This vital study offers a new interpretation of Hume's famous "Of Miracles," which notoriously argues against the possibility of miracles. By situating Hume's popular argument in the context of the 18th century debate on miracles, Earman shows Hume's argument to be largely unoriginal and chiefly without merit where it is original. Yet Earman constructively conceives how progress can be made on the issues that Hume's essay so provocatively posed about the ability of eyewitness testimony to establish the credibility of marvelous (...) and miraculous events. Potential perspectivism is the view that what an agent ought to do (believe, like, fear, … ) depends primarily on facts that are potentially available to her. I consider a challenge to this view. Potentially accessible facts do not always agglomerate over conjunction. This implies that one can fail to have relevant access to a set of facts as a whole but have access to proper subsets of it, each of which can support different incompatible responses. I argue that potential (...) perspectivism has no unproblematic answer to the question of what the agent ought to do (believe, like, fear, … ) in such circumstances. (shrink)

Excellent performance in sport involves specialized and refined skills within very narrow applications. Choking throws a wrench in the works of finely tuned performances. Functionally, and reduced to its simplest expression, choking is severe underperformance when engaging already mastered skills. Choking is a complex phenomenon with many intersecting facets: its dysfunctions result from the multifaceted interaction of cognitive and psychological processes, neurophysiological mechanisms, and phenomenological dynamics. This article develops a phenomenological model that, complementing empirical and theoretical research, helps understand and (...) redress choking. It aims at describing the experience of choking as experience, and to discuss strategies to palliate or prevent its onset at the pragmatic level at which athletes engage the phenomenon experientially. An overview of current empirical research and theoretical models highlights key ideas and points out contentious issues. The model describes the common structure of the choking experience. It identifies four core constitutive elements: A) disruptive proprioceptive and kinesthetic dynamics, B) a malfunctioning background or Jamesian fringe of consciousness, C) dislocated time dynamics, and D) emotional disturbances. The novelty of the remedy is that it is designed to cross disciplinary boundaries between phenomenology, historiography, and hermeneutics, and moreover connects theory to praxis as it looks at Japanese dō, practices of self-cultivation. It focuses on actual do-or-die situations, not putative ones such as important business deals or competing for a medal. To this effect, it examines medieval Japanese swordsmanship and training manuals and also engages risk sports, where death is indeed a real possibility. The manuals, which arise in the context of choke-inducing life or death duels, and risk sports, afford keen phenomenological observations and practical advice that prove invaluable for today’s sports world and beyond. Advance directives have been hailed for two decades as the best way to safeguard patients’ autonomy when they are totally or partially incompetent. In many national contexts they are written into law and they are mostly associated with end-of-life decisions. Although advocates and critics of ADs exchange relevant empirical and theoretical arguments, the debate is inconclusive. We argue that this is so for good reasons: the ADs’ project is fraught with tensions, and this is the reason why they are both (...) important and deeply problematic. We outline six such tensions, and conclude with some positive suggestions about how to better promote patients’ autonomy in end-of-life decision. We argue that ADs should continue to be an option but they cannot be the panacea that they are expected to be. (shrink)

Moral Failure: On the Impossible Demands of Morality asks what happens when the sense that "I must" collides with the realization that "I can't." Bringing together philosophical and empirical work in moral psychology, Lisa Tessman here examines moral requirements that are non-negotiable and that contravene the principle that "ought implies can.".

The evolutionary argument is an argument against epiphenomenalism, designed to show that some mind-body theory that allows for the efficacy of qualia is true. First developed by Herbert Spencer and William James, the argument has gone through numerous incarnations and it has been criticized in a number of different ways. Yet many have found the criticisms of the argument in the literature unconvincing. Bearing this in mind, I examine two primary issues: first, whether the alleged insights employed in traditional versions (...) of the argument have been correctly and consistently applied, and second, whether the alleged insights can withstand critical scrutiny. With respect to the first issue, I conclude that the proponents of the argument have tended to grossly oversimplify the considerations involved, incorrectly supposing that the evolutionary argument is properly conceived as a non-specific argument for the disjunction of physicalism and interactionist dualism and against epiphenomenalism. With respect to the second issue, I offer a new criticism that decisively refutes all arguments along the lines of the one I present. Finally, I draw positive lessons about the use of empirical considerations in debates over the mind-body problem. (shrink)

Bertrand Russell was, along with G.E. Moore, deserving of accolade as a founder of analytic philosophy, and of its close companion, the linguistic turn. Here I explain how his relocates philosophy's concern with appearance and reality as a concern with grammatical surface and logical depth. I then on remark the irony of Russell's unhappiness with views to the effect that an ethical judgment is not, despite linguistic appearances, really something that can be true or false. A further irony lies in (...) Russell's error of assigning metaphysical grandeur to logical truths, an error he could have avoided by more fully appreciating how logically misleading linguistic appearances can be. (shrink)

In 1991, the Australian Commonwealth Parliament unanimously passed the Council for Aboriginal Reconciliation Act 1991. This Act implemented a 10-year process that aimed to reconcile Indigenous and non-Indigenous people by the end of 2000. One of the highest priorities of the reconciliation process was to address Indigenous socio-economic disadvantage, including health, education and housing. However, despite this prioritising, both the Keating Government (1991–1996) and the Howard Government (1996–2000) failed to substantially improve socio-economic outcomes for Indigenous people over the reconciliation decade. (...) In this paper, I examine one of the most prominent socio-economic areas, that of Indigenous health. First, I discuss the appalling levels of Indigenous health throughout the reconciliation decade by analysing a number of health indicators, including life expectancy, infant mortality rate, standard mortality ratios, hospital rates and health Infrastructure. This analysis reveals significant and often worsening disadvantage in these health indicators. Second, I analyse a number of policies and programs concerning Indigenous socio-economic disadvantage that were developed by Commonwealth Governments in the 1990s. I argue that these policies and programs largely failed to address Indigenous socio-economic disadvantage. I also discuss alternative policies and programs that could reduce the significant levels of socio-economic disadvantage suffered by Indigenous people. (shrink)

No que diz respeito ao Lago Gato Selvagem, é mais interessante tratar como Xiang’er se torna lésbica, que não se refere apenas sobre sexo ou gênero, mas também sobre opressão política e econômica; assim, o chamado gênero, entendido utopicamente, poderá ser identificado. Além disso, (...) a perda da subjetividade rural durante a ampliação e a transformação posterior, a nova opressão e a exploração resultantes são as razões fundamentais para Xiang’er se tornar lésbica e eventualmente “matar seu marido”. When it comes to empty names, we seem to have reached very little consensus. Still, we all seem to agree, first, that our semantics should assign truth to negative singular existence statements in which an empty name occurs and, second, that names are used in such statements. The purpose of this paper is to show that ruling out that the names are mentioned is harder than it has been thought. I will present a new metalinguistic account for negative singular existence (...) statements in which an empty name occurs, and I will show that the account can deal both with the objections to the traditional metalinguistic account and with other objections that seem to target my new proposal. The ‘doctrine of double effect’ claims that it is in some sense morally less problematic to bring about a negatively evaluated state of affairs as a ‘side effect’ of one’s pursuit of another, morally unobjectionable aim than it is to bring it about in order to achieve that aim. In a first step, this chapter discusses the descriptive difference on which the claim is built. That difference is shown to derive from the attitudinal distinction between intention and ‘acceptance’, a distinction (...) that is in turn claimed to ground in a feature of the decisions that generate the attitudes in question. The resulting analysis is then plugged into two different normative principles that may each be thought to specify the intuitions behind the doctrine of double effect, but which have frequently been conflated. The first concerns the permissibility of bringing about the merely accepted state of affairs, the second its reduced attributability. It is argued that examination of the intuitions behind the two principles supports neither version of the doctrine. Rather, the intuitions are best captured in an attribution principle based on subjective probabilities and a principle of attitude evaluation, neither of which make explicit reference to the attitude of intending. A probabilistic logic of induction is unable to separate cleanly neutral support from disfavoring evidence (or ignorance from disbelief). Thus, the use of probabilistic representations may introduce spurious results stemming from its expressive inadequacy. That such spurious results arise in the Bayesian “doomsday argument” is shown by a reanalysis that employs fragments of an inductive logic able to represent evidential neutrality. Further, the improper introduction of inductive probabilities is illustrated with the “self-sampling assumption.”.
