Throughout more than two millennia philosophers adhered massively to ideal standards of scientific rationality going back ultimately to Aristotle’s Analytica posteriora . These standards got progressively shaped by and adapted to new scientific needs and tendencies. Nevertheless, a core of conditions capturing the fundamentals of what a proper science should look like remained remarkably constant all along. Call this cluster of conditions the Classical Model of Science . In this paper we will do two things. First of all, we will (...) propose a general and systematized account of the Classical Model of Science. Secondly, we will offer an analysis of the philosophical significance of this model at different historical junctures by giving an overview of the connections it has had with a number of important topics. The latter include the analytic-synthetic distinction, the axiomatic method, the hierarchical order of sciences and the status of logic as a science. Our claim is that particularly fruitful insights are gained by seeing themes such as these against the background of the Classical Model of Science. According to Vallicella's 'Relations, Monism, and the Vindication of Bradley's Regress' (2002), if relations are to relate their relata, some special operator must do the relating. No other options will do. In this paper we reject Vallicella's conclusion by considering an important option that becomes visible only if we hold onto a precise distinction between the following three feature-pairs of relations: internality/externality, universality/particularity, relata-specificity/relata-unspecificity. The conclusion we reach is that if external relations are to relate their relata, they must be (...) relata-specific (and no special operator is needed). As it eschews unmereological complexes, this outcome is of relevance to defenders of the extensionality of composition. (shrink)

In this position paper, we describe a number of methodological and philosophical challenges that arose within our interdisciplinary Digital Humanities project CatVis, which is a collaboration between applied geometric algorithms and visualization researchers, data scientists working at OCLC, and philosophers who have a strong interest in the methodological foundations of visualization research. The challenges we describe concern aspects of one single epistemic need: that of methodologically securing (an increase in) trust in visualizations. We discuss the lack of ground truths in (...) the (digital) humanities and argue that trust in visualizations requires that we evaluate visualizations on the basis of ground truths that humanities scholars themselves create. We further argue that trust in visualizations requires that a visualization provides provable guarantees on the faithfulness of the visual representation and that we must clearly communicate to the users which part of the visualization can be trusted and how much. Finally, we discuss transparency and accessibility in visualization research and provide measures for securing transparency and accessibility. (shrink)

It is a widely held principle that no one is able to do something that would require the past to have been different from how it actually is. This principle of the fixity of the past has been presented in numerous ways, playing a crucial role in arguments for logical and theological fatalism, and for the incompatibility of causal determinism and the ability to do otherwise. I will argue that, assuming bivalence, this principle is in conflict with standard views about (...) knowledge and the semantics for ‘actually’. The aim of this paper is to offer an analysis of the notion of artificial moral agent (AMA) and of its impact on human beings’ self-understanding as moral agents. Firstly, I introduce the topic by presenting what I call the Continuity Approach. Its main claim holds that AMAs and human moral agents exhibit no significant qualitative difference and, therefore, should be considered homogeneous entities. Secondly, I focus on the consequences this approach leads to. In order to do this I take (...) into consideration the work of Bostrom and Dietrich, who have radically assumed this viewpoint and thoroughly explored its implications. Thirdly, I present an alternative approach to AMAs—the Discontinuity Approach—which underscores an essential difference between human moral agents and AMAs by tackling the matter from another angle. In this section I concentrate on the work of Johnson and Bryson and I highlight the link between their claims and Heidegger’s and Jonas’s sug-gestions concerning the relationship between human beings and technological products. In conclusion I argue that, although the Continuity Approach turns out to be a necessary postulate to the machine ethics project, the Discontinuity Approach highlights a relevant distinction between AMAs and human moral agents. On this account, the Discontinuity Approach generates a clearer understanding of what AMAs are, of how we should face the moral issues they pose, and, finally, of the difference that separates machine ethics from moral philosophy. This paper analyzes concepts of independence and assumptions of convexity in the theory of sets of probability distributions. The starting point is Kyburg and Pittarelli’s discussion of “convex Bayesianism” (in particular their proposals concerning E-admissibility, independence, and convexity). The paper offers an organized review of the literature on independence for sets of probability distributions; new results on graphoid properties and on the justification of “strong independence” (using exchangeability) are presented. Finally, the connection between Kyburg and Pittarelli’s results and recent developments (...) on the axiomatization of non-binary preferences, and its impact on “complete” independence, are described. Several theists, including Linda Zagzebski, have claimed that theism is somehow committed to nonvacuism about counterpossibles. Even though Zagzebski herself has rejected vacuism, she has offered an argument in favour of it, which Edward Wierenga has defended as providing strong support for vacuism that is independent of the orthodox semantics for counterfactuals, mainly developed by David Lewis and Robert Stalnaker. In this paper I show that argument to be sound only relative to the orthodox semantics, which entails vacuism, and give (...) an example of a semantics for counterfactuals countenancing impossible worlds for which it fails. In recent times, representation theory has become one of the most productive and interesting sub-fields in democratic theory. Arguably, the most important theoretical innovation are the so-called ‘constructivist’ approaches to political representation. These approaches play a central role in Creating Political Presence: The New Politics of Democratic Representation and The Constructivist Turn in Political Representation, two impressive volumes that take stock of the state of the art in representation theory. I discuss the two volumes by focusing on three broader and (...) interconnected themes: the problem that constructivism is meant to respond to, the tendency of representation theorists to expand the possibilities of representation as broadly as possible, and the normative aspects of political representation and how constructivists deal with them. In this paper we present tableau methods for two-dimensional modal logics. Although models for such logics are well known, proof systems remain rather unexplored as most of their developments have been purely axiomatic. The logics herein considered contain first-order quantifiers with identity, and all the formulas in the language are doubly-indexed in the proof systems, with the upper indices intuitively representing the actual or reference worlds, and the lower indices representing worlds of evaluation—first and second dimensions, respectively. The tableaux modulate (...) over different notions of validity such as local, general, and diagonal, besides being general enough for several two-dimensional logics proposed in the literature. We also motivate the introduction of a new operator into two-dimensional languages and explore some of the philosophical questions raised by it concerning the relations there are between actuality, necessity, and the a priori, that seem to undermine traditional intuitive interpretations of two-dimensional operators. Purpose This study aims to explore whether face recognition technology – as it is intensely used by state and local police departments and law enforcement agencies – is racism free or, on the contrary, is affected by racial biases and/or racist prejudices, thus reinforcing overall racial discrimination. Design/methodology/approach The study investigates the causal pathways through which face recognition technology may reinforce the racial disproportion in enforcement; it also inquires whether it further discriminates black people by making them experience more racial (...) discrimination and self-identify more decisively as black – two conditions that are shown to be harmful in various respects. Findings This study shows that face recognition technology, as it is produced, implemented and used in Western societies, reinforces existing racial disparities in stop, investigation, arrest and incarceration rates because of racist prejudices and even contributes to strengthen the unhealthy effects of racism on historically disadvantaged racial groups, like black people. Practical implications The findings hope to make law enforcement agencies and software companies aware that they must take adequate action against the racially discriminative effects of the use of face recognition technology. Social implications This study highlights that no implementation of an allegedly racism-free biometric technology is safe from the risk of racially discriminating, simply because each implementation leans against our society, which is affected by racism in many persisting ways. Originality/value While the ethical survey of biometric technologies is traditionally framed in the discourse of universal rights, this study explores an issue that has not been deeply scrutinized so far, that is, how face recognition technology differently affects distinct racial groups and how it contributes to racial discrimination. Van Inwagen's General Composition Question (GCQ) asks what conditions on an object and its constituents make the object a whole that these constituents compose, as opposed to an object linked to the constituents by a relation other than composition. The answer is traditionally expected to cite no mereological terms, to hold of metaphysical necessity and to be such that no defeating scenarios can be conceived (e.g., a scenario in which the conditions are met but the constituents fail to genuinely compose (...) the object). While not all writers agree on setting these high expectations on the principles that constitute answers to the GCQ (Hawley 2006), there is a yet unsettled issue concerning the principles’ naturalistic accreditation: Could putative principles be constrained and informed by advanced physical knowledge? Arguing positively, we outline two styles of principles worthy of naturalistic authority. In an explorative spirit, we notice that each style incurs certain costs. First, the principle in question may fail some of the above expectations set in an aprioristic context. Second, it may require a specific meta-theoretic understanding of what it takes to achieve naturalistic accreditation. Finally, it may address the GCQ “piecemeal” and fail to generalize to objects of all physical sorts.1. (shrink)

The aim of the study was to evaluate the effectiveness of a media literacy intervention targeting, for the first time, the specific topic of Performance and Appearance Enhancing Substances use in high-school students. Overall, 389 students aged between 13 and 19 years participated to a media literacy intervention while 103 students aged between 14 and 19 year were considered as the control group. In two separate occasions over the course of six consecutive months, students in both groups filled out a (...) set of questionnaires which included measures of social-cognitive beliefs and a self-reported measure of retrospective use of doping and supplements. Compared to students in the control group = 1.96; SD= 0.85; and Mean= 2.09; SD= 0.94), intervention students on average expressed relatively stronger attitudes against doping use over time = 2.2; SD= 0.85; and Mean= 2.05; SD= 0.82). Students in the latter group also showed a statistically significant decrease in self-reported supplement use = 6.7%; Use= 3.8%;p= 0.05, McNemar Test). Interestingly, albeit marginally significant, students in the control group showed a relative increment in the self-reported use of supplements over time = 4.9%; Use= 8.7%;p= 0.22, McNemar Test). Overall, the media literacy intervention investigated in the present study was effective in decreasing adolescent student’s positive attitudes toward doping use and in reducing the use of legal PAES. These findings supported the generalizability and the usefulness of a media literacy approach in the specific field of PAES. (shrink)

The paper provides a qualified defence of Bruce Waller’s deductivist schema for a priori analogical arguments in ethics and law. One crucial qualification is that the schema represents analogical arguments as complexes composed of one deductive inference but also of one non-deductive subargument. Another important qualification is that the schema is informed by normative assumptions regarding the conditions that an analogical argument must satisfy in order for it to count as an optimal instance of its kind. This paper expands on the theory of event structures put forward in previous work by further investigating the subtle connections between time and events. Specifically, in the first part we generalize the notion of an event structure to that of a refinement structure, where various degrees of temporal granularity are accommodated. In the second part we investigate how these structures can account for the context-dependence of temporal structures in natural language semantics.

In scientific communications, journal articles, and philosophical aesthetic debates the words “art”, “creativity”, and “machine” are put together more and more frequently. Since some machines are designed to, or happens to, imitate human artistic creativity, it seems natural to use the same words to talk about human artists and machines which imitate them. However, the evolution of language in light of technology may conceal specific features of the phenomena it is supposed to describe. This makes it difficult to understand what (...) machine creativity actually is and how it is connected to human creativity. The aim of the paper is to investigate why, and in what sense, the functioning of some machines may be described in terms of artistic creativity and what is the relation between machine creativity and its human archetype. I start (§1) by introducing some general ideas concerning how language evolves alongside new technologies and focusing on the case of machine creativity. In §2 I review how some creative machines have been presented to the public, thus showing that a linguistic habit which connects machines to artistic creativity has already formed. In §3 I survey the debate on machine aesthetics and I highlight the main traits of the issue. In §4 I submit a primary scheme of machine creativity which draws on the concept of functional autonomy. Finally (§5), I argue that machine creativity cannot be mistaken for a substitute of the human kind, despite the fact that the word is the same. Creative machines are technological mediums by which new forms of human aesthetic experience can be explored. The kind of creativity machines enjoy displays a functional nature. (shrink)

In this article, based on a critical metaphor analysis, we identify and describe multimodal metaphors involving the human body and its conceptualizations in five auteur films of the 2010s. Studies on the human body in cinema have documented how it changes according to underlying ideologies. Our research focuses on the role of image schemas and metaphors as they embody meanings and sociocultural paradigms. Metaphors also frame how the body is conceptualized according to dominating ideological practices such as (a) commodification, (b) (...) the integration between artificial and organic, (c) dissatisfaction, (d) dynamics of beautification and idealization, and (e) politicization of the human body. We show how metaphors are creative tools to reframe meanings and representations of the body and how the body is a construct refashioned within the cinematic discourses of these films. (shrink)

Late antique Gnosticism and Heidegger’s Existentialism are usually counted among the main theoretical targets of Hans Jonas’s philosophy of life and responsibility, since they are supposed to share the dualistic and nihilistic attitude the philosopher deemed most mistaken and pernicious. In particular, Gnosticism is commonly understood as the exact opposite of what Jonas strove to accomplish in his work. However, I think it is simplistic to relegate Gnosticism to a merely antagonistic role in the development of Jonas’s philosophy. My claim (...) is that Gnosticism, being a non-nihilistic form of dualism, might have been a relevant source of inspiration – although not the only one – for amending the flaws of Heidegger’s Existentialism. By taking a closer look at the essay Gnosticism, Existentialism, and Nihilism, this article aims to clarify the critical and constructive role that Gnosticism might have played in shaping some of the major traits of Jonas’s thought. The first part of this essay deals with Jonas’s ‘gnostic reading’ of Heidegger’s Existentialism and highlights the positive insights drawn from such interpretative strategy. The second part focuses on three main motives in Jonas’s philosophy that may be traced back to the gnostic narrative: value objectivity and vulnerability, human responsibility and involvement in the history of being, and the sense of belonging to a wider dimension capable of providing orientation and meaning to human life. Richard Feldman’s well-known principle about disagreement and evidence – usually encapsulated in the slogan, ‘evidence of evidence is evidence’, (EEE) – invites the question, what should a rational believer do when faced by such evidence, especially when the disagreement is with an epistemic peer? The question has been the subject of much controversy. However, it has been recently suggested both that the principle is subject to counterexamples and that it is trivial. If either is the case, the question of what (...) to do in the face of evidence of evi- dence becomes less pressing. We contend that even if one or the other of these suggestions is right about (EEE) as a general principle about evidence, they leave it untouched insofar as it plays a role in the debates about the rational way to respond to disagreement and, in particular, to disagreement by an epistemic peer. This is because in such cases the evidence about which one has evidence and which is supposed to provide evidence against one's belief is the mere fact of someone’s disagreeing, rather than something that is related to the content of the proposition about which the parties disagree. We go on to argue that, so understood, the principle is false. (shrink)

This paper explores the Persistence Question about cities, that is, what is necessary and sufficient for two cities existing at different times to be numerically identical. We first show that we can possibly put an end to the existence of a city in a number of ways other than by physically destroying it, which reveals the metaphysics of cities to be partly different from that of ordinary objects. Then we focus in particular on the commonly perceived vulnerability of cities to (...) imaginary relocation; and we make the hypothesis that cities do have among their essential properties that of being surrounded by a specific geographical context. Finally we investigate the pos- sibility that a city can survive relocation in virtue of the capacity of its geographical context to survive it in the first place. We suggest that city contexts may not be essentially context-dependent in turn, and outline a possible description of the cri- teria for their persistence over time. (shrink)

The aim of this paper is to clarify the extent to which relationships between Human Agents (HAs) and Artificial Agents (AAs) can be adequately defined in terms of trust. Since such relationships consist mostly in the allocation of tasks to technological products, particular attention is paid to the notion of delegation. In short, I argue that it would be more accurate to describe direct relationships between HAs and AAs in terms of reliance, rather than in terms of trust. However, as (...) mediums of human actions to which tasks are delegated, AAs indirectly mediate trust between users and other social actors involved in their design, manufacture, commercialisation and deployment. In this sense, AAs mediate social trust. My conclusion is that relationships between HAs and AAs are thus to be understood directly in terms of reliance and indirectly in terms of social trust mediation. (shrink)

In this paper, I argue that the temporal connective prima (‘before’) is a comparative adverb. The argument is based on a number of grammatical facts from Italian, showing that there is an asymmetry between prima and dopo (‘after’). On the ground of their divergent behaviour, I suggest that dopo has a different grammatical status from prima. I propose a semantic treatment for prima that is based on an independently motivated analysis of comparatives which can be traced back to Seuren (in: (...) Kiefer and Ruwet (eds.) Generative grammar in Europe, 1973). Dopo is analyzed instead as an atomic two-place predicate which contributes a binary relation over events to the sentence meaning. The different semantic treatments of the two connectives provide an explanation for the grammatical asymmetries considered at the outset; interestingly, they also shed some light on other asymmetries between prima and dopo, which are known to hold for the English temporal connectives before and after as well: these asymmetries are related to the veridicality properties, the distribution of NPIs, and the logical properties of these connectives first described in Anscombe (Philos Rev 73:3–24, 1964). ArgumentThis article presents ancient documents on the subject of homeomeric lines. On the basis of such documents, the article reconstructs a definition of the notion as well as a proof of the result, which is left unproved in extant sources, that there are only three homeomeric lines: the straight line, the circumference, and the cylindrical helix. A point of particular historiographic interest is that homeomeric lines were the only class of lines defined directly as the extension of a mathematical property, (...) a move that is unparalleled in Greek mathematics. The far-reaching connections between mathematical homeomery and key issues in the ancient cosmological debate are extensively discussed here. An analysis of its relevance as a foundational theme will be presented in a companion paper in a future issue of Science in Context. (shrink)

ABSTRACTThe discursive analysis of criminal organizations’ family dynamics and ideological devices may provide important insights into the inner functioning of these groups. In this article, we describe and analyze a specific set of discursive strategies and the thematic narratives emerging from a TV interview with Giuseppe Riina, a member of Cosa Nostra and the son of one of the most important mafia bosses. Our analyses demonstrate the existence of recurring ideological devices such as reductionism, amoralism, familism, verticalism, normalism, victimism and (...) religious relativism. The results are discussed in light of previous research that examines how discursive strategies and narratives may represent powerful tools for understanding criminal organizations. Family-related discourses, in particular, reveal meanings, values and ideas that contribute to constructing criminal organizations’ internal structure, as well as their relationship with the external world. In our experience, we see more than what we see in a strict sense. We see things as identical through (and despite) multiple spatio‐temporal appearances; we recognize things as something. In this article, I address this issue by asking how temporality allows us to see more in the present than what the present actually contains. I argue that presence and absence are “available,” not just as they are perceived through our senses, but as they are encountered through time, and notably, (...) according to the relations that unify past, present, and future. To support this view, I refer to Heidegger's interpretation of Kant's notion of synthesis. Specifically, I consider Heidegger's reading of the so‐called A‐Deduction, where Kant describes our relation with objects as enabled by three syntheses (i.e., apprehension, reproduction, and recognition). I reconstruct Heidegger's holistic interpretation of the threefold synthesis as an interplay of past, present, and future. I show how in such interplay, temporal dimensions are unified by relations that do not rely on perception; these “time‐relations,” which Heidegger also calls “rules,” allow us to see what we see not just as it is literally perceived, but as part of an “image” of the manifold. In this essay I try to determine the extent to which it is possible to conceive robots and organisms as analogous entities. After a cursory preamble on the long history of epistemological connections between machines and organisms I focus on Norbert Wiener’s cybernetics, where the analogy between modern machines and organisms is introduced most explicitly. The analysis of issues pertaining to the cybernetic interpretation of the analogy serves then as a basis for a critical assessment of its reprise in contemporary (...) robotics and AI, where the line between organisms and technologies gets even more blurred. In brief, I argue for the necessity of defining the extent to which the analogy between robots and organisms applies in order not only to harness its heuristic potential, but also to keep track of the pivotal differences that distinguish the two classes of entities. Finally, I discuss how the ordinary use of language and the peculiar status of the idea of robot obstruct awareness of the differences between robots and organisms. (shrink)

The question on the essence of man and his relationship to nature is certainly one of the most important themes in the philosophy of Hans Jonas. One of the ways by which Jonas approaches the issue consists in a comparison between the contemporary interpretation of man and forms of wisdom such as those conveyed by ancient Greek philosophy and the Jewish tradition. The reconstruction and discussion of these frameworks play a fundamental role in Jonas’s critique of the modern mind. In (...) the first section I introduce the anthropological problem in Hans Jonas’s oeuvre. Moreover, I clarify why it becomes essential for Jonas to resort to different forms of traditional wisdom. In the second and third sections I try to give an account (as complete as possible) of the two generalisations which Jonas shapes in order to criticise the modern concepts of man and nature. In the last section I show how Jonas links these generalisations to his own philosophical assessment of modernity. Finally, I focus on his methodology, which exemplifies how critical thinking may arise from a reconsideration of traditional contents. (shrink)

When investigating the nature of culinary works, it is easy to take for granted that they all share the same ontology. This paper argues that, on the contrary, the ontology of culinary works is really threefold. Some culinary works are edible concrete particulars, or dishes, as many of us may first assume. But others are types, or multiply realisable abstract entities. And, while some of these types are determined by one recipe, others are rather chased after by their indefinitely many (...) recipes. So, there are really three kinds of culinary works; only those belonging to one of the three are edible per se; and, each kind has a very different relationship to recipes. Indeed, it is very doubtful that culinary works consisting in edible concrete particulars are suitable to have one or more recipes: by exploring what are the requirements for being a recipe, the paper also examines under what necessary conditions there is a recipe for preparing a culinary work qua concrete particular. La tecnologia contribuisce da sempre a dare forma al lavoro didattico, il quale evolve anche alla luce delle opportunità e dei rischi che essa introduce. Come far sì che l’evoluzione stimolata dall’IAG sia felice, ovvero serva i valori e gli obiettivi della (...) didattica e delle persone che la vivono? This paper investigates and develops generalizations of two-dimensional modal logics to any finite dimension. These logics are natural extensions of multidimensional systems known from the literature on logics for a priori knowledge. We prove a completeness theorem for propositional n-dimensional modal logics and show them to be decidable by means of a systematic tableau construction.

The purpose of this essay is to attempt an interpretation of Hans Jonas’s philosophical approach to tradition in terms of an exercise in critical thinking. Although several modern authors have seen in tradition a normalizing and conservative force that either constrains the powers of human reason or prevents new disruptive ideas from thriving, other philosophers have contested this accusation and concurred to sketch the general guidelines of a theory of the critical value of tradition. Commenting on both published and unpublished (...) material, I claim that Jonas’s meditation on the history of western culture belongs to this latter stance. Moving from this thesis, I then analyse some passages of Jonas’s oeuvre where his position concerning the critical potential of tradition is theorised or directly put into practice. In particular, I focus on the essay The Practical Uses of Theoryand on an unedited transcription of the 1967 conference Contemporary Problems in Science and Ethics. A Jewish Comment. (shrink)

The aim of this paper is to offer some philosophical remarks concerning the concept of moral application in applied ethics. In doing so, I argue in favour of a philosophical approach towards applied ethics as a unitary form of moral experience. In fact every form of applied ethics, no matter how specific, moves from a problem of application and tries to fill a gap between moral theory and practice. This essential unity of applied ethics as a moral phenomenon is of (...) great philosophical interest, since it belongs to the core problem from which moral thinking itself originates. For this reason, what applied ethics may reveal to a philosophical inquiry could provide valuable insight into the nature of moral experience itself. This is why it is important to reflect on what applied ethics is and whether the way in which application is usually framed be ts the properties of moral experience or not. In the first section I submit some preliminary remarks concerning the theoretical requirements to any philosophical approach to applied ethics. In the second section I present how application is commonly understood in the applied ethics debate by discussing the deductive and the procedural models of application. Both models, however, draw upon a technological conception of application which fails to t the structure of moral experience. Finally, I brie y sketch out the main features and the future tasks of what seems to me to be the most promising approach to the issue, i.e., the hermeneutic concept of application. (shrink)

Il problema della rappresentazione, connaturato ad ogni mediazione linguistica del rapporto di mente e mondo, è nelle sue molteplici forme un tema antico della riflessione filosofica. La rappresentazione letteraria appartiene alla stessa categoria e pone problemi analoghi al pensiero. Che cosa significa rappresentare poeticamente? Il concetto di finzione letteraria può avere solo un senso peggiorativo o limitante nei confronti della comunicazione dell’universale, o ne può essere una modalità? Il tema del saggio è il rapporto tra realtà e finzione letteraria che (...) pare emergere da I falsari di André Gide. Seguendo le intuizioni e i suggerimenti dello scrittore, si proverà a tracciare le linee principali di un’interpretazione positiva della finzione letteraria, che ne riconosca la potenza espressiva senza soffocarne i caratteri distintivi. Non è detto, poi, che ciò che vale per la rappresentazione poetica non possa avere un senso anche sotto punti di vista più generali. (shrink)

The purpose of this paper is to offer some critical remarks on the so-called pragmatist approach to the regulation of robotics. To this end, the article mainly reviews the work of Jack Balkin and Joanna Bryson, who have taken up such ap- proach with interestingly similar outcomes. Moreover, special attention will be paid to the discussion concerning the legal fiction of ‘electronic personality’. This will help shed light on the opposition between essentialist and pragmatist methodologies. After a brief introduction (1.), (...) in 2. I introduce the main points of the methodological debate which opposes pragmatism and essentialism in the regulation of robotics and I examine how legal fictions are framed from a pragmatist, functional perspective. Since this approach entails a neat separation of ontological analysis and legal rea- soning, in 3. I discuss whether considerations on robots’ essence are actually put into brackets when the pragmatist approach is endorsed. Finally, in 4. I address the problem of the social valence of legal fictions in order to suggest a possible limit of the pragmatist approach. My conclusion (5.) is that in the specific case of regulating robotics it may be very difficult to separate ontological considerations from legal reasoning—and vice versa—both on an epistemological and social level. This calls for great caution in the recourse to anthropomorphic legal fictions. (shrink)
