Na sua principal obra política, os _Dois Tratados Sobre o Governo_, Locke defende o direito do indivíduo de resistir ao soberano. Entretanto, segundo Locke, o ser humano abandona o estado de natureza voluntariamente para criar o Estado político com a esperança de que o poder político amenize as inconveniências do estado de natureza. Se a criação do Estado político foi voluntária, em que circunstâncias se deve resistir às determinações do soberano? Além disso, como fundamentar o direito de resistência ao soberano (...) que foi instituído com a permissão do próprio indivíduo que agora pretende resistir as suas determinações? O objetivo do presente texto é discutir os motivos pelos quais a defesa do direito de resistência se torna necessária no pensamento político de Locke, e de que forma e com quais fundamentos Locke defende tal direito no _Segundo Tratado Sobre o Governo_. Pretende-se reconstruir o argumento de Locke em defesa do direito de resistência a partir da análise da referida obra e seu contraste com o _Patriarcha _; do contexto histórico e de alguns dos seus principais comentadores.Ainda que, segundo Locke, o Estado tenha surgido para proteger os direitos individuais como a liberdade e a propriedade, o governante está sujeito a se corromper e utilizar sua posição para praticar a injustiça contra seus súditos. O direito de resistência, apoiado na lei da natureza que permanece em vigor mesmo no estado civil, é o último recurso dos indivíduos contra a tirania praticada pelo governante corrompido. (shrink)

Em Anarquia, Estado e Utopia, Robert Nozick defende um Estado mínimo ao qual não deve ser dado o direito de redistribuir a propriedade que já foi distribuída pelos individuos. Nozick se apoia na ideia de estado de natureza tal como Locke propôs no Segundo Tratado Sobre o Governo, aproveitando, inclusive, a maneira de Locke fundamentar a propriedade privada. Locke explicou o direito natural à propriedade por meio do trabalho para superar uma crítica que Robert Filmer havia dirigido a Hugo Grotius (...) anos antes. Grotuis considerava haver, originalmente, um direito comum à posse dos bens e defendia que a propriedade privada surgiu a partir de um contrato entre os indivíduos. Filmer colocou em dúvida que um contrato para dividir a propriedade pudesse ter sido firmado entre todos ao mesmo tempo. Locke também defendia a propriedade privada a partir da propriedade comum, mas precisava superar a objeção que Filmer havia dirigido a Grotius. Nesse sentido surge a ideia de trabalho como fundamentador da propriedade privada, pois é o trabalho que a legitima em vez do contrato. Nozick, apesar de uma longa análise sobre a teoria da aquisição de Locke, em que discorre, inclusive, sobre o papel do trabalho no surgimento da propriedade privada, afirma que Locke pensava os bens naturais originalmente sem dono, quando, na verdade, para Locke eles eram propriedade comum a todos. O propósito do presente texto é elencar e avaliar algumas possíveis consequências desse pequeno equívoco interpretativo. (shrink)

What is it for a picture to depict a scene? The most orthodox philosophical theory of pictorial representation holds that depiction is grounded in resemblance. A picture represents a scene in virtue of being similar to that scene in certain ways. This essay presents evidence against this claim: curvilinear perspective is one common style of depiction in which successful pictorial representation depends as much on a picture's systematic differences with the scene depicted as on the similarities; it cannot be analyzed (...) in terms of similarity alone. The same problem arises for many other kinds of depiction. The essay concludes that depiction in general is not grounded in resemblance but geometrical transformation. (shrink)

When viewed as the most comprehensive theory of collections, set theory leaves no room for classes. But the vocabulary of classes, it is argued, provides us with compact and, sometimes, irreplaceable formulations of largecardinal hypotheses that are prominent in much very important and very interesting work in set theory. Fortunately, George Boolos has persuasively argued that plural quantification over the universe of all sets need not commit us to classes. This paper suggests that we retain the vocabulary of classes, but (...) explain that what appears to be singular reference to classes is, in fact, covert plural reference to sets. (shrink)

This paper takes a close look at the thought that mereological relations on material objects mirror, and are mirrored by, parallel mereological relations on their exact locations. This hypothesis is made more precise by means of a battery of principles from which more substantive consequences are derived. Mereological harmony turns out to entail, for example, that atomistic space is an inhospitable environment for material gunk or that Whiteheadian space is not a hospitable environment for unextended material atoms.

Identity is a modally inflexible relation: two objects are necessarily identical or necessarily distinct. However, identity is not alone in this respect. We will look at the relation that one object bears to some objects if and only if it is one of them. In particular, we will consider the credentials of the thesis that no matter what some objects are, an object is necessarily one of them or necessarily not one of them.

This paper presents a new version of the democratic argument for the freedom of expression that has the resources to give a plausible reply to the perennial objection—ordinarily considered fatal—that such accounts fail to deliver protections for abstract art, instrumental music, and lots of other deserving nonpolitical speech. The argument begins with the observation that there are different things that a free speech theory might aim to accomplish. It will hope to justify a right to free speech, of course, with (...) a particular scope and shape, but that right might be a moral right, an ordinary legal right, or a specifically constitutional right. The new version of the argument—the refined argument from democracy—aims to justify a specifically constitutional right to political speech, administered by strong-form judicial review. The democracy theorist can accommodate the intuition that abstract art deserves protection by agreeing that we have a moral right, and probably ought to have an ordinary legal right, to produce and view abstract art. She must only insist that abstract art should not be protected by a specifically constitutional right administered by strong-form judicial review. Not because abstract art does not deserve constitutional protection, but because, on this view, whether a particular right ought to be enshrined in the constitution and administered by judicial review is not solely a matter of the importance of the right or the value of the interests it protects. In this paper, I first explore Hegel’s own distinctions between various types of idealism, most of which he explicitly rejects. I discuss his notions of subjective, transcendental and absolute idealism and present the outlines of his criticisms of the first two as well as the motivation behind his commitment to a version of absolute idealism. In particular, I argue that the latter does not share the defining features of what is now commonly called ‘idealism’, as Hegel neither denies the existence (...) of an external world nor even holds that we can only somehow indirectly infer the truth of propositions about the external world from the structure of some given mental material. I give a basic account of what Hegel’s concept of ‘the absolute idea’ is about, which lies behind his absolute idealism. In this context, I maintain that it is crucial for our understanding of Hegel and of his potential relevance for contemporary metaphysics and epistemology that the absolute idea is precisely not a mental or ‘spiritual’ (geistig) entity. Rather, it amounts to a set of methodological assumptions designed to guarantee the overall intelligibility of what there is, regardless of its actual natural, social or more broadly normative structure. There has recently been much debate about the idea of levying a tax on particular transactions on international financial markets. Economists have argued about how much revenue such an international financial transaction tax would raise and they disagree about what effects it would have on trade volumes, financial stability, and overall growth. Politicians have argued about the feasibility of introducing such a tax internationally and they disagree on its adequacy as a policy response to the current financial and economic crisis. (...) This article contributes to the debate about international financial transaction taxation by bringing the perspective of political philosophy to bear on the politicians’ and economists’ arguments about policy. I shall outline a framework for thinking about justice in finance, and defend the idea of an international financial transaction tax as an instrument for making the international financial system more just. Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. Während die Bedeutung Freges für die Philosophie der Gegenwart, soweit sich diese der analytischen Philosophie verpflichtet fühlt, allgemeine Anerkennung gefunden hat, ist seine Stellung innerhalb der eigenen Zeit noch weitgehend unaufgeklärt geblieben. So herrscht die Auffassung vor, Frege habe seine Ideen ganz aus sich selbst oder geradezu im Gegensatz zur deutschen philosophischen Tradition seiner Zeit gewonnen. Bei genauerer Textanalyse weisen Freges Schriften dagegen vielfältige Beziehungen zur zeitgenössischen Logik, Erkenntnistheorie, Sprachphilosophie und Philosophie der Mathematik auf, so dass bei ihm von einem (...) Bruch mit der kontinentalen Philosophie nicht die Rede sein kann. Weil die historischen Voraussetzungen unberücksichtigt geblieben sind, ist ein unzutreffendes Bild von Freges Einsichten entstanden. Dieses Bild wird durch die Entfaltung des historischen Kontextes korrigiert. Bestimmend ist dabei ein problemorientierter Zugang, der sich systematischer Bewertungen und Weiterführungen nicht enthält. (shrink)

This paper looks at the question of what regions of space are possibly exactly occupied by a material object.

The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

Although recent trends in politics and media make it appear that conspiracy theories are on the rise, in fact they have always been present, probably because they are sustained by natural dispositions of the human brain. This is also the case with medical conspiracy theories. This article reviews some of the most notorious health-related conspiracy theories. It then approaches the reasons why people believe these theories, using concepts from cognitive science. On the basis of that knowledge, the article makes normative (...) proposals for public health officials and health workers as a whole, to deal with conspiracy theories, in order to preserve some of the fundamental principles of medical ethics. In NIP theories, generically stable Keisler measures can be characterized in several ways. We analyze these various forms of “generic stability” in arbitrary theories. Among other things, we show that the standard definition of generic stability for types coincides with the notion of a frequency interpretation measure. We also give combinatorial examples of types in NSOP theories that are finitely approximated but not generically stable, as well as ϕ-types in simple theories that are definable and finitely satisfiable in a small (...) model, but not finitely approximated. Our proofs demonstrate interesting connections to classical results from Ramsey theory for finite graphs and hypergraphs. (shrink)

This paper draws a distinction between the existential quantifier and the symbol ‘∃’ used to express it, on the one hand, and existence and ‘exists’, on the other. It argues that some popular arguments in metaphysics, including arguments against vague existence and arguments against deflationary metaontology (which views ontological disputes as lacking substance), are guilty of fudging this distinction. The paper draws some lessons for metaphysical debate about existence and highlights some heretofore ignored and attractive positions in logical space.

In this paper I examine the relation between modern transhumanism and Nietzsche’s philosophy of the superhuman. Following Loeb, I argue that transhumanists cannot claim affinity to Nietzsche’s philosophy until they incorporate the doctrine of eternal recurrence to their project of technological enhancement. This doctrine liberates us from resentment against time by teaching us reconciliation with time and something higher than all reconciliation. Unlike Loeb, however, I claim that this “something higher” is not a new skill (prospective memory), but rather a (...) love for the past in the form of loving that aspect of it that is still with us, namely, the will to power itself, which is the engine of all life. Love of the past is thus equivalent to love of life. Since human beings are conscious incarnations of the will to power, in our case, love of life manifests itself as love of our humanity or love for that aspect of ourselves that connects us to each other, for we recognize it to be the same in all of us. Thus, learning this kind of love enables us to joyfully coordinate our wills in the pursuit of Zarathustra’s superhuman ideal without turning it into a destructive mockery of itself. While learning this kind of love would facilitate a joyful version of transhumanism, I conclude by suggesting that it is unlikely to be achieved through technological interventions of the sort envisioned by transhumanists. Instead, it requires the kind of participatory pedagogical program that Nietzsche thought his Zarathustra would fulfill. (shrink)

The financial crisis has led to new interest in the ethics of financial markets. In this article, we further the debate on the nature of banking contracts by showing that the fundamental subjective purposes of loan and deposit contracts are irreconcilable. Any resultant mixture of the two contracts is a legal aberration. We consider a mutual fund as an important and legitimate alternative to the common demand deposit to provide high liquidity and some yield without offering full availability of a (...) nominal sum. Besides being a close substitute for how many deposit accounts function today, the mutual fund has the additional benefit of satisfying all legal and ethical requirements. Loan and investment contracts allow for the “bank” to make use of their clients’ funds while the intents of money owners are clearly classified without running into legal or ethical problems. The paper is concerned with the bad company problem as an instance of a more general difficulty in the philosophy of mathematics. The paper focuses on the prospects of stability as a necessary condition on acceptability. However, the conclusion of the paper is largely negative. As a solution to the bad company problem, stability would undermine the prospects of a neo-Fregean foundation for set theory, and, as a solution to the more general difficulty, it would impose an unreasonable constraint on (...) mathematical practice. This paper explores several topics related to Woodin’s HOD conjecture. We improve the large cardinal hypothesis of Woodin’s HOD dichotomy theorem from an extendible cardinal to a strongly compact cardinal. We show that assuming there is a strongly compact cardinal and the HOD hypothesis holds, there is no elementary embedding from HOD to HOD, settling a question of Woodin. We show that the HOD hypothesis is equivalent to a uniqueness property of elementary embeddings of levels of the cumulative hierarchy. We (...) prove that the HOD hypothesis holds if and only if every regular cardinal above the first strongly compact cardinal carries an ordinal definable [Formula: see text]-Jónsson algebra. We show that if the HOD hypothesis holds and HOD satisfies the Ultrapower Axiom, then every supercompact cardinal is supercompact in HOD. (shrink)

How much personal partiality do agent-centred prerogatives allow? If there are limits on what morality may demand of us, then how much does it permit? For a view Henry Shue has termed ‘yuppie ethics’, the answer to both questions is a great deal. It holds that rich people are morally permitted to spend large amounts of money on themselves, even when this means leaving those living in extreme poverty unaided. Against this view, I demonstrate that personal permissions are limited in (...) certain ways: their strength must be continuous with the reasons put forward to explain their presence inside morality to begin with. Typically, these reasons include non-alienation and the preservation of personal integrity. However, when personal costs do not result in alienation or violate integrity, they are things that morality can routinely demand of us. Yuppie ethics therefore runs afoul of what I call the ‘continuity constraint’. (shrink)

In this essay, we focus on Max Weber’s concept of rationalization to understand and make sense of the rise of bureaucratic, corporate governance and online learning in higher education. We reveal the distinct disconnect between human interaction and online platforms and how such disconnection is antithetical to higher learning. We also show how Weber’s analysis helps us recognize the uniquely crass commercialism embedded in the very rationalization that makes online learning in universities thinkable and actionable. Our use of online learning (...) is only one illustration of Weber’s concept of rationalization, but it provides an important understanding of the nefarious effects rationalization has on human interaction. The nexus of marketization, technology, and higher education represents, on our view, a juggernaut against faculty autonomy, academic freedom, and humane learning and should be directly challenged. One difficulty this challenge faces is the degree to which online learning has become ubiquitous and taken-for-granted. It has, as Weber clarifies, been rationalized. (shrink)

Plato and Xenophon: Comparative Studies contains a wide variety of comparative studies of the writings of Plato and Xenophon, from philosophical, literary, and historical perspectives.

This paper tries to link Ethology to Biosemiotics by analysing the similarities between some triadic relationships like biosemiotics’ Object—Representamen—Interpretant and the one established in Ethology between Sign-stimuli— Innate Releasing Mechanism—Modal Action Pattern, or the one potentially established in communication networks comprising Sender—Receiver—Eavesdropper. I argue here that a collaborative relationship is supported by the fact that the observational method used by Ethology is based on the triadic relationship Sender—Receiver—Eavesdropper. This method, by introducing the human observer at the Interpreter/Eavesdropper place, is not (...) only applicable to the direct study of animal communication, but also to the interpretation of all other animal behaviour by assuming that behaviour is a sign/signal system on its own, for us to interpret and decode. I make three claims about the interactions between concept mastery and the knowledge argument. First, I argue that, contra Ball, the concept mastery response to the knowledge argument does not suffer from the heterogeneity of concept mastery. Second, I argue that, when doing metaphysics by relating propositions on the basis of whether a hypothetical agent who knew a base collection could infer a target proposition, it is legitimate to rely on propositions that are not contained in the base, as long (...) as those propositions are required for mastery of relevant concepts. One upshot is that, when checking whether the physical truths a priori entail the consciousness truths, it is fair game to rely on substantive truths about consciousness. Third, I argue that the only version of the knowledge argument that has any hope of succeeding against physicalism completely lacks the argument's driving intuition: that Mary learns something new when she emerges from the black and white room. Whilst agreeing with Robert Pippin that Hegel undertakes his philosophical enterprise in light of Kant's insights into the failings of pre-critical metaphysics, this paper outlines the shortcomings of Pippin's Hegel interpretation by contrasting what I call 'apperceptive idealism' on the one hand with 'transcendental ontology' on the other. By privileging subject over substance, Pippin commits Hegel to an ontologically modest form of Kantianism that, in missing how reality as a whole is the main topic of Hegel’s philosophy, leaves no room (...) for a crucial Hegelian task, namely accounting for the presence of self-conscious thinking in nature. Appreciating the nature of Hegel's true ambitions whilst remaining aware of how his Logic maps a 'realm of shadows', opens up the possibility of understanding his philosophy as forging a middle path: Hegel is neither the subjective idealist of Pippin's interpretation nor the advocate of a revival of first-order metaphysical theorising depicted by so many of Pippin's critics. We study a case that applies hermeneutics to social sciences, in particular to the Austrian School of economics. We argue that an inaccurate treatment of hermeneutics contributed to an epistemological downgrade of the Austrian School in the economic scientific community. We discuss hoe this shortcoming can be fixed and how a proper hermeneutic application to the Austrian school explains why this school of thought is neither positivist nor postmodern.

Both Frege's Grundgesetze, and Lagrange's treatises on analytical functions pursue a foundational purpose. Still, the former's program is not only crucially different from the latter's. It also depends on a different idea of what foundation of mathematics should be like . Despite this contrast, the notion of function plays similar roles in their respective programs. The purpose of my paper is emphasising this similarity. In doing it, I hope to contribute to a better understanding of Frege's logicism, especially in relation (...) to its crucial differences with a set-theoretic foundational perspective. This should also spread some light on a question arisen by J. Hintikka and G. Sandu in a widely discussed paper, namely whether Frege should or should not be credited with the notion of arbitrary function underlying our standard interpretation of second-order logic. In section 1, I account for Lagrange's notion of function. In section 2, I advance some remarks on connected historical matters. This will provide an appropriate framework for discussing the role played by the notion of function in Frege's Grundgesetze. Section 3 is devoted to this.
