The value that bioethics has added to the discourse between science and the humanities is indispensable. However, there is a need that when bioethics is taught that the focus be not solely on the identification and analysis of the problem, but also on critical reflection to enable a student to internalize that which they have experienced. This article provides an analytical description of the use of learning logs as a tool of reflection and metacognition in bioethics courses, based on the (...) experience of educators at the Faculty of Sciences of the Universidad de la República (Uruguay). An analysis of students’ learning logs shows that this tool promotes complex reflective and self-reflective processes in which the development of skills such as abstraction, argumentation and problematization is manifested in an integrated way. Like previous theorists of natural law, Kant believes in the possibility of a rational theory of ius, but also claims that the very concept of ius naturae and the method of investigation of its principles must be thoroughly reformulated. I will maintain that Kant solves the methodological problem of natural law theories by stating that a rational doctrine of Right concerns pure rational knowledge. Right must be conceived as a metaphysical doctrine in which its principles and laws are determined a (...) priori. By conceiving the idea of a “metaphysics of morals” and linking Right with it, he finds a way both to conserve the notion of ius naturae ) and to purify it from any empirical or anthropological element. La presente investigación parte del marco lógico y teórico del desarrollo de competenciasy el pensamiento complejo en el sistema universitario mundial, en ese sentido la investigacióntuvo como objetivo demostrar los efectos de la aplicación de las estrategias didácticas para eldesarrollo de competencias y pensamiento complejo en la carrera de Ingeniería de Sistemas en unauniversidad pública de Lima provincias. La investigación fue de tipo aplicada, nivel explicativo, setrabajó con un diseño pre experimental. La población la conformaron por 325 estudiantes de lacarrera (...) profesional de Ingeniería de Sistemas, y la muestra fue tomada no probabilísticamente por23 estudiantes del X ciclo. El nivel de desarrollo de competencias fue porcentualmente del 74% ydel pensamiento complejo el 64,25%. Se concluye en base a las tres estrategias didácticas utilizadas(estrategia basada en problemas, estrategias de aprendizaje colaborativo, y la estrategia incorporadade las tecnologías de información y comunicación) con un nivel de significancia del 5% y un(p-valor: 0,006<0,050) que se ha desarrollado favorablemente las competencias y el pensamientocomplejo en los estudiantes de la Carrera Profesional de Ingeniería de Sistemas en la UniversidadNacional de Cañete-Lima, Perú. The empirical circumstances in which human beings ascribe responsibility to one another are subject to change. Science and technology play a great part in this transformation process. Therefore, it is important for us to rethink the idea, the role and the normative standards behind responsibility in a world that is constantly changing under the influence of scientific and technological progress. This volume is a contribution to that joint societal effort.

This paper aims to render some aspects of the feeling of being alive more clearly comprehensible. My emphasis on the phenomenal quality of consciousness stems from the “embodied” approach to consciousness, according to which consciousness, since it is considered a phenomenon of life, includes both intentional and motivational aspects. In this view, its phenomenal quality is an inherent property of the embodied self, which relates both to the external world and to itself. The feeling of being alive is not neutral; (...) rather its hedonic character provides orientation in life. Whenever one is living through experience, one has a basis for carrying out one’s own life in the world, biologically, psychologically and ethically. The reflections in this paper follow a systematic approach often combined with a roughly historical perspective. (shrink)

Moral issues arise not only when neural technology directly influences and affects people’s lives, but also when the impact of its interventions indirectly conceptualizes the mind in new, and unexpected ways. It is the case that theories of consciousness, theories of subjectivity, and third person perspective on the brain provide rival perspectives addressing the mind. Through a review of these three main approaches to the mind, and particularly as applied to an “extended mind”, the paper identifies a major area of (...) transformation in philosophy of action, which is understood in terms of additional epistemic devices—including a legal perspective of regulating the human–machine interaction and a personality theory of the symbiotic connection between human and machine. I argue this is a new area of concern within philosophy, which will be characterized in terms of self-objectification, which becomes “alienation” following Ernst Kapp’s philosophy of technology. This article examines Kant’s theory of property through a comparative analysis of Gottfried Achenwall’s justification of ownership rights. I argue that at the core of Achenwall’s and Kant’s understanding of ownership rights lies the idea that rights are to be acquired through a juridical act (factum iuridicum, rechtlichen Act) of the will. However, while Achenwall thinks of this act as emerging from a private will, Kant holds that rights and obligations can only be brought about by an act of the (...) general will. By contrasting these two views, I aim to illuminate one of the main features of Kant’s theory of property, namely, that ownership rights are only possible in a rightfully constituted state. I conclude with a suggestion regarding Kant’s view of the notion of ‘provisional’ possession in the state of nature. (shrink)

Se propone que el análisis de “lo mío y tuyo exterior”, que tiene lugar en la sección en cuestión, tiene la función de mostrar que existe un tipo de derecho subjetivo vinculado con la posesión de objetos externos al arbitrio: los derechos adquiridos. I argue that by considering Kant’s engagement with previous theorists of natural right, we can gain a clearer understanding of how he transformed the discipline from its foundations. To do this, I focus my analysis on Kant’s (critical) reception of two models of natural right with which he was very familiar: one from Alexander Baumgarten’s Elements of First Practical Philosophy [Initia philosophiae practicae primae], the other from Gottfried Achenwall’s Natural Law [Ius naturae]. The Initia served as a basis for Kant’s (...) lectures on moral philosophy for over three decades and may thus be considered as having played an important role in shaping his practical philosophy as a whole. Achenwall’s Ius naturae was the textbook that Kant employed in his lectures on natural right for over two decades. I argue that Kant distances himself from previous models of natural right in three main regards: the identification of moral laws with laws of nature, the normative connection between the principles of right and a natural end, and the place of God as the author of moral laws. I then briefly discuss what Kant retains of Baumgarten’s and Achenwall’s models of natural right. Kant’s Metaphysics of Morals preserves the view that a rational doctrine of right belongs to a broader systematic doctrine that comprehends the entire system of duties. I address the question of the division of the Sittenlehre into two branches and claim that, whereas Kant did not consider Baumgarten’s answer to the problem of distinguishing juridical from ethical principles to be satisfactory, he found a key piece of his own resolution in Achenwall’s Ius naturae, namely the definition of right as a power to coerce. In the 17th and 18th centuries, the doctrine of just war was one of the most popular theories in international law. According to this doctrine, the right to war is an integral part of natural law and, under specific circumstances, morally justified. To my mind, Kant was a fervent critic of the theory of just war. He critically reformulates the rational and normative principles of right in a way that leaves no place for war as a legitimate procedure to resolve (...) a conflict between states. In section, I shall analyze the fundamental principles of ius gentium, in particular, the duty to leave the state of nature at the international level and the juridical form that the association between states must adopt. The exit of the state of nature between nations must generate an international legal framework that not only protects human rights but also safeguards the sovereignty of the peoples. In section, I shall examine Kant’s critique of the doctrine of just war in Zum ewigen Frieden and in the Rechtslehre, exploring why the idea of an ius ad bellum is incompatible with the critical reformulation of the right of nations proposed there. In the contemporary debate about values, information technology constitutes an important source of hard ethical questions and in turn is a testing area for the moral theory of values. Values are difficult to track down and yet there are a number of inquiries starting from economics, social psychology, ethics, and political theory that engage with the cognitive, epistemic, and moral status of values. This paper is a contribution to an account of values in connection with information technology. It argues that (...) information technology may provide further support to a theory of values that is able to embrace the transformative effects of the digital revolution. In particular, it is plausible that a non-ideal reflection on digital wrongdoings is better equipped to produce substantive knowledge about values that have been undermined than a different approach focused on ideal guiding values. Moreover, information technology overcomes the vaunted fact/value dichotomy and supports the fact/value entanglement. As the principal concern of data-mining and machine-learning communities are ways of remedying a remarkable number of biases and conformism in techno-social systems, it is within the bounds of possibility to supplement the non-ideal theory from this new practical angle. I therefore call for a fully conceptual consideration of values drawing on the experience and reflection that is growing in the field of information technology. (shrink)

In this paper I examine the relationship between the principle of right and the principle of morals [Sitten] in Kant’s Metaphysics of Morals. My interpretation denies that the principle of right is derived from the categorical imperative, but neither does it adhere to the independence thesis. I present a third way of understanding the relationship between the law of right and the universal law of morals: the latter is needed in order to formulate the former, but it is not sufficient. (...) The principle of right is obtained by applying the categorical imperative to the concept of right. I highlight the discussion on the subject within the late eighteenth-century German natural law tradition and similar arguments found in Achenwall. (shrink)

Se trata de una lectura exploratoria que reúne herramientas analíticas que provienen del giro afectivo de los estudios feministas. Quality of democratic arrangements does matter. This kind of conceptual breakthrough has been made through painfully engagement with the nonphilosophical area of inquiry arisen by the COVID-19 pandemic. The pandemic has dramatically emphasized that health is a highly political domain. No surprise then that it made possible to challenge common thought about democratic procedures in political theory that considers procedure-independent standards suspicious. Therefore it is fair to state that the COVID-19 pandemic has taken the quality of democratic outcomes back on (...) center stage in the debate in political theory, which has been dominated by fair proceduralism’s claim not to refer to any procedure-independent standards of good political decisions. Procedural values have traditionally been seen as a defining element of fair deliberation and essential for democracy. They have been extolled in social choice theory that claims that democracy does not exhibit any particular disposition to lead to good or just political arrangements. They are the focus of attention in Jürgen Habermas’ procedural rationality, though philosophers are now more skeptical about the divorce between procedures and substantive standards. Overall, issues surrounding the topic of ensuring citizens’ health make the topic politically central and philosophically interesting for epistemic theories and impartial proceduralism theories of democracy alike. The aim of this paper is to justify the legitimacy and authority of public health policies on the basis of arguments that do not simply are a matter of their being democratic. In the first part, I want to display and criticize the idea that proceduralism’s not getting one’s hands dirty with the substance of decisions and remaining neutrally adherent only to procedures is untenable in the present case. Having criticized democratic theories that want to restrict themselves to purely procedural values, in the second part I will focus on the idea of knowledge and make explicit its characters of being practical and shared. Eventually, it will help to have one example. M-Health will show that many valuable insights would be incompatible with the restrictions of the proceduralism. Philosophical consideration of health will combine epistemic issues with political ones triggered by technology and sharpened by the COVID-19 pandemic. (shrink)

Autocracies draw their political power from cronyism and organized repression. The opacity of business information protects these regimes and their crony firms from any opposition. However, autocracies might also desire to eliminate cronyism because it dampens economic growth. Autocracies survive through repression that engenders tensions, as evident in the Spanish newspaper industry during the Francoist dictatorship. State control over this industry was important because the press disseminated news to the public. From 1939 to 1957, the autocracy institutionalized both cronyism and (...) the opacity of circulation figures to sustain the political powers of Franco and the single party state. Opacity concealed the economic performance of newspapers owned by sole legal party and any distribution of resources in its favor. Franco authorized voluntary disclosure of reliable circulation figures in 1964, after eliminating cronyism in favor of a freer market. Repression guaranteed support for this industry until Franco's death. (shrink)

Este trabajo indaga en algunas discusiones alrededor del problema de la materia, marcando puntos de encuentro y divergencias entre algunos elementos presentes en las teorías queer, los nuevos materialismos y el feminismo materialista francófono. Más específicamente, se preguntará por qué consecuencias teóricas y políticas podrían tener las diversas conceptualizaciones de la materia y lo material en las elaboraciones de cinco referentes indiscutidas de esas corrientes de pensamiento: Judith Butler, Paola Tabet y Nicole-Claude Mathieu y Elizabeth Wilson y Jane Bennett.

This volume contains the first modern commentary to Boethius's last logical monograph entitled 'De topicis differentiis', his most original work written around 522 A.D., just before the incarceration and death of the Roman philosopher. His textbook aims at providing a method for the discovery of arguments, that is an art that teaches how to solve any kind of question through the use of the topics, litteraly 'places' of our mind able to produce arguments subsequently developed into argumentations. Boethius inherited this (...) teaching from two different traditions, the Greek and Latin. In light of the differences found in them, the Roman scholar undertook the writing of the 'De topicis differentiis' precisely in order to show the possible way of reconciling these two philosophical traditions. In this way Boethius was able to disseminate a unified vision of this matter to the Latin world, restoring the centrality that the Topics had in the Aristotelian Logic and restoring their noblest function, that of being instruments at the service of the search for Truth. Finally, he also provided the list of the rhetorical topics by showing the differences with dialectical topics. This study provides a full reconstruction of the structure of the Boethian work, retraces and evaluates the sources, investigates the implications, and explains why the 'De topicis differentiis' remains a foundational work for anyone who wants to understand the development of European Logic through the Middle Ages and the Renaissance. Beginning with the Ciceronian divisions of rhetorical and dialectical topics as found, respectively, in the De inventione, the De oratore, the Partitiones oratoriae and the Topica, the purpose of this study is to collect all the lists that have been transmitted from Antiquity to the early Middle Ages in order to observe — mainly through the help of several diagrams put in the appendix — their alteration, as well as their preservation.

El propósito de este estudio es el de centrar la atención sobre la coexistencia, en el curso de la transmisión de la doctrina de los _loci _en el Alto Medioevo de dos interpretaciones, las cuales, aunque surjan ambas de un comentario a los _Topica _de Cicerón, han originado una diversa, aunque notable flexión interpretativa del texto ciceroniano: el primer comentario realizado por Mario Victorino, el cual concibió los _loci _casi exclusivamente al servicio de la Retórica, el segundo llevado a cabo (...) por Boecio quien, por su parte, intentó restaurar la centralidad que los _Topica _tuvieron en la lógica aristotélica, subordinando los _loci _retóricos a los _loci _dialécticos. Mi conclusión es que la Alta Edad Media puede ser considerada con justa razón desde un punto de vista epistemológico como una larga _boetiana aetas_. Aunque el _corpus _de los escritos de lógica boeciana no estuviera disponible sino hasta la segunda mitad del siglo XI, Boecio de algún modo continuó sosteniendo con su impostación de método el esqueleto de la nueva estructura especulativo-teológica. This chapters explores Schlegel’s view on transitional forms of republicanism in his Essay on the Concept of Republicanism Occasioned by the Kantian Tract Perpetual Peace (1796). These rightful – but necessarily temporally limited – types of collective action are insurrection and provisional dictatorship. These forms of republicanism are absent in Kant’s theory of right, as they are manifestly incompatible with his account of popular sovereignty. Since Schlegel endorses a different view of sovereignty, the people, and the state, he is able (...) to combine Kantian principles of justice with a defense of revolution and dictatorship as legitimate ways of implementing the republican ideal. This makes Schlegel’s argument on transitional forms of republicanism Kantian in “spirit,” although based on two claims that oppose the “letter” of Kant’s theory of right, namely an account of the people as having the power to depose the ruler or to suspend the law and an understanding of the state as a means rather than an end in itself. This study explores the rationality behind firms’ decision to admit or deny their involvement in bribery when responding to confidential surveys conducted by international agencies. Specifically, we posit that firms’ reluctance to provide accurate information about their engagement in bribery is at least to some extent contingent on certain situational factors. In other words, we claim that this behavior is context dependent. The paper uses the notions provided by the theory of planned behavior to understand the way in which the (...) corruption of the legal environment, the intensity of market competition, and identification risk influence firms’ decision to lie about their involvement in bribery. To test these notions, we use databases from the fifth wave of the EBRD-World Bank Business Environment and Enterprise Performance Survey, country-level data from the Kauffman Foundation and macroeconomic information from the World Bank database. We run ordinary least squares with geographic region-clustered standard errors on data from 30 countries and 6122 individual firms during the period 2012–2013. Consistent with our expectations, the results indicate that firms operating within more corrupt legal environments, facing more competition, and bearing a higher risk of being identified are less likely to deny their involvement in bribery. We conclude that not all firms have the same incentives to lie about their participation in bribery, and therefore, identifying the drivers of this heterogeneity may help policymakers better assess the reliability of bribery information collected through confidential surveys. In the Doctrine of Right Kant holds that the classical Ulpian command honeste vive is a juridical duty that has the particular feature of being internal. In this paper I explore the reasons why Kant denies that the duty to be an honorable human being comprises an ethical obligation and conceives it as a juridical duty to oneself. I will argue that, despite the conceptual problems that the systematical incorporation of this type of duty into the doctrine of morals might (...) entail, these reasons are coherent. The fulfillment of the duty honeste vive involves a coercion to the self but at the same time does not necessarily imply the adoption of a moral end. (shrink)

This paper aims to analyze Schlegel’s critique of Kant’s political philosophy regarding two issues: the republican ideal and the justification of revolution. In the Versuch, Schlegel connects republic and democracy, and opposes Kant’s thesis according to which revolution is not morally allowed. The insurrection of the people is vindicated as a form of political action that aims at the institution of a republican regime. I argue that Schlegel’s view on revolution rests on two central claims: first, on a Rousseaunean account (...) of the people as a constituent power, and second, on the rejection of the Kantian doctrine about the unconditional necessity of the state. Este trabajo analiza el argumento acerca de la aprioridad de la soberanía de la voluntad del pueblo en la sección El derecho público de la Doctrina del derecho. Allí Kant, más que presentar una tesis absolutamente original, como en la sección El derecho privado, en donde llega a la necesidad de la voluntad general legisladora a través del concepto de reciprocidad; sigue ideas de Rousseau y se centra en la libertad jurídica como dependencia de la ley que uno mismo se (...) ha dado. Sostendré que, por motivos sistemáticos, Kant lleva a cabo una idealización normativa de la volonté générale rousseauniana. No obstante, la distinción fundamental entre respublica noumenon y respublica phaenomenon no implica que, desde una perspectiva práctica, el ideal republicano esté completamente escindido del ámbito fenoménico. Muy por el contrario, la república pura ejerce una fuerza normativa sobre la praxis política. (shrink)
