no longer a metaphor, but a literally functioning segment of discourse. Thus despite his initial move toward a Derridean, or atleast Nietzschean, position, Rorty ultimately takes a stand consonant with Ricoeur's desire to rescue speculative discourse from the unruliness of metaphor. Considering Rorty's celebration of Freud in an article on "The Contingency of Selfhood," 3 his failure to consider the role of unconscious associations and overdetermination in the writing and reading of texts is surprising. Dead or alive, a metaphor brings with it a host ofpersonal and public, conscious and unconscious, new and traditional associations that become juxtaposed against a similar number of associations connected with the signifying chain into which the metaphor has been inserted. Scientific data supporting rational arguments for human-made causes of climate and environmental changes might be persuasive in some contexts. Law, policy, activism and The Earth Charter similarly appear insufficient to change attitudes and behaviours. Even biblical and theological arguments fail to move some Christians beyond apathy and climate denial. Decades of ecological theology and calls for ecological conversion suggest that appeals to reason and facts are limited without an affective epistemology that join knowledge and experience to produce worldview transformation through (...) emotions, such as awe.Contribution: Departing from appeal to scientific data and arguments alone, the primary claim is that ecological conversion is not singularly a rational act. The author takes a collection of essays on concepts and approaches in evolutionary epistemology as the occasion for a critical discussion of the limits and achievements of evolutionary epistemology as well as of certain philosophical objections to the very project itself. She comes to the conclusion that evolutionary epistemology, even if it cannot explain cognition itself, can nevertheless shed light on the complex phenomenon of cognition by demonstrating the presence of traces of our evolutionary past in cognition. Modern research into (...) the structure and functioning of the brain supports this conclusion. The author argues that the questions which evolutionary epistemology can legitimately pose and answer are such that it is not in competition with traditional epistemology. For this reason she suggests that this research program be renamed "evolutionäre Informationstheorie", in the hope that its aims will become clearer to proponents as well as opponents. In the final section the author discusses the possibility that an evolutionary approach might explain the fact that human beings are less and less capable of dealing with the complexity of the world they have created. By disentangling the history of free indirect style from the history of the novel, we can see the narratorial complexity of prose fiction at a revealingly early stage, when the channeling of other minds and other experiences seemed less like a generic affordance than a problem of etiquette, moral judgment, and simple intelligibility. Lacking novelistic conventions (for example, quotation marks), the Elizabethan writer George Gascoigne experimented with a range of techniques for representing the voices and thoughts of his characters. In (...) The Adventures of Master F.J. (1573), he does not consistently or clearly mark particular expressions as belonging to either character or narrator. The effect of this is a wandering or mobile point of view, a protoform of free indirect style—not as a deliberate aesthetic effect but rather as the product of experimentation with a not yet fully articulated set of formal conventions. Gascoigne’s use of this emergent free indirect style centers on a key scene of sexual assault and its aftermath. This, I argue, is no accident as sexual consent foregrounds with particular urgency the moral stakes of attributing thoughts, desires, and motives to other people. In the early days of prose fiction, Master F.J. thus shows us the potentially disturbing entanglement between sexual nonconsent and one of the central tools and methods of literary narrative: its practice of channeling the voices of others. This article combines critical, visual and aesthetic theory to argue that the very act of design is a Utopian process. Crucially, the Utopian dimension is not simply a matter of subject matter or utility. Rather, it lies in the act of formal arrangement and composition, and therefore can apply to visual texts with no apparent subject matter at all. The argument is grounded in Ernst Bloch’s critical theory of Utopia, which sees Utopia as a process rather than a destination. It (...) is illustrated with a case study of Navajo weaving, in tandem with an analysis of Navajo creation mythology. It concludes by arguing that we need to go beyond creation theory to a critical theory of creativity. Utopia is not something that we can delegate either to nature or to the supernatural because, as Bloch declares in The Spirit of Utopia, ‘Life has been put into our hands’. (shrink)

This essay focuses on conceptual engineers who aim to improve other people's patterns of inference and attention by shaping their concepts. Such conceptual engineers sometimes engage in a form of epistemic paternalism that I call paternalistic cognitive engineering: instead of explicitly persuading, informing and educating others, the engineers non-consultatively rely on assumptions about the target agents’ cognitive systems to improve their belief forming. The target agents could reasonably regard such benevolent exercises of control as violating their sovereignty over their own (...) belief formation. This is a pro tanto reason against such engineering. In addition to the relevant projects of conceptual engineering, paternalistic cognitive engineering plausibly includes certain kinds of nudging and evidence suppression. I distinguish the sovereignty-based concern from other ethical worries about conceptual engineering and discuss how one might justify the relevant conceptual engineering projects despite the sovereignty-based reason against them. This paper considers whether we have any reason to forgive the perpetrators of the most terrible atrocities, such as the Holocaust. On the face of it, we do not have reason to forgive in such cases. But on examination, the principal arguments against forgiveness do not turn out to be persuasive. Two considerations in favour of forgiveness are canvassed: the presence of rational agency in the perpetrators, and the common human nature which they share with us. It is argued that (...) the presence of rational agency does not generate a reason to forgive. However, our common human nature may be sufficient to provide such a reason, and evidence for its general reason-giving power can be seen in phenomena such as vicarious shame, and the moral significance which we attach to the notion of crimes against humanity. A reason for forgiveness based on common human nature will not be a strong one, but a weak reason still has some force. (shrink)

In this paper, the principal objections to unconditional forgiveness are canvassed, primarily that it fails to take wrongdoing seriously enough, and that it displays a lack of self-respect. It is argued that these objections stem from a mistaken understanding of what forgiveness actually involves, including the erroneous view that forgiveness involves some degree of condoning of the offence, and is incompatible with blaming the offender or punishing him. Two positive reasons for endorsing unconditional forgiveness are considered: respect for persons and (...) human solidarity; and it is argued that the latter provides more plausible grounds for it than the former. We also help everyone involved with the care of seriously ill patients focus on what is best based on the values of the most important person in the room; the one in the hospital bed. So, when we call for (...) a bioethics consultation from a clinical ethicist, it’s because something has gotten stuck or, perhaps, we could benefit from a reframe—or a new set of eyes to ground the scenario or the emotional miasma that tends to linger and drift when on the cusp between life and death.In the 1990s, at least in my medical school and residency programs, medical ethicists in the hospital were not often a part of direct patient care. They were like philosophers, available to curbside and advise on ethically murky cases but at a distance from the trenches. These wise, generally older men with white beards parceled out all potential ethical sides of the case, leaving us to decide the best way forward. The Socratic Method1 was often employed, so we were left to grapple with the ambiguity that exists in most issues about what’s right or wrong. It sometimes felt frustrating but now I realize the importance of honing the skill of tolerating the feeling of not immediately knowing the best way to proceed in the practice of medicine. As it turned out, by the time I started practicing palliative care in 2013 and began to regularly collaborate with what was then our clinical ethics partners in care, our ethics director Dr. F was also a wise older man with a white beard. But he and the rest of his (non-male, un-bearded) team didn’t have that untouchable ivory tower kind of protection around them. They were accessible. They dug into the hard stuff right alongside us when they were asked to get involved.One time when I consulted ethics on a case, I’d been navigating a switch from practicing internal medicine to palliative care. At the time I was dealing with personal ambivalence—feeling mired in the heaviness that infused my workdays and unsure if I could take it. It turned out that a clinical consultation, and a family meeting with Dr. F, helped in more ways than one.That day, we gathered in the medical intensive care unit conference room. It doubled as a storage closet, so the team, including our patient’s family, dragged in chairs and stools and crowded around the oblong melamine table next to the whiteboard with half-erased arterial blood gas calculations. We hunched together to see where things stood and make some essential decisions.As we do in family meetings, we reconfirmed our roles on the team: ICU fellow, resident, and medical student. Nurses fluttered in and out as their patient care allowed. The patient’s daughter with silver-streaked hair was in attendance, as well as her son, who was slumped in his seat. Both looked sleepless and frazzled. And finally, Dr. F and myself—clinical ethicist and palliative care doctor—gathered. Dr. F then took the lead, announcing our intention to come together and discuss what was best for our patient—their mother. I will argue that those thinking about conceptual engineering should think more about ways of believing. When we talk about what someone “believes”, we could be talking about how they are inclined to act, or what they have put forth as their position on a matter, or what gives rise to a feeling of endorsement when they reflect on the matter. If we further recognize that the contents of our beliefs are at least sometimes framed in certain concepts and that (...) projects of conceptual engineering at least sometimes aim to change our beliefs by changing the concepts they are framed in, the question arises: which beliefs does conceptual engineering target? Is it always “belief” in the same sense? I will argue that it is not, using examples from feminist and mainstream metaphysics. Suppose that revisionary ontologists call on us to eliminate the non-joint-carving concept TABLE from our beliefs about the world. They then plausibly have in mind only “belief” in the sense of practically detached reflective assent: they want the concept eliminated from the content of such assent. On the other hand, when feminist metaphysicians of gender call on us to ameliorate the ethically problematic concept WOMAN, they target our “beliefs” in a sense that encompasses both the content of our everyday observations and experiences and what might be called practically engaged reflective assent; but they do not target the practically detached assent. In this paper we defend a version of moral internalism and a cognitivist account of motivation against recent criticisms. The internalist thesis we espouse claims that, if an agent believes she has reason to A, then she is motivated to A. Discussion of counter-examples has been clouded by the absence of a clear account of the nature of motivation. While we can only begin to provide such an account in this paper, we do enough to show that our version of (...) internalism can be defended against putative counter-examples. All theories of motivation which take what motivates to be a psychological state run foul of the following plausible constraint: the reason why you ought to do an action and the reason why you do it can be the same. In our view, however, while what motivates is a reason (which is a fact) the state of being motivated is a cognitive stage, viz. the belief that one has reason to act. In cases where the agent's relevant beliefs are false, then she has no reason to act, but nontheless her action can be explained in other ways. (shrink)

Decisions related to births in the “gray zone” of periviability are particularly challenging. Despite published management guidelines, clinicians and families struggle to negotiate care management plans. Stakeholders must reconcile conflicting values in the context of evolving circumstances with a high degree of uncertainty within a short time period. Even skilled clinicians may struggle to guide the patient in making value–laden decisions without imposing their own values. Exploring the experiences of one pregnant woman and her caregivers, this case study highlights how (...) bias may undermine caregivers’ ability to meet their obligation to enhance patient autonomy and the moral distress they may experience when a patient’s values do not align with their own. Management strategies to mitigate the potential impact of bias and related moral distress are identified. I draw on Merleau-Ponty’s account in Phenomenology of Perception of how bodily capabilities are rooted in unreflective, or “anonymous,” resources furnished by the environment. I apply his analysis to the experience of inhabiting a city, which I argue encourages the development of a perspective inclusive of diversity that offers a means of challenging forms of (...) social and political oppression. I consider how expression, as a further dimension of experience that draws on anonymous resources, plays a critical role in our developing the terms according to which we understand ourselves and the environment we inhabit. I argue that giving voice to diverse experiences is a crucial complement to the challenge to oppressive social and political structures we discover in the anonymous dimensions of urban experience. It is an intuitively attractive view that the importance of a proposition affects the amount of evidence a subject needs in order to know that proposition—the more important the proposition is to the subject, the more evidence the subject must have in order for her to count as knowing the proposition. Background: Few robust autism-specific outcome assessments have been developed specifically for use by teachers in special schools. The Assessment of Barriers to Learning in Education – Autism is a newly developed teacher assessment to identify and show progress in barriers to learning for pupils on the autism spectrum with coexisting intellectual disabilities. Aims: This study aimed to conduct a preliminary validity and reliability evaluation of the ABLE-Autism. Methods and procedures: Forty-eight autistic pupils attending special schools were assessed using the ABLE-Autism. (...) Multi-level modelling was used to evaluate test-retest reliability, internal consistency and convergent validity with the Teacher Autism Progress Scale. Outcomes and results: Results showed excellent test-retest reliability and internal consistency. A large effect size suggested that the ABLE-Autism is strongly correlated with the Teacher Autism Progress Scale. Teacher feedback was positive and suggested that the ABLE-Autism is easily understood by teachers, relevant to autistic pupils in special schools, and adequately covers the skills and behaviours that teachers believe are important to assess for these pupils. Conclusions and implications: Although further validation is recommended, the preliminary evaluation of the ABLE-Autism suggests that it is a useful and has the potential to be an effective outcome assessment for autistic pupils in special schools. This article analyzes the institutionalization of the global organic agriculture field and sheds new light on the conventionalization debate. The institutions that shape the field form a tripartite standards regime of governance that links standard-setting, certification, and accreditation activities, in a layering of markets for services that are additional to the market for certified organic products. At each of the three poles of the TSR, i.e., for standard-setting, certification, and accreditation, we describe how the corresponding markets were constructed over time (...) and the role of the different actors in their evolution. We analyze the politics at stake among the actors at each pole, their competing or cooperative interests and visions, and the tensions between them in the promotion of markets. Through the lens of the TSR heuristic, we show that the institutionalization of the organic field beginning in the 1990s and its de facto inclusion in the broader sustainability field beginning in the 2000s contribute to a progressive distancing between the organic movement and its initial political project of alterity, to which public and private actors both contribute actively. As a set of interlinked market institutions, the TSR orients and narrows the scope of debate, which becomes restricted to “market-compatible” dimensions and objects. We conclude that the TSR is a promising heuristic for analyzing contemporary global regulation. (shrink)

Most philosophers in the phenomenological tradition hold that in addition to the explicit self-consciousness we might get in reflection, there is also a pre-reflective self-consciousness. Despite its popularity, it can be a little difficult to get a grasp on this notion. It can seem impossibly thin—such that it really amounts to little more than a restatement of the notion of consciousness—or problematically robust—such that it seems to conflict with the apparent transparency of consciousness. This paper argues for a notion of (...) pre-reflective self consciousness that avoids these extremes. It is argued that though pre-reflective self-consciousness exists and is an important part of conscious ex­perience, it is not an intrinsic feature of first-order consciousness. Instead, it is constituted by an agent’s background awareness of her ability to reflect and thereby self-ascribe her experiences. (shrink)
