This essay discusses the ethical challenges and dilemmas in allocating scarce medical resources during the COVID-19 pandemic, using the German legislative process as a starting point. It is guided by the right to non-discrimination of people with disability and generally contrasts utilitarian and rights-based principles of allocation. Three approaches that were suggested in the German discussion, are presented, the lottery principle, the first come first served principle and the probability to survive principle. Arguments in favour and against each principle are (...) discussed. The focus is on the utilitarian probability to survive principle, which was adopted in German legislation in 2022, and its discriminatory potential against people with disability. The essay suggests ways to mitigate the concerns of discrimination related to the probability to survive principle. It concludes that resolving the triage dilemma requires a balanced approach between utilitarian and rights-based concerns, which promotes both maximising the number of patients surviving and the right not to be discriminated against and be treated equally. It calls for a further debate on how many ethical values such as equity, fairness and non-discrimination we are willing to sacrifice for a higher number of survivors and when we are willing to sacrifice survivors to secure ethical values. The purpose of this cross-sectional investigation was to examine the item characteristics, factor structure, reliability, convergent validity, and construct validity of the Psychobiosocial States in Physical Education (PBS-SPE) scale. In Study 1, a sample of 1,030 students (582 girls and 448 boys, 10 to 19-year-olds), drawn from middle or high schools, rated the intensity of the 20 items version of the PBS-SPE scale thinking about the feelings they had usually experienced in physical education classes. In Study 2, an additional sample (...) of 1,025 students (578 girls, 447 boys, 10 to 19-year-olds), rated the 16 items of the final version of the scale. Two subsamples also completed an affective-related measure (i.e., the Physical Activity Enjoyment Scale) and two motivation scales often used in the physical education domain (i.e., the Teacher-Initiated Motivational Climate in Physical Education Questionnaire and the Situational Motivation Scale). Exploratory structural equation modeling and confirmatory factor analyses of the data showed that a two-factor, 16-item solution (i.e., 8 pleasant/functional items and 8 unpleasant/dysfunctional items) of the PBS-SPE scale reached satisfactory fit indices. Multi-group comparisons provided support for measurement and structural invariance across samples, gender, and age. Convergent and construct validity was also upheld. Overall, the findings offer support for the use of a new instrument in the assessment of psychobiosocial states in physical education settings. (shrink)

The paper describes a highly specific Italian action research experience, connected with the trade unions, going through different phases from the 1970s to the present day. The journey is not only a journey through time but also through different approaches. It ranges from the initial experience focusing on health and safety problems at the workplace involving the workers as co-designers of new working environments to today’s search conference experience. For each phase there is a full description and comment on the (...) methods utilised by the research group. The main methodological shift described in the paper is the one from discussion groups, based on Bion’s thinking, to the search conferences, based on Emery’s line of thinking. Both are oriented to the subjectivity of the people involved, although in the discussion group experience the research groups considered the subjectivity of the people involved as the subject of the observation. The researchers’ aim of was to acquire a reliable knowledge of what was at stake and to pass it on to the union that organised the research in order to promote actions. Hence, the action-research circuit is based upon different actors and the process is integrated only from the point of view of the union. In the search conference experience the researchers are involved in a co-design process and so the action-research circuit is really integrated from the researchers’ perspective; there are, of course, multiple perspectives in this case and this opens up epistemological problems that are not discussed in the paper. Numerous learning tasks can be described as the process of extrapolating patterns from observed data. One of the driving intuitions behind the theory of algorithmic randomness is that randomness amounts to the absence of any effectively detectable patterns: it is thus natural to regard randomness as antithetical to inductive learning. Osherson and Weinstein [11] draw upon the identification of randomness with unlearnability to introduce a learning-theoretic framework (in the spirit of formal learning theory) for modelling algorithmic randomness. They define two (...) success criteria—specifying under what conditions a pattern may be said to have been detected by a computable learning function—and prove that the collections of data sequences on which these criteria cannot be satisfied respectively correspond to the set of weak 1-randoms and the set of weak 2-randoms. This learning-theoretic approach affords an intuitive perspective on algorithmic randomness, and it invites the question of whether restricting attention to learning-theoretic success criteria comes at an expressivity cost. In other words, is the framework expressive enough to capture most core algorithmic randomness notions and, in particular, Martin-Löf randomness—arguably, the most prominent algorithmic randomness notion in the literature? In this paper, we answer the latter question in the affirmative by providing a learning-theoretic characterisation of Martin-Löf randomness. We then show that Schnorr randomness, another central algorithmic randomness notion, also admits a learning-theoretic characterisation in this setting. (shrink)

There is growing interest in examining dark personality traits, to better explain malevolent and self-serving behaviour patterns commonly observed in clinical and non-clinical settings. Recently, taxonomies of dark personalities have been developed, along with psychometric tools to measure and delineate between traits including psychopathy, Machiavellianism and narcissism. The extent to which these constructs are distinct or overlapping remains controversial. Psychophysiological research can improve understanding of biological mechanisms contributing to personality that may help to evaluate taxonomies. This study investigated diurnal variations (...) in salivary cortisol (on waking, cortisol awakening response, and at bedtime, over two days) and their relationship to personality traits (Short Dark Triad Scale and IPIP Mini), psychopathology (Depression, Anxiety and Stress Scale; DASS) and quality of life (WHOQOL-BREF) in a non-clinical sample (N=45, 26 females, 19 males, 18-59 years). Dark personality traits correlated with low bedtime cortisol, reduced sleep, depression and poorer quality of life. Hierarchical linear regressions analyses indicated that bedtime cortisol levels significantly accounted for variance in Psychopathy (F(1,39)=5.55, p=.02, R=.52, B=-1.81, 95% CI [-3.37-(-.26)], β=-.33, sr2=.10) and reduced sleep uniquely accounted for variance Machiavellianism (F(2,40)=5.99, p=.01, R=.48, B=1.01, 95% CI [.16-2.02], β=.34, sr2=.11). These data provide preliminary evidence that supports the cortisol hypoarousal hypothesis of Psychopathy and has identified a link between Machiavellianism, sleep-wake cycles, and chronotype. The hypoarousal hypothesis of Psychopathy contends that the hypothalamic-pituitary-adrenal axis is unresponsive to the stress of social engagement. Machiavellianism was predicted by longer days with evidence for an evening chronotype. These findings indicated that the Dark Triad traits have different underlying biological mechanisms that require further exploration. (shrink)

In this article we discuss the moral and legal aspects of causing the death of a terminal patient in the hope of extending their life in the future. We call this theoretical procedure cryothanasia. We argue that administering cryothanasia is ethically different from administering euthanasia. Consequently, objections to euthanasia should not apply to cryothanasia, and cryothanasia could also be considered a legal option where euthanasia is illegal.

After preliminarily pointing to the undeniable differences between Jonas’ philosophical biology and Schelling’s philosophy of nature, I contend that, besides their divergencies, the two philosophers agree on several important points. I then show to what extent, based on these elements of convergence, their two approaches could even be taken as complementary. In the core of my paper I lay emphasis on what I believe to be the main ground for the complementarity of the two philosophical inquiries, that is to say, (...) their common radicalization and superseding of Kant’s principle of self-organization. In this respect – all differences considered – they both can be said to delineate a philosophy of the organic that can fruitfully contribute, even better than Kant’s input, to the currently widely discussed topic of biological autonomy. In Poggiolesi we have introduced a rigorous definition of the notion of complete and immediate formal grounding; in the present paper our aim is to construct a logic for the notion of complete and immediate formal grounding based on that definition. Our logic will have the form of a calculus of natural deduction, will be proved to be sound and complete and will allow us to have fine-grained grounding principles.

At Columbia University in 1906, William James gave a highly confrontational speech to the American Philosophical Association (APA). He ignored the technical philosophical questions the audience had gathered to discuss and instead addressed the topic of human energy. Tramping on the rules of academic decorum, James invoked the work of amateurs, read testimonials on the benefits of yoga and alcohol, and concluded by urging his listeners to take up this psychological and physiological problem. What was the goal of this unusual (...) speech? Rather than an oddity, Francesca Bordogna asserts that the APA address was emblematic—it was just one of many gestures that James employed as he plowed through the barriers between academic, popular, and pseudoscience, as well as the newly emergent borders between the study of philosophy, psychology, and the “science of man.” Bordogna reveals that James’s trespassing of boundaries was an essential element of a broader intellectual and social project. By crisscrossing divides, she argues, James imagined a new social configuration of knowledge, a better society, and a new vision of the human self. Criminal liability for acts committed by AI systems has recently become a hot legal topic. This paper includes three different contributions. The first contribution is an analysis of the extent to which an AI system can satisfy the requirements for criminal liability: accomplishing an actus reus, having the corresponding mens rea, possessing the cognitive capacities needed for responsibility. The second contribution is a discussion of criminal activity accomplished by an AI entity, with reference to a recent case involving an online (...) bot, the Random Darknet Shopper. This discussion will provide the context for the analysis of commonalities and differences between criminal activities by humans and by artificial systems. The third contribution concerns the evaluation of different ways of addressing criminal activities by AI systems in a regulatory perspective. (shrink)

I deal with the issue of the environmental crisis from the perspective of a phenomenologically embedded qualitative social ontology. The first point I make is that our environment is a «personal world», and not a «naturalistic world»: a world that is experienced in the «personalistic attitude» and as such is an ontologically qualitative world, in which both natural and social entities are given to us as essentially constituted by value-qualities and meanings, and not as merely material things. The second point (...) I argue for is that our environment is also a «common-surrounding world» whose personal collectives are its essential correlate: «common-surrounding world» and personal collectives existentially depend on one another, and human persons, both individual and collective, are responsible for the existence of their environment and its entities. I apply the tools of phenomenological eidetics to the ideas of «personal world» and «common-surrounding world», and inquire into the ontologically qualitative implications that they have for our environment and its crisis. My partner Annie and I have brought our fouryear -old daughter Cece and her best friend Gilda to (...) the barbecue, and they’ve dressed themselves in layers, with leggings and hoodies and dresses, girlie but survivalist at the same time in their sequins and metallic purple, discowear for preschoolers. We are at the end of a daylong play date, and we’ve already survived two playgrounds and several tearful standoffs, the ups and downs that come with friends so young. So Annie and I come hungry for some time with our adult friends. The closely packed, brick, three-flat apartment buildings on either side of Laila’s yard provide us with some protection from the wind for a good part of the afternoon. But as the sun goes down and the light dims, we pile on more jackets and scarves over our T-shirts and shorts. Gusts of wind randomly fan the flames until they’re visible over the lid of the grill as Laila cooks. I look out for Laila at the grill while Annie plays catch with the little girls. But I have to do so in stealth, because Laila is as stubborn as she is glamorous. She has insisted on wearing a jacket with green flowing sleeves as she tends the fire, and while she has put her long, graying blond hair up in a chop-sticked bun, she has also pulled out long wispy strands to achieve high femme style. It flies around her face in the wind, flirting with the flames. 504 Francesca T. Royster We are all getting together because later this week Laila will be boarding a plane for the twelve-hour flight home to spend time with her aging mother and father for the summer. “Home” is Lebanon, and we have already experienced losing Laila for a several months in 2006 during a visit home when Israel and Lebanon’s tensions grew into a violent series of bombings that came very close to her Beirut apartment. At the nadir of that time, Laila sent us frantic group letters conveying her worry, sometimes her despair, and her flashbacks to her childhood experiences in wartime Beirut in the 1970s and also in the war of 1982. For a few agonizing weeks her letters stopped coming altogether. The afternoon of our barbecue was the same day as the early morning shootings in the Pulse nightclub in Orlando, Florida, where forty -nine people were killed, and at least fifty others were wounded. The victims were all killed while practicing a rite that all of us considered as sacred and necessary as going to church might be for some—dancing the night away in a gay nightclub. This morning we had woken up to this news, blinking still without our glasses, the magnitude of the news headline hard to fathom as it flashed across the screens of our phones. It’s wrong that mass shootings have become part of the fabric of our lives, and probably will be for the lives of Cece and Gilda. The story feels both shocking and sadly familiar: the apparently easy availability of weapons and a pattern of anger taken to the next outrageous step. And then there’s the gay part. Even when I first heard that the shooting took place at a gay bar, I wondered if the killer, Omar Mateen might be gay himself. “Why Orlando?” I thought. Why a mostly unknown dance club? I thought of the messy, red-hot fury of hate and desire when they get mixed up together. As Annie and I talked about the shooting in hushed voices on the playground that morning, we thought of Matthew Shepard. We thought of the recent theory that Shepard most likely knew his killers; that he hung out with them, maybe did drugs with them. Francesca Y. Albertini (1974‐2011) compares Maimonides’ idea of peace, as developed in MT Sefer shofetim (Book of Judges), with Kant’s work on the notion of “eternal peace” ( Zum ewigen Frieden ). Both authors develop a historical vision pointed against the use of force and war in light of a framework not limited by historical time (messianic age, eternity). Despite all differences in method and historical context, the authors agree on the notion that universal ethics provides the basis of (...) a determination of right grounded in the will. Maimonides’ universal messianism as well as Kant’s universal history emphasize the pivotal role and decisive responsibility of the human being in realizing, through reason, the reign of peace and prosperity on earth first envisioned by the biblical prophets. Machine learning classifiers are increasingly used to inform, or even make, decisions significantly affecting human lives. Fairness concerns have spawned a number of contributions aimed at both identifying and addressing unfairness in algorithmic decision-making. This paper critically discusses the adoption of group-parity criteria (e.g., demographic parity, equality of opportunity, treatment equality) as fairness standards. To this end, we evaluate the use of machine learning methods relative to different steps of the decision-making process: assigning a predictive score, linking a classification to (...) the score, and adopting decisions based on the classification. Throughout our inquiry we use the COMPAS system, complemented by a radical simplification of it (our SAPMOC I and SAPMOC II models), as our running examples. Through these examples, we show how a system that is equally accurate for different groups may fail to comply with group-parity standards, owing to different base rates in the population. We discuss the general properties of the statistics determining the satisfaction of group-parity criteria and levels of accuracy. Using the distinction between scoring, classifying, and deciding, we argue that equalisation of classifications/decisions between groups can be achieved thorough group-dependent thresholding. We discuss contexts in which this approach may be meaningful and useful in pursuing policy objectives. We claim that the implementation of group-parity standards should be left to competent human decision-makers, under appropriate scrutiny, since it involves discretionary value-based political choices. Accordingly, predictive systems should be designed in such a way that relevant policy goals can be transparently implemented. Our paper presents three main contributions: (1) it addresses a complex predictive system through the lens of simplified toy models; (2) it argues for selective policy interventions on the different steps of automated decision-making; (3) it points to the limited significance of statistical notions of fairness to achieve social goals.
