Should refugees receive political rights in liberal democracies? I argue that they should. Refugees are special – at least when it comes to claims towards democratic inclusion. They lack exit options and are significantly impacted by decisions made in liberal democracies. Enfranchisement is a matter of urgency to them and should occur on a national level. But what justifies the democratic inclusion of refugees? I draw on the all-subjected principle in arguing that all those subjected to rule in a political (...) unit should have a say in such rule. I show that refugees cannot be denied democratic inclusion based on the argument that transients should be excluded from participation. Refugees are not transients. Finally, I show that naturalization is not a prerequisite for enfranchisement. Political rights and citizenship can be had independently of each other. Refugees, then, should be nationally enfranchised as soon as they receive refugee status. (shrink)

Studies on students' perception of corporate social responsibility (CSR) have been growing in western scholarship. For students in African countries, such as Nigeria, there is little that is known about how and whether gender, level of study, and being enrolled in business education courses impact their perception of and disposition towards CSR. This study explores the significance of gender, academic status or level of study, and exposure to business ethics education (BEE) on Nigerian students' perception of CSR as a veritable (...) business ethic. Specifically, the effects of these factors on students' perception of CSR are examined using analysis of variance. The results show a significant effect of exposure to BEE and gender on CSR‐sensitivity, and a mild, but significant effect of academic status. This implies that male students and female students had different perspectives on CSR issues. Students who took ethics courses and those who did not would run businesses differently. However, age and experience on campus did not influence students' perception or position on CSR. The study recommends that more behavioral models be estimated with the inclusion of more demographic and socioeconomic variables to elicit more robust results. (shrink)

Should refugees govern refugee camps? This paper argues that they should. It draws on normative political thought in consulting the all-subjected principle and an instrumental defense of democratic rule. The former holds that all those subjected to rule in a political unit should have a say in such rule. Through analyzing the conditions that pertain in refugee camps, the paper demonstrates that the all-subjected principle applies there, too. Refugee camps have developed as near distinct entities from their host states. They (...) have formed their own economic, legal and even political systems within which refugees are subjected to political rule. The paper then demonstrates that democratic rule should be preferred over any other decision-making procedure. No amount of experts can replace the institutions that would lead to the accountability of decision-makers and to the incorporation of refugees as situated and epistemically diverse knowers of the problems they face and the solutions that would work best. In the era of consumer distrust of corporations, transparency is becoming a must rather than an option. While prior research has explored why businesses should disclose their costs and how consumers may react to such cost transparency, it is still unclear how marketers can best communicate cost transparency. The present research offers a practical examination of how and when cost transparency is effective, specifically, by examining the moderating role of authentic and hubristic pride on the effectiveness of cost transparency. Across (...) two experimental studies, the effectiveness of cost transparency is leveraged using authentic pride, whereas hubristic pride decreases it. Further, we empirically demonstrate the mediating role of moral elevation. Overall, the results demonstrate that marketing messages that elicit authentic pride can increase the effectiveness of cost transparency. Hence, the current research highlights how marketers and brands can effectively combine specific emotional appeals with cost transparency to obtain favorable consumer evaluations. (shrink)

Neither the hype exemplified in some exaggerated claims about deep neural networks (DNNs), nor the gloom expressed by Bowers et al. do DNNs as models in vision science justice: DNNs rapidly evolve, and today's limitations are often tomorrow's successes. In addition, providing explanations as well as prediction and image-computability are model desiderata; one should not be favoured at the expense of the other.

One of the main topics of the völkisch racial scientist Ludwig Ferdinand Clauß was the racial cartography of the Orient. Based on older discussions in anti-Semitic literature, Clauß constructed a racially divided – double – Orient and made a sharp distinction between Arabs and Jews. His depiction largely follows patterns of ascription from Orientalist as well as anti-Semitic discourses. By doing so he draws attention to structural overlaps and differences between Orientalism and anti-Semitism: a romanticized Arabic Orient served as an (...) antipole to a “Nordic” Europe, and as such was finally able to advance to a positive alternative. The Jewish Orient, on the other hand, embodied for Clauß a threatening ambivalence and contrariety, which from the very beginning precluded romanticization and identification. (shrink)

Team reflexivity has gained increasing research attention as an effective response to the core challenge of constant learning, innovation, and adaptation in teams due to changing circumstances. Under the right conditions, empirical studies have found that team reflexivity can improve team performance, team learning, team innovation, team creativity, and team member well-being. Thus, research shows that team reflexivity is an effective means to improve teamwork and team outcomes. This book addresses the problem that team reflexivity research is focused too narrowly (...) on improving these empirical team outcomes while neglecting the importance of normative principles and values in good teamwork, such as the do no harm principle. Therefore, this book proposes that the team reflexivity concept needs broader reframing and deeper reflection to realize normative principles and values in teams as a precondition for good teamwork, e.g., do no harm. It further presents two team reflexivity tools and applies them in the cases of burnout prevention and speaking up freely in teams to illustrate the point of this book: Do no harm in teams requires team reflexivity, and vice versa, team reflexivity requires do no harm. This paper explores whether human proactivity can be considered an expression of free will. The discussion involves two paradigms, which are mutually complementary and encompass psychological proactivity and reactivity. Both paradigms raise the question of linear and non-linear determinism, which inevitably leads to the issue of free will. The analysis attempts to find a compromise between linear and non-linear determinism through the approach of human dialectical complexity (Lebed & Bar-Eli, 2013). This refers to the relationships of two types of complex (...) subsystems within a human: the perceptual-motor dynamic system (PMDS), which is mostly determined by linear impacts and expressed through reactive behavior, and the “free-will”Footnote1 complex system (FCS), which is mostly determined by non-linear redundant determinism and expressed through proactive dynamics. In summary, it is concluded that there cannot be a categorical assertion of the permanent existence of free will in human functioning. The human dialectical complexity expressed by both proactivity and reactivity causes the “floating” presence of free will depending on the prevalence of proactive control factors and the non-linear determination of a living human system. Charles Parsons’ book “Mathematical Thought and Its Objects” of 2008 (Cambridge University Press, New York) is critically discussed by concentrating on one of Parsons’ main themes: the role of intuition in our understanding of arithmetic (“intuition” in the specific sense of Kant and Hilbert). Parsons argues for a version of structuralism which is restricted by the condition that some paradigmatic structure should be presented that makes clear the actual existence of structures of the necessary sort. Parsons’ paradigmatic structure is the (...) so-called ‘intuitive model’ of arithmetic realized by Hilbert’s strings of strokes. This paper argues that Hilbert’s strings, considered as given in intuition, cannot play the role Parsons assigns to them: the criteria of identity of these strings do not have the sharpness that Parsons wants to see in them, and Parsons inadvertently projects abstract structures into his ‘intuitive model’. This diagnosis is exemplified with respect to (a) Parsons’ distinction between addition and multiplication on the one hand and exponentiation on the other and (b) his analysis of arithmetical knowledge in simple cases like “7 + 5 = 12”. All in all, it is claimed that Parsons book contains many important insights with respect to, for example, different versions structuralism, the notion of “natural number” and its uniqueness, induction, predicativity and other things, for which he is rightly famous, but that his way of drawing on the notion of intuition leaves too many questions unanswered. An increasing number of genetic tests are available as an early spin-off from human genetic research. Beyond their application in the context of medical diagnosis there are other possible domains of use: e.g. in the testing of individuals asking for life or health insurance. It is claimed that individuals with an increased genetic risk might have to pay higher premiums or, worse, might be unable to obtain insurance coverage at all. The main question discussed in this paper will be whether (...) there is a right to health and/or life insurance coverage without prior genetic testing. The legal regulations of the use of genetic tests in the insurance system are various. While some countries in principle permit the use of (some) genetic tests for the calculation of actuarial risks, others banned genetic tests for non-medical uses; still other countries have not made any explicit provisions up to now. In the face of the attempted harmonisation of legal systems, as well as an increasing commercialisation of the international market for genetic tests, which neglects national borders, providing criteria for a moral evaluation of this issue appears to be a timely and urgent task. The view defended in this paper is that a right to health insurance without genetic testing is legitimised, insofar as health insurance belongs to the provision of elementary requirements, and insofar as the latter is everybody's moral right. On the other hand, it is implausible to postulate a right to life insurance without genetic testing – as long as life insurance is understood to be a part of one's provision of supplementary requirements. Este artículo plantea la necesidad de revisar la noción de ética judicial en el sentido de que, mientras la ética en general tiene una raíz eminentemente filosófica, en la actualidad parece como si se pretendiera minimizar tal influencia con el fin de dotar a las denominadas éticas aplicadas de mayor rigor y pragmatismo al ser explicadas por quienes tienen la responsabilidad de aplicarla. Se parte de una reflexión en torno al lugar de la ética dentro de la ética judicial. Para (...) ello, se analiza un caso concreto de faltas graves a la ética judicial en Colombia, lo que demuestra que, más allá de la retórica formativa en torno a la ética judicial, cumplirla implica una perspectiva desde la objetividad epistémica. Se concluye que las consideraciones formativas y funcionales en torno a la ética judicial deben comprometer su abordaje más allá de las generalidades en que suele caer tal discusión. (shrink)

Este artículo reconstruye y problematiza el debate sobre la relación entre humanitarismo y uso de la fuerza. Para ello analiza los giros históricos en la familia humanitaria y la consolidación del nuevo humanitarismo político. A continuación, se revisa la convergencia entre las agendas del nuevo humanitarismo y el proyecto de un orden internacional liberal intervencionista en cuyo núcleo se sitúa un discurso transformador, maximalista y utópico de los derechos humanos. Luego, se recogen algunas perspectivas críticas de ese humanismo militar de (...) la posguerra fría, prestando especial atención a los estudios críticos del humanitarismo y a los análisis pospositivistas de la política internacional. Finalmente, se presentan algunos argumentos en favor de quienes consideran que el humanitarismo debe recuperar el mayor grado de neutralidad e independencia posible, alejándose del intervencionismo militar y de los proyectos de transformación a gran escala del sistema internacional. El texto plantea una revisión crítica de la literatura especializada sobre el humanitarismo contemporáneo, cuya naturaleza es esencialmente interdisciplinar, combinando los fundamentos teóricos y metodológicos provenientes de la antropología, el derecho, la filosofía, las relaciones internacionales, y las reflexiones provenientes de los trabajadores humanitarios sobre el terreno. The threat of terrorism once again raises some of the classic questions about constitutionalism: is it possible for constitutions to do what they aim to do—channel and control political power in such a way as to make it safe and beneficent for those under its rule but also competent to govern? Does not terrorism reraise the Schmittian problem of “the exception”, i.e., the situation of emergency that necessarily escapes all constitutional limitations? Although they did not face the problem of terrorism (...) as we know it, the American founders developed three different models of constitutionalism, embodying three different ways of responding to emergent circumstances and yet remaining bound to the constitutionalist aspiration. We develop the main outlines of the three models both conceptually and historically and show how they continue to be relevant to current discussions of constitutionalism in the age of terror. Finally, we make a tentative effort to judge which of the three models is most able to do what constitutions should do in difficult times. (shrink)
