Clinical fields of the “sciences of the mind” (psychotherapy, psychiatry, etc.) lack integrative conceptual frameworks that have explanatory power. Mainly descriptive-classificatory taxonomies like DSM dominate the field. New taxonomies such as Research Domain Criteria (RDoC) aim to collect scientific knowledge regarding “systems” for “processes” of the brain. These terms have a supradisciplinary” meaning if they are considered in context of Systems Science. This field emerges as a platform of theories like general systems theory, catastrophe theory, synergetics, chaos theory, etc. It (...) provides a lot of abstract concepts, constructs, methods and models. We assume that these tools also enable theoretical integration in the diversified field of clinical practice in the sciences of the mind. Additionally, systems thinking in clinical psychology improves conceptual links to currently network-oriented neurobiology. However, clear definitions of systemic terms are necessary to emerge from their mainly metaphorical use. Here we revise mainly terms like “structure”, “process” and “dynamics” as they are used already in psychology, psychoanalysis, psychopathology and psychiatry in an ill-defined way. For instance, affective-cognitive structures like “life space” or “object representations” can be seen as products of mental processing. These structures, in turn, modulate dynamics of mental processes. Additionally, we suggest a coupled network concept of emotions and motivations as the main subsystem that modulates mental dynamics that results in a qualitative systemic model of the mind. Under which conditions are we epistemically justied to believe that what other people tell us is true? Traditionally, the answer has either been reductionist or anti-reductionist: Either our justication reduces to non-testimonial reasons, or we have a presumptive, though defeasible, right to believe what we are told. However, different cases pull in different directions. Intuitively, someone asking for the time is subject to different epistemic standards than a surgeon consulting a colleague before a dangerous operation. Following this line of thought, (...) this paper develops an account of testimonial justication that captures our reductionist as well as our anti-reductionist intuitions. It is argued that the speaker’s commitment to an epistemic norm, as well as the hearer’s understanding of that norm, gives the hearer a presumptive right to believe what she is told. However, this justication doesn’t apply to situations with high practical risks. The threat of terrorism once again raises some of the classic questions about constitutionalism: is it possible for constitutions to do what they aim to do—channel and control political power in such a way as to make it safe and beneficent for those under its rule but also competent to govern? Does not terrorism reraise the Schmittian problem of “the exception”, i.e., the situation of emergency that necessarily escapes all constitutional limitations? Although they did not face the problem of terrorism (...) as we know it, the American founders developed three different models of constitutionalism, embodying three different ways of responding to emergent circumstances and yet remaining bound to the constitutionalist aspiration. We develop the main outlines of the three models both conceptually and historically and show how they continue to be relevant to current discussions of constitutionalism in the age of terror. El presente artículo pretende acercarse a la propuesta de una concepción republicana de la ética empresarial realizada por la Escuela de Erlangen que se ha convertido en una referencia ineludible a nivel europeo. Esta propuesta, fundamentada en el constructivismo de la Escuela de Erlangen y la ética del discurso de la Escuela de Frankfurt, empezó a fraguarse a finales de los años ochenta en Alemania y define a la empresa como una institución con responsabilidades y deberes públicos. The main purpose of this paper is to present the proposals of the Erlangen School for a republican conception of business ethics, which has become a key reference in the European context. Republican business ethics, based on the constructivism of the Erlangen School and the discourse ethics of the Frankfurt School, began to take shape at the end of the eighties in Germany and defines the company as "an institution with public responsibilities and duties". Throughout this article I will attempt to present a solid and coherent conception of business ethics, from both the theoretical and the practical points of view. What exactly do we need to do in order to make a promise, or to exercise some other normative power? On a view relied on by many philosophers writing on promising, consent, and related phenomena, the answer is that we must communicate a suitable kind of intention. On this view, power-conferring principles assert that specific normative consequences, determined in part by the content of the communicated intention, attach to such communicative acts, and these principles need not be socially practised or (...) accepted to be true. The paper offers a defense of this convention-independent view against the forceful challenge developed by Jed Lewinsohn in ‘The “Natural Unintelligibility” of Normative Powers’. Lewinsohn appeals to action-theoretic considerations to show that the relevant type of communicative act could not be performed under conditions of rationality and full information, and that therefore promissory power and other normative powers require the existence of social rules conferring such powers. The defense of the view targeted by Lewinsohn turns partly on the exact content of plausible constraints on the intelligibility of actions done with a particular aim, and partly on the question just how the social acceptance of power-conferring rules should be thought to matter. The official and politically correct language of the educational world consistently insists on the importance of learning to think during the period of formal and compulsory education. Returning to a basic principle of political life, possibly as old as mankind but more clearly declared in forms of democratic organization, we cannot understand a democracy without the existence of an educated and informed citizenry, able to think for itself in confrontation with options and world conceptions different from its own. Intelligence - (...) understood as the ability of people to develop abstract thinking and reasoning, to understand complex ideas, solve problems and overcome obstacles, learn from experience and adapt to the environment - is the most valuable attribute that we have. Reasoning well, therefore, is essential to all human beings, both in relation to their personal lives and in the relations we have living in society. Despite this, there are several mistakes that we make when thinking, when we make decisions or solve problems, both in our everyday lives and in decisions about social and political issues of a general nature. So it is necessary to improve our ability to reason in general, with emphasis on formal and informal reasoning. This improvement is a fundamental goal of education, although in practice it has not received enough attention. In order to achieve this, the implementation of programs of learning to think are required, including the Philosophy for Children program, which involves one of the most solid and consistent proposals on this subject. The program uses the Western philosophical tradition, focusing on the quality of the arguments during discussions of the classical themes of philosophy, all considered within the framework of the school converted into a community of inquiry. Public trust is paramount for the well functioning of data driven healthcare activities such as digital health interventions, contact tracing or the build-up of electronic health records. As the use of personal data is the common denominator for these healthcare activities, healthcare actors have an interest to ensure privacy and anonymity of the personal data they depend on. Maintaining privacy and anonymity of personal data contribute to the trustworthiness of these healthcare activities and are associated with the public willingness to (...) trust these activities with their personal data. An analysis of online news readership comments about the failed care.data programme in England revealed that parts of the public have a false understanding of anonymity in the context of privacy protection of personal data as used for healthcare management and medical research. Some of those commenting demanded complete anonymity of their data to be willing to trust the process of data collection and analysis. As this demand is impossible to fulfil and trust is built on a false understanding of anonymity, the inability to meet this demand risks undermining public trust. Since public concerns about anonymity and privacy of personal data appear to be increasing, a large-scale information campaign about the limits and possibilities of anonymity with respect to the various uses of personal health data is urgently needed to help the public to make better informed choices about providing personal data. The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading. In moral and political philosophy, collective obligations are promising “gap-stoppers” when we find that we need to assert some obligation, but can not plausibly ascribe this obligation to individual agents. Most notably, Bill Wringe and Jesse Tomalty discuss whether the obligations that correspond to socio-economic human rights are held by states or even by humankind at large. The present paper aims to provide a missing piece for these discussions, namely an account of the conditions under which obligations can apply to (...) loose collections of agents that do not qualify as collective agents in their own right. I first explain the notion of joint obligations of loose collections of agents as opposed to collective obligations of collections of agents that are collective agents in their own right, and argue that the conditions under which agents can jointly have obligations are the conditions under which they are jointly able to do what is required. I then build on Virginia Held’s seminal work on the moral responsibility of “random collections” to develop such conditions for joint ability. My discussion shows that collections of individuals can more easily be subject to moral obligations than previously assumed. It also shows that putative joint obligations need to be carefully time-indexed, and that it is largely an empirical question whether a given collection can be subject to a moral obligation to perform a given joint action at a particular time. Many philosophers, following Williamson (The Philosophical Review 105(4): 489–523, 1996), Williamson (Knowledge and its Limits, Oxford, Oxford Univer- sity Press, 2000), subscribe to the constitutive rule account of assertion (CRAA). They hold that the activity of asserting is constituted by a single constitutive rule of assertion. However, in recent work, Maitra (in: Brown & Cappelen (ed). Assertion: new philosophical essays, Oxford, Oxford University Press, 2011), Johnson (Acta Analytica 33(1): 51–67, 2018), and Kelp and Simion (Synthese 197(1): 125–137, 2020a), Kelp and (...) Simion (in: Goldberg (ed) The Oxford Handbook of Assertion, Oxford, Oxford University Press, 2020b) aim to show that, for all the most popular versions of the constitutive rule of assertion proposed in the literature, asserting is not an activity constituted by a single constitutive rule and that therefore CRAA is very likely false. To reach this conclusion, they all present a version of what can be dubbed the engagement condition objection. That is, they each propose a necessary condition on engaging in rule-constituted activities. Then they argue that, for all the most popular versions of the constitutive rule of assertion proposed in the literature, one can make assertions without satisfying this condition. In response, I present a counterexample that shows that the proposed engagement conditions lead to coun- terintuitive results, and I propose an alternative that better captures our intuitions. Then I argue that this alternative engagement condition is compatible with all the most popular versions of the constitutive rule of assertion. (shrink)

Since the outbreak of the war in the Ukraine, realism has made a comeback in public discourses but it is not clear what realism actually means as it seems to stand for everything: from supporting the Ukraine against Russian aggression to the war is the West’s fault. This is the result of decades of not distinguishing between neorealism and classical realism and implicitly acknowledging neorealist storytelling of having systematized classical realist thought. The present paper is a further intervention to carefully (...) distinguish between both theoretical perspectives to uncover what they can add to current world political problems. It finishes by asking if neorealist scholars like John Mearsheimer have a point that it is the West’s fault and a diplomatic solution needs to be found. They often refer to Hans Morgenthau not least because he was one of the most outspoken critics of the Vietnam War. (shrink)
