Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

The question of where, between theory and experiment, computer simulations (CSs) locate on the methodological map is one of the central questions in the epistemology of simulation (cf. Saam Journal for General Philosophy of Science, 48, 293–309, 2017). The two extremes on the map have them either be a kind of experiment in their own right (e.g. Barberousse et al. Synthese, 169, 557–574, 2009; Morgan 2002, 2003, Journal of Economic Methodology, 12(2), 317–329, 2005; Morrison Philosophical Studies, 143, 33–57, 2009; Morrison (...) 2015; Massimi and Bhimji Studies in History and Philosophy of Science Part B: Studies in History and Philosophy of Modern Physics, 51, 71–81, 2015; Parker Synthese, 169, 483–496, 2009) or just an argument executed with the aid of a computer (e.g. Beisbart European Journal for Philosophy of Science, 2, 395–434, 2012; Beisbart and Norton International Studies in the Philosophy of Science, 26, 403–422, 2012). There exist multiple versions of the first kind of position, whereas the latter is rather unified. I will argue that, while many claims about the ‘experimental’ status of CSs seem unjustified, there is a variant of the first position that seems preferable. In particular I will argue that while CSs respect the logic of (deductively valid) arguments, they neither agree with their pragmatics nor their epistemology. I will then lay out in what sense CSs can fruitfully be seen as experiments, and what features set them apart from traditional experiments nonetheless. I conclude that they should be seen as surrogate experiments, i.e. experiments executed consciously on the wrong kind of system, but with an exploitable connection to the system of interest. Finally, I contrast my view with that of Beisbart (European Journal for Philosophy of Science, 8, 171–204, 2018), according to which CSs are surrogates for experiments, arguing that this introduces an arbitrary split between CSs and other kinds of simulations. Developments in Machine Learning (ML) have attracted attention in a wide range of healthcare fields to improve medical practice and the benefit of patients. Particularly, this should be achieved by providing more or less automated decision recommendations to the treating physician. However, some hopes placed in ML for healthcare seem to be disappointed, at least in part, by a lack of transparency or traceability. Skepticism exists primarily in the fact that the physician, as the person responsible for diagnosis, therapy, and (...) care, has no or insufficient insight into how such recommendations are reached. The following paper aims to make understandable the specificity of the deliberative model of a physician-patient relationship that has been achieved over decades. By outlining the (social-)epistemic and inherently normative relationship between physicians and patients, I want to show how this relationship might be altered by non-traceable ML recommendations. With respect to some healthcare decisions, such changes in deliberative practice may create normatively far-reaching challenges. Therefore, in the future, a differentiation of decision-making situations in healthcare with respect to the necessary depth of insight into the process of outcome generation seems essential. One of the goals of computerized tutoring systems is to optimize the learning of facts. Over a hundred years of declarative memory research have identified two robust effects that can improve such systems: the spacing and the testing effect. By making optimal use of both and adjusting the system to the individual learner using cognitive models based on declarative memory theories, such systems consistently outperform traditional methods (Van Rijn, Van Maanen, & Van Woudenberg, 2009). This adjustment process is driven by (...) a continuously updated estimate of the rate of forgetting for each item and learner on the basis of the learner's accuracy and response time. In this study, we investigated to what extent these estimates of individual rates of forgetting are stable over time and across different materials. We demonstrate that they are stable over time but not across materials. Even though most theories of human declarative memory assume a single underlying rate of forgetting, we show that, in practice, it makes sense to assume different materials are forgotten at different rates. If a computerized, adaptive fact‐learning system allowed different rates of forgetting for different materials, it could adapt to individual learners more readily. (shrink)

We challenge an argument that aims to support Aesthetic Realism by claiming, first, that common sense is realist about aesthetic judgments because it considers that aesthetic judgments can be right or wrong, and, second, that becauseAesthetic Realism comes from and accounts for “folk aesthetics,” it is the best aesthetic theory available.We empirically evaluate this argument by probing whether ordinary people with no training whatsoever in the subtle debates of aesthetic philosophy consider their aesthetic judgments as right or wrong. Frankfurt-style cases are supposed to constitute counter-examples to the principle of alternate possibilities, for they are cases in which we have the intuition that an agent is morally responsible for his action, even though he could not have done otherwise. In a recent paper, Swenson rejects this conclusion, on the basis of a comparison between standard FSCs, which typically feature actions, and similar cases involving omissions. Because the absence of alternate possibilities seems to preclude moral responsibility in the cases of (...) omissions, and because there is no morally relevant difference between the cases of actions and omissions, Swenson concludes that agents are not morally responsible in standard FSCs. In the present paper, I argue that Swenson’s argument fails because there are at least two very important differences between both types of cases. First, there is a difference about whether agents in such cases actually perform the relevant action: while agents actually perform the relevant action in standard FSCs, they do not in FSCs supposedly involving omissions, for omissions require the possibility to have done otherwise. Second, while the agent’s behavior in standard FSCs actually explain that he performed the relevant action, the agent’s behavior in FSCs including omission actually fails to explain why the agent did not perform the relevant action. Beyond Swenson’s argument, I end up discussing what factors ultimately explain our intuitions about FSCs involving omissions. (shrink)

Das höchste Gut ist nun derjenige Zustand der Welt, der erreicht würde, wenn alle Menschen diesem Prinzip gemäß handeln würden und ihrem gemeinsamen Streben nach allgemeiner Glückseligkeit auch Erfolg beschieden wäre. Dieser Zustand ist ein notwendiges Ziel vernünftigen Handelns, das (...) sich aus dem kategorischen Imperativ ergibt, dessen Verfolgung aber trotzdem über das bloße Handeln nach verallgemeinerbaren Maximen hinausgeht. Durch eine Neuinterpretation von Kants These, im höchsten Gut sei das Glück stets proportional zur Tugend, gelingt es dem Autor, nicht nur diese These, sondern auch Kants Aussagen über Gerechtigkeit, Glückswürdigkeit und Hoffnung argumentativ an den kategorischen Imperativ zu binden und damit im Kontext des höchsten Guts zu rechtfertigen. In this paper, I question the dichotomy between fundamental moral disagreements, arising from divergences on moral principles, and superficial moral disagreements, that are expected to disappear under ideal epistemic circumstances. I claim that there are many other possibilities for moral disagreements, including moral disagreements that do not arise from different moral principles but would not disappear under ideal epistemic conditions. I describe two major kinds of such disagreements: semi-fundamental disagreements, which are made possible by the fact that the same moral (...) rules can be applied in different ways to the same situations, and non-morally fundamental moral disagreements, which arise by the fact that moral truths are not the only potentially non-factual truths. Die Münchner Dissertation untersucht auf der Grundlage der frühen theologischen und staatskirchenrechtlichen Schriften Hugo Grotius' dessen theologische Positionierung und Argumentationsstrategien im Arminianischen Streit und den politischen Auseinandersetzungen Anfang des 17. Jahrhunderts. Besonderer Wert wurde darauf gelegt, die Äußerungen Grotius' vor dem Hintergrund der zeitgenössischen Politik zu lesen. Als christlicher Humanist relativierte er die verschiedenen Streitpunkte und rief die Konfliktparteien zu Toleranz und Versöhnung auf.

The term 'Taoism of Clarified Tenuity' designates a new branch of religious Taoism developed since the 13/14th century by priests of the long-established Heavenly Masters Taoism. They claimed to continue Taoist exorcist traditions that since the Sung-period especially flourished because emperor Sung Hui-tsung (r. 1100?1126) appreciated the exorcism of 'Taoism of the Divine Empyrean' and 'Five Thunders rituals'. The purpose of the exorcist rituals was the expulsion of demoniac molestations, relief from droughts and inundations, and the healing of illnesses. Outstanding (...) priests rationalized the exorcist practice, using theories of a meditative self-cultivation which peaked in the transformation into a Thunder divinity. The priest adopted a divine 'alter ego' for the time of the ritual. 'Taoism of Clarified Tenuity' developed on the basis of these traditions and embraced regionally different religious habits. It adopted and adapted older cults, partly including Buddhist-Tantric practices. Leading priests of 'Clarified Tenuity' presented theoretical essays, discussing the requirements of the personal cultivation of the Taoist to be a worthy performer of exorcism who was entitled to write and use amulets. The amulet was the essential ritual tool. However, the amulets of 'Clarified Tenuity' were remarkably different from the older 'Thunder' amulets of the Sung era. Also, the new branch adopted different attitudes concerning ritual practices such as the transformation into a divinity.0The book features developments of the more recent Taoist history and presents content and intention of 'Taoism of Clarified Tenuity'. The selected canonical texts also show that the priests of 'Clarified Tenuity' insisted on a clear distinction between exorcism in Heavenly Masters Taoism and shamanism that they disavowed. The book presents and analyses several 'Great Rituals' of 'Clarified Tenuity' and features elements of religious Taoism that today can still be traced. (shrink)

Definition of the problem. In the field of biomedical research on humans, ethical committees have an important role. They ensure the necessary protection of the subjects and contribute to quality assurance in medical research. Originally established as an instrument of ethical self-regulation in the medical profession, the ethical committee soon advanced to a statutory institution and is now on the way to becoming the body charged with judicial control in medical research. This development implies the need for changes in both (...) position and function of the ethical committee, but these have not been made with due consideration for all the developments there have been. Arguments and conclusion. The existing uncertainties are hampering medical research, which is in the interests of neither the public nor the actual medical research. Owing to the different and obscure legal arguments used, it has not been possible to make any definitive decision on the legal standing of decisions made by ethical committees. It seems obvious that these problems cannot be solved unless the work of ethical committees can be based on a clear and reliable legal basis regulating the judicial nature of the committees’ decisions, the composition of the actual committees and the procedures they are to follow in reaching their decisions. With regard to the existing regulations, this might be best achieved by integrating the work of the ethical committees into the approval procedures of an administrative authority. (shrink)

In his invited essay for Business & Society’s 60th anniversary, Archie B. Carroll refers to human rights as “a topic that holds considerable promise for CSR [corporate social responsibility] researchers in the future.” The objective of this article is to unpack this promise. We discuss the momentum of business and human rights in international policy, national regulation, and corporate practice, review how and why BHR scholarship has been thriving, provide a conceptual framework to analyze how BHR and corporate social responsibility (...) relate to each other, and provide a research agenda outlining how BHR can expand business and society scholarship in general and one of its foundational constructs, CSR, in particular, beyond the current confines of the business and society field. It is commonly argued that natural language has the expressive power of quantifying over intensional entities, such as times, worlds, or situations. A standard way of modelling this assumes that there are unpronounced but syntactically represented variables of the corresponding type. Not all that much as has been said, however, about the exact syntactic location of these variables. Meanwhile, recent work has highlighted a number of problems that arise because the interpretive options for situation pronouns seem to be subject to (...) various restrictions. This paper is primarily concerned with situation pronouns inside of determiner phrases, arguing that they are introduced as arguments of (certain) determiners. Verbal predicates, on the other hand, are assumed to not combine with a situation pronoun. The various restrictions on their interpretation are shown to fall out from the semantic system that is developed based on that view. Further support for such an account comes from situation semantic analyses of donkey sentences as well as data on the temporal interpretation of nominal predicates. Its ability to account for this full range of data in a unified manner is shown to set it apart from previous proposals. The paper closes with an outlook on further extensions, including an account of quantifier domain restriction based on situation pronouns. (shrink)

More and more companies are publicly taking a stand on social and political issues such as gay marriage legislation. This paper argues that this type of engagement, which can be called “corporate political advocacy,” raises new conceptual and normative challenges especially for theories of corporate responsibility. Furthermore, it poses practical challenges for managers who are confronted with it. This paper addresses all three challenges: first, it defines and conceptualizes corporate political advocacy and distinguishes it from other forms of corporate political (...) involvement. To operate in an unpredictable environment, a vehicle with advanced driving assistance systems, such as a robot or a drone, not only needs to register its surroundings but also to combine data from different sensors into a world model, for which it employs filter algorithms. Such world models, as this article argues with reference to the SLAM problem in robotics, consist of nothing other than probabilities about states and events arising in the environment. The model, thus, contains a virtuality of (...) possible worlds that are the basis for adaptive behavior. The article shows that the current development of these technologies requires new concepts because their complex adaptive behaviors cannot be explained by referring them to mere algorithmic processes. Instead, it proposes the heuristic instrument of microdecisions to designate the temporality of decisions between alternatives that are created by probabilistic procedures of world modeling. Microdecisions are more than the implementation of deterministic processes—they decide between possibilities and, thus, always open up the potential of their otherness. By describing autonomous adaptive technologies with this heuristic, the question of sovereignty inevitably arises. It forces us to re-think what autonomy means when decisions can be automated. Studying the folk concept of intentional action, Knobe (2003a) discovered a puzzling asymmetry: most people consider some bad side effects as intentional while they consider some good side effects as unintentional. In this study, we extend these findings with new experiments. The first experiment shows that the very same effect can be found in ascriptions of intentionality in the case of means for action. The second and third experiments show that means are nevertheless generally judged more intentional than side effects, (...) and that people do take into account the structure of the action when ascribing intentionality. We then discuss a number of hypotheses that can account for these data, using reactions times from our first experiment. (shrink)

According to tradition, logic is normative for reasoning. Gilbert Harman challenged the view that there is any straightforward connection between logical consequence and norms of reasoning. Authors including John MacFarlane and Hartry Field have sought to rehabilitate the traditional view. I argue that the debate is marred by a failure to distinguish three types of normative assessment, and hence three ways to understand the question of the normativity of logic. Logical principles might be thought to provide the reasoning agent with (...) first-personal directives; they might be thought to serve as third-personal evaluative standards; or they might underwrite our third-personal appraisals of others whereby we attribute praise and blame. I characterize the three normative functions in general terms and show how a failure to appreciate this threefold distinction has led disputants to talk past one another. I further show how the distinction encourages fruitful engagement with and, ultimately, resolution of the question. (shrink)

Despite remarkable efforts, it remains notoriously difficult to equip quantum theory with a coherent ontology. Hence, Healey (2017, 12) has recently suggested that ‘‘quantum theory has no physical ontology and states no facts about physical objects or events’’, and Fuchs et al. (2014, 752) similarly hold that ‘‘quantum mechanics itself does not deal directly with the objective world’’. While intriguing, these positions either raise the question of how talk of ‘physical reality’ can even remain meaningful, or they must ultimately embrace (...) a hidden variables-view, in tension with their original project. I here offer a neo-Kantian alternative. In particular, I will show how constitutive elements in the sense of Reichenbach (1920) and Friedman (1999, 2001) can be identified within quantum theory, through considerations of symmetries that allow the constitution of a ‘quantum reality’, without invoking any notion of a radically mind-independent reality. The resulting conception will inherit elements from pragmatist and ‘QBist’ approaches, but also differ from them in crucial respects. Furthermore, going beyond the Friedmanian program, I will show how non-fundamental and approximate symmetries can be relevant for identifying constitutive principles. (shrink)

Computer simulations are involved in numerous branches of modern science, and science would not be the same without them. Yet the question of how they can explain real-world processes remains an issue of considerable debate. In this context, a range of authors have highlighted the inferences back to the world that computer simulations allow us to draw. I will first characterize the precise relation between computer and target of a simulation that allows us to draw such inferences. ABSTRACT This article examines Bergson’s critique of intensive magnitude in Time and Free Will. I demonstrate how his rejection of a different kind of quantity that is ordinal and does not allow measurement, and the underlying strict dualism of quantity and quality, is inconsistent with both the letter and the spirit of his later philosophy. I dismantle two main strategies for explaining these inconsistencies. Furthermore, I argue that Bergson’s simplistic conception of quantity in terms of homogeneous multiplicity, which is operative (...) in his rejection of an alternative conception of quantity, lacks justification in the face of the transformations that the concept of quantity underwent in the history of mathematics and physics. Responding to recent concerns about the reliability of the published literature in psychology and other disciplines, we formed the X-Phi Replicability Project to estimate the reproducibility of experimental philosophy. Drawing on a representative sample of 40 x-phi studies published between 2003 and 2015, we enlisted 20 research teams across 8 countries to conduct a high-quality replication of each study in order to compare the results to the original published findings. We found that x-phi studies – as represented in our sample (...) – successfully replicated about 70% of the time. We discuss possible reasons for this relatively high replication rate in the field of experimental philosophy and offer suggestions for best research practices going forward. (shrink)

Quantum mechanics notoriously faces the measurement problem, the problem that if read thoroughly, it implies the nonexistence of definite outcomes in measurement procedures. A plausible reaction to this and to related problems is to regard a system's quantum state |ψ> merely as an indication of our lack of knowledge about the system, i.e., to interpret it epistemically. However, there are radically different ways to spell out such an epistemic view of the quantum state. We here investigate recent developments in the (...) branch that introduces hidden variables λ in addition to the quantum state |ψ> and has its roots in Einstein's views. In particular, we confront purported achievements of a concrete model that has been considered to serve as evidence for an epistemic view of the envisioned kind, as well as specific no-go results and their import. It will be argued that while an epistemic account of the particular kind is not straightforwardly ruled out by the no-go results, they demonstrate that the evidential character of the model(s) discussed rests on a rather shaky foundation, and that they make some achievements widely recognized in the literature appear worthy of doubt. _In times of economic crisis austerity becomes a rallying cry, but what does history tell us about its chances for success?_ Austerity is at the center of political debates today. Its defenders praise it as a panacea that will prepare the ground for future growth and stability. Critics insist it will precipitate a vicious cycle of economic decline, possibly leading to political collapse. But the notion that abstinence from consumption brings benefits to states, societies, or individuals is hardly new. This (...) book puts the debates of our own day in perspective by exploring the long history of austerity—a popular idea that lives on despite a track record of dismal failure. Florian Schui shows that arguments in favor of austerity were—and are today—mainly based on moral and political considerations, rather than on economic analysis. Unexpectedly, it is the critics of austerity who have framed their arguments in the language of economics. Schui finds that austerity has failed intellectually and in economic terms _every time_ it has been attempted. He examines thinkers who have influenced our ideas about abstinence from Aristotle through such modern economic thinkers as Smith, Marx, Veblen, Weber, Hayek, and Keynes, as well as the motives behind specific twentieth-century austerity efforts. The persistence of the concept cannot be explained from an economic perspective, Schui concludes, but only from the persuasive appeal of the moral and political ideas linked to it. (shrink)

In this article, I will argue that it is time to rethink and reconfigure some of the established assumptions underlying our conception of moral responsibility. Specifically, there is a mismatch between the individualism of our common sense morality and the imperative for collaborative responses to global problems in what I will call the “collective age.” This must have an impact also on the way we think about the responsibility of corporations. I will argue that most plausibly we ought to reframe (...) corporate responsibility as a conception of collaborative responsibility. Such a conception of collaborative responsibility is characterized by five key elements: first, it is based on the moral imperative for collaboration. Second, it shifts emphasis from commission to omission. Third, it is not only negative but also, and perhaps essentially, positive responsibility. Fourth, it is political responsibility. And finally, it is, most basically, human rights responsibility. (shrink)

This paper explores an apparent tension between two widely held views about logic: that logic is normative and that there are multiple equally legitimate logics. The tension is this. If logic is normative, it tells us something about how we ought to reason. If, as the pluralist would have it, there are several correct logics, those logics make incompatible recommendations as to how we ought to reason. But then which of these logics should we look to for normative guidance? I (...) argue that inasmuch as pluralism draws its motivation from its ability to defuse logical disputes—that is, disputes between advocates of rival logics—it is unable to provide an answer: pluralism collapses into monism with respect to either the strongest or the weakest admissible logic. Logic, the tradition has it, is normative for reasoning. But is that really so? And if so, in what sense is logic normative for reasoning? As Gilbert Harman has reminded us, devising a logic and devising a theory of reasoning are two separate enterprises. Hence, logic's normative authority cannot reside in the fact that principles of logic just are norms of reasoning. Once we cease to identify the two, we are left with a gap. To bridge the gap one would (...) need to produce what John MacFarlane has appropriately called a bridge principle, i.e. a general principle articulating a substantive and systematic link between logical entailment and norms of reasoning. This is Harman's skeptical challenge. In this paper I argue that Harman's skeptical challenge can be met. I show how candidate bridge principles can be systematically generated and evaluated against a set of well‐motivated desiderata. Moreover, I argue that bridge principles advanced by MacFarlane himself and others, for all their merit, fail to address the problem originally set forth by Harman and so do not meet the skeptical challenge. Finally, I develop a bridge principle that meets Harman's requirements as well as being substantive. (shrink)

Do laypeople think that moral responsibility is compatible with determinism? Recently, philosophers and psychologists trying to answer this question have found contradictory results: while some experiments reveal people to have compatibilist intuitions, others suggest that people could in fact be incompatibilist. To account for this contradictory answers, Nichols and Knobe (2007) have advanced a ‘performance error model’ according to which people are genuine incompatibilist that are sometimes biased to give compatibilist answers by emotional reactions. To test for this hypothesis, we (...) investigated intuitions about determinism and moral responsibility in patients suffering from behavioural frontotemporal dementia. Patients suffering from bvFTD have impoverished emotional reaction. Thus, the ‘performance error model’ should predict that bvFTD patients will give less compatibilist answers. However, we found that bvFTD patients give answers quite similar to subjects in control group and were mostly compatibilist. Thus, we conclude that the ‘performance error model’ should be abandoned in favour of other available model that best fit our data. (shrink)

Dans cet article, nous proposons de montrer expérimentalement que le "sens commun" n'est en matière moral ni complètement objectiviste ni complètement relativiste, mais qu'un même individu peut être tantôt objectiviste tantôt relativiste. De même, nous montrons que les jugements de goût portant sur le prédicat "dégoûtant" ne sont pas toujours relativiste mais peuvent varier selon le contexte entre objectivisme et relativisme.

The fact that Descartes describes mind and body as two fundamentally different entities has mostly led to the view that he has to be seen not only as the father of modern Philosophy, but also as the father of substance dualism. Against this commonsense view, I will argue that Descartes’ dualism does not primarily aim to prove an ontological, but a transcendental distinction between mind and body as a constitutional fact of human existence. As a consequence, Descartes’ dualism has to (...) be seen as a kind of perspectivism: Depending on one’s point of view, the human mind can, according to Descartes, be seen as part of a union with the body, as self-consciousness (“ego cogito”) or, from a naturalistic point of view, as a natural function that has its correlate in the human brain.
