How should judges deal with the manifestation of religious symbols in public educational institutions? In light of the important role of human rights in our legal and political system, courts should grant maximum protection under the freedom of religion or belief. The central thesis of this article is that the European Court of Human Rights fails to live up to this standard. In order to reach this conclusion, the article analyzes relevant case law of the European Court and compares its (...) case law with that of the high courts of Canada and South Africa. In addition, the article assesses the case law of all three courts from the angle of interpretation theory and particularly Cass R. Sunstein’s theory of judicial minimalism. Adoption of a more consistently minimalist methodology by the European Court might lead to a greater protection granted to individuals and groups. However, a wide and deep ruling is first required to overturn the current line of reasoning. The European Court can draw inspiration from Canada and South Africa for such a judgment. (shrink)

Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

Zusammenfassung: Die für diesen Schwerpunkt ausgewählten Beiträge setzen sich aus sachlich, methodologisch sowie disziplinär vielfältigen Perspektiven mit dem Thema der Grenze, der Grenzziehung und des Grenzregimes auseinander. Während Grenzen in der normativen politischen Philosophie und Theorie kaum als eigenständiges Problem behandelt bzw. zumeist traditionell, d. h. als für territorial verankerte staatliche Zuständigkeitsbereiche konstitutive statische Trennlinien begriffen werden, wird in den hier versammelten Texten der Versuch unternommen, diese präziser und detaillierter in ihrer gegenwärtigen Gestalt und Wirkungsweise zu bestimmen, um auf dieser (...) Grundlage alternative grenztheoretische Modelle zu entwickeln. Im Zentrum steht dabei die Frage, in welcher Weise sich die zunehmende Beweglichkeit von Grenzen – eine Beweglichkeit, die nicht nur neu konfigurierten politisch-rechtlichen Maßnahmen und Institutionen, sondern auch neuen Kontrolltechnologien geschuldet ist – auf das Verständnis von staatlicher Souveränität, von demokratischer Legitimität oder von Menschenrechten auswirkt. In dieser Einleitung werden zum einen einige maßgebliche rezente Grenzziehungsphänomene erörtert, die im Licht der Covid-19-Pandemie in besonderer Deutlichkeit zutage treten; zum anderen werden Grundzüge eines veränderten politiktheoretischen Nachdenkens über Grenzen skizziert. We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. Increasingly, global businesses are confronted with the question of complicity in human rights violations committed by abusive host governments. This contribution specifically looks at silent complicity and the way it challenges conventional interpretations of corporate responsibility. Silent complicity impliesthat corporations have moral obligations that reach beyond the negative realm of doing no harm. Essentially, it implies that corporations have a moral responsibility to help protect human rights by putting pressure on perpetrating host governments involved in human rights abuses. This is (...) a controversial claim, which this contribution proposes to analyze with a view to understanding and determining the underlying conditions that need to be met in order for moral agents to be said to have such responsibilities in the category of the duty to protect human rights. Dieser Beitrag nimmt als Ausganspunkt die gegenwärtige kontroverse Debatte um den adäquaten Erklärungsansatz in der Kognitionswissenschaft, und zwar zwischen Enaktivisten einerseits und Repräsentationalisten andererseits. Beispielhaft wurde aufgezeigt, dass in Bezug auf die soziale Kognition der enaktivistische Ansatz eine Voraussetzung machen muss, die er mit seinen eigenen Mitteln nicht einzufangen in der Lage ist. Denn der Versuch, das Verstehen des Anderen durch gemeinsame Sinnstiftung der Akteure innerhalb ihrer sozialen Interaktion zu erklären, gerät in einen Zirkel, da nicht erklärt wird, wie die (...) Kopplung und damit der Prozess der sozialen Interaktion allererst zustande kommen kann. Als Lösung dieses Problems wird eine repräsentationalistische Analyse der vorausgesetzten Fähigkeit, andere als potentielle Kooperationspartner anzusehen, entwickelt, und zwar mit den Mitteln von Millikans Teleosemantik. Diese Theorie aus dem Kontext der Debatte um die Naturalisierung mentaler Repräsentationen liefert mit den PP Repräsentationen den adäquaten Begriff, um sowohl verkörperte, handlungsorientierte Repräsentationen zur Analyse von Affordanzen, als auch verkörperte interaktionsorientierte Repräsentationen zur Analyse sozialer Affordanzen zu entwickeln. Dies erlaubt die Annahme einer zentralen Funktion für die soziale Wahrnehmung, die den blinden Fleck des enaktivistischen Ansatzes ausfüllen kann. Zugleich demonstriert diese Analyse der sozialen Wahrnehmung die explanatorische Überlegenheit (minimal) repräsentationalistischer Erklärungen gegenüber rein enaktivistischen Alternativen. (shrink)

During the past century and a half historians and sociologists have often shown signs of considerable simplicity of mind when assessing the motivating forces behind the men whose deeds they are studying, and those attaining the most flattering notoriety in the intellectual world have been among the simplest. From the early nineteenth century, beginning with the fall of Napoleon, there is a tendency to present the historical disciplines as sciences: the re-creative anecdote is greeted with increasing disdain, and sociology undergoes (...) its act of baptism. The Revolution of 1789 and the epic of imperial France are events of such dimension that it is difficult to associate them with the conscious designs of a few individuals. No longer a muse, Clio becomes a goddess. In War and Peace Tolstoi ironically treats historians of the old school who pretend to offer the key to the Revolution “in exposing the deeds and gestures of a few dozen men in one building in the city of Paris.” The French emperor's gallop into Russia and the stubborn but apparently passive resistance offered by Kutuzov—these are facts in which Tolstoi sees the manifestation of forces far surpassing the play of a few human wills. Tolstoi's manner in extolling Kutuzov is typical: Kutuzov is not a visionary; he shows no signs of genius, but with humble and patient fervor he turns aside all obstacles which might stifle the voice of popular instinct. Thirty years before Tolstoi, in a letter to his fiancée, Georg Büchner stated the case in another good example of this type of thinking: “I have studied the history of the Revolution. … I find in human nature a frightening equality, in the condition of man an ineluctable power conferred at once upon all and upon no one. The individual is but a fleck of foam upon the wave, greatness merely the result of chance, the power of genius a puppet show, a ridiculous struggle against a law of iron.” Men are interesting insofar as they are representative. Saint-Simon, mentor of Auguste Comte and father of sociology, declares that the great men of the world merely play the role assigned to them in historical evolution. According to Saint-Simon, the sixteenth century, an age of theology, gave birth to theologian-kings: Charles V and Henry VIII. Because he is a theologian, Henry VIII easily prevails over gallant and witty Francis I. The eighteenth century, a siècle of philosophy, “counts but two great names among its sovereigns: Catherine and Frederick the Great, friends of philosophers and patrons of philosophy.” Seen in this light, the features of the individual become blurred and shadowy. History is admired instead— history which, often with material of mediocre quality, builds solid edifices. But, faced with the astonishing drama played out by Napoleon himself, Tolstoi merely shrugs his shoulders, while following step by step simple men like Tostopchin or Kutuzov, who are obviously the mere instruments of history. Heine, who went through a Saint-Simonian phase, is amazed that Luther, that rough, gross monk whose brain was clouded by anxiety and superstition, so easily wielded the battering ram that shattered the old medieval world. In the 1830’s Auguste Comte foresees a “history without proper names,” a definition which is of prime importance in the analysis we are undertaking here. But, a hundred years later, Maxime Leroy, nourished on both Comte and Sainte-Beuve, draws more subtly shaded definitions: history becomes a “sociology containing proper names.”. (shrink)

Artykuł ukazuje problematykę rozwoju majątku Floriana Zebrzydowskiego h. Radwan (zm. 1566), jednego z najbardziej zaufanych dworzan, wojskowych i urzędników Zygmunta Augusta. Stosując metodę indukcyjną, zwrócono uwagę na niemal nieznane dotychczas w historiografii wejście przez Zebrzydowskiego w posiadanie majątku we wsi Radocza k. Wadowic w księstwie zatorskim. Jako współwłaściciel tej wsi Zebrzydowski procesował się w latach 1549–1550 z Jakubem Frydrychowskim. Z kolei dokumentem z 1551 roku król nadał Zebrzydowskiemu przywilej budowania tamy/ fosy na rz. Skawie w celu doprowadzania wody do majątku (...) w Radoczy, co było niezbędne m.in. do zbudowania stawów rybnych (edycja wraz z tłumaczeniem w Aneksie). Osiem lat później Florian Zebrzydowski przeprowadził transakcję majątkową dotyczącą Radoczy z Felicją Frydrychowską i jej mężem Stanisławem Milanowskim. Nie udało się jednak ustalić, kiedy dostojnik pozbył się majątku w tej wsi, jednak źródła z okresu ostatnich lat jego życia i kolejnych dziesięcioleci wymieniające właścicieli Radoczy nie wspominają już o Zebrzydowskich. Przy okazji ustaleń dotyczących Radoczy ukazano także przykładowe inne transakcje majątkowe, w których brał udział Zebrzydowski. Studium miało za zadanie zasygnalizować konieczność podjęcia szerszych badań nad rozwojem majątku Floriana Zebrzydowskiego w powiązaniu ze sprawami majątkowymi jego rodziny, szkicując tym samym nowe perspektywy badawcze. Definition of the problem The research and regulatory levels for data-intensive research in medicine are divergent. This results in a heterogeneous global field of regulating institutions with regionally unequal regulations, both in terms of the depth and restrictiveness of regulations. Despite or precisely because of the lack of globally binding regulation, nonbinding or only partially binding normative guidelines can also serve as orientation. But how should such normative regulation be designed in view of data-intensive research in medicine and what should (...) it be based on? Arguments The question of how concrete and in detail such research should be regulated can only be answered on a case-by-case basis for specific situations and institutions. Whether new norms or weightings of norms should be introduced, or whether the norms and their weightings should remain in place, can only be answered with reference to strong normative arguments. So far, there is a lack of compelling arguments in favour of new standards in view of data-intensive medical research. However, it is always necessary to translate norms, whether new or old, and apply them to a new method or technology. As in the past, both established and transparently communicated standards and an independent judgement on the application of these standards are therefore required. Conclusion In view of their particular suitability for this task, ethics committees should continue to be required and qualified as a procedural authority in the approval of data-intensive research in medicine; as an independent institution, they should make a judgement appropriate to the individual case on the basis of existing norms and standards. However, the changing practices of data-intensive research projects can also be reflected in new demands on research ethics committees, which should be addressed with reforms of their operating mode. Cell‐based therapies for degenerative diseases of the musculature remain on the verge of feasibility. Myogenic cells are relatively abundant, accessible, and typically harbor significant proliferative potential ex vivo. However, their use for therapeutic intervention is limited due to several critical aspects of their complex biology. Recent insights based on mouse models have advanced our understanding of the molecular mechanisms controlling the function of myogenic progenitors significantly. Moreover, the discovery of atypical myogenic cell types with the ability to cross the blood‐muscle (...) barrier has opened exciting new therapeutic avenues. In this paper, we outline the major problems that are currently associated with the manipulation of myogenic cells and discuss promising strategies to overcome these obstacles. (shrink)

In his Geography, Ptolemy recorded the geographical coordinates of more than 6,300 toponyms of the known oikoumenē. This study presents the type of geographical information that was used by Ptolemy as well as the methods he applied to derive his geographical coordinates. A new methodological approach was developed in order to analyse the characteristic deviations of Ptolemy’s data from their reconstructed reference locations. The clusters of displacement vectors establish that Ptolemy did not obtain his coordinates from astronomical observations at each (...) geographical location. The characteristic displacement vectors reveal how Ptolemy derived the coordinates: he constructed locations on maps using a compass and ruler, for which he employed a small amount of astronomical reference data and geographical distance information; he made schematic drawings of coastlines, based on textual descriptions of coastal formations; and he situated additional locations within the established framework using reports of travel itineraries. Forming implementation intentions has been consistently shown to be a powerful self-regulatory strategy. As the self-regulation of thoughts is important for the experience of involuntariness in the hypnotic context, investigating the effectiveness of implementation intentions on the suppression of thoughts was the focus of the present study. Participants were randomly assigned to one of four conditions . Results showed that participants who received information included in the “Carleton Skill Training Program” and in addition formed implementation intentions improved their hypnotic responsiveness (...) as compared to all of the other three groups on measures of objective responding and involuntary responding. Thus, in line with the nonstate or cognitive social–psychological view of hypnosis stating that an individual’s hypnotic suggestibility is not dispositional but modifiable, our results suggest that hypnotic responsiveness can be heightened by furnishing hypnotic instructions with ad hoc implementation intentions. Der Laureatus dieser Schrift hatte 1986 Hans Jonas eröffnet, daß er an einer Politischen Philosophie arbeite, aus der, wie die Autoren dieses Bandes wissen, nichts geworden ist und von der man auch sonst nicht viel vernommen hat. Jonas wandte damals ein: "Wie wollen Sie der Politischen Vernunft auf die Beine helfen? Das Wissen über die politischen Bewußtseinsvoraussetzungen in uns und ihre Struktur in Gesellschaften ist in esoterische Teilbestände und exoterische politische Religionen, Ideologien und Denkschulen zerfallen. Diese Angelegenheit müßte einer umfassenden (...) Kritik unterzogen werden. Außerdem müßten alle gescheiterten Restitutionsversuche von Platon bis heute auf ihre Prägnanz hin durchgegangen werden. Er nannte Thomas von Aquin, Spinoza, Kant, Hegel, Arendt, Strauss, Voegelin und sich selbst. Sie müßten die Erfahrungen und die Maßstäbe, aus denen das politische Bewußtsein sich ernährt und aufrichtet und die, die es vergiften, frei legen." Im nachfolgenden Gespräch über verschiedene Denker und ihre Texte zur politischen Philosophie tauchten metaphorisch die "leuchtenden Fünkchen" oder "Goldklümpchen" auf, in denen Jonas und der Laureatus lebendige Reste der Politischen Vernunft und die menschheitliche Erinnerung an sie erkannten. "Wir sind womöglich aus einer Jeremiade herausgekommen …" lautete der verheißungsvolle Schlußpunkt des kurzen Gesprächs. Der Laureatus, Jurist und Politikwissenschaftler, konnte während seiner Lehr- und Forschungstätigkeit einige Anregungen für "philosophische Fragestellungen" zu den grotesken und verflachten Formationen des politischen Denkens unserer Zeit geben.
